2 1 THE MAURITIUS SCOUT ASSOCIATION RULES MADE UNDER THE MAURITIUS SCOUT ASSOCIATION ACT 1976 ARTICLE I - TITLE, HEADQUARTERS AND JURISDICTION 1 The present document shall be known as the Constitution of the Mauritius Scout Association for the purpose of its operation. 2 The name of the Association shall be THE MAURITIUS SCOUT ASSOCIATION and its management shall be vested in a body known as the Mauritius Scout Council. 3 The Headquarters of the Association shall be at Trianon, Mauritius, or at any other place determined by the Mauritius Scout Council. 4 The activities of the Association and the Mauritius Scout Council shall be over the Republic of Mauritius. 5 There shall be a Patron and the President of the Republic shall be invited to be the Patron of the Association. In the event that the Chief of State is not available to become the Patron, the Vice-President can be invited or any other distinguished citizen whose patronage, encouragement and support are specially recognised and registered by the Committee of the Council. Potential candidates should not be voting members of the Association. ARTICLE II DEFINITION, MISSION, AIM AND METHOD 1 DEFINITION The Scout Movement is voluntary, non-political educational movement for young people in accordance with the mission statement below. 2 MISSION STATEMENT The Mission of Scouting is to contribute to the education of young people, through a value system based on the Scout Promise and Law, to help build a better world were people are self fulfilled as individuals and play a constructive role in society. This is achieved by:- i) involving them throughout their formative years in a non-formal educational process, ii) using a specific method that makes each individual the principal agent in his or her own development as a self reliant, supportive, responsible and committed person, and iii) Assisting them to establish a value system based upon spiritual, social and personal principles as expressed in the promise and law. 3. AIM 1 The aim of the Mauritius Scout Association is to encourage the physical, mental, social, emotional and spiritual development of young people so that they may take a constructive place in society. 2 The method of achieving the aim of the Association is by providing an enjoyable and attractive scheme of progressive training based on the Scout Law and Promise and guided by adult leadership. 4. THE SCOUT METHOD The Scout method is a system of progressive self-education through: A Promise and Law Learning by doing Membership of small groups (for example: the Patrol) involving under adult guidance, progressive discovery and acceptance of responsibility and training towards self-government directed towards the development of character and the acquisition of competence, self-reliance dependability and capacities both to co-operate and to lead. Progressive and stimulating programmes of varied activities based on the interests of the participants, including games, useful skills and services to the community taking place largely in an outdoor setting in contact with nature

THE LAWS (A) The Scout Law shall be: 1. A Scout is to be trusted. 1. A Scout is loyal. 2. A Scout is friendly and considerate. 3. A Scout is a brother to all Scouts. 4. A Scout has courage in all difficulties. 5. A Scout makes good use of his time and is careful of is possessions and property. 6. A Scout has respect for himself and for others. or in French: 1. GENERAL ARTICLE III - PRINCIPLES AND POLICY (A) Membership of the Mauritius Scout Association shall be voluntary. (B) Membership of the Association is open to: i. all boys and girls and adults irrespective of origin, race, creed, sect or class who accept and adhere to the principles of the Movement and who make the Scout or Cub Promise as the case may be.

