1 BROOKLYN NAVY YARD DEVELOPMENT CORPORATION REQUEST FOR PROPOSAL FOR PROFESSIONAL SERVICES AS CONSTRUCTION MANA GEMENT/DESIGN-BUILD FIRM FOR BLDG 92 EXHIBIT, MAKING IT IN NYC: THE ERA OF NEW MANUFACTURING I. INTRODUCTION A. Invitation The Brooklyn Navy Yard Development Corporation (BNYDC) is seeking to retain a Construction Management/Design-Build firm for MAKING IT IN NYC: THE ERA OF NEW MANUFACTURING, an exhibit to be located in Gallery 92 at the Brooklyn Navy Yard Center at BLDG 92. A proposer will be hired to collaborate on the design, oversee a select group of design collaborators, develop construction documents, fabricate and install this exhibit. The services shall include: 1. Exhibit design; 2. Oversight of design collaborators; 3. Preparation of Project design including cost estimates; 4. Preparation of construction documents and specifications; 5. Preparation, submission, and approval of all requisite permits; and 6. Construction administration services during the Project implementation, preconstruction, and construction phases of the Project. Your firm is invited to submit a proposal for undertaking the work described in this Request for Proposal (RFP). B. Background BNYDC is a not-for-profit corporation whose mission is to improve Brooklyn s economic potential by developing and maintaining the former naval shipbuilding facility as a center for diverse industrial businesses on behalf of its owner, the City of New York. The Brooklyn Navy Yard occupies Block 2023, Lots 1 and 150. It is within the M3-1 zoning district that permits heavy and light manufacturing. The 300-acre site, bounded by the East River, Navy Street, Flushing Avenue, and Kent Avenue, includes six dry docks, five piers, and significant lengths of bulkhead. Brooklyn Navy Yard Center at BLDG 92 (located on Flushing Ave. between Carlton and Adelphi Sts.) provides the interpretational lens for BNYDC s overall economic development by highlighting stories of innovation, entrepreneurship and craft at the Brooklyn Navy Yard. Hands-on workshops and behind-the-scenes tours draw architects, designers, buyers and tastemakers from around the City who are eager to explore and find the next big thing, as well as NYC s savvy general public, families and local residents of Brooklyn s hottest neighborhoods, like DUMBO and Williamsburg. Annual visitation 1
2 of about 25,000 includes exhibits, school programs, workforce development services, and public programs. C. Gallery Description Gallery 92 measures a total of 746 square feet, with floor dimensions measuring 44 3 x 16 6 and a celling height of 9 6. II. SCOPE OF WORK The full and binding description of the scope of work is presented in Appendix A, Scope of Services, attached to this RFP. III. COST ESTIMATE A. Exhibit Budget The approved budget for this exhibition is $25,000. BNYDC will consider all proposals, including those with budgets above the approved amount. BNYDC may seek to fundraise accordingly for the proposal most appropriate to the exhibit intent. In this case, BNYDC will advise the selected Construction Management/Design-Build Firm and work together to arrange the project schedule in accord with available funding. IV. PROPOSAL EVALUATION A. Selection Process: An Evaluation Committee comprised of the VP BDG 92 Exhibits & programs, staff and advisors, will review, evaluate and score all Proposals in accordance with established qualitative and quantitative criteria. This evaluation and scoring will determine the proposer's Rating. Some proposers may be invited for interviews for the purpose of clarifying their Proposals, after which their Ratings will be reviewed. Proposers will be ranked in accordance with the Total Evaluation Score. B. Project Proposal Evaluation Criteria The Project Proposal evaluation criteria will be as follows: 1. Proposed concept/approach; 2. Firm s understanding of the project, project proposal, adequacy and adherence to all rules and regulations governing construction in the City of New York and other provisions of the RFP; 4. Firm's general organization and experience; 5. Principal and Project Manager's Qualifications; 6. Project-related experience; 7. Time schedule. 2
3 Each of the above evaluation criteria is weighted by a factor of importance ranging from 0 to 100 points. An evaluation committee will review, evaluate and score all Proposals in accordance with these criteria to determine the proposer's Rating. C. Fee Proposal The Fee Proposals of the firms with the highest Total Evaluation Scores will then be opened. The proposer determined to have the best combination of Total Project Score and Fee Proposal will be offered the project. D. Selection Upon selection, the successful proposer must execute a Contract For Services substantially in the form as attached hereto. The contents of the selected proposal, together with this RFP and any formal questions and answers provided during the proposal process, may be incorporated into the final contract at BNYDC's discretion. V. PAYMENT FOR SERVICES Payment for services shall be consistent with the limitations, terms, and conditions set forth in the attached CS-29D Certificate and any other terms as BNYDC may require. VI. PROPOSAL REQUIREMENTS A. Proposal Subdivisions Each firm responding to this request shall submit on the submission deadline date two sealed packages containing the items set forth below: 1. Project Proposal: The Project Proposal shall be submitted in a separate sealed package and shall include the information outlined in Subsection B below. The Project Proposal shall not include any fee or other Contractor costs required for the performance of the project. Note: Time Proposal: The Time Proposal for completion of this project shall be submitted as part of the Project Proposal. 