1 OKLAHOMA DEPARTMENT OF ENVIRONMENTAL QUALITY 2013 OKLAHOMA AIR CURTAIN INCINERATOR MUNICIPAL GRANT PROGRAM I. FUNDING OPPORTUNITY DESCRIPTION A. Summary The Oklahoma Department of Environmental Quality (DEQ) is inviting proposals for projects that reduce emissions from the burning of storm debris. Potential projects are those which utilize air curtain incinerators for the burning of clean wood waste and comply with OAC 252:100, Subchapter 13. The grant funds are to be used for the rental of an air curtain incinerator for the purpose of burning storm debris. B. Funding The total funding for this competitive opportunity is approximately $20,000. The Oklahoma Department of Environmental Quality will award the assistance agreements for projects resulting from this announcement. The award amounts will vary, but DEQ anticipates that each award will be approximately $2,000. The anticipated number of awards is variable due to the number of applications received, the size of the project and the availability of funding. Each successful Recipient must enter into a Memorandum of Agreement (MOA) with the DEQ. C. Funding Closing Date Applications will be accepted until September 20, Intial awards will be announced by September 30, If funds are not fully awarded after the September 20, 2013, deadline, DEQ may elect to extend the application deadline. All projects must be completed and monies spent within 180 days of notice of grant approval from DEQ. II. ELIGIBILITY INFORMATION A. Eligible Entities The grant program will be open to Oklahoma counties and municipalities that were either: (1) declared a federal disaster area as a result of storms occurring in May 2013 AND are receiving FEMA funds to aid in storm clean-up operations OR (2) a municipality within the Oklahoma City or Tulsa Metropolitan Statistical Area (MSA) with a population of less than 2000 based on the 2010 federal census AND engaged in clean-up of storm debris. Preference will be given to those addressing May 2013 storm debris. B. Eligible Projects Any application proposing emission reductions through use of air curtain incinerators for destruction of storm waste will be considered. Projects must follow all guidelines listed below. 1. Rental of Air Curtain Incinerator Eligible projects are those renting air curtain incinerators. "Air curtain incinerator (ACI)," also called "air curtain destructor," or "open pit incinerator" means an incineration unit operating by 1

2 forcefully projecting a curtain of air across an open, integrated combustion chamber (fire box) or open pit or trench (trench burner) in which combustion occurs. Use of air curtain incinerators, in lieu of a traditional burn pile, dramatically reduces the emission of pollutants such as particulate matter, nitrous oxides, and carbon monoxide produced during combustion. Grant funds may ONLY be used towards the rental fee. The grant may not be used for any other related costs such as labor, mileage, necessary permit fees, or transportation. 2. Allowed waste Waste to be burned in the air curtain incinerator during the grant project is limited to the category of wood waste, clean lumber, or a mixture of both, as defined in OAC 252: : Wood waste means untreated wood and untreated wood products, including tree stumps (whole or chipped), trees, tree limbs (whole or chipped), bark, sawdust, chips, scraps, slabs, millings, and shavings. Wood waste does not include: (A) Grass, grass clippings, bushes, shrubs and clippings from bushes and shrubs from residential, commercial/retail, institutional, or industrial sources as part of maintaining yards or other private or public lands. (B) Construction, renovation, or demolition wastes. (C) Clean lumber. (D) Treated wood and treated wood products, including wood products that have been painted, pigment-stained, or pressure treated by compounds such as chromate copper arsenate, pentachlorophenol, and creosote, or manufactured wood products that contain adhesives or resins (e.g., plywood, particle board, flake board, and oriented strand board). "Clean lumber" means wood or wood products that have been cut or shaped and include wet, air-dried, and kiln-dried wood products. Clean lumber does not include wood products that have been painted, pigment-stained, or pressure-treated by compounds such as chromate copper arsenate, pentachlorophenol, and creosote, or manufactured wood products that contain adhesives or resins (e.g., plywood, particle board, flake board, and oriented strand board). 3. Regulatory Requirements The air curtain incinerator must be operated in such a way so as to meet all requirements as listed in OAC: , Open Burning; OAC: , Incinerators; 40 CFR Part 60; Oklahoma DEQ s May 2013 publication Disaster Debris Management Guidelines for County and Municipal Governments and any other applicable federal, state, or local regulations. C. Special Requirements for Eligibility 1. Matching Funds Recipients will be required to provide matching funds. Matching funds may be provided in one of two ways: One, matching funds may be in the form of FEMA-issued assistance at the percentage scale as established by FEMA. This grant will only cover the remainder of the cost of renting the ACI which is not covered by FEMA. For example, if FEMA-issued funds provide for 75% of the rental fee of the ACI, this DEQ grant will provide reimbursement for the remaining 25% of the rental fee. Prior to reimbursement, Recipient will be required to provide appropriate paperwork demonstrating the amount of funds received from FEMA and a copy of the invoice for the ACI rental fees. This grant is only for the rental fee and therefore will not provide matching funds or 2

3 reimbursement for any other costs such as labor, mileage, necessary permit fees, or transportation. Two, matching funds may be provided by the municipality. This grant will only cover up to 50% of the reimbursement cost of renting the ACI. Prior to reimbursement, Recipient will be required to provide appropriate paperwork demonstrating the amount of funds paid by the municipality and a copy of the invoice for the ACI rental fees. This grant is only for the rental fee and therefore will not provide matching funds or reimbursement for any other related costs such as labor, mileage, necessary permit fees, or transportation. 2. Memorandum of Agreement Upon awarding the grants, the Recipient must enter into an MOA committing to the terms of the award. This agreement will establish project timelines, describe the reimbursement process and generally outline the terms of the grant. D. Evaluation Criteria Applications must demonstrate eligibility as indicated in this announcement. Additionally, a successful application must satisfy all of the requirements in items 1-7 below. 1. Projects must demonstrate a benefit to public health by reducing air emissions through use of an ACI. 2. Applications must be received on or before the closing date and time. If any funds remain available after the closing date and initial selection process, an extension may be granted to additional applicants. 3. Applications must be complete. 4. Projects must be located within the state of Oklahoma. 5. Projects must be located in a federally-designated disaster area and must be recipients of associated FEMA disaster relief; OR 6. A municipality located in the Oklahoma City or Tulsa MSA with a population of less than 2000 based on the 2010 federal census and engaged in clean-up of storm debris. 7. Additional consideration will be given to municipalities engaged in the disposal of May 2013 storm debris. III. AWARD INFORMATION A. Amount of Funding Available DEQ has approximately $20,000 available under this announcement for grants. B. Funding Type Funding will be in the form of reimbursement upon receipt of invoice(s) and all other necessary paperwork from the Recipient. Recipients must have a prior executed agreement with DEQ to receive reimbursements. 3

4 C. Start Date/Project Duration/Timeline All projects should be started as soon as possible. All projects must be completed and monies spent within 180 days of notice of grant approval from DEQ. All invoices and grant completion paperwork must be submitted to DEQ by February 28, IV. APPLICATION AND SUBMISSION INFORMATION A. The Recipient must have an executed MOA with DEQ in order to receive reimbursement. The Recipient is responsible for expending its own monies first, and then will be reimbursed for the award amount specified in the signed agreement with the DEQ. Without a fully executed MOA in place, the Recipient will be responsible for all costs of the rental of the ACI. Recipient must execute the MOA with the DEQ and receive a work commencement notification BEFORE a rental agreement for the ACI is completed. Any funds for the rental of the ACI spent by the Recipient before official notification is received will not be reimbursed. 4