4 3 ii. active leaders. Adults who actively participate in the education of young people or in the management of the Association at group, district and national levels and are registered by the Association. 2. RELIGIOUS (A) The Association recognises all religions and expects every scout to belong to some religious denomination and to understand his duty to his religion. (B) Every Scout shall show tolerance and respect for the religious conviction of others. (C) RELIGIOUS REPRESENTATION a. A member of each religious denomination recognised by the state may be elected as National Commissioner for Catholics, Hindus, Muslims, etc., to advise the Chief Commissioner and ensure the well being of Groups sponsored by his religious denomination and the provision of training in their faith. b. Each religious denomination having youth members may appoint a representative as a member of the Mauritius Scout Council. c. Where, in any District, there are Groups sponsored by religious denominations differing from that of the District Commissioner, Assistant District Commissioners who are members of those denominations may be appointed to advise the District Commissioner and ensure the well-being of Groups sponsored by their own denominations and the provisions of appropriate religious training. d. Sponsored Groups of the same religion may join together for training in their faith and may hold joint camps where facilities for religious observance and special arrangements for members of their faith, such as diet, may be provided. (D) Each invested member of the movement shall be encouraged to make every effort to progress in his understanding and observance of his Promise: To do my best to do duty to God, to belong to some religious body, and to carry into daily practice what he professes. (E) In order to make the warrant structure for Commissioners, Group Scout Leaders and Leaders of the Training Sections more effective, the District Commissioners must satisfy themselves that any applicant for such a warrant is fully aware that he will be expected by his personal example to implement the Religious Policy of the Movement. (F) Attendance by Scouts of various forms of religion at a Combined Service is allowed with the permission of the District Commissioner and/or Sponsoring Authority concerned. Such attendance should be voluntary. 3. POLITICAL (A) The Association is not connected with any political body. (B) The internal management of the Association shall not be subject to control by any Ministry or Department of Government (C) Every member shall have individual freedom of thought and action in political matters, provided that the aims and policy of any political party to which he may give allegiance shall not conflict with those expressed in this Constitution. (D) No member of the Association shall influence or involve the Association in any question of a political nature nor shall he take part as a scout or in a scout uniform in any meeting, gathering or other occasion associated with any particular political party. 4. MILITARY The Association is not military. Technical military training shall not be given to the members of the Association, as such. 5. FINANCIAL The spirit of the Association is that scouts should earn and not solicit money. Scouts in uniform must not take part in any street sales or collections of money either for their own funds or for those of others. The Association

5 4 depends financially on the contribution of its own members and on public support. No appeals to the Government or to the public may be made without the approval of the Mauritius Scout Council, and at District level, no appeals should be made to Local Bodies or others without the approval of the District Scout Council, and this approval will not be given where illegal or undesirable methods of raising funds are proposed. 6. EXTERNAL RELATIONS (A) The Association shall promote friendly relations with other national organisations of a non-political character having similar aims. (B) The Association and all its members shall endorse and adhere to the principles and policy of the World Organisation of the Scout Movement. The Association is a national organisation and shall be registered with the World Organisation of the Scout Movement with all other recognised National Scout Associations. (C) The Association shall to the best of its ability carry out its obligations to the World Organisation of the Scout Movement and promote friendship and co-operation with other recognised National Scout Associations of the World. ARTICLE IV - CHIEF SCOUT The Chief Scout shall be appointed by the Patron upon the recommendation of the outgoing Chief Scout and approval of the Mauritius Scout Council from any outstanding Scout Leaders who have given exceptional services and leadership within the Movement. The appointment is made for five years, which may be renewable for one consecutive term of five years. The functions of the Chief Scout shall be: (A) To act as Chairman of the Mauritius Scout Council. (B) To foster and encourage the Scout Movement in the Republic of Mauritius and seek to gain the highest standard of effective Scouting throughout the Association in all respects. (C) To sign warrants of appointment in the rank of Assistant District Commissioner or any higher rank on the