2. Fee Proposal: The Fee Proposal, as described in Subsection C below, shall be submitted in a separate sealed package. B. Project Proposal Each Project Proposal must contain the following information: 1. A cover letter summarizing the respondent s understanding of the project, including the company name and address, and the name, address and telephone number of the person authorized to represent the responding firm. 2. Previous Experience: a) The firm s brochure, website and/or other promotional materials; 3
4 b) Documentation of the firm s experience in providing relevant services to clients with projects similar in size, cost and/or type. For each project, identify the project duration and a client reference with phone numbers; c) Indication of the proposed Principal-in-charge and the project manager for the subject project. 3. Specific Requirements: a) Descriptive presentation of the proposed design(s) in compliance with Appendix A, Scope of Services, of this RFP; b) Listing of proposed sub-contractors. If a contract is awarded, the successful Contractor will provide as sub-contractors the same subcontractors proposed in the RFP. Changes to the project team must meet with BNYDC s approval. c) Completed Declaration of Understanding; d) Confirmation of VENDEX Compliance; e) The Contractor understands that, while not a requirement to undertake the provisions of Services, BNYDC encourages proposals by MBEs and WBEs. For the purposes of this proposal W/MBEs must have received certification as such by the Department of Small Business Services. Businesses that have been certified by PANY/NJ may be eligible to receive expedited certification from DSBS after completing the Expedited Certification Affidavit. f) Local Law 34 Doing Business Data Form. C. Fee Proposal Respondents must propose a lump sum fee for completion of this project in its entirety, including cost estimates for subcontractors (in this case, design collaborators), overhead, profit, and staff. The successful Contractor will be required to provide a Maximum Payment schedule for the Tasks indicated in Section 2.01 of the Contract for BNYDC s approval and inclusion in the Contract. VII. PROPOSAL ADMINISTRATION AND CONDITIONS A. Proposal Administration 1. Submission Deadline: a) Respondents shall deliver six (6) hard copies of the proposal plus any attachments, exhibits or appendices and one (1) PDF version of the Project Proposal and one (1) hard copy of the fee proposal form on or before 12:00pm, October 10, Any proposals received after the deadline will be considered for evaluation solely at the discretion of BNYDC. BNYDC will evaluate the need to respond to inquiries, and, in general, no oral responses will be provided, and any information given to a prospective proposer will be furnished to all prospective proposers as an addendum to the RFP. A MANDATORY Pre-Proposal conference will be held at 10:00am on September 26, 2013, at BLDG 92. Any firm that fails to attend the conference may not be permitted to submit a proposal. All addenda shall become a part of the requirements for this RFP. 5. RFP Schedule: The following is the estimated timetable for receipt, evaluation, and selection of proposals. As regards the exhibition cost estimate (part III), contractor will submit a phased schedule of design and implementation. B. Conditions of Proposal Submissions 1. Non-binding Acceptance of Proposals: This RFP does not commit BNYDC to award a contract for any services. 2. Incurring Proposal Costs: BNYDC is not liable for any costs incurred in the preparation of a response to this RFP. 5
