(Rev 10-07) DESK OFFICER - Supervise the performance of the: C A P T a I n C Command Clerk A - Attendant P Patrol Wagon Operator T TS Operator PLATOON CMNDR. - Patrol Sergeants - 2 nd Platoon - Responsible for maintenance and weekly inspection of Department vehicles. 1 st Platoon Review reports and forms prepared for the previous 24 hours. ICO - Integrity Control Program - Develop & maintain a comprehensive Overtime Control Plan, which includes an audit & review process. SOL - School Safety Sergeant, Anti-Crime, S.N.E.U., CPU; Crime Prevention, Traffic Safety Officer, Youth Officer, Auxiliary Police Coordinator, Peddler Enforcement & Domestic Violence Unit (IO 92 s.13) personnel. - Field Training Program of Probationary Officers assigned to CPU. - Crime Prevention Program - Auxiliary Police Program LIMITATIONS OPERATIONS - DO NOT perform patrol duty or desk duty. COORDINATOR DESK OFFICER - Sign out in COMMAND LOG when leaving desk area for any reason. * When there is more than 1 supervisor working on patrol, one will relieve the desk officer for meal. ~ Meal relief is not an emergency. ~ Police Officers will not be assigned to desk duty. ~ Precinct Training Sergeants are available for relief. ICO - Perform no duties other than integrity control. PLATOON CMNDR. - Perform duties of desk officer if assigned to precinct except when responding to emergency situation occurring in the field. * Remain on scene only as long as presence is required. * At discretion of Pct. C.O. and as long as there are 2 sergeants assigned to duty with platoon, Pct. platoon commander may perform the same duties as platoon commanders in other than PSB Pcts., i.e., patrol supervision (Rev 09-01).

6 Duties P.10 KSA ROLL CALL OPERATIONS - Review orders and prepare summaries for Command Level Training Program (Rev 09-01) or roll call. COORDINATOR Supplement instructions of desk officer, in absence of C.O., to outgoing platoons. DESK OFFICER - Conduct roll call. - In absence of platoon commander, inspect uniforms and equipment, instruct and question member s knowledge of command conditions, and ensure familiarity with integrity concerns. - Make required ROLL CALL adjustment prior to start of incoming platoon. (IO 72 s.13) * After platoon is posted, record post changes, as they occur, in COMMAND LOG and on front of ROLL CALL. * Finalize ROLL CALL per A.R.C.S. - Prepare PRECINCT CONSOLIDATED TOUR REPORT on every tour and attach to the desk copy of the ROLL CALL. - Verify return ROLL CALL. * Supervise platoon sign-out. ICO - Instruct uniformed MOS, during roll call training, on proper methods of identifying, reporting and combating corruption. PLATOON CMNDR. - Cause necessary adjustments at beginning of tour. * Schedule supervisors meals so a supervisor is on duty at all times. - Supervise roll call by personally inspecting MOS, instructing and questioning re: conditions, and -ensuring that MOS are familiar with integrity concerns. - Designate a supervisor to conduct "Platoon briefings" that include: * Info compiled by the Precinct Training Sergeant. * Incident critiques. * Regular updates regarding crime patterns, crime trends, wanted persons and discussions of Precinct conditions and tactics for addressing these conditions. PATROL - Conduct roll call, if directed by platoon commander or desk officer. SERGEANT OVERTIME OPERATIONS - Coordinate all overtime programs within the command. (Rev 09-01) COORDINATOR * Ensure that all MOS are working within the correct chart per their assignment. ICO - Develop and maintain a comprehensive overtime control plan, which includes an audit and review process.

7 Duties P.17 KSA - Confer with Facilities Management Division to implement recycling program. * Contact quarterly report actions taken. * Post info on what & where to recycle. - Attend community meetings per C.O. s instructions. PRECINCT SCHOOL SAFETY SERGEANT (PG ) - Assist precinct C.O. in developing and implementing the precinct school safety plan. - Perform an operational tour of duty, ensuring that hours are consistent with school hours of operation, particularly dismissal times. - Act as conduit to Department for and coordinate the evaluation and supervision of school safety agents. * Respond to incidents where a school safety agent is a victim of an offense while performing duty. - Liaison with principals, school staff, borough truancy task force and DVPO (child abuse cases). - Keep SOL apprised of activities in and around school facilities. - Coordinate efforts with the School Safety Division, Truancy Coordinator. * Identify locations at the beginning of the school year where truants will be delivered & identify at least 1 person in each school who will accept responsibility for truants delivered. (IO 47 s.12) FIELD INTELLIGENCE OFFICER (PG ) This unique UMOS, who can be a Sergeant, Detective or Police Officer, works in & provides intelligence to local command (Precinct) but works for and under directions of Commanding Officer, Criminal Intelligence Section (CIS). The FIO shares intelligence with all Department units and supports the Borough Level Intelligence Strategy. - Perform intelligence related duties in assigned command in business attire unless authorized by CO, CIS - Enter intelligence into Department Intelligence Database or COMPLAINT FOLLOW-UP database. - Exchange information with other FIOs & other commands regarding Parolees, Parole Absconders, subjects of INVESTIGATION CARDS, wanted persons & other matters of importance. - Prepare weekly INTELLIGENCE DIVISION ACTIVITY REPORT & submit to CO, CIS. - Address Roll Calls and participate in Detective & Patrol training sessions. - Obtain intelligence by: * Conferring regularly with patrol officers, detectives, supervisors, specialized units (including School Safety Division) crime analysis officer and community. * Reviewing reports, e.g., COMPLAINT REPORTS, JUVENILE REPORT SYSTEM WORKSHEETS, OLBS ARREST WORKSHEETS, UNUSUAL OCCURRENCE REPORTS, SQ&F REPORT WORKSHEETS, SCHOOL SAFETY DIVISION INCIDENT REPORTS, DIRs, patterns, statistics, trends, Intelligence Division reports, etc. * Accessing CIS databases not available at command. - Document intelligence forwarded to other units & record follow-up action. - Assist in registering Confidential Informants and obtaining SEARCH WARRANTS * Notify CO, CIS prior to execution of a SEARCH WARRANT, if possible. * Utilize secure system for notification and inquiries to FIOs & Intelligence Division. - Debriefings * Conduct secondary debriefing of prisoners for intelligence * Coordinate with Detective Bureau & OCCB personnel * Develop command-specific questions re: crimes, patterns or trends. * Maintain records, including details of positive debriefings * Be present during debriefing of all arrests, particularly SNEU arrests, when possible - Respond to major incidents in the field to provide assistance & gather intelligence. * Identify self to ranking Patrol Commander & Investigator. * Prepare COMPLAINT FOLLOW-UP & forward copy to CO, CIS. - Notify CO, CIS re: all unusual incidents.

8 Duties P.18 KSA DUTIES OF POLICE OFFICERS POLICE OFFICER (PG ) - Report to the desk officer when entering or leaving the command during tour of duty, indicating reason for presence. - Report immediately to the patrol supervisor & platoon commander any unusual crime, occurrence, or condition. - Report conditions not requiring immediate attention to the Command Clerk. - Familiarize self with the everyday routine of people residing, doing business or frequenting post or sector. - Signal * Command each hour if not equipped with a portable radio: * All uniformed MOS will ring between 0200 and 0700 Hours direct to the Desk Officer. * When assigned to school or church crossing, signal before and after crossing. Respond to assignments when directed. * DO NOT signal when assigned to a traffic post. * UMOS assigned to the Transit Bureau will signal the command when: ~ Arriving & leaving post ~ Going on & off meal ~ As indicated on roll call - When dispatched to assignment by TS Operator, keep the TS Operator informed of Police services rendered. - Report Police services rendered in another Precinct to Desk Officer of that Precinct. - Submit POLICE OFFICER S MONTHLY CONDITIONS IMPACT MEASUREMENT REPORT for review & signature on the 7 th, 14 th & 21 st day of every month * Submit completed REPORT by 2 nd day of month for the previous month. [IO 50 s.11] * Submit REPORT prior to leave, or if not possible, without delay upon return to duty, if scheduled for vacation or other leave. - Call the Desk Officer if unable to return to the Command to sign the return ROLL CALL at the end of the tour. - Preserve completed ACTIVITY LOGS and produce them as required. - No travel time for meal.

