ORANGE COUNTY CORRECTIONS DEPARTMENT INTERNAL AFFAIRS UNIT ADMINISTRATIVE INVESTIGATION IAU Primary Investigator: Brandon Halaychik Secondary Investigator: Shantay Smith LIEUTENANT MICHAEL DEAN SERGEANT DONALD CASEY MISCONDUCT / WORKPLACE VIOLENCE BASIS OF INVESTIGATION: On April 13, 2013, the Fraternal Order of Police (FOP) chartered two Mears Transportation Buses to travel from Orlando to the Guns and Hoses event located in Jacksonville Florida. It appears during the return trip to Orlando, Lieutenant Michael Dean and Sergeant Donald Casey were involved in a physical altercation on bus 4208 resulting in the Mears Transportation Bus Operator, to stop the bus on Interstate 95 and require Lieutenant Dean to board the second bus to restore order. Additionally, upon returning to the Orange County Corrections Complex that same evening, it appears Sergeant Casey and Lieutenant Dean engaged in a verbal altercation in the South Perimeter parking lot where it is alleged, Sergeant Casey removed a firearm from his privately owned vehicle and threatened Lieutenant Dean. It is clear none of the participants in this incident were on duty at any time during the course of this incident, nor were any of the witnesses and/or subjects acting in their official capacities. However, as a group they are reflective of the Orange County Corrections Department, and the parking lot of their work place was used to park their vehicles while they attended the Guns n Hoses event in Jacksonville. Additionally, by all accounts this violent incident began on a Mears Transportation bus en-route back to the parking lot of the Orange County Jail, and continued in the parking lot of their workplace (Orange County Jail) upon their return to Orlando. The credibility of a witness in part is determined by his or her knowledge of the circumstances, and disinterested relationship to the matter in question, therefore the unique relationship among some of those involved will be examined. Corporal Nelson Cruz was the highest ranking union official present during this incident, as he serves as the President of the Fraternal Order of Police, and Lieutenant Michael Dean served as the 1st Vice President of the Fraternal Order of Police at the time of the incident. 2 The vast majority of individuals providing written and oral testimony are members of the Fraternal Order of Police to include Sergeant Donald Casey. It is common knowledge Officer Mona Lisa Colon and Lieutenant Michael Dean have been involved in an intimate relationship for several years. There is no evidence of any prior incidents and/or disputes between Lieutenant Michael Dean and Sergeant Donald Casey according to their testimony, as Lieutenant Dean would testify, Prior to this incident, I never had any previous issues with Sergeant Casey, and Sergeant Casey would testify, Prior to the incident that night, I had no previous confrontations with Lieutenant Dean and considered him a friend. Sergeant Steven Dunn maintains a sound professional working relationship with both Lieutenant Michael Dean and Sergeant Donald Casey, and there exists no evidence of any prior disputes, disagreements, arguments, or accusations between Sergeant Dunn and either Lieutenant Dean or Sergeant Casey. There is no evidence of a personal relationship between Sergeant Dunn and either Lieutenant Dean or Sergeant Casey. It must also be considered the consumption of alcoholic beverages occurred unabated while en-route to the event, during the event, and while en-route back to Orlando. Testimony would include accusations of intoxication, however the degree of intoxication could not be established for any of the participants, however it could reasonably be inferred the consumption of alcohol was a contributing factor to this incident. This investigation was initiated to determine if Lieutenant Michael Dean and/or Sergeant Donald Casey violated Orange County Corrections Department Administrative Orders, Department Standard Operating Procedures, Post Orders, or Orange County Policy Manual & Operational Procedures. Any act, omission, or other allegation or misconduct sustained during the course of the investigation shall be clearly and sufficiently detailed such as to allow the employee to ascertain the charges made against him/her. This investigation was concluded on September 23, *The following are general summations from interviews and written documents. 3 SYNOPSIS OF WRITTEN STATEMENTS/DOCUMENTS: Mr. David Crawford Mears Transportation Company On April 13, 2013, the people from the Orange County Jail that I picked up today were very drunk and very rude. They completely trashed the bus and got into an incident on the way back on I-95 when two gentlemen got into an argument and then a fight on the bus. I pulled the bus over and removed one of the gentlemen and put him on motor coach I suggest in the future, that we do not accept this charter, unless we have some type of deposit on the bus. Corporal Javier Santiago On April 13, 2013, I was witness to a commotion that occurred inside the Mears Bus while in route to our destination, which was the Orange County Corrections Department parking lot. I was awakened by some sort of argument between two unknown parties occurring towards the front of the bus. An unknown person stated that he needed to get out of the bus, which pulled over to the side of the road. Due to my location towards the rear of the bus and the lighting conditions, I was not able to see exactly what was going on during the commotion. Once the bus pulled over Michael Dean and Mona Liza Colon stepped off the bus, and after a short moment the bus continued its route towards Orlando. Once the bus arrived at the Orange County Corrections Department parking lot and came to a complete stop, I gathered all my belongings and stood up in order to depart. I waited to exit and from the window I witnessed Michael Dean and Nelson Cruz talking to each other in the parking lot. While still looking out the window of the bus I also witnessed from a distance Michael Dean and Donald Casey talking back and forth. I next exited the bus, along with everyone else, and entered my personal vehicle, and departed towards my home. Maria Kelly On April 13, 2013, I attended the Guns n Hoses event in Jacksonville, and following the show we were driven back to the jail by Mears Transportation. During the return trip I watched music videos with a fellow co-worker on their telephone, while falling in and out of sleep. I m not sure of the time but I noticed several people standing near the front of the bus and I heard yelling. I could not tell what was being said, or who was yelling, as other people were standing up and I was unable to see over the people standing. An unknown person on the bus stated Sergeant Casey and Lieutenant Dean were having an argument, and in response the Mears Bus driver pulled over to the side of the road. The argument between them continued, so I asked Sergeant Casey if he wanted to sit with me on the bus, in an attempt to separate the two of them since they were sitting in close proximity. 4 Instead, Lieutenant Dean got off the bus and took a seat on the other Mears bus that was behind us. Once we returned to the jail, I got off the bus and walked over to my vehicle, started the car and drove home. I did not observe anything in the South parking lot. Corporal Joey Melendez On April 13, 2013, I was a passenger on the Mears Transportation bus; I was sitting in the back of the bus, 4th row to the back, when I heard a loud commotion coming from the front of the bus. I directed my attention towards that area, and observed Lieutenant Dean and Sergeant Casey in a verbal altercation. Due to the amount of noise subsequent to the argument starting, I could not hear or understand everything that was said between these individuals. I heard Sergeant Casey state that he wanted Lieutenant Dean off the bus and that he ll press charges. The bus stopped on the side of the highway and Lieutenant Dean got off. Upon the bus arriving to the visitor s side of the South parking lot, I was gathering my belongings when I looked out the window and observed Lieutenant Dean and Sergeant Casey walking towards their respective vehicles still arguing with one another. I observed Sergeant Casey open the driver s side of his vehicle, reach for something underneath the seat or floor, and tuck it into the waist of his pants; however I could not determine what the object was. I exited the bus, walked to my vehicle, and departed the premises, and did not observe anything else in reference to this incident. Corporal Nelson Cruz On April 13, 2013, I was awakened by a heated exchange between Dean and Casey, and observed Joshua Sardam and Stephen Dunn in the aisle of the bus attempting to deescalate the disagreement. The bus driver was asked to pull over on the shoulder of the highway so that we could separate the individuals involved and quell the disturbance. Once the bus was stopped, I asked Casey to board another bus to which he replied, I m not going to let him punch me in the face, and he s the one that got to go. Dean and Casey were in close proximity, and Dean was standing, so I understood the concern. I then asked Dean to board the other bus and he replied, I ll go but he s holding onto my arm these people are all holding me but they need to hold him. I asked Jeremy Smith to let go of Dean s arm as Dean continued to exclaim, I ll go but he s got my arm. Once separated, Dean and Mona Liza Colon exited the bus to join the rest of our group on the second charter bus. I spoke with Casey in an attempt to determine why the incident occurred, however Casey didn t appear to know exactly why the incident occurred. During our discussion, he stated that he actually likes Dean and was surprised that a confrontation had occurred. Page 4 of 57