6 3. Modifications: Respondents may be asked to make such revisions, additions, or deletions to their proposals as may be required by BNYDC. 4. Reserved Rights: All proposal material submitted becomes the property of BNYDC and BNYDC reserves the right at its sole discretion to: a) Reject any and all proposals received in response to this RFP; b) Award a contract to other than the lowest fee proposer; c) Waive, modify or correct any irregularities in proposals received, after notification to the respondent; d) Change the structure of the proposed fee, if such is in the interest of BNYDC; e) Revise the fee as BNYDC may require subsequent to receipt of a competitively bid proposal for the work of construction; f) Extend the time for submission of all proposals after notification to all prospective respondents; g) Terminate negotiations with a selected respondent and select the next most responsive respondent, or take such other action as deemed appropriate if negotiations fail to result in a signed contract within a reasonable amount of time from the commencement of negotiations; h) Terminate or modify the RFP process at any time and reissue the RFP; i) Approve or reject any sub-contractors proposed by the Contractor; j) Request a change of any sub-contractor at any time in the contract process. 5. Contractual Requirements: a) Any firm awarded a contract as a result of this RFP will be required to sign a contract substantially in the form as attached hereto. b) Any information which may have been released orally or in writing prior to the issuance of the RFP shall be deemed preliminary in nature and bind neither BNYDC nor the respondent. c) Any firm awarded a contract as a result of this RFP will be required to obtain clearance through the City s Vendor Information Exchange System (VENDEX). Since VENDEX clearance is a pre-requisite to BNYDC s award of a contract, Proposers are urged to submit a completed VENDEX form to the Mayor s Office of Contract Services prior to submitting their response to this RFP. d) Notice to Vendors: Pursuant to Local Law 34 of 2007, amending the City's Campaign Finance Law, the City is required to establish a computerized database containing the names of any "person" that has "business dealings with the city" as such terms are defined in the Local Law. In order for the City to obtain necessary information to establish the 6
7 required database, vendors responding to this solicitation are required to complete the attached Doing Business Data Form and return it with this proposal. (If the responding vendor is a proposed joint venture, the entities that comprise the proposed joint venture must each complete a Data Form.) If the City determines that a vendor has failed to submit a Data Form or has submitted a Data Form that is not complete, the vendor will be notified by the agency and will be given four (4) calendar days from receipt of notification to cure the specified deficiencies and return a complete Data Form to the agency. Failure to do so will result in a determination that the proposal is non-responsive. Receipt of notification is defined as the day notice is ed or faxed (if the vendor has provided an address or fax number), or no later than five (5) days from the date of mailing or upon delivery, if delivered. 15 BROOKLYN NAVY YARD DEVELOPMENT CORPORATION APPENDIX A SCOPE OF SERVICES FOR PROFESSIONAL SERVICES FOR CONSTRUCTION MANAGEMENT/DESIGN- BUILD FIRM FOR BLDG 92 EXHIBIT, MAKING IT IN NYC: THE ERA OF NEW MANUFACTURING The result of the professional services solicited under this RFP is the design, fabrication and implementation of the exhibit, Making it in NYC: the Era of New Manufacturing, to open May 2014, in conformance with the objectives of the Brooklyn Navy Yard Development Corporation (BNYDC). The work shall consist of: (1) Proposal Phase, (2) Design Phase, (3) Contract Bidding Phase, and (4) Construction Phase. The selected firm will report directly to the VP BLDG 92 Exhibits and Programs, coordinate all subcontractors including design collaborators, and present at each phase of the contract to various stakeholders, including BLDG 92 Exhibits Advisory Committee, and the Advisory Committee specific to this exhibit, which includes Jordan Brandt/Technology Futurist at Autodesk; Matilda McQuaid/Deputy Curatorial Director at Cooper Hewitt National Design Museum; Sara Garretson/President of ITAC (Industrial + Technical Assistance Corporation); Nina Rappaport/Editor and Publications Director at Yale School of Architecture; and, Adam Friedman/ED Pratt Center, Made in NYC. I. PROPOSAL PHASE A. Submission Requirements Each proposer shall submit the concept, and path to complete implementation, of Making it in NYC: the Era of New Manufacturing. This exhibit will provide audiences a deliberately collaborative, maker-made experience, by showcasing the designers, makers and manufacturers engaged in the design/fabrication process. The submission shall consider the objectives and conditions indicated in the following Subsections and demonstrate an understanding of BNYDC s project objectives. The proposal shall be presented with floorplans and concept renderings that fully describe the proposer s concept. Alternate proposals are encouraged. Cost estimates for the work should be included in the presentation. B. Exhibit Focus There is a profound movement growing in the homes and workplaces of a surprising number of New Yorkers. They re meeting on the streets and gathering in groups. Innovative thinkers, seasoned leaders of the old guard, and inconspicuous tinkerers are driving a revolution in design-driven production. In May 2014, BLDG 92 will launch an exhibit to help shine light on the growing nationwide maker phenomenon, and focus it on the disruptive power of artists, techies and traditional manufacturers who are driving the new manufacturing movement here in New York City. 15