9 Duties P.27 KSA COMMAND AUXILIARY POLICE COORDINATOR (PG ) - C.O. does not assign APC until approved by C.O., Auxiliary Police Section. - Wear business attire when not in uniform. - Recruit and supervise APOs. * Perform tours that coincide with APO personnel, when possible. (Rev 09-01) - Conduct basic training classes for new recruits twice a year with at least 10 recruits. * Applicants must be a permanent resident or possess a valid visa issued by Immigration and Customs Enforcement (ICE). - Identify & recommend to SOL suitable volunteer APO for the Purchase of Alcohol to Minors program. - Obtain shields & ID cards of members leaving Auxiliary Police Program. - Confer with C.O., SOL & planning officer to develop plans for optimum use of APOs in emergency. * Ensure auxiliary police mobilization plans are developed & tested. * Ensure that all APOs are instructed re: plans. - Submit requests for recognition awards & promotions to Auxiliary Police Section via AP Coordinator. - Ensure that hours performed by APOs are accurately recorded & forward to: * Borough Auxiliary Police Coordinator * Auxiliary Police Section - In the event of an emergency, APC confers with C.O., SOL and Planning Officer - To assist in problem solving, APC liaisons with Community Policing Coordinator and Crime Prevention, Community Affairs, Youth and Planning Officers. - Create & maintain Command Auxiliary Reference Library. - Inspect daily portable radios and the reserve supply of bullet resistant vests assigned for auxiliary police use. * Document inspection by listing serial numbers in APU COMMAND LOANER VEST/RADIO LOG. (IO 72 s.09)

10 Duties P.28 KSA DUTIES OF CIVILIANS PRINCIPAL ADMINISTRATIVE ASSOCIATE (PG ) - Principal assistant to Operations Coordinator. - Supervise and train uniformed & civilian MOS assigned to: custodial, clerical, and administrative functions, including Roll Calls, payroll/time records, clerical, crime analysis, and communications. - Assist in providing staff supervision of SP 9, telephone switchboard, command clerk, and non-clerical civilian personnel. - Request civilian personnel be included in Pct/PSA/TD level training, when appropriate. - Develop procedures, methods, records, and operational controls. - Prepare routine, complex, and confidential communications, including self-inspection reports. - Enter time arriving and leaving Precinct Station House/PSA/TD in COMMAND LOG. - Prepare self-inspection of command s military leave records. * Notify Operations Coordinator and ICO if member s current military contract and current drill schedule are not provided by the member.

11 Duties P.29 KSA EVIDENCE AND PROPERTY CONTROL SPECIALIST (PG ) PROPERTY - Receive, voucher, release, package, and label property. - Perform intake function, including check and examine property. - Assign storage number location., store and safeguard property. - Prepare property for transport. - Process release of evidenced property. - Check ID of persons requesting release - Fingerprint if necessary. - Transport, deliver, deposit money - Return and log bank receipts. - Notify Desk Officer of the number of INVOICES stored in command over 30 days. (Rev 09-01) STORAGE AREA - Secure and maintain storage area. - Receive, review, and maintain vouchers, records, logs, and indexes. - Verify ID and authorization of personnel in storage area. VEHICLES - Perform all activities re: Ro-Tow operations when not engaged in other functions. * Photocopy & forward INVOICE re: recovered stolen vehicles to Patrol Borough Pattern Identification Module by next business day. (IO 20 s.10) - Inspect and schedule maintenance of vehicles assigned to property functions. ALARMS - Cancel alarms. - Monitor alarm systems, security cameras and other security systems. OTHER DUTIES - Respond to inquiries from government agencies and other jurisdictions. - Make notifications.

12 Duties P.30 KSA COMMAND CLERK (PG ) - Assigned to post adjacent to Desk Officer. - Perform clerical duties as assigned by the Desk Officer. - Bring to the attention of the Desk Officer matters of importance or other conditions requiring attention. - Distribute Department mail. - Input info into On Line: * Complaint System * Aided Index * Accident Index TELEPHONE SWITCHBOARD OPERATOR (PG ) - Answer telephone promptly, stating in courteous manner, the following: * Command * Rank or title * Surname * May I help you? - Process requests for service. - Notify Desk Officer * Of all important messages. * When a member required to signal fails to comply within a reasonable time. - Maintain the? 13 Duties P.31 KSA PATROL WAGON OPERATOR (PG ) - Supervisor * Report to supervisor at beginning of tour and when relieved at EOT. * Obtain assignment and meal period from supervisor at the beginning of tour. * Notify supervisor when leaving and returning from calls and meals. * Remain available for service and in location known to supervisor when not on assignment and render police assistance as required. - Borough Court Section * Call from all stops on the way to court or other destination, upon arrival at and prior to departure. * Notify if prisoners are not ready to be transported within 20 minutes after arrival at location where prisoners are to be picked up. * Pick up Dept. supplies and equipment after receiving clearance from BCS. - Commanding Officer * Report necessary repairs to C.O. - Patrolwagon * Keep wagon and equipment in clean, serviceable condition. * Operate in a safe manner and obey all traffic laws. * Check rear and compartment doors for serviceability and security before and after loading prisoners. * Search interior for weapons or other contraband after delivering prisoners. ~ Immediately notify ranking officer at the facility if contraband is discovered. - Records * Maintain Patrolwagon Record in a plain Number 2 book. ~ Enter name, time reporting, leaving and meals. - Return transport chains to where obtained.

14 Duties P.32 KSA POLICE ATTENDANT (PG ) - Assume control of and inspect prisoners upon arriving for duty * Remove the following types of property: ~ Dangerous to life ~ Facilitate escape ~ Damage or Deface property * Enter inspection on PRISONER ROSTER. ~ Re-inspect and make new entry every 30 minutes. * Notify Desk Officer of inspection results immediately after reporting for duty. - Remain inside cell block at all times while prisoners are confined therein. - Attend to personal needs of prisoner, including meals. - Keep cells supplied with paper cups, toilet paper and paper towels. - Report any physical condition or unusual need of prisoner to the Desk Officer. - Report necessary repairs to Commanding Officer (repairs to detention area or other area of command). - Perform clerical duties or other task relating to precinct operations if no prisoner confined in cells. - Cleaning * Keep command and abutting areaways, yards, and sidewalks clean and sanitary. * Prevent rubbish or dust from accumulating in any part of command. * Wash male and female cells. - Operate heating plant. - Test emergency alarms in cell block each day immediately after prisoners have been taken to court. - Keep green lights at building entrance lighted from sunset to sunrise. - Male Attendant visits female detention cells as follows: * When accompanied by female officer, and then, only with permission of officer in command, or * In daily cleaning of female cells, or * In an emergency - Perform other duties as directed by Desk Officer.

15 PERFORMANCE ON DUTY GENERAL (PG 203-5) Rules P.3 KSA - Remain on post until properly relieved, except for: * Police necessity * Personal necessity * Meal ~ Notify switchboard before and after leaving & make ACTIVITY LOG entry. - Take meal in:? P B A * Police facility * Bona fide restaurant (C. 0. may ok meal in adjoining precinct.) * Auto - Department vehicle. - Wear Helmet: * In supervised situations: ~ Ranking member on the scene determines if helmet is worn. ~ In emergencies, where member reasonably believes that there is a substantial & specific imminent threat to safety of member, member can wear it without direction. * If no supervisor, wear: ~ At own discretion if it is believed that: Safety is endangered Conditions warrant * Motor Scooter Operator ~ Must wear helmet Face shield is also required if 2-wheel scooter - Carry Helmet * Whenever directed to do so. * RMP uniformed officers keep helmets in vehicle trunk. * All others keep helmets in lockers. - Deliver these to the D.O. of the precinct where obtained:? R I P E * Recovered property, or property removed from: * Intox, or Incapacitated person * Prisoner * EDP - Entering or Inspecting facilities of opposite sex (i.e., locker room, dormitory and lavatory) * 1st - Peruse INTERRUPTED PATROL LOG to ascertain who is authorized in facility. * 2nd Be accompanied by member of opposite sex, if practicable. * 3rd Announce presence before entering (except in emergency). - Be responsible for humane treatment and safekeeping of prisoners in custody in Department facility. - Department Records: * Entries in chronological order, using black ink. * Sign with full first name, middle initial and surname. * Use shield and tax registry numbers as required. ~ Civilian MOS and UMOS in rank of lieutenant and above use tax registry numbers when shield number is called for. * Make corrections by drawing an ink line through incorrect matter, entering correction above and initialing. * Use numerals when entering dates. * Use Do for ditto. * Start serial numbers with 1 at beginning of each year for official forms, unless otherwise specified. - Cell phones (Department & personal) may be used for field communications when content not appropriate for radio transmission (e.g., detailed or personal information, names of persons, notifications, etc.) [IO 83 s.13]

16 Rules P.4 KSA PERFORMANCE ON DUTY PROHIBITED CONDUCT (PG 203-6) - Prohibitions concerning intoxicants: * DO NOT consume intoxicants ~ in uniform ("On" or "Off" Duty No Exceptions!). ~ while on duty (in uniform or civilian clothes) Bureau Chief/counterpart may authorize civilian clothed MOS to drink alcohol due to nature of member s assignment (undercover MOS). [Rev 09-02] * DO NOT bring or permit a MOS to bring an intoxicant into a Department facility, booth, vehicle, and/or boat except in the performance of duty. * DO NOT enter premises serving intoxicants, except on meal or performance of duty. - When in uniform DO NOT carry below unless in performance of duty: * Umbrella * Package * Cane. - Sergeants and Police Officers, in uniform, DO NOT ride in any vehicle (PD or private) unless: * Assigned to vehicle, or * Authorized, or * Emergency. - Prohibitions concerning smoking and gambling: * DO NOT smoke in public in uniform (PG ). * DO NOT engage in card playing or games of chance in Department facility. * DO NOT engage in illegal gambling anywhere, except in performance of duty. - Prohibitions concerning steering (other than personal affairs): * DO NOT steer businesses to prospective clients. * DO NOT steer prospective clients to businesses. - DO NOT advise someone who lost property or had it stolen to pay for its return. * Except towing fees for recovered stolen vehicles. - Department Logo * DO NOT use logo, unless authorized by the Police Commissioner. * DO NOT wear any item of apparel that contains logo or shield, or in any way identifies MOS with NYPD unless approved by Uniform and Equipment Review Committee. NOTE: Prohibition includes using logo or shield in artistic or mural form, in caricature or cartoon-like, or on items, including: * Pins, jewelry or adornment * Clothing, hat or patches * Mugs, writings implements, challenge coins or curio * Department property (walls, muster room entryway, watercraft, etc.) [IO 4 s.12] - DO NOT use Department letterhead, personnel, equipment, resources, or supplies for any non-department purpose or non-city purpose. - DO NOT manipulate, transmit or distribute any official Department recorded or evidence media except as authorized for Department business. - DO NOT have any person make a request or recommendation that affects the duties of any MOS, except as provided by Department procedures. - Portable Radio * DO NOT carry or use unauthorized radio * DO NOT make an unauthorized radio transmission (Rev 08-01) - DO NOT use any electronic/digital device (e.g., game, MP3 player, PDA, Bluetooth, etc.) while on duty * Cell phone is permitted if carried in concealed manner that doesn t interfere with authorized equipment &: ~Conducting official Department business ~Meal ~Authorized by Competent Authority (IO 7 s.10)

