Superintendent ofschools Dear Parents/Guardians; As you may be aware thecedar Grove Board of Education approved a revised policy #9180 for"school Volunteers" at ourmarch 6, 2012 board meeting. Commencing September 1,2012 any person that may want to serve inthecapacity ofanunpaid school volunteer in any district school building during the operation ofthe school day while students are present, shall berequired to complete a criminal historyrecord check prior to any volunteer service. As per policy,a "volunteer" is a person who is not paid by the Board of Education, who assists classroom or other school activitiesunder the direct supervision of an appropriately certified or licensed school district employee, and provides assistance for school activities ona "regular basis" throughout the school year. A"regular basis" means volunteering services more than three (3) occasions during a school year. All volunteers must be approved bythe Board of Education prior to commencing their service as a volunteer. Our building principals will assist me in screening/selecting volunteers fortheir building and will recommend volunteers to my office. Initial volunteers will make anappointment toschedule a criminal history background check. Then each volunteer will contact my office for an appointment tocomplete the necessary state paperwork. Once the criminal history background check is approved bythestate, the volunteer will thenbe approved bythe board of education. Each building principal will be responsible to monitor each of his/her volunteers throughout the school yearby requiring the volunteer to sign-in/out during each school visit. No one canvolunteer their services until the Division of Criminal History Review Unit approves the volunteer's application. All unpaid volunteers will beprocessed for background checks via MORPHOTRAK atthe cost of$26.00 payable to Morphotrak at the time offingerprint scheduling. There will also bean$11.00 processing fee that will be paid to thestate ofnew Jersey bycredit card in my office. TheBoard of Education will reimburse the volunteer forall costs of the criminal history record check in accordance with N.J.S.A. 18A: If you are a present NewJersey employee of a school district and were fingerprinted after 1993, please call our offices to have your fingerprints "archived" from the Division of Criminal History fora onetime processing fee of $33.55, in myoffice by credit card. In addition, for your convenience, I have also attached for your review the NJSA 18A Statute 18A:6-7.1 that outlines what offenses disqualifies a volunteer should there be a record of conviction for anycrime of the first or second degree. Ifyou are interested in becoming a school volunteer in your child's school for the school year, please notify the building principal of yourchild's school forapproval before theendof June Thebuilding principals will forward to methose volunteers thattheyare recommending for approval. 2 Volunteer Instruction Sheet: Below arethe instructions that need to be followed for the fingerprinting process. 1. Please print Morphotrak form and fill in boxes Call (877) to set up a finger printing appointment in Parsippany, and be prepared to pay$26.00 by phone to Morphotrak for finger printing processing. (Visa / MasterCard). Bringthis form and Driver's license to your appointment. 2. After the finger prints are taken the volunteer must call ( ) and ask for Ms. Lombardito set up an appointment at the Superintendent's office between the hours of 9-2p.m. Monday - Thursday, to continue the process by bringingthe items listed below: PCN receipt given to you from Morphotrak Morphotrak form Drivers' License Social Security Number Visa, Master Card, Discover or American Express credit card (to pay the State fee of$11.00) - Superintendent's office will do this in the office. 3. Superintendent's office will check criminal history web site for completed status of paperwork, then print a copy of the approved status, and finally place the Volunteer's name on the agenda to be approved at the next BOE meeting. 4. The Last step is to submit a copy of the Criminal History letter (which will be mailedto your home from the state of New Jersey) to our office. When the Superintendent's office receives a copy of your letter, the Volunteer will then be notified they are allowed to volunteer in the schools. The Superintendent's office will only process reimbursement after receipt of the Criminal History letter. If you havealready been fingerprinted for the field of education (after February 1993), archiving may be possible for a reimbursable amount of $33.55, please contact the Superintendent's Office. Acceptable ID MUST meet all of the underlined requirements above and MUST be present on one (1) ID. Combinations of documents are NOT acceptable. If acceptable ID is not presented you will not be fingerprinted. Forapplicants who are required to pay for their own fingerprinting fees, paymentis required at the time of scheduling. Payment may be made with a credit card or electronic debit from a checking account. Remember youraccount will automatically be debited. An $11 fee is charged to cover the cost ofa scheduled appointment for applicants who do not cancel/reschedule