16 The Brooklyn Navy Yard Industrial Park is NYC s prime example of this collective strength. Artists, small entrepreneurial enterprises, and established industrial leaders in a broad variety of sectors, from film to fashion, fine arts and home goods, are building their networks, and leveraging unprecedented access to sophisticated technology and materials. B. Design Concept Making it in NYC will immerse both the exhibits team and its visitors into the world of new manufacturing by implementing the principles explored via collaboration with a showcase selection of designers, makers and manufacturers as subjects of the exhibit. The result will provide a deliberate maker-made experience. In the spirit of the maker movement, BLDG 92 will undertake a crowd-funding campaign in fall 2013, possibly in collaboration with an entrepreneur partner like MakersRow.com, to support aspects of the exhibition or related public programs. C. Audiences Beyond BLDG 92 s general public and school groups, this exhibit will target maker and designer communities in NYC and around the country. The DIY movement has spurred zeal and expertise in small-scale craft and prototyping. Designers and makers who think they have a viable product concept are exploring next steps; maybe even think they re ready to make the leap from making to manufacturing. Traditional manufacturers curious about new technologies and models of collaborative design and development will explore the current phenomenon of new manufacturing in both the exhibit, and its related programs. D. Basic Objectives The best proposal will present an innovative exhibit concept that reveals the various characteristics of new and advanced manufacturing by creatively exposing state-of-theart processes behind product design. BNYDC s basic objectives for this BLDG 92 exhibit are as follows: Engage audiences with product development, from concept and design, to supply chain, and niche manufacturing as a driver of NYC industry. Highlight personalities and personnel behind-the-scenes of the new manufacturing industry; who are the entrepreneurs, where did they develop their vision and expertise? Who are the workforce, where did they acquire their skills and how did they find their way into these jobs? Illustrate the value of local sourcing and collaborative work environments, emphasize synergies of artists, small entrepreneurial enterprises, and established industrial leaders in NYC and at the Brooklyn Navy Yard Industrial Park. Expose visitors to off-the-shelf and otherwise accessible methods of rapid prototyping, such as 3D printing, electronics and programming (Arduino). Reveal state-of-the-art and advanced technologies developed in private industry and academia, including software, equipment and materials. E. Specific Objectives In developing the proposal, the proposer shall consider the following items, which will be required in conjunction with preparing construction documents. 16
17 1. Engage potential design-build collaborators as subcontractors representative of relevant sectors in advanced manufacturing, including the following, or appropriate alternates: i. Material ConneXion (Manhattan) maintains the largest subscription-based Materials Library of innovative materials and processes in the world an indispensable asset to a wide audience of designers and architects and a vital tool for the development of design, industry and economy. ii. AdaFruit Industries (Lower Manhattan) was founded in 2005 to create the best place online for learning electronics and making the best designed products for makers of all ages and skill levels expanded offerings include tools, equipment and electronics Founder, Limor was the first female engineer on the cover of WIRED magazine and was recently awarded Entrepreneur magazine's Entrepreneur of the year. iii. NewLab (BNY) is slated to be kind of a non-denominational MIT Media Lab, where cross-pollination between green manufacturing start-ups, R&D teams, academia, designers, technologists, and digital fabricators will run rampant. " Tenants in the beta space give visitors a glimpse of advanced manufacturing: a) Within Medical Software can be used to design medical implants with porous structures that may aid osseointegration. b) Edward Jacob designed the DNI X132 Hellcat (motorcycle) and the Lowline Solar Collector c) Rock Paper Robot Float Table is a matrix of magnitized wooden cubes that levitate with respect to one another. The repelling cubes are held in equilibrium by a system of tensile steel cables. /MIT & Parsons d) Bioworks Institute: Living Watch /Harvard Medical School BioSciences e) Spuni is an ingeniously designed, ergonomically superior tool to help babies eat solid food with less mess. f) Jason Krugman Studio produces large-scale LED cable systems as well as installation artworks for public spaces and events. Work combines materials with electronics, referencing nature