II RCOMMNDATION: THAT an amount of $23,750 be approved from the Community Initiated Cost Sharing Projects fund for the installation of a water fountain and a stair counter at Fred Gingell Park. II PURPOS: To seek support for the installation of a water fountain and a stair counter at Fred Gingell Park (Park, as part of the Community Initiated Cost Sharing Projects fund (Fund. II BACKGROUND: The Park opened in 2001 and was named after the former MLA for South Delta. It has become a destination for people wanting to enjoy the views of the Strait of Georgia and Active Pass. The Corporation of Delta (Delta leases the land on which the Park is situated from BC Hydro and Power Authority. Stairs, installed in 2004, from the upper Park down to the beach, are heavily used by recreation enthusiasts as a fitness circuit. In 2014, geotechnical reports indicated that a number of trees from the upper Park to the beach required removal to preserve stability of the slope. The trees were removed under supervision of a Geotechnical ngineer, and native tree and shrub species were replanted along the slope. The replanting was partially funded by a BC HydrolTrees Canada grant. In February 2015, the President of the Rotary Club of Tsawwassen (Rotary approached the Chief Administrative Officer and Director of Parks, Recreation & Culture to discuss working with Delta to install a water fountain and a stair counter (Attachment A which would support the recreational uses of the Park.

DISCUSSION: The stairs at the Park have turned into a significant free workout space for fitness enthusiasts. It is estimated that the stairs receive daily patronage of between 150 and 500 persons, depending on the weather and time of year. The Rotary is a civic minded and active community group that has been involved in community oriented projects. The Rotary has noted that the Park has become a destination for individuals using the stairs as a fitness circuit and, as such, would like to pursue the installation of a water fountain and a means to count repetitions of flights of stairs climbed. The Rotary is requesting that Delta enter into a cost sharing agreement for the installation of these two features. The total cost for the stair counter is $5,000 and the cost for the water fountain is $42,500, totaling $47,500 for both elements. Limits for the Fund, PR&C-3 (Attachment B, places Delta's contribution at 50% of the total project costs. The Rotary has demonstrated that it can contribute its 50% share, or $23,750, to the project. Delta's contribution would include water and drainage connections and geotechnical consulting services. The Rotary would contribute the remaining 50% of the costs by way of engineering consulting services, in kind services and the manufacture of the components. As a demonstration of their commitment to this project the Rotary has agreed to execute the draft memorandum of understanding (Attachment C should the project receive approval by Council. At its September 17, 2015 Regular Meeting, the Parks, Recreation & Culture Commission endorsed the recommendation contained in this report. Implications: Financial Implications - Should this project be approved by both the Parks, Recreation & Culture Commission and Council, provision has been made in the 2015 Capital Plan PR&C-3 for funding of $23,750, which would be 50%, of the total project cost.

BC Hydro & Power Authority is the registered owner, and The Corporation of Delta is an interested party, of the following lands situated in the municipality of Delta legally described as: 265 nglish Bluff Road, Delta, British Columbia Parcel Identifier: L T 2 SC 3 & 4 TWP 5 NWD PL 3724 ("Fred Gingell Park" B. The Rotary wish to provide service to the community of Tsawwassen through the creation of additional community recreation amenities that are accessible to all residents. C. Delta and the Rotary are interested in a possible future relationship, which would involve the Rotary funding jointly approved capital projects in Fred Gingell Park. D. Delta and the Rotary have created this Memorandum of Understanding ("MOU" to generally set out the objectives of this relationship and potential role'each party may play in the provision of capital projects in Fred Gingell Park.
9 Attachment C Page 2 of 5 General Terms 1. MOU Non-Binding. Delta and the Rotary intend that this MOU be used simply to facilitate planning and funding steps regarding potential recreational amenities in Fred Gingell Park. Delta and the Rotary agree that this MOU does not in any way create any legallybinding rights or obligations on either party. 2. Definitions In this MOU, the following words have the following meanings, unless the context otherwise requires: a "Fountain" means a custom designed drinking fountain, which would provide potable water for adults, children and pets, including a water bottle filling station. b "Stair Counter" means structure located at the top of the stairs in Fred Gingell Park which facilitates the temporary, manual recording of completed circuits of the stairway. Collectively, the definitions contained in this section are the "Projects". 3. Rotary's Role The Rotary agree: a to conduct fundraising efforts for the purpose of providing 50% funding for the design and delivery of the Projects based on the following estimates: i. Fountain = $42,500 ii. Stair Counter = $5,000 b that professional services and in kind services can be provided in lieu of funding. c professional and in-kind services provided by the Rotary must be incorporated into and are consistent with Delta's Purchasing Policy. 4. Delta's Role Delta agrees to: a plan and implement the Projects, including engaging professional services where required.
10 Attachment C Page 3 of 5 b conduct all ongoing operational aspects of Fred Gingell Park, including the annual maintenance of completed Projects, in accordance with park maintenance standards as defined by Delta. c assume all costs for Delta staff in the planning and implementation of the Projects. d work cooperatively to support the Rotary in funding opportunities whenever possible that are congruent with Delta's interests as a whole. e fund up to 50% of the cost of the Project. 5. Mutual Responsibilities Delta and the Rotary agree that: a the Projects will be implemented in the following priority order: i. Fountain ii. Stair Counter b the Fountain and Stair Counter will be located at the sites generally identified in Schedule A. c the lifespan of each amenity would be as follows: i. Fountain = 20 years ii. Stair Counter = 15 years d all designs, specifications and plans related to the Projects are subject to mutual approval by Delta and the Rotary. e Delta and the Rotary are recognized as equal partners in the delivery of the Projects resulting from this MOU. f the involvement and recognition of any additional party in the Projects will be subject to mutual agreement of Delta and the Rotary. g in order to receive consideration for recognition in the Projects, an additional party's involvement must include provision of financial resources that could not be realized by Delta and the Rotary without the involvement of the additional party.