by noon on the business day prior to yourscheduled appointment (Saturday noon for Monday appointments). All appointments can be canceled/rescheduled via the web without penalty ifcancellation requirementsare met. The $11 fee will also applyforapplicants who are turned away from the printing sites due to the inability to present proper ID, who fail to present this completed Universal Fingerprint Form provided to you by your requesting agency or employer, or who are turned away because information on this form does not match the information provided during the scheduling process. You will be refunded State and Federal search fees only. Appointment scheduling is available via the web at 24 hours per day, 7 days per week. For applicantswhodo not have web access, appointments can be made by contacting us toll free at (877) on a first call, first served basis Monday through Friday, 8:00 AM to 5:00 PM EST and Saturday, 8:00 AM to 12 noon EST. English and Spanish speaking operators are available. Hearing impaired scheduling is available at (800) ONLY applicants who schedule through the call center can make payment by money order at the fingerprint site. No other form of payment is accepted at the fingerprint site. Your APPLICANT ID, Site, Date, Timeof your appointment, and payment authorization will be confirmed by the call center agent or web confirmation when scheduling is complete. You must record this information in the appropriate blocks below while speaking with the operator. Ifyou appear for fingerprinting at a site where you are notscheduledor on a different date and time, you will be turned awayand not fingerprinted. If applicable, you may incur the $11 appointment fee. Your PCN numberwill be recorded when your fingerprinting has been completed. 4 NJSA 18A Statutes 18A: Criminal record check in public school employment, volunteer service Chapter: Provisions Relating to Educational Institutions and Systems Date Created: October, 1986 Date Edited: September, A facility, center, school, or school system under the supervision of the Department of Education and board of education which cares for, or is involved in the education of children under the age of 18 shall not employ for pay or contract for the paid services of any teaching staff member or substitute teacher, teacher aide, child study team member, school physician, school nurse, custodian, school maintenance worker, cafeteria worker, school law enforcement officer, school secretary or clerical worker or any other person serving in a position which involves regular contact with pupils unless the employer has first determined consistent with the requirements and standards of this act, that no criminal history record information exists on file in the Federal Bureau of Investigation, Identification Division, or the State Bureau of Identification which would disqualify that individual from being employed or utilized in such capacity or position. An individual employed by a board of education or a school bus contractor holding a contract with a board of education, in the capacity of a school bus driver, shall be required to meet the criminal history record requirements pursuant to section 6 of P.L.1989, c.104 (C.18A: ). A facility, center, school, or school system under the supervision of the Department of Education and board of education which cares for, or is involved in the education of children under the age of 18 may require criminal history record checks for individuals who, on an unpaid voluntary basis, provide services that involve regular contact with pupils. In the case of school districts involved in a sending-receiving relationship, the decision to require criminal history record checks for volunteers shall be made jointly by the boards of education of the sending and receiving districts. An individual, except as provided in subsection g. of this section, shall be permanently disqualified from employment or service under this act if the individual's criminal history record check reveals a record of conviction for any crime of the first or second degree; or a. An offense as set forth in chapter 14 of Title 2C of the New Jersey Statutes, or as set forth in N.J.S.2C:24-4 and 2C:24-7, or as set forth in R.S.9:6-1 et seq., or as set forth in NJ.S.2C:29-2; or b. An offense involving the manufacture, transportation, sale, possession, distribution or habitual use of a "controlled dangerous substance" as defined in the "Comprehensive Drug Reform Act of 1987," NJ.S.2C:35-1 et al. or "drug paraphernalia" as defined pursuant to N.J.S.2C:36-1 et seq.; or c. (1) A crime involving the use of force or the threat of force to or upon a person or property including, but not limited to, robbery, aggravated assault, stalking, kidnapping, arson, manslaughter and murder; or (2) A crime as set forth in chapter 39 of Title 2C of the New Jersey Statutes, a third degree crime as set forth in chapter 20 of Title 2C of the New Jersey Recklessly endangering another person Terroristic threats Criminal restraint Luring, enticing child into motor vehicle, structure or isolated area Causing or risking widespread injury or damage Criminal mischief Burglary Usury Threats and other improper influence Perjury and