1 GOVERNMENT OF JAMMU AND KASHMIR GENERAL ADMINISTRATION DEPARTMENT (Establishment Section) Civil Secretariat, Jammu/Srinagar ***** Subject:- Seniority lists of the various categories of officials belonging to J&K Secretariat (Subordinate) Services as on Government Order NO:%?-GAD of 2014 Dated : S Whereas, the last seniority list of the members of the J&K Secretariat (Subordinate) Services with reference to l3 January, 2013 was notified vide Notification No. GAD(Estt)Misc-1/2013 dated ; and Whereas, during the process of updation of the seniority list as it stood on , representations were received from Mr. Kabir Ahmad and Mr. Raj Kumar, Head Assistants posted in the General Administration Department, who were aggrieved with their positions assigned to them in the seniority list of Junior Assistants for the year , as according to them, their position was not assigned in accordance with the merit obtained by them during the selections made by the Service Selection Board; and Whereas, these employees had also, in support of their claim, attached documents obtained from the Service Selection Board under the Right to Information Act, substantiating their claim that despite their superior claim they were not shown appropriately in the select list by the Service Selection Board, causing disadvantage to them; and Whereas, the matter was examined denovo with reference to the records and in consultation with the Service Selection Board, and it was found that the Services Selection Board had not drawn the select list in accordance with the proviso to Rule 31 of J&K Reservation Rules notified vide SRO 294 of 2005 dated 213 October, 2005 as the applicants, though with the superior merit, were not shown in the

2 OM category as they should have found place in the select list on the basis of the merit obtained by them and that the seniority so assigned to them was not in accordance with Rule 24 of the J&K, Civil Services (Classification, Control and Appeal) Rules 1956; and Whereas, during examination, it has also been observed that both the officials along with other officials appointed earlier on the basis of the select list of 2007 who were, otherwise, eligible & had qualified the 'Secretariat Assistant Training Course'were promoted to next levels viz Senior Assistants and Head Assistants and all such candidates are at present Head Assistants working in the Civil Secretariat; and Whereas, it has, accordingly, been decided to rework the seniority of the Junior Assistants appointed vide Government Order No. 658-GAD of 2007 dated , pursuant to the recommendations of the Service Selection Board, based on the merit obtained by them in the Service Selection Board, necessitating further changes in the seniority positions assigned to the candidates at the level of Junior Assistants/Senior Assistants, thus warranting year wise changes in the seniority lists notified vide Notification Nos. 3 Any member(s) of the service aggrieved with the position assigned to the officials figuring in Annexure-B from Sr. No.144 to 192, Annexure-C from Sr.No.110 to 116 and in the Statement appended as "X" of this Order shall submit a Review Petition within 15 days from the date of issue of this Order failing which, no such, Review Petition shall be entertained and the seniority position, so assigned shall remain unchanged and deemed to have been treated as final. The date(s) of birth recorded against the officials in the above seniority lists shall not be taken as authentic and shall be subject to further verification from the Service Books/Matriculation certificates issued from the J&K State Board of School Education/Central Board of Secondary Education (whichever applicable). The Reserved Category status mentioned against the officials in the seniority list shall also not be taken as authentic and shall be subject to receipt of the authentication report about genuineness of the same from the concerned issuing authorities (in respect of the case where it has not been obtained so far before considering their promotion against the said category slot). In case the category certificate produced by any official proves to be falselfake, the Government shall cancel it with all benefits which the official would have availed on the basis of such falselfake certificate.
