1 NOTICE OF SPECIAL ELECTION UNDER CHAPTER 41 OF THE TEXAS EDUCATION CODE THE HOUSTON INDEPENDENT SCHOOL DISTRICT November 8, 2016 STATE OF TEXAS COUNTY OF HARRIS 1. Pursuant to the Special Act of 1923 passed by the 38th Legislature of the State of Texas, creating and incorporating the Independent School District; Articles 2774b, as amended; and in accordance with Chapter 41, Subchapter D, Sections of the Texas Education Code and Section and of the Texas Education Code, and the Texas Election Code, the Board of Education for the Independent School District hereby calls and orders a special election to be held on the 8th day of November, 2016, for the purpose of obtaining voter approval to purchase average daily attendance credit from the Texas Education Agency. 2. The election called herein shall be conducted as a joint election with Harris County, and only qualified voters of the Independent School District shall be eligible to vote at the election. 3. The polling places for this election shall be open for voting from 7:00 a.m. to 7:00 p.m. on November 8, The following regular county polling places in Harris County election precincts within the Independent School District are hereby designated as polling places for the election: See Attachment A 5. The Harris County Administration, 1001 Preston Street, First Floor,, Texas is designated as the main early voting place, and Mr. Stan Stanart, Harris County Clerk, is hereby appointed clerk for early voting in the election. Requests for ballots by mail should be directed in writing to Mr. Stan Stanart, Early Voting Clerk, P.O. Box 1525,, Texas Requests for ballots by mail must be received by the close of business on October 28, Early voting by personal appearance will be held Monday, October 24, 2016, through Friday, November 4, Early voting times are: October 24 - October 28: 8:00 a.m. - 6:00 p.m.; October 29: 7:00 a.m. - 7:00 p.m.; October 30: 1:00 p.m. - 6:00 p.m.; and October 31 - November 4: 7:00 a.m. - 7:00 p.m. Early voting will be conducted at the following established Harris County early voting locations:

The official ballot for the election shall be prepared in accordance with the Texas Election Code and shall have printed on it the following proposition: Authorizing the board of trustees of Independent School District to purchase attendance credits from the state with local tax revenues. 8. The proposition is approved if the proposition receives a favorable vote of a majority of the votes cast. 9. The results of the election shall be canvassed by the Board not earlier than November 16, 2016, or later than November 22, 2016, at a meeting called by the Board in accordance with the requirements of the Texas Open Meetings Act. 10. All election materials including the notice of election, ballots, instruction cards, affidavits, and other forms which the voter may be requested to sign, and all early voting materials, shall be printed in English, Spanish, Chinese and Vietnamese, or Spanish, Chinese, and Vietnamese translations thereof shall be made available in the circumstances permitted and the manner required by law. -4-

5 11. A substantial copy of this order shall serve as proper notice of the election. The notice, including a Spanish, Chinese and Vietnamese translation, shall be published at least one time not more than thirty (30) days or less than ten (10) days before the day of the election in a newspaper of general circulation in the District and posted not later than the 21st day before the election and remain posted continuously through election day on the bulletin board used for notices of meetings of the Board of Education and in a public place in each election precinct. The District shall deliver notice of this election to the Harris County Clerk not later than the 60th day before the election.