5 Casey and I continued talking and during our conversation he gave me reason to be concerned when he stated, Dean better not start no shit with me when we get there because I ve got an arsenal in my car. Upon our arrival at the Orange County Jail, I gave instructions for everyone to stay on the bus until further notice. My plan was to ensure that Dean and Colon left the South parking lot to avoid any conflicts. Casey did not stay on board and continued walking through the South public parking lot where his vehicle was coincidentally parked in close proximity to Dean s vehicle, and when they encountered each other they began making comments. Casey opened his driver s side door, reached underneath the seat and grabbed a black colored gun, then turned around to face Dean placing the gun in his waistband and stating to Dean, what now while raising his hands up in the air. I grabbed Dean and guided him away from the area until I saw Captain Barry White and asked him to take Dean further away. I returned to speak with Casey, Paul Rowley was present and we told him that no one would think less of him if he got in his vehicle and left. Casey complied and departed the public parking lot. Corporal Natasha Fisher On the way back from Jacksonville, I was asleep and awakened by a commotion behind me, and then noted the bus pulling over and the lights being turned on. I observed several individuals between Dean and Casey. Casey was asked to come off the bus and go to the other bus, but he refused, so Dean got off the bus. When we arrived back to the parking lot, Nelson Cruz told everyone to stay on the bus; however Casey started yelling towards the front of the bus for everyone to get off. After words were exchanged between individuals on the bus, Casey exited the bus and began walking toward his car. Casey threw his belongings on the trunk of his car and then opened his car door, retrieved something and stuffed it in his pants. He then began walking towards Dean and Cruz who were standing near Dean s car. Lieutenant Paul Rowley On April 13, when returning from the Jacksonville FOP sponsored Guns and Hoses event on the Mears Transportation bus, I had been sleeping and was awakened from a liquid that got spilled all over me during a commotion (verbal exchanges being made between Sergeant Casey and Lieutenant Dean) taking place in the aisle of the bus. I asked my son what was going on and he stated they were about to fight, and although I did not observe what initially occurred, both individuals were now in a heated verbal exchange, and trying to get at each other. I observed Corporal Sardam along with others in between Casey and Dean preventing them from having a physical confrontation. I reached over the seat to hold Sergeant Casey s right arm and was among a mass of people all trying to either hold or pull the combatants in order to keep them separated. I have a rapport with both staff members; therefore I spoke with Sergeant Casey to calm him down. Page 5 of 57

6 Casey informed me Lt Dean had punched him and it appeared Sergeant Casey was upset after being punched and was trying to get back at Dean. Both individuals kept verbally challenging each other, and due to the disturbance the Mears Transportation bus driver pulled the bus off the highway and arrangements were made for Dean to get off the bus. Lieutenant Dean and Officer Colon exited the bus and we then resumed with the ride home without further incident. Upon arriving in the public parking area of the South perimeter, Sergeant Martin remained at the front of our bus and advised everyone that Nelson Cruz requested our bus wait before being unloaded to allow time for the second bus to unload and for Lt Dean to depart to avoid contact with Sergeant Casey. I had then looked out the window and observed Lt Dean being held back by Nelson Cruz to prevent him from going towards Sergeant Casey who had managed to get off the bus. Sergeant Casey was standing next to his car with the door open and I observed Lt Dean trying to get around Nelson Cruz, who was holding him back preventing him from advancing towards Sergeant Casey, who was about 2 or 3 parking spaces away. I heard someone on the bus state Casey has his gun however I didn t observe it and thought they were mocking or joking about the situation, and assumed they weren t serious because I didn t see Sergeant Casey with anything in his hand when I looked out the window. I asked Sergeant Martin to allow me to get off the bus, so I could assist with deescalating the situation, and after being allowed to do so I exited the bus, and approached Sergeant Casey who didn t appear to have a weapon in his hands, thus allowing me to safely approach. I advised Casey I knew he was frustrated, however I would respect him more as a man if he got in his car and went home. Sergeant Casey then told me out of respect for me he would do that and he subsequently departed. Officer Wheeler McLilly On April 13, 2013, I attended the Gun and Hoses event in Jacksonville, however on the return trip to Orlando; I wasn t on the bus in which the alleged incident occurred. I only observed the lead bus stop on the shoulder of I-95 and witnessed Lt Dean and Officer Colon depart the lead bus and board the bus I was travelling on. After arriving at the South parking lot, I departed the bus, got into my vehicle and exited the parking lot. DSO Angela McCaskill On April 13, 2013, traveling back to Orlando from the Guns and Hoses event in Jacksonville on the Mears Transportation bus, I was asleep on the way back and was awoken by a bump on my seat and what appeared to be the sound of an argument. When I opened my eyes, the bus driver turned on the lights and pulled the bus over and stated one of you has to get off the bus and go to the other bus or I will call the police. Page 6 of 57