recommendation of the Chief Commissioner. (D) In consultation with the Chief Commissioner, to fix the date of the Annual General Assembly of the Council. (E) To act as chairman of the Awards Committee. The Deputy Chief Scout (A) The Deputy Chief Scout shall be appointed by the Council from among the members on recommendation of the Chief Scout. The appointment is made for four years, which may be renewable for one consecutive term of five years. (B) Functions of the Deputy Chief Scout shall be to carry out such duties or responsibilities that may be assigned to him by the Chief Scout or the Council. (C) The proposal for appointment of the Chief Scout and his Deputy should be made in writing to the outgoing Chief Scout through members of Scout Board. ARTICLE V-CHIEF COMMISSIONER -DEPUTY CHIEF COMMISSIONER -NATIONAL COMMISSIONERS AND HEADQUARTERS COMMISSIONERS 1. The Chief Commissioner of the Association shall be appointed by the Chief Scout with the agreement of the Mauritius Scout Council. The appointment is made for four years, which may be renewable for one consecutive term. The Chief Commissioner shall appoint, a Deputy Chief Commissioner, one or more National Commissioners and one or more Headquarters Commissioners to exercise such functions as the Chief Commissioner may delegate to them. In the event of there being no Chief Commissioner at any time or during the absence or inability to act, the Deputy Chief Commissioner shall act for him pending resumption of duties or appointment of a new Chief Commissioner, or there be no Deputy, the Chief Scout may appoint one of the National Commissioners as Acting Chief Commissioner pro-term with the

6 5 agreement of the Scout Board. Such appointments will take effect after the Chief Commissioner gives notice to the Scout Board. 2. The functions of the Chief Commissioner shall be: a. To appoint the Executive Director and one or more National Commissioners and one or more Headquarters Commissioners to exercise such functions as the Chief Commissioner may delegate to them. b. To chair the meetings of the National Executive Committee. c. To organise and implement or cause to be implemented the work of the Association measured by the national targets set by the Mauritius Scout Council. d. To supervise generally the execution of the directives and decisions of the Mauritius Scout Council. e. To supervise and co-ordinate the work of the National Commissioners, Headquarters Commissioners and District Commissioners. f. To supervise the registration of District Scout Councils and to attend Annual General Meetings of the District Scout Councils as an ex-officio member. g. To supervise the issue of warrants to Commissioners and Scout Leaders and registration of the Groups. h. To provide for the issue of instructions to all Headquarters staff and warranted Leaders of the Association, to ensure the performance of their duties in accordance with the policy and decisions of the Mauritius Scout Council and its Scout Board. i. To define, after consultation with the Deputy Chief Commissioner, the areas of the District Scout Councils and to decide any difference of opinion between a District Commissioner and a District Scout Council, or between two or more District Scout Councils. j. To withdraw or suspend the registration of District Scout Councils, Groups or units provided that he shall bring such action to the notice of the Scout Board at its next meeting for approval. k. To conduct an annual census of members of the Association. l. To sign warrants of appointment of Scout Leaders below the rank of Assistant District Commissioners with the concurrence of the Mauritius Scout Council and on its behalf, and to withdraw or suspend the warrant of any Scout Leaders provided that he shall bring such action to the notice of the Scout Board at its next meeting for approval. m. To provide for the appointment and convening of such Advisory Committees as he may deem necessary to assist the effective working of the Association, provided that the Chairman of all such Committees be appointed with the agreement of the Scout Board and after consultation with Headquarters/National Commissioners or other officers of the Association whose work may be primarily concerned, (e.g. the Finance Commissioner). 3. Particular responsibilities may be delegated by the Chief Commissioner to his Deputy or to a National Commissioner (provided both are appointed as in 1 above) for the purpose of one or more of the following duties: (a) International (b) Training, (c) Adult Resources Development (d) Programme (e) Communications & Public Relations; (f) Finance (g) Growth and Planning; (h) Headquarters Commissioners for Building and Maintenance, the Scout Band and the Scout Shop or (i) Other major services of the Association. 4. EXECUTIVE DIRECTOR The Executive Director shall be appointed by and reports to the Chief Commissioner. As such the Executive Director shall be responsible for the management of the Secretariat of the Association in accordance with its established policy. The Executive Director may, at the discretion of the Scout Board, be paid a salary out of the Association s funds, and be employed on such terms and conditions as the Chief Commissioner and the