17 Rules P.5 KSA PERFORMANCE ON DUTY PERSONAL APPEARANCE (PG 203-7) BEARD, GOATEE & LONG HAIR - Do not grow, unless: * Written approval of the Police Surgeon and C.O., Medical Division due to medical problem. * C.O. may approve, in writing, due to nature of assignment (non-uniform). * Written approval of Deputy Commissioner, EEO to accommodate religious beliefs. (Copy of written approval for all above exceptions will be in possession of MOS whenever in uniform. When in uniform MOS will conform to NYPD grooming standards to the extent possible, e.g., no goatees, designer beards or chin strap beards for medical reasons) HAIR - Hair must not reach collar, fall over eyebrows or show beneath the visor of the cap. * Hair holding devices must be plain, transparent or color of hair, and concealed as much as possible. * Beads or similar ornaments are not authorized. * Length, bulk and style of hair should allow for uniform headgear to be worn squarely on head, without visible bulk. No ponytails. - Sideburns must be closely trimmed and not extend below bottom of earlobe. - Mustache must not extend beyond, nor droop below, the corners of the mouth. - DO NOT shave design into hair/scalp. (IO 8 s.14) JEWELRY OR OTHER ADORNMENTS - Do not wear items that are visible on head, neck or wrist while in uniform * Examples of prohibited ornaments include earrings, neck chains, bracelets (except medical alert) and body piercing are prohibited. * Watchbands must be a conservative color (e.g., navy, black, brown, yellow or white metal, etc.). * Rings may be worn if they are generally smooth and not likely to catch on other objects. HATS - Wear cap squarely on head. - Have center of visor directly over nose. - Cap may be removed while riding in a Department vehicle. - Rules for June 1-October 1 (PG 204-1) * Summer cap may be worn * Police Officers and Detectives performing subway patrol have option of wearing hat NOTE: At all other times, the uniform cap must be worn except where there are exigent circumstances. * When the exigent circumstances have stabilized, the cap must be worn. - Wear winter hat (black, soft vinyl with mouton trimming) only if temperature is expected to fall below 32 Fahrenheit (PG 204-4). NON-UNIFORM ITEMS - Prevent non-uniform items from showing above uniform collar, within open collar or below ends of shirt. - Eyewear must be of conservative style and color (no neon or bright colored frames). * Eyeglass straps, if worn, must be black. FINGERNAILS - Fingernails will be neatly trimmed and extending no more than ¼ inch from fingertip. * Nail polish may only be worn if it is clear or a natural, conservative color. ~ Designs or decorations are prohibited. TATTOOS (only for MOS hired on or after 1/1/07) - Cover by uniform, business attire or neutral colored skin covering (e.g., sports wrap or bandage). - Commanding Officer may exempt MOS due to nature of member s assignment. * Approval must be filed in member s personnel folder. NOTE: While in uniform in public view, do not chew gum, use tobacco in any form, or hold toothpicks in mouth. While performing duty in civilian clothes, wear attire suitable to assignment. Commanding Officers will inspect MOS upon notification re: promotion, using UNIFORM PROMOTION CHECKLIST, which promotee will submit to CO, Leadership Training Section when assigned to leadership training course.

18 Rules P.6 KSA MAKING FALSE STATEMENTS (PG 203-8) - Making of false official statements will result in dismissal from NYPD, absent exceptional circumstances, as determined by the Police Commissioner. - The Department will not bring false official statement charges against an MOS who pleads not guilty in: * Criminal matter * Civil action * Administrative charge of misconduct (Rev 07-01) PUBLIC CONTACT GENERAL (PG 203-9) - When lecturing or writing articles, DO NOT conflict with Department policy. * Questions regarding fees are resolved by the Chief of Personnel. - Give rank, name, shield number and command to anyone requesting & give ample time to note info. (IO 11 s.04) * Anyone who would interfere with your Police duties. - Political activity: * Join a political club in the precinct of assignment. * Solicit, receive or collect $$ for any political club (OK to give $$). * Serve as a member or be a candidate for election of a school board located in NYC. * Endorse political candidates or publicly express personal views re: ~ Political party or candidate for public office ~ Public policy matter or pending legislation ~ Any matter to be decided by a public election NOTE: Prohibitions regarding political endorsement are for members who are on duty or in uniform. Except, P.C. can give permission for political endorsement. - Community Boards: * Serve on a Public Safety Committee (OK to be a member of Community Board). * Vote on any matter that concerns Police Department activities in the district that the Board serves. - Associate with premises engaged in illegal activities. (Gambling, Smokeshop, After Hours - Supervisor must suspend - PG ) - Patronize unlicensed premises (PG prohibits patronizing a neighborhood tavern or restaurant involved in the illegal sale of alcoholic beverages - unlicensed. Captain or above may suspend or modify.) - Occupy a seat in a public conveyance, while in uniform, to exclusion of paying passenger. NOTE: Uniformed members assigned to patrol trains may not occupy a seat at any time.

19 Rules P.9 KSA FINANCIAL RESTRICTIONS PROHIBITED ACTS (PG ) - Using confidential official information to advance financial interest of self or another. - Becoming interested, directly or indirectly, in any manner except by operation of law, in any business dealing with the city. - Engaging, or rendering a service, in any financial, commercial, or private interest which is in conflict with official duties. - Purchasing, or acquiring property of another, without approval of Commanding Officer, knowing or having reason to know, that such property was held in custody of this Department. - Fund Raisers - Getting involved with organizations that print advertising publications used to raise funds for any purpose AND the publication contains the word POLICE, indicating an affiliation with N.Y.P.D., unless approved by the Chief of I.A.B. - l0-13 PARTIES * Issuing any writing for admission to functions within the N.Y.P.D. containing words: POLICE DEPARTMENT CITY OF NEW YORK or similar words indicating an affiliation with this Department unless approved by the Chief of I.A.B. * Request to IAB (PG ) will include all of the following: ~ Date, time and location ~ Identities of organizers and recipient ~ The following checks re: premises and principals: Intelligence Division OCCB SLA, when appropriate Precinct Integrity Monitoring File (location) ~ Specific manner funds will be raised and method of compensation to principals of premises. ~ The following statements: No illegal gambling. Specific accounting of the funds will be forwarded within 30 days after fund-raiser to the Chief of IAB. * Soliciting or giving money or other valuables which will be used in connection with a matter affecting the Department or any persons connected with the Department without the permission of the Chief of I.A.B. (DO NOT donate $$ if the purpose is to defray the costs of an MOS's suspension or department trial.) - For purposes of Commercial Advertisement DO NOT authorize: * Use of photo in uniform. * Mentioning rank, title, or membership in Police Department. - DO NOT borrow money from businessmen or residents within the area of assignment (including banks). - Prohibitions concerning purchase of real estate: * DO NOT purchase city-owned real property, except may purchase residential building of 6 units or less. * DO NOT purchase real estate for rental purposes in precinct of assignment. - DO NOT do business with another MOS who is your superior or subordinate, where the superior has power to affect subordinate at work (e.g., same command). Contact DCLM for questions. (Rev 09-04) NOTE: The Conflicts of Interest Board has determined that it is a violation for a superior to solicit charitable contributions or sell products of any value to a subordinate. * However, a subordinate may sell products for profit or charity, or solicit donations for charity from a superior if $25 or less.