7 The bus driver was referring to Lt Dean and Sergeant Casey, who appeared to be arguing, however I didn t know what had initiated the argument because I was asleep. Lt Dean removed himself from the bus and we continued back to Orlando, and upon arriving at the South parking lot, we were instructed to wait prior to departing the bus. When they cleared us to get off the bus I proceeded to my truck and left the area without observing anything. DSO Adrian McRae On April 13, 2013, I attended the FOP Guns and Hoses event that was held in Jacksonville, and during the trip an incident occurred between two individuals on the bus I was riding in. When the incident initially took place I was seated towards the back of the bus, and asleep, therefore I did not visually see what occurred. The lights were turned on, due to a commotion taking place towards the front of the bus between some individuals, however due to my location at the back of the bus I did not see who the individuals were, but was told that it was Lt Dean and Sergeant Casey. I recall Dean being escorted off the bus and getting on the second bus. Once we arrived back in the parking lot, I got off the bus, went to my vehicle and departed the property. Officer Ismael Aguirre On April 13, 2013, I boarded the bus after the event sitting in a rear seat next to the restroom. The bus departed after everyone was on board and I ended up falling asleep approximately 15 minutes into the return trip. I m not sure of the time, but I felt the bus stop and I thought we pulled over to a rest stop, as we did when we were going to the event. I looked out the window and noticed cars on the highway and wondered why we pulled over. I asked my wife what was going on and she responded she though Casey got off the bus and went on the other bus. I did not hear any commotion, nor did I witness anything. After about two minutes, the bus doors shut and we were on our way again. I fell back a sleep and awoke when the bus stopped at the South parking lot. My wife and I exited the bus and departed the parking lot. DSO Enrique Ceballos On April 13, 2013, while returning from the Gun and Hoses event in Jacksonville, I fell asleep on the bus, but all of a sudden I heard a big commotion coming from the front of the bus and noted the bus driver turning on the interior lights. I observed Lt Dean and Sergeant Casey surrounded by other people, who were attempting to keep them away from each other. While this was occurring the bus driver pulled to the side of the road and stopped the bus. Once the bus stopped I observed Lt Dean and Officer Colon leaving the bus, and the bus then resume normal operations. Once we arrived at the South parking lot, I observed Lt Dean and Sergeant Casey exchanging words, and then Sergeant Casey walking to his vehicle and returning to Dean s location, which occurred as I exited the bus, walked to my car and departed the area. 8 Officer Mona Liza Colon On April 13, 2013, I was on a Mears bus returning to Orlando from Jacksonville, and seated in the aisle between Michael Dean and Donald Casey when they began arguing, however I do not remember what the dispute was over, or what was said between them. All of a sudden, I noticed everyone was grabbing them in an attempt to keep them separate, and during the incident, I remember hearing Donald Casey mention a knife, stating I am going to stab him in the neck. The bus driver stopped the bus and pulled over to the side of the road, and due to the threats against Michael Dean, it was determined that we should exit the Mears bus and re-enter the second bus to continue the return trip. When we arrived at the South perimeter parking lot, Michael Dean and I exited the bus, and walked towards our vehicle. The passenger side of my vehicle was facing the direction of Donald Casey s vehicle. I sat in the passenger seat of my vehicle and instantly noticed Donald Casey walking quickly to his vehicle while talking to himself. He appeared agitated, and I observed him open the driver s side door to his vehicle and reach inside. When Donald Casey turned around, I saw a gun in his hand, and he appeared to chamber a round, and then place the gun in his waist band. Donald Casey then shouted Now let s do this, and Donald Casey and Michael Dean began to argue until Dean returned to my vehicle and we departed the parking lot. Officer Edwin Concepcion On April 13, 2013, I was asleep in the back of the Mears bus when I heard loud yelling, and upon awakening I observed Lt Dean walking off the bus. The bus driver continued to drive so I fell back asleep, and when the bus arrived back at the South perimeter parking lot I got off the bus, went to my car and departed the area. Officer Edwin Drummond I took a bus trip to the Guns and Hoses event, and once the event ended, I boarded the bus and went to sleep. Later in the evening I awoke when the bus stopped, and observed Dean and Colon depart the bus. I went back to sleep and when we arrived at the facility parking lot, I exited the bus and got into my vehicle and departed. Officer Dwight Irving In regards to the incident on the Mears bus, I was asleep when the incident happened therefore I did not witness anything. In regards to the South parking lot, I did not witness anything as I went from the bus straight to my car and left. Page 8 of 57

9 Officer Jatavious Abrams On April 13, 2013, I was a passenger on the Mears transportation bus; however prior to that time I had consumed an unknown amount of alcohol, and due to being intoxicated, I can t be sure exactly what took place at the time the commotion began, however I did hear noise and a crowd of people at the front of the bus. Officer Jeremy Smith On April 13, 2013, I was awakened by a loud commotion, which turned out to be a verbal altercation between Lt Dean and Sergeant Casey. The verbal altercation escalated and I responded by placing both of my arms on top of Lt. Dean s upper torso area in an attempt to deescalate the situation. Officer Michael Martinez I did not witness anything related to both situations that occurred on April 13, 2013, as I was not on the bus where the altercation occurred and upon arriving at the parking lot, I went straight to my vehicle and drove home. Officer Peter Bromfield On April 13, 2013, I boarded the Mears Transportation bus to attend a charity event. I slept most of the trip back to Orlando although I awoke when I felt the highway surface become bumpy, due to the driver pulling off the road, onto the shoulder. While we were on the shoulder, I noticed occupants vacate this vehicle and walk towards the second bus. Both buses then proceeded South-bound to Orlando. When we arrived at the South perimeter, I remained seated for a moment, because the aisle was crowded with individuals waiting to depart. I got out of my seat and went to my vehicle and departed. Officer Ricardo Gillard On April 13, 2013, I was awakened by a loud commotion on the bus ride home, which was later determined to be a verbal altercation between Lt Dean and Sergeant Casey. I stood up to make sure things were alright, and when I observed things were handled I sat down. Officer Sandy White On April 13, 2013, immediately after boarding the bus, I placed a headset on my ears, turned the music on and the volume up. Page 9 of 57

10 I did not see or hear anything until Corporal Tyre gained my attention by grabbing my leg. I took the headset off and at that point I observed Lt Dean being escorted off the bus. Sergeant Stephen Dunn On April 13, 2013, I attended the Guns and Hoses event in Jacksonville, and during the ride to Jacksonville and the ride back to Orlando, I consumed alcohol. Around 2350 hours while in route back to Orlando on the Mears Transportation bus I was talking with a small group of people to include Lt Dean, Sergeant Casey, Sergeant Sardam, Officer Colon and myself. The conversation was light and in a joking manner however during the conversation, Lt Dean accused Sergeant Casey of harassing his girl. Sergeant Casey asked Lt. Dean what he was talking about. Lt. Dean said Sergeant Casey was harassing her while she was entering the North Perimeter Building. Sergeant Casey responded unless he meant not allowing people to use the Kronos clock at North Perimeter, he did not know what Lt. Dean was talking about. The mood of the conversation began to change as we realized Lt. Dean was not joking concerning the situation. Lt. Dean continued to say Sergeant Casey was harassing his girl, and Sergeant Casey appeared clueless to the situation Lt. Dean was referring to. A couple of times during this exchange, Lt Dean pointed his finger at Sergeant Casey while he was talking. Based on my seating position relative to them, I waved Lt. Dean s hand away, attempting to prevent Sergeant Casey from felling uncomfortable. The conversation lulled and nothing was being said, in that moment I sensed a rapid motion and believed Lt Dean was standing up. I instinctively stood up as well to place myself between Lt Dean and Sergeant Casey in an attempt to prevent any physical altercation from taking place. I found myself between them and words were being exchanged. Sergeant Casey was holding Lt. Deans right wrist. The bus driver pulled to the side of the road and stopped. Sergeant Casey stated Lt. Dean struck him. Sergeant Casey made this statement after the bus driver stated that he would have to contact authorities if someone didn t get off the bus. I did not observe Lt. Dean strike Sergeant Casey. Corporal Cruz asked Lt. Dean to go to the other bus, and Sergeant Casey let go of Lt. Dean s wrist and he exited, and then walked to the other bus. Once we arrived in Orlando, Sergeant Casey announced his need to relieve himself and exited the bus. Looking out the bus window I observed Captain White walking towards where Lt. Dean was parked, and then talking to Lt. Dean. After exiting the bus, I approached Sergeant Casey, who was standing in the open door of his vehicle about two parking spaces away from Lt. Dean s vehicle. I asked Sergeant Casey to head home to prevent escalating the situation which he complied. Lt Dean approached and stated Sergeant Casey displayed a weapon although I did not observe the weapon when interacting with Sergeant Casey. Page 10 of 57