through accumulation and modularity, including environmentally responsive LED systems like Firefly, a wind sensitive LED network based on tiny hand-made switches. g) Terreform ONE is the official non-profit design group that promotes green design in cities. Through our creative projects and outreach efforts, we aim to illuminate the environmental possibilities of New York City and inspire solutions in areas like it around the world. iv. Duggal Energy Solutions (BNY)/Lumi Solair specializes in offgrid renewable products. Lumi Solair's lighting products eliminate the need for underground wiring to produce significant cost savings compared with traditional grid connected lamp posts. v. Product & Design (BNY) diverse, computerized, modern shop facility and group of people with backgrounds in engineering, science, design and machine technology [bringing] together the best in fabrication technology from many fields and apply[ing] this to architectural construction. 17
18 vi. Scott Jordan (BNY) makers and merchants of fine furniture, chiefly utilizing CNC machine technology and computer-aided design systems. vii. MakerBot (Downtown Brooklyn) 3D Printing is one of the most disruptive technologies around, and MakerBots are changing the way we create and learn. These printers are affordable, personal fabrication tools, compact enough to sit on any desktop, and allow anyone at any skill level to become producers, inventors and artists. viii. Shapeways (Manhattan) individuals can make, buy and sell their own products. By providing a platform for our community members to share ideas and gain access to cutting edge technology, we're bringing personalized production to everyone, whether you're already designing in 3D or are looking to find something just right. We 3D Print everything on-demand, which means that every order is customized and personalized. 2. Utilize the aesthetic of design, for example, brainstorm devices (post-its, graph paper, pencil, marker and whiteboard) as a visual motif might express the exhibit s key themes of design for small- and large-scale product development, emphasizing creativity, collaboration, efficiency and sustainability. 3. Develop engaging interactives, for example, visitors may play the role of entrepreneur by developing their own product concepts, building at various stations of the exhibit, and sharing their concepts at the end. 4. Incorporate tech components as examples of DIY electronics and 3D printing technology (Arduino, Autodesk 123D Catch & 123D Make). 5. Negotiate rights and reproductions licensing and purchase, for what should be only the rare occasion to use existing visual materials. 6. Develop Construction Documents in conformance with all administrative codes, rules, and regulations. 7. Obtain all approvals required for the work. F. Drawings Provided With This RFP Plans available at II. DESIGN PHASE Only after a proposal is accepted and a contract delivered will the Construction Management/Design-Build Firm be expected to proceed into the Design Phase of the project. BNYDC will provide the form of the Construction Contract, contractor Information For Bidders and Bid Submission documents. (The complete contract to be prepared jointly with Contractor and BNYDC). A. Change Orders and Supplementary Drawings Following 100% Submission 1. Design Change Orders For change orders that require design modifications, the Contractor shall describe in detail the nature of the change, reason for the change, and estimated change in cost of the contract amount. 18
19 a. The Contractor shall not perform any design work on a change order prior to being notified by BNYDC in writing that the change order request is approved. b. As a prerequisite for change order approval, the Contractor shall submit a proposal showing the number of technical employee work-hours and nonsupervisory principals time that will be required for each change order. The technical employee work hours shall be broken down as to employee title, expected work-hours and the rate of pay for each title. c. The Contractor shall be compensated for change order work involving scope changes or field conditions that could not reasonably be anticipated, in accordance with Article 2, Section 2.02 of the Agreement, as the maximum payable for the change order. There is no intent herein to restrict the Contractor s right to assign or reassign employees working on the change order, once the change order is approved in accordance with Article 2 of the Contractor Contract and this Section. 2. Construction Change Orders When requested, the Contractor in conjunction with the Project Manager through a Construction Change Order process shall make all modifications and clarifications to contract documents after the contract has been awarded for construction and, if required, the Contractor shall issue Supplementary Drawings. 