5 EXECUTIVE SUMMARY: In accordance with the Community Development Block Grant Disaster Recovery Program Hurricanes Ike and Dolly Round 2 Housing Guidelines and the Homeowner Opportunity Program Guidelines, the Deep East Texas Council of Governments (DETCOG) must submit a Homeowner Opportunity Program Outreach Plan. Such plan must address the concerns demonstrated in the Needs Assessment related to the damage in the impacted communities. The Outreach Plan must receive General Land Office (GLO) approval prior to DETCOG accepting any Round 2 Housing applications. The DETCOG is using the GLO Needs Assessment for the purpose of its HOP Outreach Plan. Because the Housing Opportunity Program guidelines were finalized after the Affirmatively Furthering Fair Housing Marketing Plans were submitted by DETCOG as part of its Community Development Block Grant Disaster Recovery Program Hurricanes Ike and Dolly Round 2 Housing Guidelines, the Affirmatively Furthering Fair Housing Marketing Plan is superseded by this HOP Outreach Plan. The Plan outlines DETCOG s commitment to executing the program objectives, on a county-by-county basis, in accordance with the Conciliation Agreement, the Phase 1 Analysis of Impediments, and the Federal, State and Local Housing Guidelines. 5 P age

6 BACKGROUND: The 2008 hurricane season will go on record as having been the most active in Texas history. The State was impacted by Hurricanes Ike, Gustav, Dolly and a significant tropical storm within a 52 day time frame. Hurricane Ike, the most damaging, was enormous miles wide, which is the size of West Virginia. As it rolled across the Gulf of Mexico, Ike grew from a Category 2 storm to a powerful Category 4 that unleashed a 20-foot storm surge that engulfed Galveston and other coastal areas, proving to be the third-most destructive storm to ever hit the United States. According to bulletin #50 issued by the National Hurricane Center in Miami, FL at 10:00 AM CDT, Saturday, September 13, 2008 the center of Hurricane Ike was located near Trinity, Texas and was headed north near 16 mph. The bulletin says that maximum sustained winds had decreased to near 80 mph with higher gusts. Ike was still a Category 1 Hurricane with hurricane force winds extending outward up to 45 miles and tropical storm force winds extending outward up to 230 miles. Except for Deweyville, which is located on the Sabine River in extreme south Newton, none of the DETCOG Region was affected by storm surge. However, the high sustained winds did significant damage in the heavily forested region. In September 2009, the State of Texas submitted its Action Plan for the second portion of funding for hurricane recovery. During that time, an administrative complaint and a Fair Housing complaint were filed with the United States Department of Housing and Urban Development (HUD) against the State of Texas. The Fair Housing complaint was filed on December 1, The State of Texas Action Plan for Round 2 funds submitted in September was not accepted by HUD between the date it was filed and the date the Fair Housing complaint was filed. Subsequently, the State of Texas and the Fair Housing Complainants reached a Conciliation Agreement that modified DETCOG s original housing program. The state conducted several necessary steps and developed the guidelines to expend funds. As a part of that process, the state conducted a detailed Needs Assessment to establish targeted outreach locations based on the most need. As a result of the Action Plan for the Second Round of Hurricanes Ike & Dolly Disaster Recovery funds, the Deep East Texas Council of Governments received housing funds to assist disaster victims. Because of the Conciliation Agreement, the resources came with conditions: First, it required that at least 55% of all disaster recovery funds in Texas be spent on housing. 6 P age

