Project: Applicant: The Marshall 672 Marshall Ave. Austin Magruder The Marshall, LLC 516 Tennessee St. STE 419 Memphis, TN Applicant s Request: Exterior Improvement Grant in the amount of $60,000. Project Description: Scope of Work: The subject property is a 1-story commercial building at the northeast corner of Marshall Avenue and South Orleans Street in the Edge neighborhood. The 0.28 acre site is bound on the north, west, and south sides by public streets and sidewalks. Built in 1949, the building has been home to a variety of activities ranging from auto-oriented uses to office space. The applicant plans to renovate the property as a mixed-use building with three commercial bays and five apartment units. Exterior improvements to the building will include replacing the commercial storefront, new paint, enhanced lighting, new entry doors, a wood rainscreen, and a new patio fronting Marshall Avenue. This project will likely be submitted for review and approval at the August or September meeting of the Design Review Board (DRB). Following DRB approval, construction should begin this fall and be completed next spring. Budget: The Exterior Improvement Grant is for exterior work only and requires minimum leverage of 1 to 1. The maximum grant for this proposed location is $60,000. 2 Entry doors $12,000 Exterior lighting $5,000 New windows $26,000 Trellis $9,600 Landing at east entry $6,000 Overhead door $3,000 Total Uses: $147,175 Sources: Owner funding $87,175 CCDC grant funding requested $60,000 Total Sources: $147,175 EBO Program: Staff Evaluation: Any project that is awarded financial incentives from the Downtown Memphis Commission shall include a best faith effort to reach no less than 20% participation by women and/or minority-owned businesses (W/MBE) in the project's development cost (design and construction hard costs). Compliance with this Equal Business Opportunity (EBO) Program is a closing requirement. If the requirements of the EBO Program are not met, the CCDC will cancel the incentive. 20% W/MBE inclusion for the above listed scope of work is approximately $29,435. The Exterior Improvement Grant program is designed to help Downtown commercial property owners and businesses make high-quality improvements to the exterior of their property. A secondary goal of the grant is to help new and existing businesses succeed by enhancing their curb appeal in ways that might not be possible without assistance. Staff is supportive of approving an Exterior Improvement Grant for this project given the prominent location of the subject property and anticipated impact of the improvements. Located just a few doors west of Sun Studios, this mixed-use development will sit in the heart of the burgeoning Edge District. The Edge is an area of strategic focus for the DMC. Notable recent CCDC and DMC investments in the neighborhood include a Storefront Grant for High Cotton Brewing Company, public art through the Collaboratory, and public realm and streetscape improvements in partnership with the Memphis Medical District Collaborative (MMDC). This new development will add much-needed ground-floor retail and commercial space to the neighborhood. Providing opportunity for new commercial activity and growing the small business ecosystem Downtown is an important goal of the DMC. Moreover, improving the exterior appearance of this building will further strengthen Marshall Avenue as a Page 2 of 3

3 reemerging commercial corridor connecting the Medical District with the Downtown Core. Additionally, the exterior enhancements planned for this property include several high-impact changes including new pedestrian-oriented lighting, artistic painted treatment along South Orleans Street, and an expansive outdoor patio at the front of the building. Staff believes that the proposed development is a creative way to help transform an underutilized property into a neighborhood amenity and community gathering place. Staff Recommendation: Staff recommends approval of an Exterior Improvement Grant (EIG) in an amount up to $60,000, based on approved receipts and subject to all standard closing requirements and conditions. Executive Summary The subject building, located at 672 Marshall ave, which is held under contract and to be known as The Marshall, is in the heart of the edge district just a few doors down from Sun Studios. Originally constructed in 1949, the budiling has been used for a variety of mixes but today is mostly abandoned except for one commercial bay. Beyond the property, our group recognizes the work done by the city to improve the street scapes and overall appeal to the neighborhood. We hope to further improve the neighborhood by implementing a fully reimagined exterior facade. The design will feature, new storefronts, paint, exterior lighting, entry doors, a wood rainscreen and most importantly, a shaded patio along Marshall ave that will provide shared space for tourists, students, and workers to enjoy one of the most iconic places in Memphis. 15 Downtown Memphis Commission Exterior Improvement Grant 11 Attachment C Explanation of Equal Business Opportunity (EBO) Program and Best-Faith Effort to Attain Minority-Owned Business Participation As further detailed in the Downtown Memphis Commission Affiliated Boards Equal Business Opportunity (EBO) Program, Section 10, the applicant must give women and / or minorityowned businesses (W/MBEs) an equal and fair opportunity to receive notice, to bid on, and be considered for selection for all contracting opportunities associated with the professional and construction services in the design and renovation/construction of the project. Applicants are required to take affirmative steps to ensure an open and fair contracting process. While there are no mandated quotas, results achieved may evidence whether a fair process was employed. Applicants shall make a best-faith effort to allot, as a goal, no less than 20% of the professional and construction services to W/MBEs in the design and renovation/construction of the project. Commensurate with the size and scope of the project, specific steps that may be indicative of a best-faith effort to identify and contract with W/MBEs include but are not limited to the following: notice to W/MBEs, soliciting bids/quotes directly from W/MBEs, providing constructive notice, utilizing plan rooms, utilizing the DMC for assistance (W/MBE lists and Project Alerts), and working with applicable minority-owned business support organizations (e.g., Mid-South Minority Business Council, Memphis Area Minority Contractors Association, Memphis Hispanic Chamber of Commerce, National Association of Women Business Owners, etc.) To ensure that the EBO requirements are clearly understood, and antecedent to meeting the goals set forth in the EBO Program, all utilization plans must be coordinated with the DMC staff and submitted with the application. In accordance with the EBO Program, once the incentive application is approved and design/construction commences, the applicant shall provide written documentation of the status of the utilization plan (which shall include any and all changes or modifications) and the applicable amounts spent (or value of the work completed), on a monthly basis. If the requirements of the EBO Program are not met, the CCDC reserves the right to revoke and cancel the incentive. 12
