I would like to cordially invite you to attend ACWA s 2011 Fall Conference & Exhibition, Financing Our Future scheduled for November 29 December 2 in Anaheim. Considering the economic climate we find ourselves in today; how do we continue to manage the business of delivering high quality water to California s farms, industries and people? This conference will engage attendees with discussions about how we will be able to finance and deliver the future of California s water needs. There will be programs and discussions about water supply, groundwater, agricultural water issues, the Delta, climate change, energy, industry and more! Programs specifically aimed at legal, finance, human resources, and water treatment and distribution professionals will be available, along with opportunities for directors to receive their ethics training. All conference delegates are encouraged and welcome to attend the committee and region meetings that will be held during the conference. Additionally, the elections for ACWA President and Vice President will be held November 30th at conference, immediately following the Wednesday luncheon. 3 Conference Programs ATTORNEYS PROGRAMS These programs are approved by the State Bar of California for attorneys to receive general MCLE credits. Does the Public Trust Doctrine Apply to Groundwater Wednesday, Nov. 30; 10-11:45 a.m. (1.75 hours of general MCLE credit) Whether the public trust doctrine applies to groundwater in California, and whether the State Water Resources Control Board (SWRCB) has the right to regulate groundwater under the public trust doctrine. This issue is the subject of a pending action involving the Scott River in Siskiyou County. The issue is of major importance to all California water districts and users in California, because if the public trust doctrine applies to groundwater and the SWRCB can regulate groundwater under the doctrine they would have authority that the Legislature has never granted to them. Fish and Game Code Section 1602 and Water Diversions What to Do if the California Department of Fish & Game Warden Shows Up at Your Door Wednesday, Nov. 30; 2:30-3:45 p.m. (1.25 hours of general MCLE credit) The California Department of Fish & Game (DFG) recently required diverters in Northern California to sign on to blanket Streambed Alteration Agreements (SAA) permits for diversions. Can they enforce the requirement for water rights holders to comply with Section 1602 and what does that look like? Demystifying Local Public-Private Partnerships Thursday, Dec. 1; 10-11:30 a.m. (1.5 hours of general MCLE credit) Hear from experts who will review current legal issues confronting local publicprivate partnerships (P3 s) and the case summary of Santa Paula Water Recycling Facility. The High Cost of Retirement-Strategies for California Water Agencies Thursday, Dec. 1; 2:30-3:45 p.m. (1.25 hours of general MCLE credit) What can you do about the skyrocketing costs for retirement benefits? A lot more than you might think, but you have to do it right to stand up to a legal challenge. This program will explore what can and cannot be done and how to do it. Topics will include Employer Paid Member Contribution (EPMC), two-tiering, employee cost-sharing, changes to retiree medical programs as well as the fundamental issue of whether a benefit is vested. ACWA/JPIA Sexual Harassment Prevention for Board Members & Managers (AB 1825) Tuesday, November 29 1:30-3:30 p.m. Have you ever thought what it would be like to be the accused and the impact it would have on your personal and professional life? This course revolves around an actual case where the accused goes through the cycle of chaos that developed as a result of the accusation of sexual harassment. The course presented by ACWA/JPIA experts, will guide management through the sexual harassment investigative process. Other points covered by this course are understanding the California and federal sexual harassment laws, recognizing early signs of sexual harassment, maintaining open communication in a respectful environment, and investigating and resolving sexual harassment complaints. By equipping management with the knowledge they need to prevent and respond to harassment situations, the course helps to prevent and eliminate sexual harassment in the workplace. In order to receive credit for this class, attendees must arrive on time and attend the entire two-hour session. Human Relations professionals may count these session hours as electives towards JPIA s Human Resources Certification Program (HRCP). Continuing Education and Training Opportunities Many of ACWA s program sessions qualify for credit for professional career development. This conference will offer continuing education credit to Certified Public Accountants, attorneys and legal professionals, human resource administrators, and water treatment and distribution operators. There will also be three opportunities to receive water agency official ethics training. Public officials in office must receive this training every two years (24 months).
