6 Mississippi Contract Requirements Applies to work on West Pier, Port of Gulfport if local labor is used Does not apply to work outside Mississippi All subcontracts not included in the bid package must be pre-approved by MSPA Mississippi Jobs First Before work on the west pier, the contractor shall enter into an agreement with MSPA that requires the contractor not to hire any personnel to fill vacant positions necessary for the project for a period of 10 days after the date of agreement. During this 10 day period the Mississippi Department of Employment Security shall submit qualified individuals to the contractor to consider for the vacant positions. The contractor shall review the individuals submitted by the department before hiring individuals who are not submitted by the department. Davis Bacon Certified Payroll-Only applies during Construction of Cranes at site. Section 3

8 What is Section 3? HUD s Section 3 program requires that recipients of certain HUD financial assistance to the greatest extent feasible provide job training, employment and contract opportunities for low or very-low income residents in connection with projects and activities in their neighborhoods.

9 Section 3 Section 3 applies to the Port of Gulfport Restoration Program because of the expenditure of HUD CDBG funds on public construction. Section 3 differs from Minority Business Enterprise/Women Owned Business Enterprise Section 3 preferences focus on household income and location Section 3 preferences are race and gender neutral

10 PGRP Section 3 Goals 30% of all employment and training opportunities to be awarded to Section 3 residents 10% of all construction contracting opportunities to be awarded to Section 3 businesses 3% of all non-construction contracting opportunities to be awarded to Section 3 businesses

11 Preference for Section 3 Business Concern Section 3 Business Concern preference in this procurement: The Contract will be awarded to the lowest and best responsive, responsible Bidder, subject to review of the Minimum Qualifications and Evaluation Criteria as stated in the bid package and further, to the extent permitted under applicable law, a 5% preference for a Section 3 Business concern as provided in 24 CFR Part 135.

12 Who can qualify as a Section 3 Business or Section 3 Resident? Section 3 Business Concern is either: 51% or more owned by Section 3 Residents; 30% of full time employees are Section 3 Residents; or 25% of subcontracts are to Section 3 Business Concerns Section 3 Residents are low (or very low) income persons residing in the PGRP service area (i.e., the 3 MS coastal counties) Low income level is based on community and number of household members:

14 Section 3 Business Concern Certification Process Ways to qualify as a Section 3 Business Concern: - Contractor s firm is 51 percent or more owned by Section 3 residents. - Contractor s permanent, full-time employees include persons, at least 30 percent of whom currently are Section 3 residents, or within three years of the date of their first employment with the business were Section 3 residents. - Contractor commits to subcontract in excess of 25 percent of the dollar amount of all subcontracts to be awarded by the business under the proposed contract to Section 3 businesses that meet the above two criteria. This must be detailed further in the contractor s Section 3 Subcontracting Plan.

16 How to Identify Section 3 Residents PGRP Contractors are required to utilize the WIN Job Centers for open positions Utilize local media such as radio, newspapers and television to announce employment opportunities Contact local community organizations for assistance in identifying Section 3 residents Contact PHAs for assistance in identifying Section 3 residents Offer contractor events and job fairs at which Section 3 Business Concerns can participate and Section 3 residents can attend Contact organizations such as community centers, employment agencies, churches, non profits and housing developments Post signs and distribute flyers in the community

17 Section 3 PGRP Contractor Reporting Requirements All PGRP contractors will be required to submit monthly reports to MSPA covering their hiring and subcontracting opportunities. Contractors will also be required to maintain and submit to MSPA monthly reports covering all subcontractors hiring and subcontracting activity and accomplishments. Demonstrate providing opportunities, to the greatest extent feasible to reach PGRP Section 3 project goals: 10% of Construction Contracts subcontracted to Section 3 Business Concerns 3% of Non-construction Contracts subcontracted to Section 3 Business Concerns 30% New Hires are Section 3 Residents Document the outreach to Section 3 Business and Residents
