1 Terms and Conditions CIMB FIESTA 2016 Count Octo Contest The Contest Period 1. The CIMB FIESTA Count Octo Contest ( Contest ) is organised by CIMB Bank Berhad (13491-P)(referred to as CIMB ) and held in conjunction with CIMB FIESTA Count Octo organised by CIMB Islamic Bank Berhad ( H).The Contest shall run from 22 August 2016 to 30 September 2016, both dates inclusive ( Contest Period ) hosted in selected CIMB branches within Klang Valley as listed in Appendix 1 hereof ( Participating CIMB Branches ) and on CIMB Clicks. 2. CIMB reserves the right upon giving prior notice of twenty one (21) calendar days to change the duration and/or commencement and/or expiry date of the Contest Period. Eligibility 3. This Contest is open to all CIMB Credit Card Members who are (i) existing CIMB Credit Card Members; and (ii) CIMB Credit Card Members approved on or before 30 September 2016, except for the following persons/entities who shall NOT be eligible to participate in this Contest: (i) Permanent and/or temporary staff or employees of CIMB (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or (ii) Representatives and/or agents (including advertising and Contest agents, 3 rd party vendors and service providers) of CIMB (including its subsidiaries and related companies) and their permanent and/or contract employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters); (hereinafter collectively referred to as the Eligible Participants ). Contest Mechanism&Participating Criteria 4. To participate in this Contest, Eligible Participants are required to:- (i) complete the official CIMB Count Octo contest entry form ( Contest Form ) available at the Participating CIMB Branches or on CIMB Clicks by providing the details required; (ii) count the number of Octo found on the Contest Form and state the number; (iii) answer the CIMB Fiesta question; (iv) complete the slogan; and (v) submit the Contest Form by dropping it off in the drop box provided at the Participating CIMB Branches or via online through CIMB Clicks. 5. Only the official CIMB Count Octo Contest Form provided at Participating CIMB Branches and on CIMB Clicks will qualify as a contest entry. Photocopies of the Contest Form are not acceptable and such entries will be disqualified. Each Eligible Participant is permitted to submit more than one (1) Contest Form. 1

2 6. Qualified entries will be compiled and selected based on the correct answer and creativity of the slogan. The 12 best overall shortlisted entries will be selected and contacted by CIMB via phone call for purposes of verification ( Shortlisted Participants ). 7. If a Shortlisted Participant is not contactable via phone call after 3 attempts, the Shortlisted Participant shall be disqualified and CIMB reserves the right to select a new Shortlisted Participant. Shortlisted Participants who are contactable by CIMB via phone call within 3 attempts and who are successfully verifiedshall be declared a winner ( Winner ). 8. The prizes for this Contest consist of two (2) Grand Prizes and ten (10) Bonus Prizes ( Prizes ). The Grand Prize is 1,000,000 CIMB Bonus Points each which is equivalent to Ringgit Malaysia Four Thousand (RM4,000) and the Bonus Prize is 125,000 CIMB Bonus Points each which is equivalent to Ringgit Malaysia Five Hundred (RM500). 9. In order for the Winner to claim the Prize, the Winner must either be: i) an existing CIMB Credit Card Member; or ii) a newly approved CIMB Credit Card Member, approved on or before 30 September The Prize will be credited to the Winner s CIMB Credit Card after 45 days from the end of the Contest Period. 11. The Winner must attend the CIMB Fiesta 2016 to be held at Mid Valley Exhibition Centre on 14 October 2016 for prize giving ceremony ( Prize Ceremony ). In the event the Winner does not attend the Prize Ceremony, the Prize will be forfeited. 12. The Winners are only entitled to win one (1) Prize under this Contest and the Prizes are not exchangeable for other items/ products/ cash. General Terms and Conditions 13. By participating in the Contest, the Eligible Participants hereby consent to CIMB processing and disclosing their personal data in accordance with the CIMB Group Privacy Notice which can be found at By participating in this Contest, the Eligible Participant(s) agree to be bound by the Terms and Conditions herein and the decisions of CIMB. The Eligible Participant(s) participating Credit Card MUST (i) not be in breach of material terms and conditions of CIMB Credit Cardagreement or CIMB account agreement or CIMB Clicks Internet Banking Agreement or CIMB Clicks Mobile Banking Agreement; (ii) be current and have not been terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, (iii) not be in delinquent, and/ or be invalid or cancelled within CIMB s definition, otherwise the Eligible Participant(s) will be disqualified from participating in this Contest and shall not be entitled to receive the Prize. 15. Decision of CIMB s judges in relation to every aspect of the Contest shall be final, binding and conclusive provided always that the decision must appear to be fair and reasonable. 2

3 No further correspondence, appeals, protests or attempts to dispute the same would be entertained. 16. CIMB shall not be responsible or held liable in any manner whatsoever in respect of technical failures of any kind, whatsoever intervention, interruptions and/or electronic or human error in the administration and/or submission of answer and slogan unless the same is due to the gross negligence or willful default of CIMB. 17. CIMB reserves the right to suspend, cancel, terminate or withdraw this Contest in whole or part, by giving the Eligible Participant(s) prior notice of fourteen (14) calendar days. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of this Contest shall not entitle the Eligible Participant(s) to any claim or compensation against CIMB for any losses or damages suffered by the Eligible Participant(s) or any party as a direct or indirect result of the act of suspension, cancellation or termination unless the same is due to CIMB s willful default or gross neglect. 18. CIMB reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment, or otherwise howsoever) ( the Amendment ) any of the terms and conditions herein. Notification to the Eligible Participant(s) in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participant(s) last known address or by posting a notice regarding the Amendment at each of CIMB s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice, or via CIMB s website and the Amendment shall be deemed as binding as from the date of notification of the Amendment or from such date as may be specified by CIMB in the notification. 19. CIMB shall not be liable to any party, including the Eligible Participant(s), for any loss or damage of whatsoever nature suffered by the Eligible Participant(s) or any party (including but not limited to any injury or death, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) in relation to the Eligible Participant s participation or non-participation in the Contest including arising from the Eligible Participant s receipt, non-receipt and/or delayed receipt of the Short Service Message or Electronic Direct Mailer or CIMB Clicks promotional banner by the selected Eligible Participant unless the same is due to CIMB s willful default or gross neglect. 20. If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or versions in other languages of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Participant(s) and noted and acknowledged by CIMB in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the CIMB 3

4 Credit Card Account(s), then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 4
