3 I. Project Overview A. Introduction/Statement of Purpose Blue Ridge Community & Technical College (BRCTC), is soliciting proposals for providers of in-person, face-to- face sign language interpretation using American Sign Language (ASL). Interpretation activity may occur at any of our campus locations listed below: Main Campus Apple Harvest Dr., Martinsburg, WV Technology Center 5550 Winchester Ave., Martinsburg, WV Morgan County Campus 109 War Memorial Dr., Berkeley Springs, WV Hollywood Casinos Charles Town, WV Quad Graphics Martinsburg, WV Primary need is at the Main Campus and the Technology Center. Interpretation services are needed for students taking courses, along with graduations & special events, off campus. B. Organizational Overview Blue Ridge Community and Technical College has developed a strong presence in West Virginia s Eastern Panhandle. The school has seen a remarkable evolution since its unofficial inception over 40 years ago, when Shepherd College began offering two-year programs. Shepherd Community College officially began in 1974 when the nursing department became the first two-year program to be adopted by Shepherd. In 1989, at the request of the West Virginia State Board of Directors, the Community and Technical College named its first Dean, Dr. Peter Checkovich. He was later named Provost and in 2004 became President of the Community and Technical College (CTC) of Shepherd. In March 2005, CTC Shepherd was accredited as an independent institution by The Higher Learning Commission and is a member of the North Central Association (NCA). As of July 1, 2006, the Community and Technical College of Shepherd was officially renamed Blue Ridge Community and Technical College. OUR MISSION Blue Ridge Community and Technical College is dedicated to providing a diverse student population with collaborative programs and support services to improve the quality of life and promote economic development in its service area. Our quality academic programs are learnercentered and focus on career entry, university transfer, developmental education, and workforce development. OUR VISION Our curriculum is integrated directly with the economic and workforce needs of the region. Programs of study are designed to meet the needs expressed by community members, advisory 2

4 boards, employers, and workforce as reflected in an ongoing needs analysis of the region. Blue Ridge faculty and staff continuously analyze and modify the curricula and programs to meet the educational needs of an increasingly complex and technological society. The College intends to meet the educational challenges of the 21 st century and to provide quality educational experiences for the population of the Eastern Panhandle C. Project Background The services being solicited through this RFP will facilitate and support the education of deaf and hard of hearing students by allowing communication between individuals (and/or their families) who use American Sign Language (ASL) and members of faculty and staff. D. Request for Proposals BRCTC is seeking responses to this Request for Proposal (RFP) from providers with the experience and expertise to provide interpretation services using ASL. The service will be offered to degree & non-degree seeking BRCTC students. All providers, including those currently offering these services to BRCTC students, must respond to this RFP in order to be considered to continue providing the service. E. General Disclaimer This RFP does not commit BRCTC to award a contract. This RFP and the process it describes are proprietary and are for the sole and exclusive benefit of BRCTC. No other party, including any Applicant, is intended to be granted any rights hereunder. Any response, including written documents and verbal communication, by any Applicant to this RFP, shall become the property of BRCTC and may be subject to public disclosure by BRCTC. II. Scope of Work A. Project Details The overall objective of this RFP is to identify qualified organizations to provide interpretation services using ASL. Through these services, persons who use ASL will be able to attend courses offered by BRCTC. In recent years, BRCTC has utilized approximately 600 hours of ASL interpreting services per semester, on average 140 hours per month. Most of the interpretation assignments are at the Main Campus and may require multiple hours in a single day. Most assignments are in a classroom setting and are typically 2 hours in length; however, there are situations in which an interpreter may be needed to stay longer. The need for interpreting services is dependent on the number of deaf and hard of hearing students enrolled and the number of credit hours for which a student enrolls. There is no guarantee for a minimum service need. BRCTC may fund multiple providers to offer these services. 3