11 Officer Victor Rodriguez On April 13, 2013, I occupied a seat on a Mears Transportation bus to attend a charitable event in Jacksonville. Around 2300 hours, Mears Transportation departed from Jacksonville and preceded to its destination in Orlando, and during the course of the trip, the transportation driver, pulled over to the shoulder of the highway. I observed Lt. Dean and Officer Colon enter our bus, and proceed to a seat. The transportation driver then pulled back onto the highway and continued towards Orlando. When we arrived at the South parking lot, I exited the Mears Transportation bus, retrieved my vehicle and departed. Officer Angela Bellamy I was sitting in the rear of the bus next to the last seat by the restroom with Corporal Kelly when I heard a loud commotion coming from the front of the bus. I observed several people holding Lt Dean back, who appeared to be angry and trying to get to Sergeant Casey. The bus pulled over and I overheard people yelling for Sergeant Casey to get off the bus in order to quell the situation, but Sergeant Casey stated, I m not getting off the bus, because he is the one that hit me. Finally, Lt. Dean was escorted off the bus to the other and we headed back to Orlando. No one around me seemed to know what really happened. When the bus stopped everyone was waiting to get off the bus for a long time, and I heard Sergeant Martin say, Just wait a damn minute to someone upfront. Someone then yelled to take the fight off the bus so we could all go home. When I exited the bus, I remember looking back seeing Sergeant Casey talking to several people, but I continued to head for my car and departed. Corporal Sonovia Tyre On April 14, 2013, Corporal Kelly, Officer Chambers, Officer Taylor and I were laughing cracking jokes with each other when the Mears Transportation bus pulled over to the side of the road due to a disturbance on the bus. I stood up out of my seat to see what was going on and observed Lieutenant Dean and Sergeant Casey arguing. I am not sure of what they were arguing about nor did I witness any physical contact between Lieutenant Dean and Sergeant Casey. I just overheard them going back and forth with each other. To quail the situation, it was determined by someone to separate the two and place Lieutenant Dean on the second Mears bus. I observed Lieutenant Dean accompanied by Captain White and Officer Colon exit our bus without any further incident. Once Lieutenant Dean and Officer Colon were escorted safely to the second bus, Captain White returned and we proceeded to Orlando. Page 11 of 57

12 Around 0050 hours, both buses pulled into the outside parking lot of South perimeter. Corporal Cruz instructed everyone to remain on the bus to alleviate any further incident between Lieutenant Dean and Sergeant Casey. While standing in the middle aisle waiting to exit, I observed Lieutenant Dean exit off the second bus while being escorted by Officer Colon to their vehicle. During this time an argument occurred on the bus between Sergeant Casey and Sergeant Martin because Casey wanted to exit the bus. Sergeant Martin attempted to prevent Casey from exiting the bus; however he was determined to exit. I observed Casey exit the bus and walk to his vehicle, open the driver side door and stand beside it. It appeared that words were being exchanged due to their (Sergeant Casey and Lieutenant Dean) body language. After several minutes of everyone still being detained on the bus, I began to yell, Let us off this damn bus, the drama is out there and why are we being held, its 1 o clock? After several seconds, the driver opened the bus door and I exited and departed the compound. Corporal Jerry Haddock On April 13, 2013, I was riding in a Mears Transportation bus from Jacksonville to Orlando and on the way back, I heard a commotion coming from the front of the bus. The bus was very dark at the time so I could not make out who indeed was arguing at the time. After a couple of minutes of constant arguing, the Mears bus driver made the decision to pull to the side of the road. I asked who was arguing and someone replied that it was Lieutenant Dean and Sergeant Casey. Once the bus was pulled to the side of the road, the bus driver turned the interior lights on and I noticed several individuals between the two people in question, attempting to quell the situation. I heard what sounded like the voice of Lieutenant Dean yell out I don t appreciate what you said Casey. Several people suggested that one of the individuals should go and relocate to the back of the bus, but both refused. I heard what appeared to be Sergeant Casey say, Make him get off the bus. Sergeant Casey was very adamant about Lieutenant Dean getting off the bus and going the second one, which was parked directly behind us. At one point I heard Sergeant Casey say, Make him get off the bus or I m going to press charges. I then observed Officer Peace walk to the front of the bus to assist quelling the situation. After several moments, someone convinced Lieutenant Dean to relocate to the second bus and then we continued to Orlando. Once the buses returned to the unsecured premises of the South perimeter, I observed Lieutenant Dean get off the second bus and Corporal Cruz getting off the first bus to escort him to his vehicle. Everyone on bus 1 remained on the bus for a moment, and then I observed Sergeant Casey exit the bus and walk to the direction of the vehicles. I was on the bus, but it appeared that Sergeant Casey and Lieutenant Dean had another exchange of words. Page 12 of 57

13 Corporal Cruz was standing between them, to prevent them from getting too close to each other. Sergeant Dunn then exited our bus and attempted to get Sergeant Casey to walk to his car and end the argument. It was shortly after this that everyone started to exit the bus. I exited the bus, and then stated to both individuals involved that we were on County property and they should leave the situation alone, get in their cars and leave the area. Sergeant Casey stated, I don t know what his problem is, I don t know why he s still mad at me. Once I noticed the situation was under control, I proceeded to my vehicle and departed the area. It should be noted at one point during the return back to Orlando, I overheard someone say that Sergeant Casey had blood coming from his lip, however I did not witness any physical contact between the two individuals, not did I witness any weapons displayed by either person. Sergeant Chante Martin On April 13, 2013, while en-route to Orlando, I heard a commotion and someone state to tell the bus driver to pull over. I told the bus driver to pull over and he responded by pulling over and turning on the lights. Casey was screaming that he was going to kill Dean and stab him in the neck. Dean exited our bus and got on the other Mears bus. Once we arrived back in Orlando, Corporal Cruz told us to remain on the bus for a few minutes. Casey started to yell and curse at the people in the front of the bus; he pushed his way off the bus and went to his vehicle. He placed the things he had in his hand on the trunk and leaned into the driver s side of his vehicle, stood up and walked back toward Dean. I got off the bus walked directly to my vehicle and departed. Officer Ryen Brooks While en-route to Orlando from Jacksonville, I heard a loud commotion, the bus was then pulled over and a black male and Hispanic female were escorted off the bus by another black male. I did not see what happened as far as the incident in question is concerned. Once the bus arrived back to the compound, I exited the bus and went directly to my car which was parked in the secure South parking lot and departed. Sergeant Adrian Dozier On April 13, 2013, I attended an FOP Gun and Hoses event that was held in Jacksonville. An incident occurred between two individuals on the bus where I was present. When this incident took place, I was asleep towards the back of the bus and did not visually see what occurred. The lights were turned on due to a commotion taking place towards the front of the bus between some individuals. Based on where I was sitting I did not see who the individuals were but was later told it was Dean and Casey. Once we arrived back in the parking lot, I got off the bus, went to my vehicle and departed the area. Page 13 of 57