7 Second, it required a Needs Assessment to determine how the distribution of funds should occur to ensure that Low to Moderate Income persons receive Fair Housing Choice through a Homeowner Opportunity Program (HOP). For this purpose, the DETCOG is using the GLO Needs Assessment. The Deep East Texas Council of Governments developed a Method of Distribution (MOD) for the region using each county s low to moderate income proportionality, their poverty proportion, county unemployment figures and county FEMA reported damages as weighting factors. The MOD included $20,000,000 for single family repair and replacement and single family rental activities. DETCOG submitted that Method of Distribution in October of 2010 to the State of Texas and HUD, and the plan was accepted. Funds allocated in the DETCOG Regional Method of Distribution (MOD) for use in specific counties that are neither applied for, nor expended per the requirements of their grant contracts, will be reallocated to be used in the county where that entity is located. Locally allocated funds that are not claimed for use in the county will be reallocated within the DETCOG Region by action of DETCOG s Board of Directors. In April of 2009 the Deep East Texas Council of Governments was contracted to conduct a Disaster Case Management (DCM) pilot program funded by the Federal Emergency Management Agency (FEMA) and the Texas Health and Human Service Commission (HHSC). Working off of a list of unserved applicants provided by FEMA, the stated purpose of the program was to provide long-term case management services to citizens affected by the devastation of Hurricane Ike. By program end in July 2011, the highest number of unmet needs identified were in the housing category. No funds were provided for direct services under the DCM program. DETCOG will use funds available in its Housing MOD, and the number of unmet housing needs in each county at the end of the DCM Program, to estimate the number of homeowners to be served in each county of the twelve counties in the DETCOG Region in Round 2.2. On July 13, 2012 the Texas General Land Office (GLO) executed a subrecipient agreement with the DETCOG to fulfill the housing objectives outlined in the Round 2 Housing Guidelines, the HOP Guidelines, the Phase 1 Analysis of Impediments to Fair Housing and the Conciliation Agreement. 7 P age

8 OBJECTIVES: As a Subrecipient of the Round 2 funding, the Deep East Texas Council of Governments will adhere to CDBG housing regulations and address the concerns raised in the Fair Housing Complaint filed December 1, 2009 and resolved by a Conciliation Agreement between the State of Texas and the Complainants. DETCOG will meet the following objectives identified in the Housing Guidelines and the Homeownership Opportunity (HOP) Guidelines: Provide decent, safe, and sanitary housing in the hurricane-impacted areas of Deep East Texas (the area covered includes Angelina, Houston, Jasper,, Newton, Polk, Sabine, San Augustine, San Jacinto, Shelby, Trinity and Tyler Counties) through the provision of activities designed to mitigate storm damage that occurred as a result of Hurricane Ike. Ensure that the housing needs of very low, low and moderate income households in the Deep East Texas Region are addressed in the manner identified in the Needs Assessment. Prioritize the provision of decent, safe and sanitary housing for elderly and disabled populations in the Deep East Texas Region with an emphasis on housing choice and design to reduce maintenance and insurance costs as well as provide for the provision of independent living options. Provide targeted outreach to persons with demonstrated damages in the Deep East Texas Region whose homes are located in FEMA High Risk areas (identified flood areas), 2000 census block groups where the concentration of poverty is greater than 35% and census blocks where there is a minority concentration of 65% or higher. 8 P age

9 OUTREACH APPROACH: In an effort to serve eligible applicants, pursuant to Texas General Land Office (GLO) guidelines and the guidelines of the Homeowner Opportunity Program (HOP), DETCOG will fulfill the Outreach Requirements of its CDBG Round 2 Guidelines by: 1. Making funding available for each income level of applicants, based on activities in Round 1 as calculated in DETCOG s HOP service level requirements and FEMA Claims data sets provided by the GLO needs assessment, in the following proportion*: a. 0 30% Population - (FEMA Claims data = 8,960 = 47%) funds available less Round 1 = $9,978,316 $1,299,867 in Round 1 = $8,678,449 available in Round 2 b % Population - (FEMA Claims = 7,105 = 37%) funds available less Round 1 = $ 7,855,270 $1,886,320 in Round 1 = $5,968,950 available in Round 2 c % Population - (FEMA Claims = 3,025 = 16%) funds available less Round 1 = $ 3,396,874 $1,444,273 in Round 1 = $1,952,601 available in Round 2 *Round 1 numbers subject to change based on the assistance to the final three homeowners. 2. DETCOG will use the GLO-GIS supplied data from the 2000 Census Block Groups in each county comprising the DETCOG Region that show areas of High Poverty Concentration and areas of High Racial & Ethnic Minority Concentration. That information will be correlated with geo-coded post office addresses to generate addresses within the designated Census Block Groups. That correlation will be done by The Texas State Demographer, Lloyd B. Potter, PhD, MPH, who is the Director of the Institute for Demographic and Socioeconomic Research at the Texas State Data Center at the University of Texas at San Antonio. Dr. Potter will also use GIS maps of FEMA designated flood zones in Angelina, Houston, Jasper,, Newton, Polk, San Augustine, San Jacinto, Shelby, Trinity and Tyler Counties (Dark Blue Areas on /City Maps) to correlate with geo-coded postal addresses in generating a list of homes in flood zones in those counties. Those lists will be combined and examined for addresses located in all three outreach targets. As detailed in Exhibit A, this process will be performed on a county-by-county basis in the DETCOG Region. Sabine is omitted from the flood plain designation because of its decision to not participate in the FEMA Flood Mapping/Insurance program. There are FEMA Flood Maps for three cities in Sabine : Bronson, Hemphill and Pineland. However, they are not digitalized as to be available to generate postal addresses. 9 P age