7 6 National Executive Committee decide. ARTICLE VI - THE MAURITIUS SCOUT COUNCIL 1. MEMBERS The Mauritius Scout Council shall consist of the following: Ex-officio (with vote): (1) Chief Scout (2) Deputy Chief Scout Ex-officio (without vote): (1) Chief Commissioner and his Deputy, (2) National Commissioners, (3) Headquarters Commissioners for: Youth Sections, Building and Maintenance, the Bandmaster and the Badge Secretary. (4) District Commissioners (5) The Rodrigues Scout Commissioner or his representative (6) The Executive Director Elected annually and eligible for re-election (with vote): Scout District Council Chairperson Elected representatives of the District Scout Council, at the rate of one member for every 200 registered scouts computed on the census of the last but one year preceding the election, but not more than six members in all from a district 50% of these representatives shall be aged less than 30 years. Adult Leader representation shall be equal in gender. Religious representative(s) as per Article III 2 (C) ii. Four nominees (two male and two female) from the National Youth Forum (age 16-23) Other voting members: One nominated representative from: M.A.C.O.S.S., Ministry of Youth & Sports, Ministry of Education & Ministry of Environment; The Chief Commissioner of the Mauritius Girl Guides Association; Not more than three other persons (non-members of the Association) elected in any one year who have rendered valuable services to the community or the Association, these members thereafter to be reeligible for re-election on expiry of their initial term. Each voting member of the Council shall be entitled to one vote and in the event of equal voting the Chairman shall have a second or casting vote. The Executive Director shall be the Secretary to the Council. The Council shall also appoint two internal Auditors among the voting members of the Council. The Accounts of the Association shall be audited by a private firm of professional auditors. The fees shall be approved by the Mauritius Scout Council. 2. MEETINGS (A) (B) (C) (D) The Chief Scout shall chair the meeting of the Council and in his absence, the Deputy Chief Scout shall chair. In the absence of the Chief Scout and his Deputy, the Council shall elect one Chairman from among voting members present. The Mauritius Scout Council shall meet at least once in every year and Extraordinary Meetings may be called by the Chief Scout, the Chief Commissioner or the Executive Director with the consent of the Chief Commissioner or following a request made in writing by a minimum of eight voting members of the Council. At the Annual General Meeting, the Council shall consider the Annual Report of the Association, presented by the Chief Commissioner, the Balance Sheet and the Budget submitted by the National Finance Commissioner, elect office bearers, appoint a Scout Board and transact any other business admitted by the Chairman or by two-thirds of the members present at the meeting. One third of the voting members of the Council shall form a quorum at any meeting of the Council. In

8 7 (E) case there is no quorum, the meeting shall be postponed for 15 days. The next meeting shall take place notwithstanding the number of voting members present at the meeting. Notice of business to be placed on the agenda shall be sent to the Executive Director by such date as will enable him to give members thirty days notice of the Annual General Meeting and fifteen days of Extraordinary Meeting. The accidental omission to give notice of a meeting to any member entitled to receive such notice shall not invalidate anything done at such meeting. 3. FUNCTIONS The functions of the Mauritius Scout Council shall be as follows: (A) To promote the welfare of the Scout Movement. (B) To advise the Chief Commissioner on the administration of the Association. (C) To raise and administer the funds for the administration and development of Scouting in the Republic of Mauritius, and to purchase, to take on lease, or hire or otherwise acquire and hold any lands, buildings, leasements or hereditaments or any tenure, patents, patent rights, trademarks, any other real or personal property and to construct, provide, maintain or repair any building works, stores, plants and things which may from time to time be deemed requisite whether within Mauritius or its dependencies or elsewhere for any of the purposes of the Mauritius Scout Association. (D) To establish and maintain a National Headquarters Office, to act as a channel of communication between the District Scout Councils and to maintain friendly relations with the World Scout Bureau and other Members of the World Organisation of the Scout Movement (WOSM). (E) To promote the organisation and effective operation of District Scout Councils on such terms and under such regulations as the Mauritius Scout Council or its Committee may from time to time and by byelaw require. (F) To carry on publicity, produce and monitor publications, organise meetings, demonstrations, rallies, conferences and other joint undertakings where the interests of the Mauritius Scout Association are concerned. (G) With the concurrence of the Chief Commissioner, to register District Scout Councils or to remove them from the register. (H) With the concurrence of the Chief Commissioner and upon the recommendation of the District Scout Council and District Commissioner concerned to register Groups and to issue warrants, signed by the Chief Scout or Chief Commissioner and similarly to remove any Group from the register and to withdraw the warrants of any such officers. (I) To assist the Chief Scout and Chief Commissioner where either may so desire in performing any of their respective functions laid down in Articles V. (J) To delegate to the Scout Board any or all its functions as it may deem desirable in the interests of efficiency and the expeditive despatch of business in accordance with Article VII. (K) To approve and publish the Constitution, Policy, Organisation and Rules of the Association. 