20 Rules P.10 KSA - DO NOT use position with NYPD to benefit self or associate through micropurchases (up to $20,000) for NYPD (IO 6 s.14) * Associate includes immediate family, business associate & firms MOS has a potential interest in. GIFTS - DO NOT accept awards from other than the following sources: * NYC employee's suggestion * Department recognition * To a MOS's family from a metropolitan newspaper * Foundations, universities, institutions after review by DCLM and approval of the Police Commissioner. GUIDELINES FOR ACCEPTANCE OF GIFTS AND OTHER COMPENSATION BY MOS (PG ) - The only exceptions re: accepting gifts are delineated in the NYC Charter and NYPD s Board of Ethics Rulings. * Policy applies whether ON or OFF duty. * It is not unethical or illegal to accept gifts that are commonly offered as tokens of appreciation, e.g., plaques, pen and pencil sets, etc. * Cash and personal gifts (e.g., wristwatches) are strictly forbidden. - When an MOS is offered a gift or is aware that a gift will be offered in appreciation for police service: * MOS will notify the CO prior to accepting gift. * CO reviews: ~ Circumstances ~ Board of Ethics Rulings A copy of these rulings are maintained in Command Reference Library (AG ). * If the gift is a reward or present for police service in discharge of official duty: ~ Forward a report to the Police Commissioner for review and final determination. * If the gift is offered by a person/firm that is, or intends to engage in business with NYC: ~ CO will: Review City Charter to insure that there is no conflict of interest. Determine the propriety of accepting the gift. o Request Board of Ethics ruling if circumstances not reflected in current rulings. Forward report to Chief of IAB if MOS receives 2 or more gifts, regardless of value or source, within a calendar year. FINANCIAL RESTRICTIONS PROHIBITED INTERESTS (PG ) - DO NOT hold a position or have an ownership interest in a firm engaged in business dealings: * With the NYPD in any case, or * With the City, unless the firm s shares are publicly traded. - If MOS has an ownership interest, MOS must, within 10 days of learning that interest is prohibited: * Terminate such ownership in firm, or * Disclose interest to the Conflicts of Interest Board NOTE: An ownership interest means greater than five percent (5%) of the firm or investment of $32,000 or more by the MOS, spouse of MOS, or unemancipated child. - A position with a firm includes Officer, Director, Trustee, Employee, Attorney, Agent Broker, or Consultant. - An MOS may have an interest otherwise prohibited if MOS obtains written approval from the P.C. and the Conflict of Interests Board. - Contact the Conflicts of Interest Board by phone if covered by above provisions.

21 UNIFORMS AND EQUIPMENT- GENERAL REGULATIONS (PG 204-1) Uniforms P.1 KSA EQUIPMENT SECTION & POLICE ACADEMY - Recruits wear uniform only after inspected and stamped by the Police Academy. * Other UMOS bring uniforms to Equipment Section for inspection (PG 204-5). - Purchase service holster, hats, raingear, and all items sewn or attached to the uniform only from the Equipment Section or authorized supplier. MODIFICATIONS - DO NOT modify the prescribed uniform, except if authorized. CIVILIAN CLOTHES - DO NOT wear distinguishable items of the uniform with civilian clothes. RALLIES / DEMONSTRATIONS - DO NOT wear the uniform, shield, or identification card while participating in a rally, demonstration, or other public assemblage, except as authorized. INDOORS - When in uniform, wear regulation seasonal shirt and trousers. COURT/TRIAL ROOM - If regularly assigned to uniform, wear uniform when appearing in court, trial room, or at the office of Deputy Inspector or above, except if: * Off-Duty * On Sick Report, or * Excused by authority. NOTE: Compare PG An MOS assigned to uniform is not required to wear the uniform in court if (OSCAR): Off-Duty, Sick, CO authorizes, Arraigning deferred/holdover prisoner, Restricted Duty TEMPERATURES - Platoon Commander shall authorize the: * Removal, if desired, of the duty jacket/summer blouse whenever the temperature for a specific tour is expected to rise above 65 degrees. * Wearing of the optional short sleeve shirt whenever the temperature for a specific tour is expected to rise above 70 degrees. DATES - Remove the summer blouse/duty jacket between May 1 and November 1, if desired. DO NOT wear gloves or suspenders when summer blouse is removed. - Between June 1 and October l * All MOS have the option to wear short-sleeve shirt (without tie) and summer hat. * Transit Bureau Police Officers & Detectives assigned to subway patrol for entire tour have option of: ~ Regulation NYPD blue short sleeve uniform shirt. ~ Cargo style shorts (hemmed to top of knee) ~ Uniform athletic shoe black leather (high or low cut), lace-up style (maximum 5 grommets or attachments), with no visible logos or markings ~ Socks black cotton crew style, worn fully extended (visible 3-5 inches above anklebone) (Rev 10-01) ~ Not wearing uniform cap NOTE: Remember the rule and the exception: Rule: Optional items during summer months ~ June 1 October 1 Exception: Summer Blouse / Duty Jacket may be removed 1 month earlier, May 1 and 1 month later, November 1.

BOTH PROCEDURES - CO must check Highly Recommend, Recommend or Do Not Recommend on APPLICATION. * If Do Not Recommend, state specific reasons why. * Copies go to member s Personnel Folder & requesting member within 7 days of receipt. (IO 11 s14) NOTE: MOS in Levels II or III Monitoring Programs are not to be transferred without prior conferral with Bureau/Borough CO & CO, Performance Analysis Section. WHEN REQUESTING A TRANSFER, NOT THROUGH THE CAREER PROGRAM UNIT, I.E.,: Not enough Career Path Points Intra-Bureau Intra-Boro, within PSB (AG ) Civilians PROCEDURE - Prepare APPLICATION FOR TRANSFER (Typed Only) - Obtain Supervisor/witness signature and submit to CO for endorsement. * CO forwards copies to Borough/Bureau Personnel Officer in addition to member s Personnel Folder & MOS - MOS submits endorsed copy to CO, Personnel Orders Section in a sealed envelope. WITHDRAW REQUEST: - Submit report to Personnel Orders Section, requesting withdrawal. MUTUAL TRANSFERS: - Each MOS submits a report to his/her Commanding Officer. - C.O.s will endorse to C.O., Personnel Orders Section. WHEN REQUESTING A TRANSFER THROUGH THE CAREER PROGRAM UNIT FOR 1 OF THE FOLLOWING: Precinct of Choice Investigative Assignment Non-Precinct Assignment PROCEDURE - Prepare CAREER PROGRAM TRANSFER APPLICATION/RECOMMENDATION POLICE OFFICER/DETECTIVE SPECIALIST and submit to C.O. * A minimum of 12 Career Program Points are required to submit CAREER PROGRAM TRANSFER APPLICATION. ~ Members possessing special skills may be transferred with less than 12 points [IO 17 s.11] upon approval of the Police Commissioner. ~ Police Officers must have 4 years in rank prior to entering detective investigative track unless PC approves. * 3 Choices of assignments in priority order may be entered. - C.O. must verify the information, eligibility and suitability for transfer & endorse. - MOS makes copies of APPLICATION/RECOMMENDATION and forwards to: * CO, Personnel Orders Section, Career Program Unit, in sealed envelope * Borough/Bureau Personnel Officer NOTE: In order to be considered for investigative assignments, MOS must receive a Highly Recommend endorsement from the C.O. who must comment on applicant s performance, attendance, sick & disciplinary records and ability to work with & respect peers and community. * If additional space is needed, CO uses COMMANDING OFFICER S RECOMMENDATION. CAREER PROGRAM POINTS ARE EARNED BY: - Annual Performance Review Points for defined patrol officers (up to4 points): * Foot, RMP, Train, Bicycle & CPU * Anti-Crime, SNEU, Conditions, Warrants * Youth Officer, School Outreach Coordinator and DVPO * Summons * Safe Home

24 Personnel P.12 KSA - Annual Evaluation for (up to 12 points for last 5 Evaluations]. - Department Recognition - Perfect Attendance (1 point per year up to 3 points) - Education (up to 5 points) - Integrity Review Board (up to 5 points) - Voluntary Participation in Community Programs (1 point per year) - Cadet Corps (1 point) - Auxiliary Police Officer (1 point) - Language Skills (1 point per language) - Arrest Activity (up to 4 points) - Military Service (up to 9 points, i.e., 3 points per overseas deployment during conflict & Honorable Discharge) NOTE: Points may be reduced for Charges and Specifications, e.g., -.2 points for each day suspended/penalized (maximum 5 per case). NOTE: Applications will be expunged after 2 years on file. Police Officers granted a transfer under the Career Program must wait 2 years before requesting another transfer under this program. NOTE: Applicants utilizing the Career Program are given priority when filling patrol precinct vacancies. INTEGRITY REVIEW BOARD RECOMMENDATION PROCEDURE (PG ) TO RECOMMEND AN M.O.S. FOR RECOGNITION TO THE INTEGRITY REVIEW BOARD: COMMANDING OFFICER: - Have report of incident forwarded to Employee Relations Section (ERS). M.O.S.: - Report to the ERS with copies of documents relating to the incident. * In uniform of the day, if assigned to patrol duties. * In business attire, if assigned to non-patrol duties. - M.O.S. may, in addition, apply for Department recognition in the grade of Meritorious Police Duty or Commendation. (PG ) E.R.S.: - Convene the Integrity Review Board (quarterly) to review bribery arrest and acts of high integrity. INTEGRITY REVIEW BOARD: - Forward recommendation to the Police Commissioner for final approval. - IRB considers MOS s actions, needs of Department and MOS s aptitude/suitability for desired assignment. - Types of recognition UMOS are eligible to receive: * PC letter of recommendation * Career Program Points (1-5) * Waiver of all or part of Career Path requirements for assignment. * Precinct to precinct transfers. * Interviews for investigative or preferential assignments. * Investigative time. * Preferential consideration within assigned bureau. * Other appropriate award.