false swearing Resisting arrest Escape Bias intimidation or N.J.S.2C:12-2 NJ.S.2C:12-3 N.J.S.2C:13-2 P.L1993, c.291 (C.2C:13-6) N.J.S.2C:17-2 N.J.S.2C:17-3 N.J.S.2C:18-2 N.J.S.2C:21-19 N.J.S.2C:27-3 N.J.S.2C:28-3 N.J.S.2C:29-2 N.J.S.2C:29-5 N.J.S.2C:16-1; (3) Conspiracyto commit or an attempt to commit any of the crimes described in this act. d. For the purposes of this section, a conviction exists if the individual has at any time been convicted under the laws of this State or under any similar statutes of the United States or any other state for a substantially equivalent crime or other offense. e. Notwithstanding the provisions of this section, an individual shall not be disqualified from employment or service under this act on the basis of any conviction disclosed by a criminal record check performed pursuant to this act without an opportunity to challenge the accuracy of the disqualifying criminal history record. f. When charges are pending for a crime or any other offense enumerated in this section, the employing board of education shall be notified that the candidate shall not be eligible for employment until the commissioner has made a determination regarding qualification or disqualification upon adjudication of the pending charges. g. This section shall first apply to criminal history record checks conducted on or after the effective date of P.L1998, c.31 (C.18A:6-7.1c et al.); except that in the case of an individual employed by a board of education or a contracted service provider who is required to undergo a check upon employment with another board of education or contracted service provider, the individual shall be disqualified only for the following offenses: (1) any offense enumerated in this section prior to the effective date of P.L.1998, c.31 (C.18A:6-7.1c et al.); and (2) any offense enumerated in this section which had not been enumerated in this section prior to the effective date of P.L.1998, c.31 (C.18A:6-7.1c et al.), if the person was convicted of that offense on or after the effective date of that act.

5 T^i^vT T/^xr I^OJLIC/ Y CEDAR GROVE BOARD OF EDUCATION COMMUNITY 9180/Pagel of2 SCHOOL VOLUNTEERS 9180 SCHOOL VOLUNTEERS The Board ofeducation recognizes the services ofvolunteers can enrich the educational program, assist teaching staff members in the performance of their duties, and enhance the relationship between the school district and the community. The Board authorizes a program for the utilizationof volunteer services in the school(s) of the school district. An unpaid volunteer, as defined below, shall be required to complete a criminal history record check. The Board of Education shall reimburse the volunteer for the cost of the criminal history record check in accordance with the provisions of N.J.S.A. 18A: For the purpose of this Policy, a "volunteer" is a person who is not paid by the Board of Education, who assists with classroom or other school activities under the direct supervision of an appropriately certified or licensed school district employee, and provides assistance for school activities on a "regular basis" throughout the school year. For the purpose ofthis Policy, "regular basis" means volunteering services more than 3 occasions during the school year. For the purpose of this Policy, a "volunteer" is not a person who is invited into a school and provides occasional assistance for school activities, chaperones a class trip, or assists with classroom or other school activities less than 5 occasions during the school year. The Superintendent or designee shall determine if a person meets or will meet the requirements to be a "volunteer" for the purpose ofthis Policy. A volunteer must be approved by the Board upon the recommendation of the Superintendent. The Principal or designee shall be responsible for the recruitment and screening of volunteers, may delegate the assignment of volunteers to specific tasks, and must submit their names for Board approval. Volunteers must be persons of known character, responsibility, and integrity Neither the Superintendent nor any Principal shall be obligated to utilize the proffered services of a volunteer whose abilities or interests do not servethe needs of pupils.

The following guidelines shall govern the service of school volunteers: 1. Volunteers may serve only under the direction and supervision of an appropriately certified or licensed staffmember; 2. Volunteers should clearly understand their duties and responsibilities and perform no service outside those duties; 3. Volunteers serve only in a support capacity; only appropriately certified or hcensed staff members are responsible for educational planning and decisions and the teaching of new concepts; 4. Volunteers shall respect the individuality, dignity, and worth of eachchild; 5. Volunteers are not permitted access to pupil records; 6. Volunteers should exercise discretion in discussing their school activities with others in the community and must maintain confidential any information that if disclosed would violate Federal and State laws; 7. Volunteers may consult with the Principal regarding their duties and responsibilities; and 8. Volunteers shall receive no financial remuneration from the Board.
