Enclosed are documents that strongly suggest that the Intelligence activity on this Army Post warrants its re-location to another military installation where its day by day unclassijied activities can be more closely watched by others, including the general public and our nation's print and electronic media. That re-location might best be to an installation in the area of the District of Columbia. Transparency in terms of its activities that are unclassifed would be a positive step in the right direction. Enclosed are documents that show that two Army Public Affairs General Officers have elected to ignore the requirements of the Freedom of Information Act by failing to even acknowledge receipt of certified mail regarding misconduct at the United States Army Intelligence Center and Fort Huachuca including matters such as "black files" on US citizens and lawfblly admitted permanent residents (these files were protected under an order of the United States Courts), unlawful representations of government employees in violation of the Westfall Act, unlawful wire taps, the use of the "Attorney Work Product Doctrine" to conceal unlawful activity, and other matters.
3 Fort Huachuca is an asset to our nation and warrants remaining open given its electromagnetic environment and its air and land space. There is no reason why all other functions could not remain in place. The vacancy left by the Intelligence Center could be taken up by some other Army or DOD activity, or some other federal function. In fact, it might make an excellent training location for certain activities of the Department of Homeland Security such as those mandated to the Border Patrol along the US-Mexico Border. The fact of the matter is that the Intelligence Center and School could even be located on an existing Air Force, Navy, or Marine Corps facility with little reduction in capability to perform its &w_fuz missions. There is reason to believe that unknown parties decided, possibly with the concurrence of others, or at the direction of others, to the delivery of US mail to persons to whom the correspondence was addressed. That deliberate withholding of correspondence h m the intended parties and the failure to meet statutory requirements warrants this immediate appeal to your office. Although your requests were addressed to Brigadier General Gaylord and Brigadier General Brooks, none were received by the Office of the Chief of Public Affairs, possibly because you mailed them to Fort Huachuca, and not to the Office of the Chief of Public Affairs in the Pentagon. In any event, the Chief of Public Affairs is not responsible for the Freedom of lnformation Act release of any records outside of the immediate Office of the Chief of Public Affairs. Our office will have no access to any such records, if they in fact exist. Public Affairs officers at subordinate Army commands and installations work directly for their command or installation, and do not report to the Army Chief of Public Affairs.
