1 S.I No. The Civil Establishment Act Cap. 2 THE CIVIL ESTABLISHMENT (GENERAL) ORDER, 2005 The Minister in exercise of the powers conferred on him by section 2 of the Civil Establishment Act, makes the following Order:. This Order may be cited as the Civil Establishment (General) Order, () In this Order, appropriate Service Commission means the Judicial and Legal Service Commission, the Police Service Commission or the Public Service Commission as the case may be; artisan means the post of carpenter, mason or painter; code number means the letter of the alphabet together with the number, if any, appearing in the second column of Schedule A and in the first column of Schedule B; established office means any office established under paragraph 3; Schedule A. Schedule B. former Order means the Civil Establishment (General) Order, 2004; 2004/36. (Q.B.) signifies a qualification bar; (E.B.) signifies an efficiency bar; - means to. 2 2 (2) Where the emoluments of an established office are on a scale divided into segments by the symbol :, no officer holding any office is entitled to any emoluments of that scale beyond the point at which the symbol appears until after such time as the Governor-General determines in relation to offices of that class. (3) The powers conferred on the Governor-General by sub-paragraph (2) and by paragraphs 5 and 6 are to be exercised by him in accordance with the recommendation of the appropriate Service Commission. Schedule A. 3. () Subject to sub-paragraph (2), the offices specified in the first column of Schedule A are established as offices in the public service; and the numbers of those offices are specified in the third column opposite thereto. (2) Sub-paragraph () does not apply to the offices of Director of Public Prosecutions and Auditor-General that are established by sections 79 and 3 respectively of the Constitution. Schedule B. () Subject to sub-paragraph (3) and paragraph 0, the emoluments specified in the second and third columns of Schedule B opposite to the code number appearing in the first column of that Schedule, are the annual emoluments attached to the office specified in the first column of Schedule A opposite to which in the second and third columns of that Schedule the same code number appears; and those emoluments are payable to every officer holding the office according to the rates specified in the second and third columns of Schedule B, except that the emoluments of an officer appointed to act in a senior office shall be determined in accordance with such conditions as may be specified by the Minister. (2) Any officer who on 3 st March, 976 held an office specified in the first column of Schedule D to this Order is entitled to receive the annual emoluments denoted by the code number specified opposite thereto in the second column.

3 3 (3) Any officer who on 3 st March, 984, held an office specified in the first column of Schedule E is entitled to receive the annual emoluments denoted by the code number specified opposite thereto in the second column. (4) Any officer who on 7 th May, 990, held an office specified in the first column of Schedule F is entitled to receive the annual emoluments denoted by the code number specified opposite thereto in the second column. (5) Any officer who on 4th November, 2004 held an office specified in the first column of Schedule G and who received the annual emoluments denoted by the code number specified opposite thereto in the second column is entitled to receive those annual emoluments after the commencement of this Order. (6) Any officer who immediately before the commencement of this Order held an office specified in the first column of Schedule H and who received the annual emoluments denoted by the code number specified opposite thereto in the second column is entitled to receive those annual emoluments after the commencement of this Order. 5. () No officer holding an established office, the emoluments of which are on a scale divided into segments by an efficiency bar, is entitled to receive any emoluments of that scale beyond the point at which the efficiency bar appears unless that officer passes such examination as the Governor-General approves. (2) Where the emoluments of an established office to which this sub-paragraph applies are on a scale, no officer holding any such office is entitled to be advanced to a higher point in that scale until Schedule E. Schedule F. Schedule G. Schedule H. (a) (b) after such period of service in the office as the Minister determines; and after passing such examination as the Governor-General approves. 4 4 (3) Sub-paragraph (2) applies to such offices established by this Order as the Minister determines. Schedule A. Schedule A. Schedule C. Schedule C. 6. () Where a recommendation is made to the Governor- General that a member of the Police Force of or below the rank of Inspector should be reduced in rank, the Governor-General may act in accordance with that recommendation notwithstanding that the demotion to a lower office of that member of the Police Force would result in the number of officers holding that lower office exceeding the number specified opposite to that office in the third column of Schedule A, if the number of officers holding the office from which the officer is to be demoted and the number of officers holding the office to which the officer is to be demoted would not together exceed the total number of the offices specified in the third column of that Schedule. (2) Where an office in the Police Force of or below the rank of Inspector is vacant and no member of the Police Force is appointed on promotion to fill that vacant office, then, so long as that office remains vacant, an appointment may be made to any office in the Police Force below the rank of the vacant office notwithstanding that the making of that appointment would result in the number of officers holding the lower office exceeding the number specified opposite to that office in the third column of Schedule A. 7. () An officer who, after the coming into force of this Order, is appointed to hold or act in an office specified in the first column of Schedule C is in addition to the emoluments payable under paragraph 4, eligible for the payment of the fees and allowances specified in paragraph (a) or (b), opposite thereto in the second column of that Schedule, if that officer gives notice in writing at the date of assuming duty to the Permanent Secretary, the Ministry of the Civil Service, of an option to take either of the fees and allowances so specified. (2) Where an officer to whom sub-paragraph () applies fails to signify an option within the time limited by that sub-paragraph, the fees and allowances specified in paragraph (a) in the second column of Schedule C in addition to the emoluments payable under paragraph 4, are payable to that officer.

Subject to paragraph 9, this Order does not apply to any person who at the date of its publication in the Official Gazette is the holder of an office established by the former Order and by this Order, and who not later than 3 months after that date, or within such further period as the Permanent Secretary, Ministry of the Civil Service in any special case allows, gives the Permanent Secretary, Ministry of the Civil Service a notice in writing of a desire to be exempted from the provisions of this Order. 9. Notwithstanding this Order, where a notice is given under paragraph 8, the person by whom the notice is given is, during such time as the person continues in the office held at the date of giving the notice, entitled to enjoy the rights, and is subject to the terms, conditions and liabilities, applying to that office before the commencement of this Order. 0. () The emoluments according to the rates specified in the second and third columns of Schedule B have effect from the dates indicated therein. Schedule B. (2) Where an office specified in the first column of Schedule A is established after st April, 2004, the annual emoluments attached to that office are payable with effect from the date of the establishment of that office. (4) Where an office established by the former Order and in existence on st April, 2004 is abolished, then, if the holder of that office is appointed to an established office other than an office established in place of the abolished office, in this sub-paragraph referred to as the new office that person is, in addition to any emoluments payable in respect of the new office, entitled to receive for the period from st April, 2004 to the date of the appointment to the new office, the annual emoluments attached to an office specified in the first column of Schedule A opposite to which the second column of that Schedule a code number appears corresponding to the code number of the abolished office. (5) Where an office established by the former Order and in existence on st April, 2004 is abolished, then, if the holder of that office is not a person described in paragraph 3 or 4, that person is entitled to the increases in emoluments attaching to that office prior to the abolition as if the office had not been abolished. Schedule A. 2004/36.. The offices set out in the first column of Schedule A with a indicating a "C" Scale appearing opposite those offices are deemed to have been established on the st day of December, The Civil Establishment (General) Order 2004 is revoked.