3. Supplementary Drawings The Contractor shall prepare any additional drawings that may be necessary for the enlargement and clarification of the Contractor's drawings prepared under this contract at no additional cost to BNYDC. The Contractor shall make a submittal to the VP BLDG 92 Exhibits and Programs of the supplementary drawings, sealed, and containing signature of the Contractor. The Contractor is to obtain all regulatory approvals as required. III. CONTRACTOR SERVICES FOR BID, AWARD, CONTRACT REGISTRATION A. CONTRACT BIDDING During the period of advertising, receipt and analysis of bids, the Contractor shall: 1. Interpret plans and specifications when requested by the VP BLDG 92 Exhibits and Programs in response to prospective bidders' inquiries. 2. Prepare and issue addenda, amendments, and drawings required for the clarification of plans and specifications. 3. Advise BNYDC on the analysis and evaluation of bids, and make written recommendations and reports as requested by the VP BLDG 92 Exhibits and Programs on the disposition of bids and award of contracts. B. SCHEDULE OF ITEMS AND COSTS 19
20 The Contractor shall promptly examine, recommend adjustment and/or indicate its approval of the schedule of items and cost prepared by the Contractor on each awarded contract, so as to prevent unbalanced values from being established as the basis for the Contractor's partial payments. C. ADDENDA AND ADDENDA DRAWINGS shall contain all modifications to and clarifications of the Contract Documents necessary during the bidding period. 1. Addenda: The Contractor shall: a. Determine the appropriate format and numbering system. b. Submit to the VP BLDG 92 Exhibits and Programs. c. File with the appropriate Regulatory Agencies as necessary and forward approvals to the VP BLDG 92 Exhibits and Programs. 2. Addenda Drawings: The Contractor shall: a. Submit to the VP BLDG 92 Exhibits and Programs. b. Include Seal and signature of appropriate Contractor or Sub-Contractor. IV. CONTRACTOR SERVICES FOR CONSTRUCTION PHASE A. CONSTRUCTION ADMINISTRATION SERVICES 1. Contract Document Interpretation: It shall be the responsibility of the Contractor to interpret contract documents, and make recommendations by drawing or in writing when required by job conditions or when requested by the VP BLDG 92 Exhibits and Programs. 2. The Contractor shall: a. Attend kickoff meetings and job conferences on matters concerning the design and progress of the Project. b. Prepare and issue meeting minutes within three business days as directed by the VP BLDG 92 Exhibits and Programs for any job conference or progress meeting throughout the duration of the Construction Phase of the Project. c. Review the construction schedule and report to the VP BLDG 92 Exhibits and Programs any conditions, which may cause delay in completion. d. Review field conditions and advise the VP BLDG 92 Exhibits and Programs by or supplementary drawings to resolve design omissions, design errors, and unforeseen field conditions. e. Check and approve shop drawings, material samples, and catalog cuts. f. Review all construction change orders when requested and verify description of work. Report any discrepancies. 20

In addition, the Contractor is to provide periodic job supervision services by having a project representative on site to observe the progress and quality of the work for adherence to the contract documents, and submit advisory reports to the VP BLDG 92 Exhibits and Programs. 4. Provide final inspection and sign-off on construction permits. B. SHOP DRAWING SERVICES; APPROVAL OF SAMPLES 1. The Contractor shall act promptly and systematically on the checking of shop drawings and approval of material samples and catalog cuts submitted, determining whether they are in accordance with the contract drawings and specifications. The Contractor shall indicate changes necessary to conform to those contract drawings and specifications, and shall make no changes in the design, or changes requiring additional cost, without previous written approval from the VP BLDG 92 Exhibits and Programs. 2. The Contractor shall submit the lists of shop drawings, samples, and catalog cuts that it previously prepared and incorporated into the specifications for presentation to the Contractor at the construction kickoff meeting. The Contractor will be responsible for filling-in the submission and delivery dates for approval by the VP BLDG 92 Exhibits and Programs. The Contractor shall receive copies of the approved schedules, and shall review the lists and submit comments to the VP BLDG 92 Exhibits and Programs, including all information that may be necessary to clearly indicate the progress on processing these items of the project. 3. The listed information shall include names of subcontractors; titles of shop drawings; dates due in accordance with approved schedules; dates of issue, receipt, checking, return for correction, resubmission, and final approval; and any other appropriate information. In addition to checking shop drawings, samples, and catalog cuts. 4. The VP BLDG 92 Exhibits and Programs reserves the right to select samples for testing for approval of any or all materials required for construction of the Project. 21