14 Corporal Lourdes Aguirre On April 13, 2013, I attended the Guns and Hoses event in Jacksonville, and at approximately 0030 hours, I was awakened by the bus stopping and lights being turned on. I thought we were stopping at a rest stop, as we had done on the way to Jacksonville. I observed Lieutenant Dean and Officer Colon standing up in their seating area at the front of the bus. Lieutenant Dean appeared to be upset but I could not hear what he was saying as I was too far back in the bus. I then observed Lieutenant Dean and Officer Colon get off the bus. I went back to sleep and when the buses arrived at the South perimeter parking area, from what I could see through the window; whatever problem occurred on the bus was continuing outside. Officer Steven Chambers On April 13, 2013, I attended the Guns and Hoses event in Jacksonville. A bus was chartered to make a round trip to the event, and upon the return trip from Jacksonville to Orlando, I heard people arguing towards the front of the bus and others intervening to separate two individuals from each other. When I looked up, I observed Lieutenant Dean yelling out and I proceeded to the front to convince him to sit in the back with me in order to separate him from whatever was going on. However, the bus driver pulled over and Lieutenant Dean exited our bus and got on the second bus. SYNOPSIS OF SWORN TESTIMONY: Mr. David Crawford Mr. Crawford testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Mr. Crawford further testified he neither wished to add or change anything to his witness statement at this time. Mr. Crawford testified he picked up the people at the Orange County (Corrections) parking lot and took them to Jacksonville (FL) because they had an event there. Mr. Crawford indicated the people had booze and liquor on the bus so they had a good time. Mr. Crawford indicated on the way back from Jacksonville, it was really late and they asked to turn the interior lights off on the bus so they could sleep. Mr. Crawford stated on Interstate 95, he heard an argument breakout between two of the people. Mr. Crawford testified because of the argument, he decided to pull over the bus and subsequently radioed the second bus driver about what was occurring. Mr. Crawford indicated once the bus was pulled over, he took one of the gentlemen off the bus. Mr. Crawford testified the individual (LT Dean) didn t want to come off the bus at first and that Mr. Crawford threatened to call the police. Mr. Crawford stated he exited the bus and went to the second bus to speak with his fellow bus driver at which point the gentleman (LT Dean) exited Mr. Crawford s bus along with Mr. Nelson Cruz. 15 Mr. Crawford testified once LT Dean was on the second bus, the buses proceeded to the Orange County parking lot. Mr. Crawford stated upon arrival, Mr. Cruz held up his bus, and Mr. Cruz went to the second bus to get LT Dean off the bus and to his vehicle. Mr. Crawford indicated the person that was on his bus (SGT Casey) did not want to be held on the bus and he left the bus. Mr. Crawford stated once Sergeant Casey was off the bus, he started an argument in the parking lot. Mr. Crawford testified because of the ongoing situation, he told everyone to exit his bus which they complied. Mr. Crawford stated once everyone was off the bus, he got Mr. Cruz s booze off the bus, and proceeded back to the Mears Transportation yard. Mr. Crawford stated upon arrival to the yard, the bus was completely trashed with booze, puke, the bathroom was trashed and seats were soaked with alcohol. Mr. Crawford testified because of the amount of damage to the bus, he wrote an incident report and submitted it to Mears for reimbursement. Mr. Crawford testified he has worked for Mears Transportation for 14 years, and during this time he has dealt with a lot of groups; however he felt the group that was on his bus that evening were the most unprofessional people he has ever dealt with. Captain Barry White Captain White testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Captain White further testified he neither wished to add or change anything to his witness statement at this time. Captain White testified upon the return trip from Jacksonville, he was awakened when the bus came to an abrupt stop and the lights were turned on. Captain White indicated he sat up and observed Sergeant Dunn and Sergeant Sardam standing in between Sergeant Casey and Lieutenant Dean. Captain White however indicated he could not remember if Sergeant Casey was standing or sitting. Captain White did indicate Lieutenant Dean was being held up against the window of the bus by his girlfriend (Officer Colon). Captain White indicated there was some talking going on back and forth and the bus driver ended up pulling the bus to the side of the road. Captain White testified once the bus was pulled over, the bus driver stated one of the individuals needed to be placed on the other bus. Captain White testified he got up out of his seat, and told Lieutenant Dean to exit the bus. Captain White stated Lieutenant Dean complied and exited the bus and the buses returned back to Orlando. Captain White testified once the buses were back on the road, Sergeant Casey stated Lieutenant Dean had hit him. Captain White however testified he never observed Lieutenant Dean strike Sergeant Casey nor did he observe any injuries on Sergeant Casey. Page 15 of 57

16 Captain White stated once the buses arrived back at the parking lot, everyone began to unload and get off the bus at which time he looked out the window and observed Lieutenant Dean and Sergeant Casey who were standing at their vehicles. Captain White testified he exited the bus, approached Lieutenant Dean and had him walk to his (Captain White s) vehicle where they stood until Sergeant Casey left the area. Captain White testified once Sergeant Casey left, Lieutenant Dean went back to his vehicle. Captain White testified he never observed Sergeant Casey with a handgun nor did Lieutenant Dean make mention that Sergeant Casey was in possession of a handgun during the argument in the parking lot. Lieutenant Paul Rowley Lieutenant Rowley testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Lieutenant Rowley further testified he neither wished to add or change anything to his witness statement at this time. Lieutenant Rowley testified he was sleeping on the bus and woke when a liquid spilt on him. Lieutenant Rowley stated when he awoke, his son mentioned two individuals (LT Dean and SGT Casey) were about to fight. Lieutenant Rowley indicated at that point, Sergeant Casey was standing up and there were a few individuals who were standing in between Sergeant Casey and Lieutenant Dean. Lieutenant Rowley testified he grabbed Sergeant Casey s right arm and was attempting to calm him down. Lieutenant Rowley stated although he could not see Sergeant Casey s arm, it was his perception both Lieutenant Dean and Sergeant Casey were holding each other. Lieutenant Rowley testified he never observed Lieutenant Dean or Sergeant Casey strike each other, although Sergeant Casey had made the statement. Lieutenant Rowley further indicated he observed no marks on Sergeant Casey that would indicate he had been struck. Lieutenant Rowley testified once Lieutenant Dean had exited the bus, there was no further incident that occurred until the buses returned back to the property. Lieutenant Rowley indicated once back on property, Sergeant Chante Martin was at the front of the bus, and Corporal Nelson Cruz had made a request that everyone remain on the bus to allow Lieutenant Dean to safely depart. Lieutenant Rowley stated Sergeant Casey somehow managed to get off the bus. Lieutenant Rowley indicated as he looked out the window, he observed Sergeant Casey at his vehicle, which was a few parking spaces away from Lieutenant Dean. Lieutenant Rowley testified it appeared Corporal Cruz was attempting to calm down Lieutenant Dean by holding him back because he was attempting to get at Sergeant Casey. Lieutenant Rowley indicated someone on the bus verbally stated Sergeant Casey had a gun, however Lieutenant Rowley stated he did not observe Sergeant Casey in possession of a weapon. Page 16 of 57

