4 The Committee desired that letters to all the project proponents be issued apprising them regarding decision taken on their project proposal by the SEAC in its 43 rd meeting held on Item No Application for environmental clearance under EIA Notification for expansion of its existing unit M/s Sharu Steels Pvt. Ltd. at Plot No. B-48, Focal Point, Phase-VII, Ludhiana. The Committee noted that the industry has already been issued TOR vide letter no dated for its project proposal by the SEAC and the project proponent has not yet submitted the draft EIA report and EMP. The Committee further observed that the project is covered under category 3 (a) of the Schedule appended to EIA Notification dated as amended on and General Condition (GC) is applicable for this category. The Govt. of India, MoEF, New Delhi vide Office Memorandum dated had declared Ludhiana city as critically polluted area and imposed moratorium on the establishment and expansion of projects covered under EIA Notification dated Accordingly, as per stipulation No. ii of the General Condition, the then SEAC, vide letter No dated had written to PPCB to confirm as to whether the site of the project falls within a radius of 10 km from the critically polluted area of Ludhiana. But no response has been received from the PPCB. Now, the Ministry of Environment & Forests, New Delhi, vide Office Memorandum No. J-11013/5/2010-IA.II(I) dated , has lifted the moratorium. In this regard, vide letter no. F No. 19-5/2008-IA-III dated with reference to another project in Ludhiana (listed in Agenda of 44 th meeting as Item No ), the MoEF has advised the State Govt. to consider such projects as Category B. The Committee observed that with the same analogy, this project would also fall in Category B. The Committee, however, felt that Law Officer attached to SEAC be also consulted. The Committee deliberated on the issue in consultation with Law Officer of the PPCB and was of the opinion that though moratorium had been lifted, but the MoEF letter did not explicitly speak that Ludhiana ceased to be critical polluted area. The Committee, hence, felt that in view of the MoEF letter dated , there is a need to obtain clarification/advice from the MoEF/SEIAA. After detailed deliberations, the Committee authorized the Chairperson of the SEAC to seek clarification from MoEF regarding the above issue Page 4 of 12

6 Item no Application for obtaining environmental clearance as required under EIA Notification dated for cement grinding unit of capacity 30 TPD to be developed by M/s New Tech Cement Industries, in the revenue estate of Village Gholia Kalan, Tehsil Bagha Purana, Distt. Moga. The Committee noted that the industry has already been issued TOR vide letter no dated by the SEAC for its project proposal and public consultation/hearing of the project proposal has been done by Punjab Pollution Control Board on 9/4/2010. The proceedings of the said public hearing were sent by the Punjab Pollution Control Board to the MoEF vide letter No dated 18/5/2010 due to non-functioning of SEIAA/SEAC for the State of Punjab. The SEAC further observed that in the said proceedings, it has been mentioned as under: The panel members observed that the majority of the participants of the public hearing have objections from environmental angle for setting up of the 30 TPD capacity of cement grinding unit at proposed site. The land around the industry is also fertile and vegetables are grown in this land, which may be affected due to the dust/emissions from the industry. The installation of this unit may also adversely affect the residents of 2-3 houses very near to the industry and the Govt. School and village abadi situated on the left bank of canal passing on the southern side of the proposed site. The site is situated right on the State-Highway thus it is likely to prove as a traffic hazard and may also cause air pollution and resultantly poor visibility on the road due to dust produced due to grinding process. Due to the above discussed reasons the Committee (Committee of officers supervising & presiding over the public hearing) is of the unanimous view that this site is not suitable for the proposed project. After detailed deliberations in the matter, it was decided by the SEAC to call the project proponent in the next meeting of SEAC, so as to make him aware regarding the proceedings of the public hearing and to take his view point. It was also decided that Punjab Pollution Control Board be requested to intimate the status of the construction and installation of proposed industrial plant, within one week, to enable the Committee to proceed further in the matter. Item no Application for obtaining environmental clearance under EIA Notification for increase in the production capacity of existing cement grinding unit from 75 TPD to 150 TPD of M/s Shri Bala Ji Cement Industries, in the Page 6 of 12
7 revenue estate of Village Jai Singh Wala, Bagha Purana, Distt. Moga. The Committee observed that the industry has already been issued TOR vide letter no dated by the SEAC and public consultation/hearing of the project proposal has been made by Punjab Pollution Control Board on The proceedings of the said public hearing were sent by the Punjab Pollution Control Board to the MoEF vide letter No dated due to non-functioning of SEIAA/SEAC for the State of Punjab. But the project proponent is yet to submit final EIA/EMP after incorporating all the issues raised during public hearing/public consultation for appraisal of the project proposal. under:- After detailed deliberations in the matter, the Committee decided as 1. Punjab Pollution Control Board be requested to intimate the status of the construction and installation of the industrial plant for which the project proposal is pending for environmental clearance including the pollution control status of the existing unit, within one week, to enable the Committee to proceed further in the matter. 