5 B. Services to be Provided/Required Tasks Student class schedules will be made available at the beginning of each semester and most services can be scheduled in advance. Types of classes that need interpreting services are lecture classes and labs. Lecture classes are offered Monday through Friday, 8am 10pm. Saturday classes are offered from 8am 4pm. Classes are offered at the locations listed above in the Introduction paragraph. In addition to classes, students may require an interpreter when meeting with Enrollment Management staff, faculty or their advisor. There may be an occasional need for services that are not scheduled. It is expected that interpreting service providers will respond to unexpected situations and be available on-site at the specified campus location within a 4 hour time period. Please address the following scenarios in the proposal submission: 1. Scenario A: Two students are enrolled in the same lecture class from 6pm 8:45pm (weekday). What would the cost be for this scenario? Will more than one interpreter be required? 2. Scenario B: One student has lecture class from 10am-12:45pm (weekday). What is the hourly rate and how many interpreters will be needed? 3. Scenario C: One student has lecture classes from 10am-12:45pm (weekday) and another student has classes on same day from 2pm-4pm. How many interpreters are required? How many hours are billed? 4. Scenario D: One student is enrolled in a science lab from 1pm-3pm. What is the hourly rate? C. Monitoring Programs which are funded through this RFP process will be subject to evaluation and program monitoring by BRCTC. BRCTC will monitor compliance and budget issues of selected applicant(s). D. Reporting Requirements By accepting the award under this RFP, the applicant agrees to comply with the reporting requirements of BRCTC. The applicant agrees to supply all data requested by BRCTC. To fulfill the data reporting requirements, the applicant must work with BRCTC to ensure the quality and completeness of data. Reporting requirements may be modified prior to or during the contract period. E. Performance Standards All persons providing interpreting services under this contract must adhere to the qualification and registration requirements as outlined by the West Virginia Commission for the Deaf and Hard of Hearing. All persons providing interpreter services under this contract with BRCTC must have a current certification issued from, or recognized by, the Registry of Interpreters for the Deaf, Inc. (RID), which is supported by the National Association of the Deaf (NAD). It is also expected that qualified sign language interpreters will abide by the Code of Professional Conduct jointly promulgated by NAD and RID when providing services. 4

6 F. Compensation/Reimbursement The successful applicant(s) will be reimbursed by BRCTC. In order to receive payment for services provided, the selected applicant(s) will be required to submit a monthly invoice indicating the name of the student receiving services, interpreter s name, time and date of service, billable hours, rate and total. The invoice may be submitted electronically. If all of the required items are not accurately included in the monthly invoice, the invoice will be considered incomplete and returned to the provider for corrections and re-submission. Invoices must be submitted within ninety (90) days of the date of service. If an invoice is returned to the provider as incomplete, the provider must re-submit the invoice with the same ninety day submission period for payment for the identified dates of service. G. Organization and Personnel Requirements BRCTC is seeking a provider who has experience with and is currently providing interpretation services. As indicated above, all persons providing interpreter services under this contract with BRCTC must have a current certification issued from, or recognized by, the Registry of Interpreters for the Deaf, Inc. (RID), which is supported by the National Association of the Deaf (NAD). Also all persons providing interpreting services under this contract must adhere to the qualification and registration requirements as outlined by the West Virginia Commission for the Deaf and Hard of Hearing. It is also expected that qualified sign language interpreters will abide by the Code of Professional Conduct jointly promulgated by NAD and RID when providing services. The contracting provider will be held accountable for its employees and sub-contractors in both of these areas and if so requested, must be prepared to provide evidence of certification. III. Application Format, Content and Submission Requirements: Selection Process A. Required Proposal Format 1. Format Structure 1.a. Proposal Cover Sheet The cover sheet (see Appendix A) should be completed with the applicant s information and included as the first page of the proposal. 1.b. Table of Contents A table of contents should be included as the second page of the proposal with each section of the proposal included and with a page number for the first page of each section. 1.c. Proposal Proposal content as outlined in Section III.A.2. 1.d. Attachments Attachments to the RFP must be included in the proposal submission. See pages of RFP. 5

7 1.c. Format Requirements Proposals should be prepared simply and economically, providing a straightforward, concise description of the applicant's ability to meet the requirements of the RFP. Each proposal should provide all the information detailed in this RFP using the format described below. The narrative portion of the proposal should be presented in print size of 12, using a Times New Roman font, single spaced on 8.5 by 11 sheets of paper with minimum margins of 1. For each section where it is required, the applicant should fully answer all of the listed questions in the outline form in which they are presented in the RFP. Answers to each question should be numbered/lettered and correspond to the numbered/lettered questions in this RFP. Failure to number and letter the questions or to respond to all questions may result in the proposal s being considered non- responsive. Each attachment, appendix or addendum should reference the corresponding section or subsection number. If you have responded to a requirement in another part of your proposal, make reference to that section and do not repeat your response. B. Proposal Content & Selection Process An application review committee will review all responses to this RFP. Based on the criteria detailed below, the committee will make recommendations concerning the submissions that are best able to meet the goals of the RFP. Submissions will be reviewed based upon the merits of the written response to the RFP. Specific scoring criteria upon which the review will be based include: 1: Threshold Requirements Threshold requirements provide a baseline for all proposals, which means they provide basic information that all applicants must meet. Failure to meet all of these requirements may disqualify an applicant from consideration through this RFP. Threshold requirements include timely submission of a complete application with all sections outlined in Section III.A completed. Threshold requirements include having the requisite experience and licenses to provide the service and being a business in good standing with the State of WV and BRCTC. Applicants that do not meet all of the threshold requirements may have their proposals disqualified. For applicants meeting the threshold requirements, the specific scoring criteria for this RFP upon which the review will be based are as follows: 2: Proposed Content 2.a. Introduction. Prepare a brief introduction including a general demonstration of understanding of the scope and complexity of the work. 2.b. Experience/Capability (30 Points) Potential providers are requested to describe their capability and experience providing 6