4. ELECTION IN COUNCIL MEETINGS. The Secretary is responsible for the running of any election by ballot. No more than two candidates from any district shall be elected to the Scout Board. The Executive Director shall receive act of candidature for election in annual meeting of the Council not less than two months before the meeting. ARTICLE VII - THE SCOUT BOARD 1. MEMBERS (A) At the Annual General Meeting, the Council shall elect seven volunteers from amongst its members to form part of a Scout Board to exercise any of its functions except those to the Annual General Meeting under Article VI (B) The Chairman of the Scout Board is of non-executive rank and is chosen among the elected members of the

9 8 Committee. His term of office is one year and coterminous with that of the Committee. In absence of Chairman, the Committee shall elect a member present to chair on the session of the day. (C) The Executive Director of the Association shall be the Secretary of the Scout Board. (D) Composition of the Scout Board: The Scout Board shall consist of: Ex-officio members (with right of vote): (1) Chief Scout (2) Deputy Chief Scout (3) Four representatives of the National Youth Forum including the Chairperson (16 23 years) Elected (with right of vote): (4) Seven members elected by the Council Ex-officio members (without right of vote): 1 Chief Commissioner 2 Executive Director Eligible for co-option (no vote) (5) Not more than three other persons whose professional or technical assistance would be of potential value to the Movement e.g. from education, industry, banking, law, university, transport, publication and medicine. (E) The term of office of the Scout Board shall be coterminous with the term of the Mauritius Scout Council. Provided any member of the Scout Board who is a member by virtue of his office shall cease to be a member of the Scout Board when he ceases to hold such office. Provided further the Scout Board shall have power to act notwithstandingly any vacancy in the membership thereof; 2. MEETINGS OF THE SCOUT BOARD The Scout Board shall meet at least six times a year. Five members shall form a quorum, and in the event of equal voting the Chairman shall have a casting vote. If not carried, the motion will have to be referred to a next meeting of the General Assembly of the Council. Any member who is absent for three consecutive meetings without reason shall be disqualified from the Scout Board. 3. ACCESS TO THE BOARD All warranted Leaders, members of the District Councils of the Mauritius Scout Association, shall have access to the Scout Board on request to advise or report on matters concerning the welfare of the Association. 4 FILLING OF VACANCY Any vacancy among the elected members may be filled by co-option (with right to vote) with the agreement of the Chief Scout until the next Annual General Meeting. 5 ADVISORY COMMITTEES In addition to the appointment of the Advisory Committee on matters of importance to the Association, the Scout Board is authorised to appoint sub-committees for special purposes from time to time as may be deemed necessary provided that at least one of the members is a member of the Scout Board. 6 POWERS AND FUNCTIONS OF THE SCOUT BOARD (1) To form or re-form and register Districts or Scout Groups (with concurrence of District Commissioner) for such area or areas as may be determined from time to time; (2) To convene the meeting of the Council;

10 9 (3) To control and administer the funds and properties of the Association; (4) To recommend to the Council for consideration, approval and adoption of the Budget, Annual Audited Statement Accounts, Annual Balance Sheet and the Annual Report; (5) To frame, amend, delete, alter and add Bye-Laws of the Association for the approval of the Council and Chief Scout; (6) To recommend Decorations and Awards as provided in the Rules; (7) To recommend the Annual Membership fees payable to the Mauritius Scout Association by every registered member; (8) To select representatives of the Association in other external national bodies; (9) To enforce observance of the Aims and Objects, Policy, Organisation and Rules of the Association; (10) To uphold and promote the Aims and Objects and policy matters of the Scouts and to promote cooperation within Districts and other organisations with similar aims and objects within Mauritius in achieving the national targets; (11) To deal with all matters connected with the Mauritius Scout Association; (12) To determine membership of a person or Scout Group; (13) Call for reports from the Chief Commissioner or any National Commissioner or District Commissioner on any matter when they deem it