17 Lieutenant Rowley stated he requested that Sergeant Martin let him off the bus because he had a rapport with both individuals. Lieutenant Rowley testified as he approached, he did not observed Sergeant Casey in possession of any weapons, although Sergeant Casey was standing in between his driver s side door and the vehicle. Lieutenant Rowley testified Sergeant Casey was not attempting to engage Lieutenant Dean and as he approached him, he advised Sergeant Casey he would respect him more as a man if he just got in his car and left. Lieutenant Rowley testified Sergeant Casey responded that out of respect for him (Lieutenant Rowley), he would leave and subsequently departed the property. Sergeant Chante Martin Sergeant Martin testified prior to the interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Sergeant Martin further testified she neither wished to add or change anything to her witness statement at this time. Sergeant Martin testified they were coming back from the event, and heard Lieutenant Dean and Sergeant Casey talking. Sergeant Martin testified she did not hear anything that would cause her alarm until all of a sudden, someone screamed turn the lights on. Sergeant Martin testified the bus driver pulled over and when he turned the lights on she observed Sergeant Casey, who was standing up and appeared to be crying, and also heard Casey state he hit me and that he would stab him in the neck. Note: Sergeant Martin s testimony did not support the claim made by Lieutenant Michael Dean that he (Dean) swung at Sergeant Casey after he (Casey) threatened, I ll stab you. Sergeant Martin s testimony indicated Sergeant Casey made the threat after he was struck by Lt. Dean, not before, therefore not supporting Dean s claim that he swung at Casey after he was threatened. Sergeant Martin went on to state Lieutenant Dean was also standing and had his hands up, palms facing out. Sergeant Martin testified they attempted to get Sergeant Casey off the bus but he stated he wasn t leaving, so Lieutenant Dean stated he would leave. Sergeant Martin indicated Lieutenant Dean exited the bus and the bus continued to Orlando. Sergeant Martin testified once they arrived in Orlando, Corporal Cruz instructed everyone to say on the bus, and he exited to tell people on the second bus to leave. Sergeant Martin testified however Sergeant Casey began screaming, Let me off the fucking bus and she instructed him to remain on the bus. Sergeant Martin indicated Sergeant Casey said, Fuck Cruz, I m getting off this bus and he subsequently exited the bus. Sergeant Martin testified once Sergeant Casey exited the bus, he ran over to his vehicle, put some items on his trunk then went inside his car, stood back up and walked towards Lieutenant Dean and Corporal Cruz. 18 Sergeant Martin stated at this point, everyone started exiting the bus and she went to her vehicle and left. Sergeant Martin indicated she never observed any physical contact between Sergeant Casey and Lieutenant Dean. Sergeant Martin further testified she never observed Sergeant Casey with a firearm during the altercation. Sergeant Joshua Sardam Sergeant Sardam testified he was on the bus on the way home from Jacksonville, when he heard a big commotion. Sergeant Sardam stated they (LT Dean and SGT Casey) appeared angry so he stood up between them. Sergeant Sardam stated they were exchanging words and the bus driver stopped the bus, and told Lieutenant Dean to go on the other bus. Sergeant Sardam stated Sergeant Casey was holding Lieutenant Dean s arm and stated he didn t want to let go, because he feared Lieutenant Dean would hit him. Sergeant Sardam stated he had to pry Sergeant Casey s arm off of Lieutenant Dean and that once Lieutenant Dean boarded the second bus everything calmed down, although Sergeant Casey was upset the whole way back. Sergeant Sardam stated once arriving back at the Orange County Corrections parking lot, Sergeant Casey wanted to get off the bus but he was told to wait. Sergeant Sardam stated he had words with someone up front, and left the bus anyway. Sergeant Sardam stated once he left the bus, he observed Sergeant Casey at one vehicle and Lieutenant Dean at another and told Sergeant Casey to just forget about this and go home. Sergeant Sardam stated he then went to his car and departed the area. Sergeant Sardam stated at no point did he observe Sergeant Casey in possession of a firearm and threatening Lieutenant Dean. Sergeant Andria Dozier Sergeant Dozier testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Sergeant Dozier further testified she neither wished to add or change anything to her witness statement at this time. Sergeant Dozier testified she was on the bus asleep, and remembers the bus pulling over and the lights coming on due to a commotion. Sergeant Dozier indicated she wasn t aware who was arguing, but did observed Lieutenant Dean being escorted off the bus. Sergeant Dozier stated once Lieutenant Dean was on the second bus, the bus got back on the road and they proceeded to the jail. Sergeant Dozier stated there was a hold up on the bus, and that Sergeant Casey was attempting to exit. Sergeant Dozier stated once she was let off the bus she went to her vehicle and left. Sergeant Dozier stated she never heard Sergeant Casey or Lieutenant Dean use racial slurs towards each other nor did she observe Sergeant Casey with a firearm at any point. Page 18 of 57

19 Sergeant Steven Dunn Sergeant Dunn testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Sergeant Dunn further testified he neither wished to add or change anything to his witness statement at this time. Sergeant Dunn testified on the way back, about 4 or 5 people were talking, and Lieutenant Dean said something to Sergeant Casey about harassing his girl. Sergeant Dunn stated everyone laughed, and then Lieutenant Dean repeated his remark. Sergeant Dunn stated everyone looked at Lieutenant Dean because his remark was completely out of left field and no one knew what he was talking about. Sergeant Dunn testified Sergeant Casey asked Dean what he was talking about and that Lieutenant Dean stated something about coming through the perimeter. Sergeant Dunn indicated Sergeant Casey stated no one is allowed to clock in at North perimeter however Dean kept talking about how Casey was harassing her. Sergeant Dunn testified Lieutenant Dean then pointed at Sergeant Casey, so Sergeant Dunn moved Lieutenant Dean s hand down. Sergeant Dunn testified the next thing he knew, Lieutenant Dean jumped up and a verbal altercation ensued. Sergeant Dunn stated he stood up and stepped between Dean and Casey and that Sergeant Casey had control of Lieutenant Dean s arm. Sergeant Dunn indicated at this point, the bus driver pulled over and advised that one of them had to get off the bus or he would contact the police. Sergeant Dunn testified Corporal Cruz then came over and asked Dean to exit the bus; however Dean told Sergeant Dunn to watch Casey. Sergeant Dunn testified once Sergeant Casey let go of Lieutenant Dean s arm, they exited the bus and boarded the second one. Sergeant Dunn testified once the buses arrived at the South perimeter, Sergeant Casey was speaking with someone at the front of the bus, and indicated he needed to piss like a race horse. Sergeant Dunn indicated Casey then exited the bus, and Sergeant Dunn stated he observed Captain White walking away with Lieutenant Dean. Sergeant Dunn testified once he exited the bus, he approached Sergeant Casey who was standing in his door jam, and he asked Casey to leave the property. Sergeant Dunn stated Sergeant Casey hesitated but eventually complied and left the property. Sergeant Dunn indicated at this point, Lieutenant Dean came back and stated Casey had opened his car and placed his weapon in his waistband. Sergeant Dunn however testified he did not observe any weapons. Sergeant Dunn testified he has been employed by the Orange County Corrections Department since 2004 and has dealt with intoxicated people during his employment. Sergeant Dunn stated based on this experience he felt Lieutenant Dean was intoxicated the evening of the incident. Page 19 of 57

