2 2 BARGAINING THIS WEEK In contract talks last week, the CFA and CSU administration bargaining teams moved closer to agreement on Year Round Operations (YRO). The sides are trying to attain an early agreement on how faculty members will be paid for teaching YRO classes this summer, as well as in the summers of 2007 and The CSU administration has proposed to handle 2006 as was done in This means full pay just as people are paid for teaching other terms, as well as some pay per unit for indirect services. The exact amount remains under discussion. Earlier in the talks, the administration had offered less than full pay for YRO teaching. The CFA team still sees improvements it would like in the offer, but notes the administration team has improved their position on YRO. CFA has put on the table a set of talking points, or principles, regarding faculty workload. The administration is now considering them. The CFA principles address workload from three perspectives: amount of teaching credit for large classes, the need for more tenure-track faculty, and the number of WTUs (weighted teaching units) required each term. 3 TALKS ACROSS THE DIVIDE: FERP TAKE-AWAY Starting this week, CFA Headlines will explore specific issues on which the CFA and CSU administration bargaining teams are the furthest apart. This week, we look at FERP (Faculty Early Retirement Program), which the CSU administration proposed to eliminate entirely in its initial bargaining proposals released last year. Elimination of or reducing the years covered by FERP is a prime example of a take-away demand made by the CSU administration s bargaining team. A takeaway would remove something of value from the faculty contract that is already there. CFA has found that FERP is one of the CSU employment programs that has worked very well since its inception. The program is a win-win in that it provides advantages both for individuals by letting them prepare for retirement and for the university by ensuring continuity in instructional programs. What s more, FERP saves the CSU money. The CSU only has to pay half a FERP-er s salary for teaching a full load of courses (12 WTU) in one term. Health care for FERP-ers, other than vision and dental, is paid by CalPERS. That

3 saves the CSU more money. And the CSU no longer contributes to a FERP faculty member s retirement. In recent bargaining sessions, the CSU administration team dropped the demand to eliminate FERP and instead proposed to reduce the program from five to two years. So why would the CSU administration want to eliminate or reduce FERP? That is not explicitly explained. They had alleged it to be a cost savings measure, but that has been established to be not the case. CFA speculates it would be a power move to replace more quickly tenure-track jobs with temporary appointments filled by faculty members they find easier to manage. Get more background on bargaining at 4 CFA ANALYSIS OF GOV S BUDGET NOW ON WEB CFA s analysis of CSU funding in the governor s proposed 2006/07 state budget finds that while the budget-cutting measures of the recent past have ended, the governor does not provide enough to lift the university out of the hole already created by years of insufficient state funding. We had hoped that as the economy recovers we d be able to move forward, said CFA President John Travis. See Research Brief #13 in the Research Center on CFA s Web site at The governor s proposal includes an increase of $189 million to the CSU s general fund, plus $54.4 million for a one-time buy out of this year s student fee increases adopted by the CSU Trustees. While CFA applauds the fee buy-out, it notes students already are paying 76 percent more in fees than they were three years ago. Also, the governor s plan does not address the Trustees long-term plan for 10 percent increases in each of the next four years. Further, the base funding proposal would keep the CSU static rather than getting ahead. We believe that if the Legislature would increase the base budget by 6 percent rather than just 3 percent as is proposed, we really could make some positive movement to rebuild the CSU, said Travis.

