2 HOLD HARMLESS AGREEMENT Mr and Miss Heiva San Diego This hold harmless agreement is made between the Parties of each participating organization, vendor, and performer (hereinafter, Participant) and Reva Tahiti Productions (hereinafter, RTP) and Heiva San Diego - it s Committees, Board, Officers, and Heiva San Diego Volunteers, (hereinafter, HSD). TERMS 1) Hold Harmless : Upon Participants taking part at HSD by their employees, agents, invites, volunteers, and students for the purpose of their involvement with HSD, Participant shall hold harmless and indemnify RTP and HSD, from every liability, claim or demand, made by reason of: a. Any injury to person or property, sustained by any person, firm or corporation caused by any act (willful or not), neglect, default, or omission of the participant or any person, firm,or corporation directly or indirectly engaged by it upon or in connection with HSD, whether the injury or damage occurs at the HSD venue, a host hotel, or any other event related location. 2

3 b. For the use of any copyrighted or uncopyrighted composition, Tahitian cultural sacred protocol, patented or unpatented invention, article, or appliance during HSD. c. For the use of their image (s) or likeness for advertising purposes and allows HSD to videotape and photograph their performance or presence at HSD for their archives and use within HSD videotape, website and all other related media. 2) Authority to Enter Agreement: Each Participant warrants that the individual who signs this document has the legal power, right, and authority to make this Agreement and bind each respective Participant. 3) Amendment: Modifications: No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing and signed by both Parties. 4) Attorneys Fees and Costs: In the case of legal action or other proceedings due to breech of this agreement, the successful or prevailing Party shall been titled to recover reasonable attorneys fees and other related costs. Must have a sincere desire to promote and to protect the culture of Tahiti and the Polynesian people. 4. Must be between the ages of years old. 5. Unmarried or not have been previously married. 6. Must not be pregnant nor ever given birth to a child. 7. Must not have posed unclothed in any photograph, video, or publication. 4

6 III. GENERAL INFORMATION 1. All documents must be on hardcopy and (1)Headshot with Essay to 2. Mail must be postmarked no later than June 4, MR/MISS HEIVA SAN DIEGO PAGEANT RULES & REGULATIONS 4. Application MUST be complete and have all required documents or it will NOT be accepted. 5. Applicant may submit additional work, photos or video with application requirements. 6. Once application is approved, it is mandatory for contestant to attend all SCHEDULE OF EVENTS. 6. There will be no refunds, transfers, and/or changes to a registration once it is received and processed. 6