20 Corporal Jerry Haddock Corporal Haddock testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Corporal Haddock further testified he neither wished to add or change anything to his witness statement at this time. Corporal Haddock testified on the way back from Jacksonville, he overheard a commotion coming from the front of the bus, but he was unsure who was involved. Corporal Haddock stated because the argument continued, the bus driver made the decision to pull the bus to the side of the road. Corporal Haddock indicated the bus driver turned the interior lights on, and he (Haddock) was advised Lieutenant Dean and Sergeant Casey were arguing. Corporal Haddock stated there were numerous people in between Dean and Casey, so he could not get a clear view. Corporal Haddock stated he overheard Lieutenant Dean state Casey I didn t appreciate what you said, although Corporal Haddock acknowledged he did not hear the comment allegedly made by Sergeant Casey. Corporal Haddock stated Sergeant Casey was very adamant about Lieutenant Dean being placed on another bus and the decision was made to have Lieutenant Dean board the second bus. Corporal Haddock indicated the buses continued back to Orange County property, and once arrived, Corporal Cruz exited the first bus in an attempt to escort Lieutenant Dean to his vehicle. Corporal Haddock stated everyone remained on the first bus however Sergeant Casey got off the bus. Corporal Haddock indicated he observed Sergeant Casey and Lieutenant Dean again exchanging words in the parking lot, and he exited the bus, approached both subjects and made the statement, Hey its time to squash everything, head to our vehicles and go home. Corporal Haddock testified Sergeant Casey said he was cool and didn t understand why Dean still had a problem with him. Corporal Haddock testified he did not recall hearing either Lieutenant Dean or Sergeant Casey making any racial slurs during their argument nor did he observe Sergeant Casey in possession of a firearm at any point. Corporal Javier Santiago Corporal Santiago testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Corporal Santiago further testified he neither wished to add or change anything to his witness statement at this time. Corporal Santiago testified on the way back, there was a commotion on the bus; however he did not know what the commotion was about. Corporal Santiago indicated at some point the bus pulled over and someone advised you need to get out of the bus however Corporal Santiago stated he did not know who made the statement. 21 Corporal Santiago stated he did however observe Lieutenant Dean and Officer Colon exit the bus and board the second bus. Corporal Santiago testified upon arrival back at the Orange County Jail, he observed through the window, Lieutenant Dean and Corporal Cruz talking to each other in the parking lot. Corporal Santiago testified Sergeant Casey then came to the same side as Lieutenant Dean and began talking, although Corporal Santiago indicated he could not determine if they were arguing. Corporal Santiago testified he never heard Lieutenant Dean nor Sergeant Casey use racial slurs during the argument nor did he hear Sergeant Casey tell Lieutenant Dean he would stab him in the neck. Additionally, Corporal Santiago testified he never observed Sergeant Casey in possession of a firearm at any point. Corporal Sonovia Tyre Corporal Tyre testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Corporal Tyre further testified she neither wished to add or change anything to her witness statement at this time. Corporal Tyre testified coming back from Jacksonville, a commotion occurred and the bus was pulled over. Corporal Tyre testified she observed Lieutenant Dean standing up and Sergeant Casey sitting down while they were involved in a verbal altercation. Upon their arrival at the Orange County Jail, they were told to stay on the bus and Sergeant Casey began getting into an argument with Sergeant Martin. Corporal Tyre stated Sergeant Martin told Sergeant Casey you know we aren t supposed to get off the bus however Casey got off the bus. Corporal Tyre testified she observed Sergeant Casey approach his vehicle, open his door and stand by the vehicle egging it on. Corporal Tyre testified Sergeant Casey leaned against his vehicle with his arms folded and other people were attempting to hold Lieutenant Dean back. Corporal Tyre testified she never observed Sergeant Casey in possession of a firearm nor did she remember any threats of harm made by either party during the argument. Corporal Maria Kelly Corporal Kelly testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Corporal Kelly further testified she neither wished to add or change anything to her witness statement at this time. Corporal Kelly testified she remembered hearing yelling on the bus, although initially she did not know who was yelling, or what it was in reference to. Corporal Kelly stated she spoke with Sergeant Casey and asked if he wished to sit with her on the bus in an attempt to calm the situation, however Lieutenant Dean exited the bus. Corporal Kelly testified upon arriving back to Orange County property, she exited the bus, did not observe anything occur, and departed the property. Page 21 of 57

22 Corporal Kelly stated she never heard Lieutenant Dean nor Sergeant Casey utilizing racial slurs during the argument. Corporal Kelly further indicated she did not see any marks on Sergeant Casey that would indicate he had been punched by Lieutenant Dean. Corporal Joey Melendez Corporal Melendez testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Corporal Melendez further testified he neither wished to add or change anything to his witness statement at this time. Corporal Melendez testified he heard a commotion coming from the front of the bus. Corporal Melendez stated he observed Sergeant Casey and Lieutenant Dean in a verbal altercation. Corporal Melendez stated the only thing he can get from the argument was that Sergeant Casey wanted Lieutenant Dean off the bus and that Sergeant Casey would press charges. Corporal Melendez stated at this point, the bus driver pulled the bus over and Lieutenant Dean exited the bus. Corporal Melendez testified once back on Orange County property, he looked out the window and observed Sergeant Casey and Lieutenant Dean arguing in the parking lot. Corporal Melendez advised he observed Sergeant Casey approach a vehicle, open the driver s side door, reach for something on the floor and put something in his waistband. Corporal Melendez testified he then gathered the rest of his belongings and exited the bus. Corporal Melendez did not recall Sergeant Casey nor Lieutenant Dean using racial slurs towards each other during the argument. Corporal Melendez testified he never observed either of the two subject strike each other, nor did either subject have any marks that would indicated they had been punched. Corporal Nelson Cruz Corporal Cruz testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Corporal Cruz further testified he neither wished to add or change anything to his witness statement at this time. Corporal Cruz testified he was sitting in front, when he heard noise and turned around. Corporal Cruz indicated he couldn t see or understand what was going on. Corporal Cruz stated the bus driver pulled over, so he stood up because there was an obvious verbal altercation that was taking place between Lieutenant Dean and Sergeant Casey. Corporal Cruz stated he initially told Sergeant Casey to get off the bus, because he appeared to be free and clear to access the aisle, however he objected by stating, No I m not getting off. Corporal Cruz indicated he then told Lieutenant Dean, Let s go. Corporal Cruz stated Lieutenant Dean said he would go but that they are holding on to me. Page 22 of 57

23 Corporal Cruz testified Lieutenant Dean eventually got off the bus, and at that time he (Cruz) asked Sergeant Casey what had started the incident. Corporal Cruz stated Sergeant Casey didn t seem to know why it had happened. Sergeant Casey claimed Lieutenant Dean had jumped up and punched him in the face. Corporal Cruz indicated Sergeant Casey had concerns as to what would transpire once they arrived at the jail. Corporal Cruz testified Sergeant Casey stated I hope Dean doesn t start any shit when we get to the compound because I have an arsenal in my car. Corporal Cruz testified when the buses arrived at the Orange County Jail Complex, he instructed everyone to stay on the bus so he could usher Dean out of the area to prevent further escalation. Corporal Cruz stated as he approached the second bus, Lieutenant Dean was exiting the bus and they moved towards Officer Colon s vehicle, and then Lieutenant Dean opened the driver s side and allowed Officer Colon to enter. Corporal Cruz testified, as they were standing at the vehicle, he looked back and observed Sergeant Casey coming. Corporal Cruz stated at this point, he had observed Sergeant Casey closing the trunk of his vehicle, so he alerted Dean to turn around. Corporal Cruz stated Lieutenant Dean and Sergeant Casey then began to have words, although he couldn t recall what was said. Corporal Cruz indicated he stood in between them in order to manage the situation. Corporal Cruz testified at this point, Sergeant Casey walked to the driver s side of his vehicle, opened the door, reached underneath the seat, and removed a firearm. Corporal Cruz stated Sergeant Casey then turned facing Dean and placed the firearm in his waistband. Corporal Cruz stated although he observed Sergeant Casey with a firearm, he didn t feel threatened by Sergeant Casey or being shot. Corporal Cruz testified Sergeant Casey then stated what now while spreading his arms wide open. Corporal Cruz stated he then grabbed Dean and walked Dean away from Sergeant Casey. Corporal Cruz stated he then handed Lieutenant Dean to Captain White and asked him to take Dean to the farthest end of the parking lot. Corporal Cruz then returned to Sergeant Casey s location and told him it s over with. Corporal Cruz testified Sergeant Casey was still angry and felt he had gotten punked due to the incident on the bus. Corporal Cruz indicated Sergeant Casey then got into his vehicle and left the area. Corporal Cruz indicated he did not recall either Lieutenant Dean or Sergeant Casey using racial statements towards each other, nor did he recall seeing any marks that would indicate Sergeant Casey had been punched by Lieutenant Dean. Corporal Cruz stated he did not recall having to physically restrain Sergeant Casey at any point during the altercation in the parking lot. Additionally, Corporal Cruz testified during the argument, there did not appear to be an advancing aggression between the two of them other than arguing. Corporal Cruz however did recall at one point while on the bus, Sergeant Casey made the statement that he would stab Lieutenant Dean in the neck. Corporal Cruz added Lieutenant Dean and Officer Colon had already departed the bus when Sergeant Casey made the statement. Page 23 of 57