4 5 CFA TO ADDRESS TRUSTEES: FEB 1, LONG BEACH CFA and CSU students will address the Board of Trustees at its Feb. 1 meeting to demand that CSU put teaching first in the budget. CFA represents 23,000 professors, lecturers, librarians, counselors and coaches on 23 CSU campuses. The California economy is rebounding, and it s time to rebuild the educational engine that turns out most of California s engineers, teachers, and nurses, says CFA Vice President Lillian Taiz. Yet, the CSU administration has proposed a series of take-aways in the ongoing contract negotiations The outlook is brighter, said Taiz. In this new environment, it s unacceptable to be asking for takeaways in our contract or low-balling our salaries. What the CSU should be doing is making up to the faculty members for the sacrifices they have made during the past several years. The CSU Trustees and the administration need to get more funding for the university to meet the unmet needs they already know about. We need to rebuild the CSU, Taiz said. For more information, go to 6 CENSORSHIP AT DOMINGUEZ HILLS If you are reading these CFA Headlines, there s a good chance you don t teach at CSU Dominguez Hills. That s because the campus administration there has unilaterally declared CFA s weekly missive to be partisan in its critiques of the Trustees and governor s CSU funding proposals. They are censoring our communication with the faculty here at Dominguez Hills, says CFA Dominguez Hills Chapter President David Bradfield. And this is a voluntary list. The administrators say they are basing their action on their own judgment of what s proper to send out.

5 While there are statutes that prohibit the use of public resources for partisan purposes, the intent of the law and past litigation has limited the prohibition to partisan campaigning for candidates in an election. Criticizing the governor for his policies is not a partisan purpose, says Bradfield. The specific issue was the Jan 5. edition of CFA Headlines about the governor s State of the State speech. It may be viewed in the CFA Headlines archive at CFA plans to file an unfair labor practice charge with the Public Employees Relations Board, saying this is a unilateral change in a major working condition without bargaining under the terms of the contract. Other legal options are being explored. 7 CFA MAGAZINE NOW AVAILABLE ON WEB The Winter 2006 issue of California Faculty, CFA s quarterly magazine, is now available for download on CFA s Web site at This issue includes a thorough look at the Trustees non-advocacy for the CSU, a breakdown of the university s unmet needs, a review of the Nov. 8 Special Election and a preview of the June 6 primary and Nov. 7 general elections, plus a review of what s going on at the bargaining table and more. AWARDS CFA is seeking faculty nominations for its annual awards to be given out during the Spring Assembly in April. There are four award categories, and the deadline for nominations is Friday, Feb. 28. (We Honor Ours) AWARD This award is presented to a CFA member who has given outstanding service to CFA at the state level. BEN MANSELL ACADEMIC RIGHTS AWARD F. Ben Mansell was a CTA staff member who spent his career advocating for and representing faculty members in the CSU. He was involved with CFA during the founding years, and this was CFA s first award, established in 1980 following his untimely death. The award is presented to a CFA member for outstanding work as a grievance/representation advocate. MARIO SAVIO EQUAL RIGHTS AWARD Originally the CFA Equal Rights Award, this award was renamed in honor of Mario Savio, nationally known civil rights activist and long time CFA member, after his untimely death. This award is given annually to a CFA member for outstanding advocacy on behalf of civil and equal rights, especially for faculty, students, and staff in the CSU. 9 NEW STAFF HIRES CFA has successfully filled vacant positions that had been vacated by employees who retired or left the union. Lora Jo Foo will serve as CFA s Northern California organizing director. Foo, who received her bachelor s degree from San Francisco State, holds a master s degree from Harvard s Kennedy School of Government and comes to CFA from her last position as a voting project coordinator for the AFL-CIO in Washington, D.C. Foo will manage the field representative team that assists CFA chapters on campuses in the north. The two new members of that team are Kathy Sheffield to serve Monterey Bay and John Kulstad who will serve at Humboldt. Sheffield also

7 becomes CFA s representation specialist in the north, splitting duties with Gerry Daley, who will serve as the representation specialist in the south. Also in the south, Brian McNally is CFA s new field representative for the Channel Islands and San Luis Obispo campus chapters. CFA General Manager Bob Muscat said he is happy to announce these hires, as they will enhance the union s ability to secure a fair contract for the faculty and work for a strong CSU budget for 2006/07. It s very critical to bring on the very best staff for what is going to be a challenging year; we expect major battles on the budget and in both the June primary and the November general elections, said Muscat. 10 CORRECTION The date given in last week s Headlines for the upcoming faculty rights workshop was wrong.
