Michel, Executive (509) or dr@ucut-nsn.org The Primary Goal of the painting of a Mural at Drumheller Springs Park is to enhance the experience that visitors, pedestrians, and drivers will get when they go to or pass by this significant tribal site, as well as to educate local, regional, and out-of-region residents about the UCUT s culture and history. The main foci of the mural and its design are: 1. Professional and successful installation and completion of a mural on the approximately 90-foot by 6-foot(+) concrete retaining wall that serves as the eastern border of Drumheller Springs Park, which is immediately adjacent to heavily trafficked southbound Maple/Ash Avenue between Northwest Boulevard and Garland Avenue on the north side of the Spokane River in the city of Spokane (other streets that serve as boundaries to the park include Courtland, Oak, Liberty, Euclid and Ash Place); and 2. Ensure that the selected muralist has the required experience, training/background, and artistic ability to successfully complete the mural on time, within the existing budget for this project, and in an effective and efficient manner; and

2 3. To make certain that the mural has both an appropriate artistic design and thematic concepts that adequately capture tribal cultural and natural resources. The criteria and themes that the mural will cover should contain all or some of the following: tribal fisheries, tribal encampments, rivers, lakes, mountains and other regional landscapes and upland habitats such as forests and native plants, salmon, steelhead, other native fish, wildlife, and it will also include historical and cultural perspectives about Spokane Chief Garry s school, as well as the importance of past tribal uses of the Drumheller site; and 4. Ensure that the design, pattern, and composition of the mural is appropriate for an urban setting where graffiti is sometimes an issue of concern (i.e., there should not be any open spaces left within the mural where graffiti can easily find a home); and 5. Make certain that the design and composition of the mural allows for one section that is approximately 10-feet by 8-feet high to be appropriately painted by tribal enrolled youth under the direct supervision, guidance, and assistance of the selected muralist. 6. A short tour and site visit for any interested contractor can be easily arranged with reasonable advanced notice by contacting the UCUT office or by calling RFP Goals The selected mural design and muralist are scheduled for review, consultation, revisions, and approval at the discretion and desired timing of current tribal elected officials from the five Member Tribes that comprise the UCUT. It is the goal of the Mural at Drumheller Springs Park project solicitation to contract with a tribal enrolled individual or individuals who will design, paint, and successfully contribute to and complete every aspect of the processes involved with the project.

3 Contract Specifications 1. Contractor will develop a detailed Statement of Work that clearly describes how contractor will complete the design and installation of the mural, and that will include a specific timeline for how and when work on the mural will get done. 2. Contractor will provide three short reports to the UCUT a final mural design that is subject to change, a mid-term progress report, and a final report upon successful completion of the Mural at Drumheller Springs Park. 3. Contractor will be provided with ample in-kind and direct project assistance from tribal natural resources staff and the UCUT staff that includes but is not limited to things like ladders, drop cloths, a pressure washer, a water tank source, a port-a-potty bathroom, paint, assistance with securing proper and official city permits, project safety requirements (i.e., a sidewalk and a major city arterial street run alongside the project site) and project approval, as well as other supplies, materials, transportation, and accommodations that might be required or desired by the contractor. Contract Period January 14, 2011 through July 31, This is a 7-month contract, but the vast majority of the work will occur during the actual painting of the mural within a 2-3 week period in June or July (i.e., after the springs rains have passed). Selection Criteria Proposals will be judged on the following criteria: 1. Creativity, artistic ability/experience, visual pleasure, and appropriate cultural, natural, and historical tribal resources found within the mural design. 50% 2. Participation with project proponent and staff. 20% 3. Cost. 30%