10 There are 51 postal addresses located in FEMA Designated Flood Plains which are located in Block Groups of High Racial & Ethnic Minority Concentration and High Poverty Concentration in the DETCOG Region. This group will constitute, on a county-by-county basis, the DETCOG Primary Target Areas. In the Block Groups which contain both High Racial & Ethnic Minority Concentration and High Poverty Concentration in the DETCOG Region there are 12,054 individuals living in 4,135 homes. These households, on a county-bycounty basis, will be the Secondary Target Group. In the 2000 Census Block Groups which contain either High Racial & Ethnic Minority Concentration or High Poverty Concentration in the DETCOG there are 38,955 postal addresses. In FEMA Designated Flood Plains there are 3,109 postal addresses. These households, on a county-by-county basis, will make up the Tertiary Target group. 3. The Coordinator of the DETCOG Disaster Recovery, Round 2, Outreach Program will be Bob Bashaw. Mr. Bashaw has a communications and targeted marketing background. His experience working as a Disaster Recovery Housing Inspector after Hurricanes Rita and Ike in rural communities in Deep East Texas also lends itself to this program. 4. Bob Bashaw will also be conducting the targeted outreach in the field. Having worked in the region as a Disaster Recovery Housing Inspector for both the Hurricane Rita and Hurricane Ike Recovery programs, he is familiar with many of the communities, and the populace, in the twelve county region. 5. The main focus of the Deep East Texas Council of Governments Hurricane Ike Housing Disaster Recovery Program targeted marketing will be direct mail postcards containing the information from the GLO supplied marketing templates in both English and Spanish. The postcards will also contain information on where applications can be obtained and how to get further information. As a part of using the GLO Marketing Templates a statement will be included indicating that DETCOG retains the right to suspend or close intake if: The total number of applications exceeds 1.75 times the number of applicants the Subrecipients intends to serve in each county, and; The application disqualification and withdrawal rate does not exceed 42% of the applications collected. 6. In addition to the postcards, double sided yard signs containing the GLO supplied marketing templates, in both English and Spanish, will be placed along arterial roadways near the boundaries of the targeted Census Blocks. DETCOG will take measures to make the Program accessible to persons who are considered members of a protected class under the Fair Housing Act by working with the NAACP to hold informational meetings in buildings that are compliant 10 P age