25 - Uniformed M.O.S. will not usually be considered for: * Patrol Precinct to Patrol Precinct transfer with less than 2 years of service. * Interview for an investigative assignment with less than 3 years of service. Personnel P.13 KSA NOTE: A Supervisor performing normal supervisory duties regarding bribery/attempted bribery incidents is not eligible for recognition by the Integrity Review Board. OVERTIME (PG ) NON-ORDERED OVERTIME - Extension of tour by 15 minutes or more to prevent the interruption of services. - DO NOT approve for administrative duties at any level. ORDERED OVERTIME - Required for ongoing or future operational situation. - May be ordered for administrative duties in connection with the operational situation. - Only authorized by Police Commissioner, First Deputy or Chief of Department. EMERGENCY ORDERED OVERTIME - Work schedules are suspended due to large-scale disorders or disasters. - Only authorized by Police Commissioner, First Deputy or Chief of Department. GENERAL - Submit OVERTIME REPORT to the Desk Officer at the end of the tour. * If command is closed, submit it on next scheduled tour. * If OT earned at other than assigned command, submit it to Desk Officer of that command. * If OT earned at parade, demonstration, etc., submit to immediate supervisor. NOTE: If MOS fails to submit OT in a timely manner, discipline may be taken, but the MOS is still entitled to compensation for OT performed (FLSA). NOTE: Though it does not happen in practice, the PG mandates the OT REPORTS be collected at parades or outside commands and forwarded to members C.O.s. The OT REPORTS are not to be returned to members at the scene. That is what makes this a tough exam question. - At time of dismissal, Desk Officer makes COMMAND LOG entry and Supervisor makes ACTIVITY LOG entry. - MOS must submit COURT ATTENDANCE RECORD with OVERTIME REPORT where overtime is connected to court appearance. (Cash or time.) - If COURT ATTENDANCE RECORD is not submitted, Desk Officer will not approve overtime for court appearance unless investigation is conducted and report is submitted with OVERTIME REPORT in lieu of COURT ATTENDANCE RECORD. NOTE: The maximum amount of compensatory time a MOS may accumulate is 5 days. When a MOS accrues in excess of 5 days, the excess must be taken within 30 days, needs of the service permitting. All compensatory time must be taken within 1 year of the date earned.

26 ABSENT WITHOUT LEAVE (PG ) Personnel P.14 KSA WHEN A MOS IS A.W.O.L. FOR 2 HOURS AT BEGINNING OF TOUR: DESK OFFICER - Make telephone inquiries, including: * Command ROLL CALL. * Sick Desk Supervisor. * Court Sign-In Rooms. * Member s Residence. - Check Department Records, including: * TELEPHONE RECORD. * ROLL CALL CHANGE SHEETS. - Make inquiries of Command personnel. - Request that Desk Officer, MOS s resident Precinct have a Supervisor respond to MOS s residence. - If MOS resides outside N.Y.C., request Inter-City Correspondence Unit to make a notification to the local Law Enforcement Authority and request that they respond to the MOS residence. IF MOS IS NOT CONTACTED 4 HOURS AFTER COMMENCEMENT OF TOUR: DESK OFFICER - Make a COMMAND LOG entry, including facts and notifications to: * C.O./Duty Captain * Borough Command/Counterpart * Operations Unit * Internal Affairs Bureau, Command Center C.O./ - Conduct investigation, entering results in COMMAND LOG. DUTY CAPTAIN - Telephone results of investigation to the Operations Unit. * Enter results in COMMAND LOG. If MOS is located: - Prepare 2 copies of Report to Chief of Department, including: * Full particulars of the investigation. * Results obtained. * Actions taken or contemplated. C.O./ - Interview M.O.S. and ascertain reason for absence and location. DUTY CAPTAIN - Notify: * Operations Unit. * Borough Command/Counterpart. * Sick Desk Supervisor. * Internal Affairs Bureau, Command Center. - Make COMMAND LOG entry. - Forward Supplementary Report to Chief of Department. NOTE: An MOS AWOL for an entire tour will not be assigned to duty without permission of Chief of Dept.

27 APPEAL OF EVALUATION UNIFORMED & CIVILIAN MOS (PG & 59) Personnel P.43 KSA WHEN A MOS IN A PERMANENT RANK WANTS TO APPEAL A PERFORMANCE EVALUATION: RATER - Inform the Commanding Officer. COMMANDING - Act as initial hearing officer. OFFICER * Schedule interview with Rater, Ratee & Reviewer within 30 days of appeal. - Attempt to resolve the appeal. NOTE: If the CO is also the rater, the CO of the next higher command will serve as the hearing officer. If the ratee performs below desirable standard, the CO must be the Reviewer. If an appeal is NOT resolved by the Commanding Officer, the Ratee will submit a TYPED LETTERHEAD, as follows: * UMOS below Captain to Personnel Officer concerned (e.g. Borough) * Captains & above to the Personnel Officer, Deputy Commissioner, Personnel (IO 41 s.12) * Civilians to Bureau/Borough Personnel Officer for a Review Board determination. ~ The Review Board determination can be appealed in writing to the Police Commissioner for final determination. NOTE: Uniformed & Civilian MOS on probation CANNOT appeal their EVALUATIONS. * Provisional Civilian MOS who have served less than 2 years in provisional status CANNOT appeal. MOS in permanent rank can only appeal for following reasons: * Factual error * Rater s misinterpretation of instructions * Bias or prejudice * EVALUATION was based upon other than performance factors All MOS may review comments and recommendations of reviewer but may NOT appeal the EVALUATION because of them.

28 Personnel P.44 KSA FIREARMS PROFICIENCY REQUIRMENT (P.G ) WHEN A UMOS HAS BEEN DEEMED FIT FOR FULL DUTY BY THE MEDICAL DIVISION AFTER CLAIMING TO BE MEDICALLY AND/OR PSYCHOLOGICALLY UNABLE TO USE FIREARMS: - MOS reports to the Range for firearms qualification - If MOS fails to qualify: * Report to medical specialist designated by Medical Division for examination. * Complete NOTICE OF FAILURE TO QUALIFY WITH FIREARMS. NOTE: UMOS failing to qualify within 90 days of signing NOTICE, will: * Receive CHARGES AND SPECIFICATIONS * Face an administrative hearing per the NYS Civil Service Law, Removal and Other Disciplinary Action ~ If found to be incompetent, UMOS will be removed from the Department.

29 REPORTING VIOLATIONS OBSERVED BY SUPERVISORS (PG 206-1) Discipline P.1 KSA WHEN BECOMING AWARE OF A VIOLATION OF THE RULES OR PROCEDURES OF THE DEPARTMENT, A SUPERVISOR WILL DO THE FOLLOWING: - Prepare a SUPERVISOR'S COMPLAINT REPORT/COMMAND DISCIPLINE ELECTION REPORT. - Notify the Desk Officer of the M.O.S.'s Command for the next serial number from the COMMAND DISCIPLINE LOG. - Submit SUPERVISOR'S COMPLAINT REPORT to Commanding Officer of subject M.O.S. * Provide copy to Supervisor s C.O. if M.O.S. is from a different command. NOTE: If the C.O. needs assistance re: C.D. charges, confer with the Department Advocate s Office. COMMAND DISCIPLINE (PG & 4) COMMAND DISCIPLINE - Non-judicial punishment to correct deficiencies and maintain discipline. COMMANDING OFFICER - Holds non-formal interview and decides penalty within 60 days of date of issuance. - Should schedule the interview when Supervisor is available. - No lawyer and no recording (Informal and Non-Adversarial). THE PREFERRING SUPERVISOR - Will confer with the C.O. if required. - C.O. will notify Supervisor of the results of the investigation and the proposed penalty. MEMBER OF THE SERVICE - May have one line organization representative present. - May make statement in rebuttal. - May request C.O. to seek additional information from other persons. - May elect charges, even if the C.O. offers C.D. - Must notify the C.O./Executive Officer, within 3 working days of the C.O. s offer, whether the MOS will accept the finding and penalty.

