3 Helping Charter Schools Hurt by Harvey Districts and charter schools in 58 county disaster area may apply for up to four additional waiver days for any instructional days missed from Sept. 5 to Sept. 8 (Cameron and Willacy counties are included). 4 Helping Disaster Areas TREA is sponsoring donations of school goods through Region 2 ESC. Affected districts recommend donation in currency to avoid logistics of warehousing and distributing goods. For more information check the TEA website at er/weather_and_disaster_information/

5 QUESTION Is it legal to pay teachers and other contracted personnel for days a district is closed due to Hurricane Harvey for evacuation and recovery purposes? Local school board in concert with local counsel may resolve the question. To solve consider the following: Terms of teacher contracts Prohibition against using public funds for private purposes TX Const. Art. III, Secs. 51 and 52 (expenditure must serve a public purpose). Section of TEC requires a min. of 187 days of service, but allows the Commissioner to reduce number of days in event of floods or extreme weather without reducing teacher salary. A district may request that the commissioner authorize a reduction in number of days or may give employees the opportunity to make up the lost days. District that requests a shorter contract term will need to apply by selecting the other waiver type using the TEAL waiver application.

6 Adjustments for ADA To the Administrator Letter was sent on September 12 If a district loses enrollment, TEA will continue to make full payments to all districts and charter schools. For charter schools, it is practice to update the Legislative Payment Estimates. Therefore, they should contact Dina Black at TEA. TEA is exploring options to adjust ADA during settle up process for Districts that experience increase of 10% or 30 displaced students may report it to the State Funding Division to increase their LPE. Districts may report only increased enrollment and ADA due to Hurricane Harvey and were assigned a crisis code of 05. You must complete the form attached to letter. Requests for LPE adjustments are due by September 29.

7 Memorial Day Reminder HB 441 prohibits students from having class on Memorial Day, May 28th. This information is collected through the PEIMS system Teachers may work that day, but students may not attend school. Please check your school calendar Check to make sure your calendar adds up to 75,600 minutes of instruction in the school year.

8 SB 7 UPDATE SB 7 requires that employment applications include additional language to seek relevant information regarding inappropriate relationships with students. SB 7 became effective on September 1, However, TEA has not issued a form affidavit pursuant to SB 7 We would not encourage districts to attempt to create a homegrown affidavit. The statute specifically says the affidavit will be a form adopted by TEA. A locally adopted form would not suffice. Consequently, districts may decide to take no action at this time. If your district uses the model TASB HR Services application form, it already inquires as to adjudicated offenses and includes a verification that the information is true and accurate and a statement that deliberate falsifications, misrepresentations, or omissions of fact may be grounds for rejection or dismissal from employment. If your district is a member of Region One ESC s One App, you are in compliance since we follow a similar model to TASB. In addition, as soon as TEA issues the form affidavit, we will adopt it in One App.

9 SB UPDATE SECTION 7. Subchapter A, Chapter 21, Education Code, is amended by adding Section to read as follows: Sec PRE-EMPLOYMENT AFFIDAVIT. (a) An applicant for a position described by Section (a) or (b) with a school district, district of innovation, open-enrollment charter school, regional education service center, or shared services arrangement must submit, using a form adopted by the agency, a pre-employment affidavit disclosing whether the applicant has ever been charged with, adjudicated for, or convicted of having an inappropriate relationship with a minor. (b) An applicant who answers affirmatively concerning an inappropriate relationship with a minor must disclose in the affidavit all relevant facts pertaining to the charge, adjudication, or conviction, including, for a charge, whether the charge was determined to be true or false.
