1 .. SOUTH DAKOTA POLICE CHIEFS ASSOCIATION An Affiliate of the South Dakota Municipal League Business meeting minutes Wednesday, January 17, 2018 SDML Conference Room, Ft. Pierre, SD Chief Lee McPeek (Watertown) called the meeting to order at 10:00am (CST). A list of those in attendance is attached. Presenters: Governor Dennis Daugaard reviewed the status of Criminal Justice Reform, including information about functional family therapy being available statewide, increased sanctions for re-occurring drug users on probation, as well as cognitive substance abuse treatment and other types of treatments reducing recidivism of drug abuse crimes. He also went over stats related to the closure of STAR Academy. The Governor reiterated his continued support of the state s current concealed carry laws. DCI Director Bryan Gortmaker provided information on the following: * status of Elder Abuse unit referrals. * 3,390 arrests related to meth in 2017 and described the various drug units across the state, including those in cooperation with the Highway Patrol. * Recent launch of the Blue Alert program to provide information to the public about at large individuals who have taken aggressive action against law enforcement officers and are a danger to the public. * The future Criminal History Information Exchange Format (CHIEF) program will provide a consistently formatted database for all 50 states to look up criminal history. * The LET Academy is exploring ways to continue to provide spots to all law enforcement officers that request training. SD Attorney General Marty Jackley spoke on the bills that his office is bringing this legislative session including one that increases the level of crime by one level for crimes that include drug distribution. Another bill provides for a mandatory sentence for certain drug crimes. SD DOC Secretary Denny Kaemingk provided prison population data for Kaemingk discussed issues with having too many inmates in low medium and minimum security units in the state. HB 1052 will allow the Executive Director of the Board of Pardons and Paroles to issue a warrant in the event of an escape from extended confinement. Mike Waldner, BIT, FirstNet The Governor recently opted into the FirstNet program. AT&T won the national bid to place FirstNet equipment in states. There will be 38 new towers placed in SD. All first responders and others can be on the FirstNet system that will prioritize their calls over all others that are accessing the cell tower. 2 Jeff Pierce, BIT, State Radio See attached Document Business Meeting A motion was made by Chief Headid (North Sioux City) and seconded by Chief Schuler (Eagle Butte) to approve the October 2017 minutes as presented. All approved. A motion was made by Chief Kull (Brandon) and seconded by Chief Schueth (Winner) to approve the financial statement as of December 31, 2017 as presented. All approved. Chief McPeek asked about a mentoring update. There was nothing new to report. SDPCA Membership Dues- The list of those that have paid dues was shared. Please pay your dues as soon as possible. Dues notice will be sent out for those who have not paid. Liaison Committee Updates: Joint Awards Committee - Chief McPeek requested a volunteer to serve on the Joint Awards Committee, to replace retired Chief Jeff Miller. Chief Schuler volunteered to serve on this committee. The nomination form for the Joint Awards is due by March 1 st. Attorney General s 24/7 Committee- Chief Schueth (Winner) provided a handout that displayed the success of the PBT, U/A, Drug Patch, Scram Bracelet, and Ignition Interlock programs. SD 911 Coordination Board- Chief McPeek (Watertown) reported that all PSAPS have new equipment, however not all have been deployed yet. South Dakota Law Enforcement Standards & Training Commission Chief Burns (Sioux Falls) reported that the SD LET will now re-certify canine teams in the state. South Dakota Public Safety Communications Council Chief Kull reminded Chiefs to get a budget in place ahead of time for radio upgrades to P25. This will need to happen by 2023 to maintain State Radio functionality. Honorary Lifetime Memberships: A motion was made by Chief Overweg (Mitchell) and seconded by Chief Burns to nominate retired Chiefs Jeff Miller (Brookings), Denny Meyer (Huron) and Dave Panzer (Pierre) for Honorary Lifetime Memberships to the SDPCA. All approved. Legislative Update: Yvonne Taylor, Executive Director of the SDML gave a legislative overview of bills currently posted. Weekly updates will be sent out to the entire SDPCA membership from the SDML. Please respond back with any comments or questions as soon as possible regarding requests for a position on bills. A motion was made by Chief Burns and seconded by Chief Headid to support SBs All approved. A motion was made by Chief Overweg and seconded by Chief Kull to support HB1052, SB 20 and SB 32. All approved.