2. The project proponent be requested to intimate, within one week, the status of final EIA report and EMP. Item no Application for Environmental Clearance under EIA Notification for carrying out expansion in the existing unit by installing 2 no. induction furnaces of 8 Ton/heat capacity each of M/s Khurana Steels Ltd. at Vill. Dhandari Khurd, adjoining Phase-VII, Focal Point, Ludhiana The Committee noted that the industry has already been issued TOR vide letter no dated for its project proposal by the SEAC and the project proponent has not yet submitted the draft EIA report and EMP. The Committee further observed that the project is covered under category 3 (a) of the Schedule appended to EIA Notification dated as amended on and General Condition (GC) is applicable for this category. Item no Application for Environmental Clearance for the replacement of existing induction furnace of capacity 4.5 T/heat with 2 no. induction furnaces of capacity 8 T/heat each and installation of a steel rolling mills of M/s Sudershan Forge Pvt. Ltd., Industrial Area-C, Kanganwal Road, VPO Jugiana, GT Road, Ludhiana. The Committee noted that the industry has already been issued TOR vide letter no dated for its project proposal by the SEAC and the project proponent has not yet submitted the draft EIA report and EMP. The Committee further observed that the project is covered under category 3 (a) of the Schedule appended to EIA Notification dated as amended on and General Condition (GC) is applicable for this category. Item No Application for environmental clearance for Residential Group Housing Project namely Rosewood Green Housing to be developed by M/s Virat Infra Projects Pvt. Ltd. at Vill. Sadhe Majra, Habitpur Road, Dera Bassi, Distt. Mohali. The Committee scrutinized the documents submitted by the project proponent vide letter dated and it was observed that all the documents are in order except the reply in respect of obtaining permission for CLU. The Committee further observed that the project proponent has intimated vide the aforesaid letter that 5% of the total construction has been completed. After detailed deliberations in the matter, it was decided by the Committee as under: 1. The project proponent be requested not to carry out any further construction activity at site till he obtains environmental clearance as required under EIA Notification dated The project proponent be also requested to submit the latest photographs from all the four sides showing the status of construction. 2. The project proponent be requested to get information regarding classification of the area from the Department of Town & Country Planning, Page 9 of 12
10 Punjab, in which the site of the project is located, as per Master Plan, within 7 days. Item No Application for Environmental Clearance for construction of emerging technologies complex for Sri Guru Granth Sahib World University, Fatehgarh Sahib. The Committee deliberated on the contents of letter no dated of Sri Guru Granth Sahib World University, Fatehgarh Sahib and observed that submission of approved layout/building plan is one of the main requirements for getting environmental clearance. The Committee further observed that in the 43 rd meeting of SEAC held on , it was decided that the project proponent shall carry out representative ambient air sampling of the site area at 3-4 locations for atleast 7 days from the NABL accredited/moef approved Laboratory and submit approved layout and building plan. After detailed deliberations in the matter, it was decided by the Committee to request the project proponent to carry out representative ambient air sampling of the site area at 3-4 locations for atleast 7 days from the NABL accredited/moef approved Laboratory. Meanwhile the project proponent also submit the layout/ building plan duly approved by the Competent Authority of the State. Item No Application for Environmental Clearance to establish an "Integrated Municipal Solid Waste Management Facility" by Municipal Corporation, Ludhiana at village Jainpur and Jamalpur. Following were present on behalf of M.C., Ludhiana 1. Sh. V.P. Singh, Superintendent Engineer (Public Health), M.C., Ludhiana 2. Sh. Yashwant Chauhan, Manager, IL&FS Sh. V.P. Singh informed that sufficient time has not been given to M.C., Ludhiana to make presentation and further informed that their consultant could not attend to make presentation in such a short notice as he belongs to Hyderabad. He produced the plan showing the various features within a radius of 10 km from both the sites which are located at Village Jainpur and Jamalpur, District Ludhiana, where integrated Municipal Solid Facilities are to be developed. The Committee noted that this project is of importance w.r.t environment improvement, hence, is in public interest. The project falls under Category 7 (i) of the Schedule appended to the EIA notification dated and General Condition is applicable in this case. The site is located within a radius Page 10 of 12
11 of 10 km from the critically polluted area of Ludhiana, declared by the Govt. of India, MoEF, New Delhi vide Office Memorandum dated As per the provisions of EIA Notification dated , any project or activity specified in Category 'B' will be treated as Category 'A', if located in whole or in part within 10 km from the boundary of Critically polluted areas as identified by the Central Pollution Control Board from time to time. The Committee further deliberated on contents of letter no. F.No. 19-5/2008-IA-III dated of the MoEF, New Delhi written to the Secretary to Govt. of Punjab, Deptt. Of Science, Technology & Environment, which is reproduced as under:- In continuation to the Ministry s letter of even number dated , I am directed to return the following Category B projects for appraisal at State Level under EIA Notification, 2006 as amended in 2009 since the SEIAA/SEAC for Punjab have been reconstituted and Moratorium on CEPI for the Ludhiana, Punjab has been lifted vide OM No. J-11013/5/2010-IA-II(I) dated CMSWMF at Jainpur and Jamalpur, Ludhiana 2. CETP at Tajpur Road, Ludhiana It may kindly be noted that out of six number of CETP/CMSWMF projects of Punjab, only CMSWMF at Samgouli, Mohali is Category A project due to the location of the site within 10 km radius of inter-state boundary and ToR was issued on Deliberations were made on the issue in consultation with Law Officer of the PPCB and it was observed that though moratorium had been lifted, but the MoEF letter did not explicitly speak that Ludhiana ceased to be critical polluted area. F.No /2010-1A.III dated for the project proposal by the EAC of MoEF and the project proponent has not yet submitted the draft EIA report and EMP. After detailed deliberations, it was decided by the Committee that the project proponent be reminded to submit the detailed draft EIA/EMP report to the SEIAA/SEAC at the earliest, so that further action may be taken in the matter.
