1 NOTICE OF ELECTION THE STATE OF TEXAS TARRANT COUNTY CARROLL INDEPENDENT SCHOOL DISTRICT TO THE RESIDENT, QUALIFIED ELECTORS OF SAID DISTRICT: TAKE NOTICE that an election will be held in said District as provided in an ORDER CALLING A BOND ELECTION duly passed by the Board of Trustees of said District, which Order is substantially as follows: ORDER CALLING A BOND ELECTION THE STATE OF TEXAS : COUNTY OF TARRANT : CARROLL INDEPENDENT SCHOOL DISTRICT : WHEREAS, this Board of Trustees of the Carroll Independent School District (the "District") deems it advisable to call the election hereinafter ordered (the "Election"); and WHEREAS, the Election is subject to the provisions of Section , Texas Education Code, and the District is contracting with Tarrant County, Texas (the "County") for the administration of the Election pursuant to an interlocal agreement with the County (the "Election Contract") and the Texas Election Code (the "Code"); and WHEREAS, the County, acting through its elections administrator (the "Elections Coordinator") in accordance with the Election Contract, will provide for the administration of the Election; and WHEREAS, it is hereby officially found and determined that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Government Code, Chapter 551. THEREFORE, BE IT ORDERED BY THE BOARD OF TRUSTEES OF CARROLL INDEPENDENT SCHOOL DISTRICT: 1. That an election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on May 6, 2017 ("Election Day"), in said District at the respective polling places designated by the County in the Election Contract as set forth in Exhibit "A" below, which exhibit shall be modified to include additional or different Election Day polling places required to conform to the Election Contract and the Code. 2. That the early ballot board and all the election officers designated pursuant to law and the Election Contract by the County are hereby appointed and confirmed to hold said election at said polling places and all early voting places. 3. (a) That early voting shall be conducted by personal appearance at the locations and during the period early voting is required or permitted by law, being April 24, 2017 through May 2, 2017, on the dates and at the times set forth in Exhibit "B" below, which exhibit shall be modified to include additional or
2 different early voting polling places, dates and times required to conform to the Election Contract and the Code. (b) Applications for voting by mail for all residents of the District shall be mailed to the address below and received (not postmarked) by April 25, 2017; if application to vote by mail is made by personal delivery, the application must be delivered by close of business on April 21, By personal delivery: Tarrant County Elections 2700 Premier St. Fort Worth, Texas By mail/fax/electronic mail: Tarrant County Elections P.O. Box Fort Worth, Texas Fax: That all resident, qualified electors of said District shall be entitled to vote at said election. 5. That at said election the following PROPOSITION shall be submitted in accordance with law: PROPOSITION Shall the Board of Trustees of Carroll Independent School District be authorized to issue the bonds of the District, in one or more series, in the aggregate principal amount of $208,000,000 for the purpose of the construction, acquisition and equipment of school facilities in the District and the purchase of necessary sites for school facilities, including, but not limited to: classroom additions, capital improvements, maintenance, technology, safety and security, extra-curricular/co-curricular facilities and transportation vehicles, with said bonds to mature, bear interest, and be issued and sold in accordance with law at the time of issuance; and shall the Board of Trustees be authorized to levy and pledge, and cause to be assessed and collected, annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on said bonds, and the costs of any credit agreements executed in connection with the bonds? 6. That the official ballot for said election shall be prepared in accordance with the Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION with the ballot to contain
3 such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows: PROPOSITION The issuance of $208,000,000 of bonds by Carroll Independent School District for the construction, acquisition and equipment of school facilities in the District and the purchase of necessary sites for school facilities, including, but not limited to: classroom additions, capital improvements, maintenance, technology, safety and security, extra-curricular/cocurricular facilities and transportation vehicles, and levying the tax in payment thereof, including the costs of any credit agreements executed in connection with the bonds. 7. That proper notice of said election shall be given and, in all respects, said election shall be conducted in accordance with the Code. 8. In accordance with the provisions of Section 3.009(b) of the Code, it is hereby found and determined that: (a) The proposition language that will appear on the ballot is set forth in Section 6 hereof. (b) The purpose for which the bonds are to be authorized is set forth in Section 5 hereof. (c) The principal amount of the bonds to be authorized is set forth in Sections 5 and 6 hereof. (d) If the bonds are approved by the voters, the Board of Trustees will be authorized to levy annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on the bonds and the cost of any credit agreements executed in connection with the bonds. (e) Based upon the bond market conditions at the date of adoption of this Order, the maximum interest rate for any series of the Bonds is estimated to be 4.50%. Such estimated maximum rate is provided as a matter of information, but is not a limitation on the interest rate at which the Bonds, or any series thereof, may be sold. (f) If the bonds are approved, they may be issued in one or more series, to mature serially, over a period not to exceed 25 years from the date of issuance of each series of bonds. (g) The aggregate amount of the outstanding principal of the District s debt obligations as of the beginning of the District s fiscal year is $199,631, (h) The aggregate amount of the outstanding interest of the District s debt obligations as of the beginning of the District s fiscal year is $102,960, (i) The ad valorem debt service tax rate for the District for the fiscal year is $0.35 per $100 of taxable assessed valuation
