2 TERMS OF REFERENCE FOR NPOs PARTICIPATION IN THE EPWP PHASE 3 NON-STATE SECTOR PROGRAMME INTAKE 1. PURPOSE The purpose of these terms of reference is to guide Non-Profit Organisations in all the Provinces of South Africa that will be appointed to create work opportunities for the unemployed people as part of the Expanded Public Works Programme (EPWP) Phase 3 Non- State Sector (NSS) Programme. 2. TERMS OF REFERENCE (ToR) AND SPECIAL CONDITIONS OF THE CONTRACT The appointment of NPOs is to create work opportunities in the Provinces of the Republic of South Africa funded by the Department of Public Works through the Independent Development Trust. 3. BACKGROUND TO THE PROJECT The Independent Development Trust (IDT) is a Schedule 2 Public Entity governed by applicable legislative frameworks and a Deed of Trust. The organization is accountable to Parliament through the Minister of Public Works who is the Executive Authority. In pursuit of this mandate, the IDT primarily operates as a strategic partner in the management, integration and implementation of certain government s development programmes. The IDT has representation in all provinces and is organized on the basis of regional offices. The majority of the programmes undertaken by the IDT are managed from these offices. PROJECT AIM AND SCOPE The NPOs will be appointed on a contract basis for 2 financial years from 1 st April 2017 to 31 st March The contract is renewable annually based on performance. In this period the NPO is expected to create work opportunities as agreed with the IDT Regional offices in a stipulated signed contract. The duration is calculated in person working days within a financial year cycle. NPOs to participate in the EPWP NSS Programme should meet the following requirements: Projects must create work opportunities for poor and unemployed people; Projects must be labour intensive; Projects cannot be implemented by profit making organisations; The outputs and outcomes of the activities should benefit society and/or communities where they are being implemented and should have focus on the poor; 2

3 Projects should have a developmental approach and pay special focus on demographic targets of women, youth and people living with disabilities. 3. EXPECTED OUTCOMES AND DELIVERABLES 3.1. Outcomes The NPO will be expected to: Appoint participants to deliver work opportunities as agreed with the IDT. The appointed NPOs should also ensure that participants are appointed legally through a contract as contained in the procedure manual. The NPOs should also ensure that they comply with the EPWP Ministerial Determination and other statutory requirements. Registration with SARS, Departments of Labour and Social Development is compulsory Deliverables The NPOs will be expected to Create work opportunities as outlined in the agreed implementation plan; Provide monthly reports at the end or beginning of every month; Submit invoices to the IDT and upon receipt of funds, process payments to all the contracted participants timeously; Appoint and supervise participants by ensuring that contracts, attendance registers and all relevant reporting templates provided for by the IDT are duly completed and submitted to the relevant Regional Office; Submit original and clear certified ID copies, participants contracts and the approved signed Implementation Plan. 4. REQUIREMENTS In order to be eligible to participate, NPOs should submit proposals that meet the following requirements: Proof that the entity has complied with the relevant authority and is in good standing by submitting the following: Valid Tax Clearance Certificate from SARS must be produced. Valid UIF Compliance Certificate. Latest Letter of Good Standing from the Compensation Fund. Latest Letter of Compliance from the Department of Social Development. In addition, the following conditions will apply: The entity must be in existence and operational for a minimum of 2 years. The entity must describe how it will create labour intensive (at least 60%) activities and EPWP work opportunities. The proposal must include information that displays proof of the NPOs good financial, administrative and reporting systems. The work of the NPO must have a developmental focus. 3

EVALUATION CRETERIA The Scorecard designed specifically for this project will be utilised. 6. EVALUATION PROCESS Proposals will be evaluated in accordance with the IDT s Procurement Policy, using the scorecard that is designed specifically for this programme. The evaluation team will also conduct a due diligence on the short listed NPOs. 7. Compulsory Briefing Session Compulsory briefing sessions will be held at the Regional Offices of the IDT. Only proposals of NPOs which attended the briefing session will be accepted. 13. GENERAL If you do not hear from us within 6 weeks after the closing date, please accept that your proposal was unsuccessful. 14. Disclaimer The IDT reserves the right not to appoint a service provider and is also not obliged to provide reasons for the rejection of any proposal.
