The promotion of the drivers will take effect from the date on whic h they actu ally join the po t of Grade I Driver. 3. Under the provision contained in OM No. F-7/180-Estt. Dated of Department of Personnel and Training, ew Delhi incorporated in Govt. of India order below FR 22, officials promoted on regu lar basis are entitled to e erci an option for fixation of pay on promotion under FR 22 (1) a (I ) on the date of promotion or on the date of accrual of the ne t increment in the icale of pay in lower post, if they have not already availed the benefit of pay fixation under ACP/ MACP. The option in this regard should be e erc ised witbin one montb fr om the date of promotion. Option once exercised is final. 4. If the officials are already getting higber pay band / Grade Pay by virtue of financial up gradation under MACP, they may conti nue to get their pre ent pay band / Grade Pay without any further fixatio n due to their promotion to Gra de I Driver Cadre in MMS ordered in this Memo. 5. In case any Vigilance I Disciplinary ca e of the type referred to in the OM No E tt. (A) dated and DOP&T circulated vide Directorate's Memo No. 25/19/88-SPG dated (subseq uently) revised vide DOP & T Memo No /4/91-Estt (A) dated circ ulated vide Directorate's Memo No /88 SPG dated is pending against the official, he should not be relieved for posting, without obtaining pecific orders from th i office. The official against whom any punishment is current should not be promoted before expiry of currency of punishment, and a report in this regard hould be submitted immediately. 6. The appointing authority reserves the rigbt either to modify or cancel the promotion, if the officials are found not eligible for the promotion or if found necessary for any cause at a later date. 7. If the officials refuse the regular promotion before becoming entitled to a financial upg radation, no financial upgradation under MACP shall be allowed as such they have not been stagnated due to lack of opportunities. If, however, fina ncial upgradation ha been allowed due to stagnation and they subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. Th ey hall, bowever not be eligible to be con idered for further financial upgradation under MACP, till they agree to be considered for promotion again and the second and the next financial upgradation shall al 0 be deferred to the e. tent of period of debarment due to the refusal. 2 -2 8. It should be ensured that no Vigilance / Disciplinary case is pending against the official, while effecting Grade I Driver promotion. Relief of the official to the promotional po t wherever necessa ry hould be ordered bv the Heads of Division / Unit only after satisfying the above points. 9.