8 interpretation services. List company contact information, how long the company has been in business and what services are provided. Describe only recent work (within three years) related to the proposed effort and include any examples of similar activities. Describe your structural capability to implement an interpretation service for BRCTC in a range of settings and locations. 2.c. Personnel (25 Points) List key personnel who will be assigned to this program. Detail their work experience in areas related to the proposed program and identify who will serve as the contact person for the management of the contract. 2.d. References (10 Points) Provide references and contact information from three organizations that have used interpretation services provided by your organization for at least 12 months. 2.e. Budget (35 Points) Submissions must include a schedule that provides a cost estimate for each scenario provided in the Section II, Part B, as well as applicable price differentials. The rate should include all expenses including travel time, mileage and all other expenses related to interpretation services. No expenses will be paid for by BRCTC which have not been included in the rate. The budget should have an accompanying budget narrative and include a statement of the applicant s ability to provide monthly billing invoices and cumulative annual reporting. Final rates will be determined in negotiations with the qualified Applicant(s) after the proposal submissions have been reviewed and contract negotiations have begun. It is expected that rates will be set at a competitive level consistent with the current regional market for American Sign Language interpretation. The need for more than one interpreter shall be a shared decision by BRCTC and the successful bidder and may be addressed on a case by case basis. Although BRCTC may award a contract based on an initial offer, BRCTC reserves the right to have discussions with those Applicant(s) falling within a competitive range, and to request revised pricing offers from them and to make an award or conduct negotiations thereafter. C. Eligibility Requirements 1. Vendor Registration WV Code 5A The West Virginia Code requires that all vendors be registered with the WV Department of Administration, Purchasing Division, prior to receiving a purchase order for competitive products and/or services exceeding $25, Resident Vendor Preference WV Code 5A West Virginia vendors may claim an in-state resident vendor preference in accordance with the WV Code on purchases of commodities or printing that are competitively offered. Claims for the resident vendor preference must be made in writing by the vendor and must be submitted with the vendor s offer. 7

9 3. Debarment WV Code 5A-3-33 through 5A-3-33F. Vendors that have been debarred by the federal government are not eligible to offer on or receive contracts to supply goods or services to the state and its subdivision for a specified period of time. 4. West Virginia Secretary of State. The vendor must be in compliance with the Secretary of State and should provide a copy of their business license with the proposal. For more information, contact the WV Secretary of State. 5. Taxpayer Identification Information. The Internal Revenue Service (IRS) requires the Commission to request a taxpayer identification number (TIN) for tax reporting purposes. IRS Form W9 is used to obtain this information. 6. Purchasing Affidavit WV State Code 5A-3-10a. WV State Code requires all vendors to submit an affidavit regarding any debt owed to the State. The Affidavit should be completed, signed and returned with the bidder s proposal. 7. Disclosure of Interested Parties to Contracts. The WV Ethics Commission requires any business entity who will enter into a contract with an estimated value of $100,000 or greater to complete a Disclosure of Interested Parties to Contracts form. The Disclosure Form should be completed and returned with the bidder s proposal. IV. Application Administration A. This RFP is issued on November 20, In order to be considered for selection, all applications must be delivered to the address below no later than 4:30 PM on January 5, Blue Ridge Community and Technical College Apple Harvest Dr. Martinsburg, WV ATTN: Tyler Carey Application packages should be marked ASL Interpretation Services. Applications submitted by any means other than mailing, courier, or hand delivery will not be accepted. Applications submitted after the deadline date and time will be returned unopened. The individual applicant or an official of the submitting agency, authorized to bind the agency to all provisions noted in the application, must sign the bid response. Proposal shall be submitted in a sealed, opaque envelope and clearly labeled RFP 1801, Opening Date: 01/05/2018. B. Questions Relating to the RFP All questions concerning this RFP must be submitted in writing via to Tyler Carey at TCarey@blueridgectc.edu by December 1, BRCTC will respond to questions it considers appropriate to the RFP and of interest to all Applicants, but reserves the right, in its discretion, not to respond to any question. BRCTC reserves the right, in its discretion, to revise responses to questions after posting, by posting the modified response. No oral response to any Applicant question is permitted. Contact with other BRCTC staff, or other related staff, regarding this RFP is not permitted and failure to comply with this restriction could result in disqualification. C. Term of Contract Negotiations will be undertaken only with a successful applicant whose application shows it to be qualified, responsible and capable of performing the work required in the RFP. The initial contract will be effective for one year from date of award. Continuation of funding is contingent upon the availability of funds, quality of service being provided and contract compliance. BRCTC reserves the right to continue subsequent yearly contracts. All contracts become binding on the date of signature by the provider agency s chief executive officer and Blue Ridge CTC s chief financial officer. BRCTC reserves the right to re- issue all or part of the RFP if it is not able to establish acceptable providers for any or all services. BRCTC also reserves the right to amend contracts throughout the contract period, and to renegotiate the contract length as needed. This contract does not provide exclusive rights to the provider to perform interpreting service for BRCTC students. The provider agency shall maintain full responsibility for maintenance of such insurances as may be required by law of employers, including but not limited to Worker s Compensation, General Liability, Unemployment Compensation and Employer s Liability Insurance, and 9