3 Chief Burns requested a vote of support for a bill that will be coming to enhance penalties for crimes that are committed as part of gang activity. Chief McPeek made a motion and was seconded by Chief Schuler to support this bill. All approved. HB 1052 Authorize the executive director of the Board of Pardons and Paroles to issue a warrant in the event of any escape from extended confinement SB 20 Enact the State and Providence Emergency Management Assistance Memorandum of Understanding SB 32 Place certain substances on the controlled substances schedule and to declare an emergency SB 61 - Revise certain provisions regarding sex offender registration SB 62 - Provide for the notification related to a breach of certain data and to provide a penalty therefor SB 63 - Revise certain prohibitions regarding methamphetamines and to create a mandatory penalty for a violation thereof SB 64 - Revise certain provisions related to attempted human trafficking in the first degree and to provide a penalty therefor SB 65 - Revise certain provisions regarding drug deliveries that result in death and to provide a penalty therefor Next Meetings: The next meeting of the SDPCA will be at the Joint meeting of the Chiefs and Sheriffs April 17-19, 2018 at The Lodge at Deadwood. Business meeting will be on Tuesday the 17 th. The tentative date for the SDPCA to meet during the SDML Annual Conference will be October 3rd in Pierre from 1:00-4:00 pm. 4 2018 SDML Chiefs Meeting FirstNet 1. South Dakota has opted into the National Public Safety Broadband Network which means: Qualified First Responders will be able to purchase cellular voice and data services that will allow a priority service during routine operations, and during times when the system might become congested, first responders can preempt the general public for access to those services. We are working on the addendum to the NASPO collective purchasing agreement for these services, and as soon as we get that signed that service will be available. For responders currently using ATT this is a no-brainer as the subscription cost is less, and you will have the added priority and pre-emption capabilities. For Verizon or other service subscribers, before committing to this, ensure that you have adequately tested and that the service meets your needs. Can use existing devices, hardened devices are available. This is not a radio system replacement for the foreseeable future. Device and system capabilities are not up to what first responders expect at this time, coverage. Nationally and locally this is being presented as an auxiliary service. As part of the state agreement, 38 additional sites will be constructed over the next 5 years in our state, many in western SD. So hopefully improvements for that side are coming. Be careful about coverage maps that might be shown you, most of you know what your local coverage is and are the best judges of how to interpret what might be shown you. We have asked our SD FirstNet rep to provide a conservative map, the national maps used in their campaign are very optimistic. Pricing, standard phone for voice & text is $41.99, for a standard phone that can be used as a hotspot $51.99, and for a data only device such as a mifi, that is $36.80/month. Their unlimited plan means up to 22gb. Radio System We are still planning with Motorola for a system upgrade starting in July What this means to you is that all radios will need to be P25 READY by that date. This should be the last major upgrade for around the next 20 years, or the life cycle we got out of the current system.

5 What P25 ready means is that radios will have the P25 software loaded, and a second profile in each radio. Our goal is to convert all sites in a particular region, have the users switch to the P25 profile. There will be a short period of time where users will need to switch back and forth along the edge of a region, but we will minimize that as much as possible. All traffic through the system will continue to flow to all sites. We are currently in process to purchase the P25 capability for our system. As soon as we get that, we will begin working with radio shops, our SRC staff, and whomever wants to participate in creating a code-plug that will have common programming in all radios. This will allow agencies to still maintain control over how the rest of the radio is configured while easing interoperability issues and training problems with common banks, including naming and location of certain talkgroups such as SRC, INT, and SP OPS. Once this is set, radio shops can begin adding that profile in every radio they touch, making the transition easier. We are working within my Bureau and with the SDPSCC to establish a sustainable funding mechanism that will allow us to get back to the system site expansion which stopped once the grant funds dried up. With the current budget 100% general funds additional funding to fill identified gaps has been difficult to get. We would like to do more than keep the lights on. Lastly, SRC is working on a statewide initiative to catalog radio programming, or codeplugs used in the state. Initial use will be for EM s to connect agencies using different naming conventions for the same talkgroups. The other purpose is to correct radio parameter programming that affects how the radio interacts with the system, of which we are finding some significant issues.