4 Background Information Drumheller Springs Park is an approximately 10-acre urban natural area that is administered and maintained by the City of Spokane s Parks and Recreation Department. It was established in It consists of both native and non-native grasses, plants, shrubs, trees, wildlife, and a small natural spring that flows from the very large upper area of the park down to the lower area of the park where the mural will be painted. Prior to its current uses, Chief Spokane Garry School was located at this significant tribal site in Born in 1813, Chief Garry was a teacher to his people for 60 years. Since 2005, the UCUT has conducted an annual clean up day at Drumheller when tribal natural resources staff support and attend this effort by generously donating time, materials, and tools. The UCUT has also completed a couple of park infrastructure improvements such as the installation of hand railings along some steep stairs. The UCUT intends to conduct and sponsor future clean up days and enhancements to the park. Safety All applicable regulations pertaining to safety, the Contract Manager shall strictly adhere to including Tribal Occupational Safety and Health Act (TOSHA) standards and regulations. Particular care shall be exercised regarding the operation of vehicle and other equipment on the site. The contractor, as might required, shall provide some safety equipment. Selection Process Vacating Work Area During exercises, natural disaster, national emergencies, or for security or safety reasons, the contractor may be required to vacate work areas An award to one respondent/s for the services specified herein will be made following a procedure using competitive sealed proposals. Respondents will be asked to submit proposals, including monetary proposals and an itemized budget, by the close of business (4:00 p.m.) on January 14, Proposals will be opened publicly to identify the names of the Respondent/s, and the monetary proposals. Other contents of the proposals will be afforded security sufficient to preclude disclosure of the contents of the proposal prior to award. Within 1 month after the date of opening the proposals, the UCUT will evaluate and rank each proposal. After opening and ranking, an award may be made on the basis of the

5 proposals initially submitted, without discussion, clarification or modification, or, the UCUT may discuss with the selected Respondent/s offers for cost reduction and other elements of the Respondent s proposal. If the UCUT determine that it is unable to reach a contract satisfactory to the UCUT with the selected Respondent/s, then the UCUT will terminate discussions with the selected Respondent/s and proceed to the next Respondent/s in order of selection ranking until a contract is reached or the UCUT has rejected all proposals. The UCUT may not disclose any information derived from the proposals submitted from competing offers in conducting such discussions. The UCUT reserves the right to award a Contract for all or any portion of the requirements proposed by reason of this request, award multiple Contracts, or to reject any and all proposals if deemed to be in the best interests of the UCUT and to re-solicit for proposals, or to reject any and all proposals if deemed to be in the best interests of the UCUT and to temporarily or permanently abandon the procurement. If the UCUT award a contract, it will award the contract to the offeror or offerors whose proposal is the most advantageous to the UCUT and offers the best value, considering price and the evaluation factors set forth in the RFP. The contract file must state in writing the basis upon which the award is made. The UCUT may discuss or negotiate all elements of the proposal with Respondent/s in ranking order as described above. The UCUT may not disclose any information derived from the proposals submitted from competing offers in conducting such discussions. The UCUT will not provide compensation to Respondents for any expenses incurred by the Respondent/s for submittal preparation or for any demonstrations that may be made, unless otherwise expressly stated or required by law. Each submittal should be prepared simply and economically, providing a straightforward, concise description of your ability to meet the requirements of this RFP. Emphasis should be on completeness, clarity of content, responsiveness to the requirements, and an understanding of the UCUT needs. The UCUT makes no guarantee that an award will be made as a result of this RFP, and reserves the right to accept or reject any or all submittals, waive any formalities or minor technical inconsistencies, or delete any item/requirements from this RFP or contract when deemed to be in the UCUT s best interest. Representations made within the qualifications submittal and any subsequent proposal will be binding on responding firms. The UCUT will not be bound to act by any previous communication or submittal submitted by the firms other than this RFP.

6 Instructions for Submittal Respondent/s must complete and sign their proposal response. Failure to sign the proposal will subject your proposal to disqualification. Page Size, Binders and Dividers Submittals may be typed and sketched with some color provided on any size paper. Preprinted material should be referenced in the submittal and included as labeled attachments. Number each side of each page consecutively, including letter of interest, proposed mural project budget, licenses, resumes, representative examples/samples of prior artistic and/or mural works, supplemental information, etc. Submittals must be limited to 5 pages or less. Any covers, table of contents and divider tabs that might be used will not count as pages, provided no additional information is included on those pages. Provide the number of copies of the submittal specified in the advertisement. Any submittals exceeding the 5-page limit will be disqualified. Number of Copies Submit a total of six (6) complete copies of the entire response. An original signature must appear on a letter that provides for an execution of the offer of at least one (1) copy submitted. The materials submitted must be enclosed in a sealed envelope (box or container); the package must clearly show the submittal deadline; the RFP title must be clearly visible; and name and the return address of the Respondent/s must be clearly visible. Late proposals will not be considered under any circumstances. All materials submitted will not be returned to the respondent/s unless specified. Telephone, , or facsimile (i.e., fax) proposals will not be accepted or returned.