11 Professional Liability and Automobile Insurance. V. General Rules Governing RFPs/Applications; Reservation of Rights; Confidentiality and Public Disclosure A. Revisions to RFP BRCTC reserves the right to change, modify or revise the RFP at any time. Any revision to this RFP will be posted as an addendum on the Blue Ridge CTC website with the original RFP. It is the applicant s responsibility to check the website frequently to determine whether additional information has been released or requested. B. Proposal Binding By signing and submitting its proposal, each Applicant agrees that the contents of its proposal are available for establishment of final contractual obligations for a minimum of 180 calendar days from the proposal deadline for this RFP. An applicant s refusal to enter into a contract which reflects the terms and conditions of this RFP or the applicant s proposal may, in the BRCTC sole discretion, result in rejection of applicant s proposal. C. Reservation of Rights By submitting its response to this notice of Request for Proposals as posted on the BRCTC website, the Applicant accepts and agrees to this Reservation of Rights. The term notice of request for proposals, as used herein, shall mean this RFP and include all information posted on the BRCTC website in relation to this RFP. 1. Notice of Request For Proposals (RFP) BRCTC reserves the right, and may in its sole discretion, exercise any one or more of following rights and options with respect to this notice of contract opportunity: a) to reject any and all applications and to reissue this RFP at any time; b) to issue a new RFP with terms and conditions substantially different from those set forth in this or a previous RFP; c) to issue a new RFP with terms and conditions that are the same or similar as those set forth in this or a previous RFP in order to obtain additional applications or for any other reason BRCTC determines to be in their best interest; d) to extend this RFP in order to allow for time to obtain additional applications prior to the RFP application deadline or for any other reason BRCTC determines to be in its best interest; e) to supplement, amend, substitute or otherwise modify this RFP at any time prior to issuing a notice of intent to develop a provider agreement or consultant contract to one or more Applicants; 10

12 f) to cancel this RFP at any time prior to the execution of a final provider agreement whether or not a notice of intent to develop a provider agreement has been issued, with or without issuing, in BRCTC s sole discretion, a new RFP for the same or similar services; 2. Proposal Selection and Contract Negotiation BRCTC may, in its sole discretion, exercise any one or more of the following rights and options with respect to application selection: (a) to reject any application if BRCTC, in its sole discretion, determines the application is incomplete, deviates from or is not responsive to the requirements of this RFP, does not comply with applicable law, is conditioned in any way, or contains ambiguities, alterations or items of work not called for by this RFP, or if BRCTC determines it is otherwise in their best interest to reject the application; (b) to reject any application if, in BRCTC s sole judgment, the Applicant has been delinquent or unfaithful in the performance of any contract with BRCTC or with others; is delinquent, and has not made arrangements satisfactory to BRCTC; is financially or technically incapable; or is otherwise not a responsible Applicant; (c) to waive any defect or deficiency in any application, including, without limitation, those identified in subsections 1) and 2) preceding, if, in BRCTC's sole judgment, the defect or deficiency is not material to the application; (d) to require, permit or reject, in BRCTC s sole discretion, modifications, clarifying information, and/or corrections to their applications by some or all of the Applicants at any time following application submission and before the execution of a final provider agreement or consultant contract; (e) to issue a notice of intent to develop a provider agreement or consultant contract and/or execute a provider agreement and/or consultant contract for any or all of the items in any best interest; (f) to enter into negotiations with any one or more Applicants regarding price, scope of services, or any other term of their applications, and such other agreement or contractual terms as BRCTC may require, at any time prior to execution of a provider agreement or consultant contract, whether or not a notice of intent to develop a provider agreement or consultant contract has been issued to any Applicant and without reissuing this RFP; (g) to enter into simultaneous, competitive negotiations with multiple Applicants or to negotiate with individual Applicants, either together or in sequence, and to permit or require, as a result of negotiations, the expansion or reduction of the scope of services or changes in any other terms of the submitted applications, without informing other Applicants of the changes or affording them the opportunity to revise their applications in light thereof, unless BRCTC, in its sole discretion, determine that doing so is in and BRCTC's best interest; (h) to discontinue negotiations with any Applicant at any time prior to the execution of a provider agreement or consultant contract, whether or not a notice of intent to develop a provider agreement or consultant contract has been issued to the Applicant, and to enter into negotiations with any other Applicant, if BRCTC, in its sole discretion, determine it is 11