30 Discipline P.2 KSA COMMANDING/EXECUTIVE OFFICER RESPONSIBILITY - Investigate. * Direct ICO to investigate subject s prior 12-month disciplinary history & document on SUPERVISOR S COMPLAINT REPORT/COMMAND DISCIPLINE ELECTION REPORT (C.D.) ~ Consider history when adjudicating C.D. (IO 86 s.13) * If substantiated, decide on C.D. or CHARGES & SPECIFICATIONS (C&S). ~ File A & B C.D.s in back of COMMAND DISCIPLINE LOG ~ Forward copy of B C.D. to next higher command. * Complete the process within 60 days of the date of issuance. - A C.D. always stays in the command of issuance. * If a Commanding Officer/Executive Officer is transferred, the new CO/XO handles. * If the MOS is transferred, the former CO/XO handles and forwards disposition records to new Command. NOTE: There is no time limit to observe before accepting a report of a missing person. DESK OFFICER - Review the above reports and ensure that: * The COMPLAINANT S REPORT OF LOST OR STOLEN PROPERTY/IDENTITY THEFT is attached to the precinct file copy of the COMPLAINANT REPORT. * Copies of both reports are forwarded to the precinct detective squad. - Refer the complainant to the precinct detective squad for investigation and preparation of an IDENTITY THEFT PRELIMINARY INVESTIGATION REPORT, if detective squad member is available. - Ensure notification is made to the Organized Theft and Identity Theft Task Force if the Identity Theft involves a Larceny valued at $5,000 or more. * Enter notification in Details section of COMPLAINT REPORT. NOTE: If a COMPLAINT REPORT is prepared for lost property or another offense involving the theft of property and the complainant subsequently claims to be a victim of Identity Theft resulting from the initial complaint, a thorough investigation will be conducted to determine if there is a connection between the initial complaint and the Identity Theft. If there is a nexus, MOS will: * Prepare a COMPLAINT FOLLOW-UP or INFORMATIONAL, as appropriate * Instruct and assist complainant in preparing COMPLAINANT S REPORT OF LOST OR STOLEN PROPERTY/IDENTITY THEFT (as above). * If the reporting command is not the command of occurrence, the Desk Officer will ensure that the above reports are forwarded to that command. (LBB 19/3) - If an attorney is present, he can: * Not talk to witnesses * Make reasonable suggestions but may not interfere * Observe from the lineup room or place where he can t be observed. DESK OFFICER - Use Electronic SUMMONS Tracking System (ESTS) to determine if MOS has previously distributed unused SUMMONSES. * Certify, by visual inspection, these SUMMONSES. * Notify IAB & obtain Log # if MOS cannot produce listed SUMMONSES. * Determine if MOS should be given additional SUMMONSES. - Use bar code reader to scan each SUMMONS being distributed, served, resubmitted after correction & /or returned unused for entry into ESTS. * If reader is inoperable, enter manually into ESTS. * Notify Patrol or Transit Borough of defective reader & obtain replacement. ~ Enter notification into TELEPHONE RECORD. * Notify IAB & obtain Log # if any SUMMONS is missing from those returned unused by MOS. ~ Also notify ICO if not available, notify CO/XO. - Distribute SUMMONS packets in numerical order. * Ensure Department sticker WARNING! SPECIAL CRIMINAL COURT OFFENSE RULES Front - At the bottom of all summonses there are two lines: * Rank/Full Signature of Complainant * Complainant s Full Name (printed) - The issuing MOS ALWAYS signs his/her name in 1 and prints his name in 2. - However, in C summonses, where there is a civilian complainant, the word Complainant will be crossed out in both boxes and substituted with the word OFFICER. Then the MOS may sign and print his name. - In these Complainant situations, the MOS will also cross out the phrase I personally observed the commission of the offense charged above. - Violator s signature is optional on bottom line. OFF-DUTY ACTION: An MOS will be represented when making an Off-Duty arrest, except: - When personally involved in the underlying incident. (Includes members of the MOS's family or friends who have had a dispute or been involved in an incident), or - When engaged in Off-Duty employment. (the MOS's actions will be scrutinized to see if they were furthering the interests of the MOS's private employer rather than the City of New York), or - When enforcing traffic regulations. (Put up with aggravating drivers and do not use Police powers to get even.)

58 Courts P.20 KSA Make an arrest only when: GUIDELINES FOR OFF-DUTY CONDUCT - WITHIN THE CITY OF N.Y. - The MOS is not personally involved in the incident; and - There is an immediate need for the prevention of crime or apprehension of a suspect; and - The offense is a crime (DO NOT enforce minor violations such as harassment, dis con and quality of life offenses.) - The arresting Officer is armed. NOTE: While not required to make an arrest off-duty, a MOS must notify on-duty personnel of an emergency. NOTE: EXCEPTION TO ABOVE: Off-duty Officers riding city buses and subways may: * Take Police action against minor offenses such as smoking or loud radio playing, or * The MOS may notify an On-duty MOS. GUIDELINES FOR OFF-DUTY CONDUCT - OUTSIDE THE CITY OF N.Y. Make an arrest only when: - The MOS is not personally involved in the incident; and - There is an immediate need for the prevention of crime or apprehension of a suspect; and - The offense is a serious felony involving imminent danger to human life; and - The arresting Officer is armed. NOTE: It is strongly recommended that an MOS not carry a firearm while Off-duty and outside the City, unless travelling to and from the City. If unarmed and MOS encounters a serious emergency, MOS must notify local Police authorities.

Command Operations P.49 KSA NOTE: If a foreign national requests asylum, MOS notifies the desk officer, provides necessary protection and accompanies to command. The desk Officer notifies the Commanding Officer, Intelligence Division immediately, interviews the person re: personal info, circumstances of/reasons for asylum and if any criminal charges are alleged. Protection will be given until determination is made of status. (PG ). SERVICE OF FAMILY COURT/SUPREME COURT ORDERS OF PROTECTION (PG ) Police Officers will serve all Family Court ORDERS of PROTECTION and NYS Supreme Court OOP pertaining to matrimonial actions. ORDERS OF PROTECTION will be sent to the Precincts from the Patrol Borough. Each ORDER will have attached a STATEMENT OF PERSONAL SERVICE and a WARRANT OFFICER'S REPORT OF INVESTIGATION. DESK OFFICER - Verify that all ORDERS on Letter of Transmittal have been received. - Make an entry in the LOG maintained at the Desk containing captions identifying each ORDER and efforts made to serve the ORDERS. - Assign a M.O.S. to serve the ORDER. MOS - Attempt to serve the ORDER at any time 7 days, 24 hours a day. - If an ORDER is served, prepare STATEMENT OF PERSONAL SERVICE and then photocopy for delivery to the Domestic Violence Prevention Officer via the Desk Officer. - If unable to serve the ORDER: * Document each attempt on WARRANT OFFICER'S REPORT OF INVESTIGATION. * Make an ACTIVITY LOG entry of each attempt. * Return the ORDER and related forms to the Desk Officer at the end of the tour. NOTE: Service must be attempted at least once on each tour for 6 consecutive tours. After the sixth tour, the ORDER is considered undeliverable. The 1 st attempt will be made on the same tour that the ORDER is received. DESK OFFICER - Enter into the LOG one of the following four dispositions: * Served. * Undeliverable - not known at address. * Undeliverable - new address located outside of Command (if respondent has moved to a new address in the Precinct, service will be attempted for an additional 6 consecutive tours and a new LOG entry will be required). * Undeliverable - attempts completed on six consecutive tours. - Prepare STATEMENT OF PERSONAL SERVICE and write Not Served on top right corner, if not served. - Place Undeliverable ORDERS in LOG for DVPO to forward. DOMESTIC - Enter information into the State Order of Protection Registry upon VIOLENCE receipt of STATEMENT OF PERSONAL SERVICE via FINEST System. PREVENTION - Check LOG containing ORDERS on a daily basis. OFFICER - Forward to Boro STATEMENTS OF PERSONAL SERVICE and (DVPO) WARRANT OFFICER'S REPORT OF INVESTIGATION for ORDERS that are undeliverable.

60 Command Operations P.50 KSA NOTE: An Order is undeliverable if: * Respondent is not known at the address. * Respondent s new address is located outside of Command. (These Orders will be returned to Boro for forwarding to appropriate Command.) * Attempts were completed on 6 consecutive tours without success. (MOS should inquire of neighbors, superintendent, etc., as to respondent's whereabouts.) NOTE: Most Orders will be obtained from the Boro, but a petitioner may appear at the Precinct with an Order. The Desk Officer should: * Inspect the LOG to see if the Order has already been served. * If the Order has not been served, assign a MOS to serve the Order. Give the petitioner the completed copy of the STATEMENT OF PERSONAL SERVICE. Petitioner delivers to Family or Supreme Court clerk * Forward copy to DVPO. NOTE: Exclusionary Order of Protection. * UMOS may not assist in clothes jobs (removing clothing or property) if OOP prohibits: ~ Contact between petitioner and respondent ~ Respondent being present at location * Advise to have OOP amended to allow for removal of clothing, or to have property delivered. FIRE (PG ) MOS - Park RMP so as not to block FDNY operations. * Establish Police lines beyond fire apparatus and hydrants. (Beyond fire operations behind the building, if necessary.) * Ensure front of building is secured for FDNY & all hydrants are free of vehicles. - Direct responsible person to remain in front of location if fire is not in view. * Warn occupants & assist evacuated persons. * Prevent persons from reentering building & secure lobby. NOTE: UMOS are not trained in or equipped for fire suppression or rescue. * Avoid entering any building on fire in most cases & await arrival of FDNY. ~ If imminent danger to life, notify dispatcher prior to entry. Maintain communication with dispatcher frequently. Use stairs, NOT elevator, in teams of 2 officers. o Do NOT hold elevator on any floor - FDNY may need it. Advise dispatcher of labeled staircase or identifying characteristics if no label. Conduct visual inspection of stairwell for smoke or flames prior to ascending. o Inspect each floor below reported fire floor & note potential areas of refuge, e.g., other stairways, exits, etc. Conduct visual inspection of hallway of reported fire floor through stairway door window. o Place back of hand on door to detect heat. o Do NOT open hot door or if smoke is present.