necessary. (14) Nominate a member if any members who for any reason whatsoever, may withdraw from the Scout Board during the year, that member to serve till the next Annual General Assembly. (A) The Scout Board shall have power to delegate any of its powers and functions to any office-bearer or Committee of the Association for such period, for such purpose and on such terms as may be deem and withdraw such delegations. The Chairman shall have an additional or casting vote. No member shall vote by proxy. (B) Any vacancy among elected members may be filled by co-option with agreement of the Chief Scout until the next Annual General Meeting. (C) Where the Scout Board considers that a national office holder of the Association in fulfilling a specific duty could have a conflict of interests, it may, as a temporary measure, appoint another national office holder for the purpose of fulfilling this specific duty to act in his place ARTICLE VIII - THE NATIONAL EXECUTIVE COMMITTEE 1. MEMBERS The National Executive Committee (NEC) is a management committee co-ordinating the tasks of all National and District Committees. It is composed of all National Commissioners District Commissioners, Headquarters Commissioners. Assistant District Commissioners shall have access when required. The Committee is chaired by the Chief Commissioner and in his absence by the Deputy Chief Commissioner. 2. MEETINGS The National Executive Committee shall meet every two months preferably at the Headquarters or at any other place determined by the Committee. 3. FUNCTIONS The functions of the NEC are:- (a) To ensure regular and effective management of the day-to-day business of the Association, through continuous evaluation, assessment, monitoring, co-ordination of activities of national commissions and districts. (b) To prepare the yearly national programme of activities. (c) To direct and co-ordinate the programmes and activities of District and Group Organisation (d) To organise activities at national level; (e) To prepare and submit the estimate income and expenditure sheet to the Scout Board;

11 10 (f) To organise and monitor expansion and quality of Scouting; (g) To publish and diffuse circulars and newsletter amongst the Association s members; (h) To run a Scout Shop providing badges, books and uniform accessories; (i) To develop and implement a training programme for Adults; (j) To advise the Scout Board on the general orientation of the Association ARTICLE IX - ACCOUNTS AND AUDIT (A) (B) (C) The Mauritius Scout Council shall cause proper books of accounts to be kept of all moneys received and expended and of all its assets and liabilities. The books of accounts shall be kept at the Headquarters Office of the Mauritius Scout Council or such other place as the Council may direct and shall be open to the inspection of any member of the council on application. The Mauritius Scout Council shall have one or more banking accounts which shall be operated jointly by any two of the following: The Chief Commissioner The Deputy Chief Commissioner The National Finance Commissioner or The National Administrative Commissioner The National Finance Commissioner shall at each Annual General Meeting lay before the Mauritius Scout Council a Balance Sheet as at the previous 30 th day of June and an income and expenditure account made up to that date, together with his Budget proposals for the year commencing on the 1 st day of July for the following year. The National Finance Commissioner shall also submit a quarterly statement of accounts to the Scout Board. (D) The Auditor shall make a written report to the Mauritius Scout Council on the accounts examined by him and such report shall be attached to the annual Balance Sheet. (E) All bank accounts should be authorised by the National Finance Commissioner and countersigned by the Executive Director. ARTICLE X - INTERPRETATION, BYE-LAWS AND AMENDMENTS 1 The interpretation of the provisions of this Constitution by the Scout Board shall be final. 2 BYE-LAWS The Scout Board shall have power to make bye-laws, and to vary or cancel the same, to carry out the objects of this Constitution and provide for the effective conduct of the affairs of the Mauritius Scout Association provided all such bye-laws do not conflict in any respect with any of the Articles of this Constitution. 3 AMENDMENTS No alteration, addition, deletion, or amendment to this Constitution shall be made except when: 1. At least two months notice setting out the proposed alteration, addition, deletion or amendment shall have been sent in writing to all members of the Mauritius Scout Council, 2. Approved subsequently by a vote in favour of two-thirds of those present at the Annual General Meeting or Extraordinary Meeting. 3. The Constitution shall not be effective unless and until it has been approved by the appropriate bodies in WOSM. 4. 12 11 ARTICLE XI - COMMENCEMENT OF THE CONSTITUTION 1 This Constitution shall be approved by 2/3 majority of the Council. It should be submitted to the World Committee of the WOSM for ratification and a circular shall be issued to all members of the Council. It will from that date come into effect. 2 All other existing handbooks of Rules shall remain in force until replaced or repealed by the Mauritius Scout Council or Committee under Article XI.