13 in the best interest of BRCTC to do so; (i) to rescind, at any time prior to the execution of a provider agreement or consultant contract, any notice of intent to develop a provider agreement or consultant contracted to an Applicant, and to issue or not issue a notice of intent to develop a provider agreement or consultant contract to the same or a different Applicant and enter into negotiations with that Applicant, if BRCTC, in its sole discretion, determine it is in the best interest of BRCTC to do so; (j) to elect not to enter into any provider agreement or consultant contract with any Applicant, whether or not a notice of intent to develop a provider agreement or consultant contract has been issued and with or without the reissuing this RFP, if BRCTC determines that it is in BRCTC s best interest to do so; (k) to require any one or more Applicants to make one or more presentations to BRCTC at BRCTC s offices or other location as determined by BRCTC, at the Applicant s sole cost and expense, addressing the Applicant s application and its ability to achieve the objectives of this RFP; (l) to inspect and otherwise investigate projects performed by the Applicant, whether or not referenced in the application, with consent of or notice to the Applicant; (m) to conduct such investigations with respect to the financial, technical, and other qualifications of each Applicant as BRCTC, in its sole discretion, deem necessary or appropriate; (n) to permit, at BRCTC s sole discretion, adjustments to any of the timelines associated with this RFP, including, but not limited to, extension of the period of internal review, extension of the date of provider agreement or consultant contract award and/or provider agreement or consultant contract execution, and extensions of deadlines for implementation of the proposed project; and (o) to do any of the foregoing without notice to Applicants or others, except such notice as BRCTC, in its sole discretion, elects to post on the BRCTC website. D. Confidentiality and Public Disclosure The successful applicant shall treat all information obtained from BRCTC that is not generally available to the public as confidential and/or proprietary to BRCTC. The successful applicant shall exercise all reasonable precautions to prevent any information derived from such sources from being disclosed to any other person. The successful applicant agrees to indemnify and hold harmless BRCTC, its officials and employees, from and against all liability, demands, claims, suits, losses, damages, causes of action, fines and judgments (including attorney's fees) resulting from any use or disclosure of such confidential and/or proprietary information by the successful applicant or any person acquiring such information, directly or indirectly, from the successful applicant. E. Incurring Costs BRCTC is not liable for any costs incurred by applicants for work performed in preparation of a response to this RFP. F. Prime Contractor Responsibility The selected contractor will be required to assume responsibility for all services described in 12

14 their applications whether or not they provide the services directly. BRCTC will consider the selected contractor as sole point of contact with regard to contractual matters. G. Disclosure of Proposal Contents Proposal contents become available for public inspection after an award is made. An offeror may request in writing, at the time of proposal or expression of interest is submitted, nondisclosure of trade secrets and other proprietary or confidential data, as provided in Chapter 29B of the West Virginia Code, the Chief Procurement Officer or designee shall examine the request to determine its validity prior to entering into negotiations. If the parties do not agree as to the disclosure of data in the contract, the CPO or a designee, shall inform the offeror in writing what portion of the proposal shall be disclosed and that, unless the offeror withdraws the proposal or protests in writing, the proposal will be so disclosed. H. Selection/Rejection Procedures The applicants whose submission is selected by BRCTC will be notified in writing as to the selection. Information will be provided in this letter as to any issues within the application that will require further discussion or negotiation with BRCTC. This letter should not be considered as a letter of award. A formal letter of award will be forthcoming at such time when mutual agreement has been reached by the parties on all issues pertaining to the application. Applicants whose submissions are not selected will also be notified in writing by BRCTC. I.