61 Command Operations P.51 KSA - Communicate with FDNY, the number of MOS who entered building & last known location. - Prepare: * COMPLAINT REPORT if fire is suspicious * AIDED REPORT for each injured person * ACTIVITY LOG - all relevant info, including: ~ Location, time & persons displaced or injured ~ Cause of fire, extent of damage & any suspicion of arson (obtained from fire officer in charge) ~ Any dangerous condition - Permit only the following persons or vehicles to enter fire lines: * Ambulances * NYPD & FDNY vehicles * Mayor and car * Governmental agency employees/vehicles in performance of duty * Public Service Corporation employees/vehicles in performance of emergency duties * Persons holding unexpired press credentials * Red Cross personnel in performance of duty - Ensure premises are secure when firefighting operations are over. PATROL - Respond to all building/structure fires in command. SUPERVISOR * Confer with FDNY supervisor & advise MOS to evacuate/tactically retreat to predetermined exit if smoke & heat are suddenly present. - Notify Desk Officer and requests PDS if fire is suspicious. FIRST - Proceed immediately to FDNY Incident Command Post once established & SUPERVISOR remain until relieved or Post is demobilized. AT SCENE * Advise FDNY Incident Commander or number of MOS inside building, unit designation & last known location. DESK OFFICER - Notify Operations and the Borough if: CODE:? U F I R S T U - UNUSUAL type of fire F - FORCED entry by the Fire Department I - INJURY or death occurs R - RELOCATION of tenants S - SUSPICIOUS cause T - THREE alarms or more NOTE: 2 Alarm Fires * Duty Captain responds to ensure coordination and police services are provided. ~ Traffic Control ~ Perimeters ~ Designate a ranking member as communications liaison when appropriate. * Ranking NYPD MOS confers with ranking FDNY to determine if additional NYPD resources are required, e.g., Aviation or Harbor. ~ FDNY may request a fire officer be assigned to Aviation Unit to view fire. If above request made, notify Operations Unit & arrange for flight.

62 VERTICAL PATROL (PG ) Command Operations P.52 KSA VERTICAL PATROL The patrol of the interior hallways, stairways, and rooftops of selected multiple occupancy buildings - to detect illegal activity. COMMANDING - Confer with community to identify buildings appropriate for vertical patrol. OFFICER - Obtain permission of building owner/authorized agent to conduct verticals on private property. - Maintain lists of potential vertical patrol locations and update. - Monitor to ensure verticals are conducted in compliance with guidelines. - Evaluate results of verticals. * Make adjustments for efficient use of resources. PLATOON - Assign groups of 2 or more MOS to conduct vertical patrol at designated times COMMANDER and locations from Precinct list. * Determine number of 2 officer teams based on: ~ Size of Location ~ # and location of exits ~ Nature of crimes being addressed MOS - Transmit radio code signal 10-75V. - Commence vertical patrols whether or not a Supervisor is present. PATROL - Upon hearing 10-75V, respond to location and supervise. SUPERVISOR - Monitor by radio if unable to respond. INTERIOR VERTICAL PATROL OF HA BUILDINGS (PG ) WHEN CONDUCTING INSPECTIONS OF HOUSING AUTHORITY BUILDINGS: - Notify: * Communications by transmitting radio code signal 10-75V * VIPER unit by radio, if VIPER cameras present ~ Viper will advise of any known conditions affecting safety or requiring attention. - Inspect: * Lobby, including mailboxes * Elevators and elevator rooms ~ Notify HA Emergency Service Department (maintenance personnel) if inoperable. ~ Notify HA Emergency Service or NYPD ESU immediately and await repairs if: Elevator door glass is missing. Outer elevator door opens when elevator is not present. Other dangerous conditions. * Roof landings * Installations * Accessible basement areas * Each building on assigned post, alternating between outside area & interior vertical patrol - Work from Top to Bottom. * Take elevator to top floor and take staircase to roof. * Patrol each floor, staircase and hallway. * Be alert for loiterers or suspicious conditions. - Upon encountering a potentially unauthorized person, approach & ask if he/she: * Lives in building * Is visiting a tenant * Has business in building

63 INVESTIGATIONS OF ANIMAL ABUSE (PG ) Command Operations P.99 KSA SCOPE - All complaints of animal abuse will be investigated by NYPD. * MOS may arrest anyone violating Agriculture and Markets Law, Article 26, Section 371 ~ DATs may be issued except for offenses designated as Unclassified Felonies * Animals will be taken into custody to prevent cruelty COMPLAINTS RECEIVED FROM ASPCA VIA ANIMAL ABUSE PREVENTION LIAISON SOL - Assign MOS to investigate. COMPLAINTS RECEIVED VIA 311 TS OPERATOR - Dispatch as command assignment. IN ALL CASES p MOS - Respond & determine if law violated &/or animal needs to be removed. * If no violation, attempt to correct condition by instruction. * If offense committed, prepare COMPLAINT REPORT WORKSHEET. ~ If no further action required, condition corrected & no perpetrator identified, close complaint to patrol. ~ If ends of justice will not be met by taking law enforcement action (e.g., unintentional neglect due to hoarding): Notify ASPCA Hotline for referral to Cruelty Intervention Advocacy Program, & Close complaint to patrol ~ Refer major cases to Precinct Detective Squad ~ Refer complaints of organized crime involving animal abuse (e.g., animal fighting for gambling), to OCCB. * If animal needs to be removed, request patrol supervisor to scene. ~ Transport apparently abused animals to ASPCA. ~ Document removal in ACTIVITY LOG. Have person receiving animal at ASPCA sign LOG to document chain of custody. PATROL - Respond to scene if requested & verify animal needs to be removed. SUPERVISOR * If animal needs to be removed for investigation but probable cause does not exist, ask owner to voluntarily surrender animal. ~ Confer with Legal Bureau before attempting to obtain a WARRANT to remove animal. SOL - Query Omniform & 311 System weekly to ensure complaints of animal abuse are being investigated &/or referred appropriately * Take corrective action, if necessary. NOTE: Call ASPCA Hotline if assistance is needed to determine charges or for information re: care & handling of animal. When accepting a voluntary surrender from a person 18 years of age or older, have that person sign a statement in the ACTIVITY LOG, indicating age & understanding re: voluntarily giving up of all rights to animal. Animals are private property * Therefore, if no probable cause exists or surrender is not voluntary, MOS must obtain a WARRANT to remove animal.

64 ACTIVE SHOOTER RESPONSE PROTOCOL (PG ) Command Operations P.100 KSA ACTIVE SHOOTER - Person actively engaged in killing or attempting to kill people in a confined & populated area. SCOPE - Top priority is to make contact with the suspect(s) to end the threat. Aim is to prevent loss of life by limiting movement of suspect(s). WHEN A MOS RECEIVES A CALL FOR OR COMES UPON A CONFIRMED ACTIVE SHOOTER: MOS - Notify the radio dispatcher * Initially to request response of: ~ Patrol Supervisor ~ ESU ~ Hostage Negotiation Team (HNT) ~ Technical Assistance and Response Unit (TARU) ~ Bomb Squad (if not previously requested) * Later of existing conditions & exact entrance used to enter building ~ If unable to enter, notify dispatcher of blocked entrance location & cause. Responding units may have tools needed to gain entry - Park vehicle at location accessible to use as cover, while not impeding arrival of other emergency units. - Liaise with administrators, private security or anyone with knowledge of building s emergency protocols to obtain details of: * Nature of threat (e.g., time of entry, location & number of shooters, etc.) * Building s response protocol & whether it s been activated - Enter location, using tactical caution. * Utilize available means if doors are locked (e.g., crowbar, sledgehammer, etc.). ~ Notify dispatcher: If unable to gain entry & reason If able to gain entry of existing conditions & exact entry used To update advancement into location and location of suspect(s) & victim(s). * Initial responders should form Contact Teams of 2-4 UMOS & move towards suspect(s). * When practicable, identify self in a loud clear voice & state: Police! Don t move. - Be aware that: * Victims may be hiding, confused & frightened and may not respond to directions by MOS. ~ Note their location & types of injuries, but do not attempt to render aid until threat has been eliminated. * On/Off-duty plainclothes MOS or security personnel may be present. ~ These personnel should remain with UMOS during search or exit & assist in victim aid, evacuation &/or perimeter security. - Comply with Hostage/Barricaded Persons procedure if a hostage situation exists or if suspect is contained.

ADDITIONAL - Establish Rescue Team, using responding MOS, to coordinate evacuations & SUPERVISORS remove injured victims from location if adequate personnel are searching for ON SCENE or engaging shooter. - Assume role of Incident Commander if not needed to supervise Contact or Rescue Teams. 67 Mobilization/Emergency Incidents P.13 KSA LARGE SCALE ARREST PROCESSING PROCEDURE (PG 213-6) WHEN THE NUMBER OF ARRESTS IS, OR IS ANTICIPATED TO BE MORE THAN 20 INCIDENT - Have groups of no more than 20 prisoners with their arrest/assigned officers COMMANDER and 1 supervisor from the scene of arrest, transported to designated precinct(s) via Patrol wagon. NOTE: Patrol Borough establishes priority order list of precincts capable of processing up to 20 prisoners. NOTE: Every effort will be made to have arresting/assigned officers process no more than 5 prisoners and the arrest supervisors assigned no more than 4 arresting/assigned officers, when practical. - Ensure that arresting/assigned officers can articulate factual elements of the offenses charged. - Have desk officer of the processing precinct notified of the number of prisoners that are enroute for arrest processing. ARREST - Ensure that each prisoner is photographed with their arresting/assigned officer SUPERVISOR before boarding patrol wagon. * Affix a MASS ARREST PEDIGREE LABEL to each printed digital photo, with all relevant caption completed. (IO 17 s.04) - Contact the Incident Commander/Command Post, upon arrival at processing precinct, to verify if prisoners will be processed as on-line arrests or be issued DATs and/or Criminal Court Summonses. - Ensure that NYC, NYS and Federal warrant checks are performed. - Directly supervise all arrest processing. NOTE: The Precinct Arrest Processing Officer (APO) will assist the arrest processing supervisor and arresting/assigned officer in all computer functions and ensure all forms are prepared. The APO s primary role is to return the arresting/assigned officer to patrol during the event that led to the arrests. The arrest processing supervisor will designated another qualified MOS to Livescan all prisoners requiring fingerprinting. - Review and sign, where appropriate, all arrest related documents. - Contact Incident Commander/Command Post to receive approval before releasing any defendant via DAT or Criminal Court Summons. * Request transportation to Court for prisoners being processed on-line. NOTE: When a large scale arrest situation is anticipated, the commanding officer must notify the borough Court Section supervisor, via telephone message, of all pertinent information.