11 with the Americans with Disabilities Act (ADA), providing sign language assistance and special assistance for those who are visually or otherwise impaired, when requested. 7. DETCOG will establish intake centers at it s Lufkin Office, its Main Office in Jasper, and it s Disaster Recovery Office in Jasper. Round 2 applications will be available online at DETCOG s web site ( and at city halls and county judges offices in the 12 counties in the DETCOG region. The Disaster Recovery marketing materials will direct those seeking further information to a toll free number. 8. The Deep East Texas Council of Governments Hurricane Ike Housing Disaster Recovery Program will not be using Round 1 Applications as a starting point in its Round 2 program. 9. The Deep East Texas Council of Governments Hurricane Ike Housing Disaster Recovery Program will be sending letters to the Chief Appraisers at each Central Appraisal District in its twelve county region asking for a list of residential properties whose improvement values have dropped more than 30% in the appraisals conducted after September 13, DETCOG will also send a letter to all city and county governments in the region requesting a list of homes condemned or abandoned, and utilities disconnected and not subsequently reconnected, after September 13, Those lists will then be checked on the Texas General Land Office Homeowner Opportunity Program Area Locator to see if they are located in a priority service area. An effort to locate and market to the former residents will be made for those abandoned homes located in a priority area. 10. The Deep East Texas Council of Governments Hurricane Ike Housing Disaster Recovery Program will follow the process, on a county-by-county basis, shown in the attached Round 2.2 HOP Intake & Outreach flow chart (Exhibit E) in reviewing applications to determine how they compare with the income groups and targeted areas. 11. The Deep East Texas Council of Governments Hurricane Ike Housing Disaster Recovery Program will submit, for GLO approval, any marketing items used in conjunction with the GLO supplied marketing templates. 12.Because the Housing Opportunity Program guidelines were finalized after the Affirmatively Furthering Fair Housing Marketing Plans were submitted by DETCOG as part of its Community Development Block Grant Disaster Recovery Program Hurricanes Ike and Dolly Round 2 Housing Guidelines, the Affirmatively Furthering Fair Housing Marketing Plan is superseded by this HOP Outreach Plan. 11 P age

14 In the first 30 days of the DETCOG Outreach program DETCOG will send English/Spanish language post cards, with the GLO Marketing Template message (Exhibit B) to the identified postal primary target addresses in Diboll, Texas. It will also locate the yard signs with the same message in the Primary Target locations. While in the area we will also attempt to locate any abandoned homes and attempt to deliver the outreach material to them. In addition, DETCOG will take measures to make the Program accessible to persons who are considered members of a protected class under the Fair Housing Act by holding informational meetings in a building that is compliant with the Americans with Disabilities Act (ADA), providing sign language assistance and special assistance for those who are visually or otherwise impaired, when requested. 15 Because the City of Lufkin has been persistent in addressing residential flooding issues, there are no postal addresses in the FEMA Designated flood plains in the high poverty/minority census blocks in that city. In days 31 to 60 of the HOP Outreach program in Angelina, DETCOG will move marketing efforts to the Secondary Targeted areas. Postcards will be sent to the 1,322 postal addresses in the secondary target Census Blocks where there are High Racial & Ethnic Minority Concentration and areas of High Poverty Concentration. It will also expand the location of the yard signs with the same GLO Marketing Templates message into the Secondary Target locations. ANGELINA CO. 17 In days 61 to 90 of the HOP Outreach program there, DETCOG will move marketing efforts to the Tertiary Targeted areas. This group is made up of the Block Groups of High Racial & Ethnic Minority Concentration, areas of High Poverty Concentration and FEMA Designated High Risk Areas in Angelina. The Block Groups of High Racial & Ethnic Minority Concentration, areas of High Poverty Concentration contain 1,981 households. There are 139 postal addresses in FEMA Designated High Risk Areas in Angelina. ANGELINA CO. 19 GENERAL OUTREACH AREA Any area in Angelina that is not included in the targeted areas identified by the Needs Assessment and HOP geographic eligibility is considered the General Outreach Area. The General Outreach Area is not eligible for the Homeowner Opportunity Program. Prior to conducting General Outreach in Angelina, DETCOG will present a description of its targeted outreach efforts and an outcome analysis to the GLO. GLO will authorize DETCOG to proceed with General Outreach after reviewing and approving its targeted outreach analysis. DETCOG retains the right to suspend or close intake if: The total number of applications exceeds 1.75 times the number of applicants the Subrecipients intends to serve in each county, and; The application disqualification and withdrawal rate does not exceed 42% of the applications collected. 19 P age

21 Because there are no postal addresses in the flood plains in the high poverty/minority census tract block groups in Houston, those lists will be combined in the Secondary and Tertiary group combinations to generate the appropriate outreach targets in Houston. In days 1 to 45 of the HOP Outreach program in Houston, DETCOG will begin marketing efforts in the Secondary Targeted areas. Postcards will be sent to the 638 postal addresses in the secondary target Census Blocks where there are High Racial & Ethnic Minority Concentration and areas of High Poverty Concentration. It will also place yard signs with the GLO Marketing Templates message into the Secondary Target locations. HOUSTON CO.