BOROUGH COMMAND - Have file created for plans at the Boro: * Wheel * Task Force * Command Post Vehicle. - Add Boro policies and procedures using appendix. - Ensure that plans are available on a 24-hour basis.

69 QUALITY OF LIFE COMPLAINTS TERMINAL (PG ) Quality of Life Matters P.23 KSA UPON RECEIPT OF A QUALITY OF LIFE COMPLAINT HAS BEEN RECEIVED THROUGH THE 311 TERMINAL OR TS: TS OPERATOR - Review the 311 terminal for duplication of requests received via phone. * Enter dispositions on the terminal and TELEPHONE DISPATCH LOG if duplicate. NOTE: Quality of Life Phone Calls * Accept but advise complainant to call 311 in future. * If call requires a referral to another City agency, direct complainant to call 311. MOS - Upon receipt of a 311 assignment code 10-61, notify Communications. - Respond ASAP except if on an emergency assignment. - Upon completion of assignment: * Notify Communications and Desk Officer. * Deliver completed 311 calls worksheet to the Desk Officer by end of tour. DESK OFFICER/ - Ensure that 311 terminal is checked at least every hour for any QOL PLATOON CMDR. Jobs received at the hotline. * Make COMMAND LOG entries for the inspections at the beginning and end of tour. - Requests for service will be dispatched as soon as resources become available except for those: * Deferred to the Special Operations Lieutenant (determined by desk officer) * Require an immediate response. NOTE: Any Quality of Life complaint that generates 5 or more calls within an 8 hour period will be assigned for an immediate 311 response. - Print 2 copies of 311 calls for each assignment to be handled by platoon. * Instruct assigned member to return with disposition by end of tour. * Maintain 1 copy with the assigned MOS recorded on each complaint. - Accept assignments that could not be completed during tour and reassign them to outgoing platoon. NOTE: Assignments that are either referred to the Special Operations Lieutenant and/or require the assistance of another governmental agency will be classified as deferred or open. Conditions that are no longer occurring because of limited duration will be closed with appropriate disposition. - File completed copy by date received in a binder at the desk with the appropriate disposition and assign a page number. * At the end of the month, remove from binder and file with completed TELEPHONE DISPATCH LOG. NOTE: 2 nd Platoon Desk Officer reviews terminal at 0800 hours for previous 24 hours to account for all dispositions. Investigate any discrepancies. SOL - Review deferred 311 complaints and ensure appropriate response and disposition. * Utilize command or other unit/agency resources.

ICO - Conduct investigation regarding integrity of 311 assignments. * Consult with SOL, Desk Officer and Commanding Officer. - Conduct random inspections and monitor outstanding dispositions. - Submit TYPE LETTERHEAD to Chief of Patrol s Resource Management Section for passwords to 311 terminal. COMMANDING - Review terminal for appropriate response and disposition. OFFICER - Confer with ICO and Desk Officer regarding outstanding dispositions. - Implement self-inspection procedures. - Ensure a list of locations deferred to SOL is maintained at the desk. NOTE: When additional caller information is necessary to address a condition, the CO, XO and SOL of a Precinct, PSA, or TD has the authority to access 311 System to retrieve anonymous caller information. RESPONSE TO COMPLAINTS OF VIOLATION OF NEW SMOKING BAN IN NEW YORK CITY (PG ) WHEN A MEMBER OF THE PUBLIC COMPLAINS THAT THE SMOKE-FREE AIR ACT IS BEING VIOLATED: - If there are no other violations, direct complainant to call 311 to have complaint forwarded to Dept. of Health. * Violations of this law are only enforced on a NOTICE OF VIOLATION RETURNABLE TO DEPARTMENT OF HEALTH issued by: ~ Department of Health ~ DCA ~ DEP ~ FDNY ~ Sanitation Department ~ Buildings Department NOTE: If a person refuses to leave a public premise after being ordered to leave by the person in charge of the premises, an MOS may enforce Trespass law. Smoking is Prohibited All enclosed or indoor areas of public places Certain outdoor locations, i.e., children areas and sports/recreation areas where tickets are issued for viewing. In any workplace, it is prohibited in indoor areas to which general public does not generally have access. Employers do not have option of establishing smoking rooms. Employees may not smoke in a private enclosed office. Company vehicle occupied by more than 1 person, whether or not occupants consent. Smoking is Permitted Hotel and Motel rooms Private homes except day care or health care (except separate smoking rooms for use by patients only and approved by Fire Commissioner) Private Vehicles Retail tobacco stores and bars Membership associations if approved by Health and Mental Hygiene Dept. Sidewalk cafes with no roof or ceiling, in an area no larger than 25% of seating capacity, at least 3 feet away from non-smoking area and clearly marked All vehicles owned by NYC. Events for promoting and sampling tobacco (limited to 2 days per year). * Electronic cigarettes are prohibited everywhere it is prohibited to smoke tobacco cigarettes. (IO 12 s.14) NOTE: UMOS can complain about violations of NYPD s smoke-free policy by preparing a SMOKING COMPLAINT FORM, which is forwarded thru the Smoking Policy Coordinator to the member s CO, who assigns the Operations Coordinator to resolve matter through informal resolution conference. (AG )

71 Quality of Life Matters P.25 KSA NYC DEPARTMENT OF BUILDINGS ACCESS WARRANTS (PG ) WHEN REQUESTED TO ACCOMPANY THE NYC DEPARTMENT OF BUILDINGS EXECUTING AN ACCESS WARRANT: DESK OFFICER - Review ACCESS WARRANT to ensure validity, i.e., Supreme Court Judge endorsement and expiration date. - Make COMMAND LOG entry consisting of: * Full name of NYC DOB inspector * Index number & issuing court * Address of location identified on Warrant NOTE: Make a 2 nd COMMAND LOG entry when inspection is completed. - Request Communications to assign an RMP to accompany inspector MOS - Enter premises with NYC DOB inspector and remain until inspection completed. * Notify the Desk Officer when inspection completed. NOTE: MOS will preserve the peace and prevent crime. The execution of the ACCESS WARRANT is the sole responsibility of the NYC DOB Inspector. Under no circumstances will an MOS assist in breaking door or damaging property to execute WARRANT or gain access. * If access to premises is denied, the NYC DOB will reschedule execution of ACCESS WARRANT. INSPECTIONS OF PAWNBROKERS AND SECOND-HAND DEALERS (PG ) SOL - Maintain an updated list of all pawnbrokers and 2 nd -hand dealers in precinct * Divide into 2 categories, i.e., stores that: ~ Enter records in Electronic Reporting System ~ Maintain manual records * Provide copy of list t: ~ Commanding Officer ~ Executive Officer ~ Detective Zone Commanding Officer ~ Field Intelligence Officer ~ Other specialty unit supervisors, as appropriate - Designate UMOS as a liaison with pawnbrokers & 2 nd -hand dealers DESIGNATED - Provide each pawnbroker & 2 nd -hand dealer with SECOND-HAND ARTICLES UMOS STORE LOG if store does not participate in Electronic Reporting System. * Provide 2 nd -hand dealers with INSTRUCTIONS TO DEALERS IN SECOND- HAND ARTICLES in all cases. - Visit each store maintaining manual records at least once every 10 days & sign SECOND-HAND ARTICLES STORE LOG. * Remove Precinct Detective Squad (pink) copy of completed transactions from LOG, if applicable, and deliver to Squad Commander. CRIME - Review list & visit all pawnbrokers and 2 nd -hand dealers in precinct. PREVENTION * Encourage use of Electronic Reporting System (ERS) OFFICER * Monitor ERS to ensure that participating stores are uploading data daily.

(CHIEF OF DEPARTMENT 4 s.91) - Flag burning is a constitutionally protected form of free speech. - NYS GENERAL BUSINESS LAW, Section 136, which prohibits burning, defacing, defiling, or trampling on the American flag, will not be enforced. - NYC ADMINISTRATIVE CODE, Section , which prohibits igniting or maintaining an open fire anywhere within NYC, will be enforced under the following guidelines. * Only if the fire poses a clear and present danger to persons or property. * Only with approval of ranking Officer. * Summons must contain very specific language that demonstrates the danger posed by the open flame, including: ~ The direction that the flame traveled. ~ The number of persons or establishments threatened. ~ The size of the flag. ~ The proximity of ashes, smoke or flame to other persons or objects. * Ranking Officer will assure that MOS makes detailed notes in his ACTIVITY LOG of the circumstances of the fire and the legitimate danger posed to persons or property. * Ranking Officer will verify and sign ACTIVITY LOG.