24 Corporal Cruz, when asked if Lieutenant Dean made a telephone call to Sergeant Casey on May 23, 2013, testified he could not 100% testify that Lieutenant Dean did not make the telephone call, although he did not remember anyone else being in possession of Lieutenant Dean s cell phone. Note: Sergeant Donald Casey would receive two (2) threatening phone calls on the evening of May 23, 2013, discouraging his scheduled testimony in this matter, and these calls (muffled voice) would be traced to the personal cell phone (407 ) of Lieutenant Michael Dean. Corporal Nelson Cruz was questioned in reference to this matter, as he was present at the residence of Lieutenant Michael Dean on the evening of May 23, 2013, attending a barbecue. MCO Mona Lisa Colon Officer Colon testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Officer Colon further testified she neither wished to add or change anything to her witness statement at this time. Officer Colon testified she was on the bus on the way back from Jacksonville, and that she was sitting in the aisle. Officer Colon went on to state she guessed an argument started and Sergeant Casey made a comment about stabbing Lieutenant Dean in the neck. Note: According to the testimony of Corporal Nelson Cruz they (Colon/Dean) had already left the bus when Sergeant Casey threatened to stab Lieutenant Dean in the neck, therefore Officer Colon could not attest to this threat. Officer Colon testified the bus driver stopped the bus, and she and Lieutenant Dean went to the second bus and went to sleep. Officer Colon stated upon arrival to the Orange County Corrections Department parking lot, Lieutenant Dean put her into the passenger seat of their vehicle. Officer Colon stated Sergeant Casey jumped off the first bus mumbling while walking to his vehicle, from which he pulled out a firearm. She heard Sergeant Casey chamber a round and then observed him place the weapon in his waistband. Officer Colon then indicated Sergeant Casey stated let s do this, what s up now. Officer Colon testified at this point, Lieutenant Dean and Sergeant Casey were involved in another verbal altercation. Officer Colon testified at this point, someone put Dean back into the car; however she indicated she is not sure who did this. Officer Colon testified, she couldn t remember the demeanor of the conversation prior to the argument ensuing on the bus because she had been drinking alcohol but believed everyone was just talking. Officer Colon, when asked if she remember Lieutenant Dean or Sergeant Casey using racial slurs towards each other, testified she did not remember but she was told afterwards, she was told a lot afterwards. 25 MCO Sandy White Officer White testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Officer White further testified she neither wished to add or change anything to her witness statement at this time. Officer White testified on the way back from Jacksonville, Corporal Tyre gained her attention by stating White they are fighting. Officer White stated she noticed three or four officers holding Lieutenant Dean. Officer White indicated Sergeant Casey announced that Lieutenant Dean had hit him, however she indicated she did not observe Lieutenant Dean strike Casey. Officer White testified once back on Orange County property, she observed Lieutenant Dean and Sergeant Casey at their respective vehicles, however she indicated she did not observe Sergeant Casey in the possession of a firearm. Officer Steven Chambers Officer Chambers testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Chambers further testified he neither wished to add or change anything to his witness statement at this time. Officer Chambers testified he was sitting at the rear of the bus and upon looking up observed people holding Lieutenant Dean back. Officer Chambers stated he told Lieutenant Dean to come to the back of the bus to sit with him. Officer Chambers stated the bus driver then pulled over and warned those involved in the commotion to stop what was going on, or he would contact law enforcement. Officer Chambers testified Lieutenant Dean then left he bus and the trip continued. Officer Chambers testified upon arrival to the Orange County Corrections complex, he got off the bus and went to his vehicle. Officer Chambers denied hearing Lieutenant Dean or Sergeant Casey using racial slurs towards each other during the argument. Officer Chamber further indicated he never observed Lieutenant Dean strike Sergeant Casey or Sergeant Casey in possession of a firearm at any time. Officer Edwin Concepcion Officer Concepcion testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Concepcion further testified he neither wished to add or change anything to his witness statement at this time. Officer Concepcion testified he was in the back of the bus sleeping when he heard a commotion. Officer Concepcion stated the bus pulled over and he observed Lieutenant Dean exiting the bus. Officer Concepcion denied hearing Lieutenant Dean or Sergeant Casey using racial slurs, nor did he observe Lieutenant Dean strike Sergeant Casey. Page 25 of 57

26 Officer Ricardo Gillard Officer Gillard testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Gillard further testified he neither wished to add or change anything to his witness statement at this time. Officer Gillard testified he was asleep on the bus when a commotion occurred and the interior lights came on. Officer Gillard stated people were keeping them (Dean and Casey) apart. Officer Gillard advised because it was being handled he decided not to get involved. Officer Gillard advised Lieutenant Dean departed the bus and boarded the other bus. Officer Gillard testified upon arrival back to the Orange County Corrections complex, Sergeant Martin made an announcement for everyone to stay on the bus. Officer Gillard stated everyone complied with the instructions with the exception of Sergeant Casey, who exited the bus. Officer Gillard denied hearing Sergeant Casey or Lieutenant Dean using racial slurs towards each other or Lieutenant Dean physically striking Sergeant Casey. Additionally, Officer Gillard denied observing Sergeant Casey in possession of a firearm. Officer Michael Martinez Officer Martinez testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Martinez further testified he neither wished to add or change anything to his witness statement at this time. Officer Martinez testified on the way back, the bus stopped and the bus driver from the lead bus came to his bus and advised his bus driver that there was a fight on the bus. Officer Martinez stated Lieutenant Dean and Officer Colon then boarded his bus and the trip continued. Officer Martinez testified once the bus arrived at the Orange County Corrections complex, he exited the bus, went to his vehicle and departed property. Officer Martinez denied seeing Lieutenant Dean and Sergeant Casey involved in an altercation in the parking lot. Officer Angela Bellamy Officer Bellamy testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Officer Bellamy further testified she neither wished to add or change anything to her witness statement at this time. Officer Bellamy testified we were headed back home when I heard a loud commotion and when I turned around I observed several people trying to hold Lieutenant Dean back. Officer Bellamy stated the bus then pulled over, and Sergeant Casey stated he wasn t going to get off the bus because he is the one that hit me. Page 26 of 57

27 Officer Bellamy testified eventually Lieutenant Dean departed her bus to board the other. Officer Bellamy advised once back on Orange County property, everyone was trying to get off the bus; however a commotion started at the front with Sergeant Martin. Officer Bellamy testified finally when she was allowed off the bus, she looked back and observed Sergeant Casey at his vehicle putting items into it. Officer Bellamy denied hearing Lieutenant Dean or Sergeant Casey using racial slurs during the argument. Additionally, Officer Bellamy denied seeing Lieutenant Dean strike Sergeant Casey or any injuries on Sergeant Casey that would indicate he was punched. Officer Peter Bromfield Officer Broomfield testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Broomfield further testified he neither wished to add or change anything to his witness statement at this time. Officer Broomfield testified he boarded the bus and began to doze off. Officer Broomfield indicated while on the way back, he felt bumpiness in the bus and felt that there was a flat tire. Officer Broomfield stated someone advised there was an incident at the front of the bus; however Broomfield stated he didn t observe anything. Officer Broomfield indicated once the bus was pulled over, he observed Lieutenant Dean and Officer Colon depart the bus. Officer Broomfield stated a few minutes later the bus continued back to Orlando. Officer Broomfield testified once the bus had arrived at Orange County property, several people stood up to gather their belongings; however someone at the front of the bus requested everyone stay on the bus so he remained in his seat. Officer Broomfield testified once he was allowed to disembark, he exited the bus, walked to his vehicle and drove home. Officer Carida Peace Officer Peace testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Officer Peace further testified she neither wished to add or change anything to her witness statement at this time. Officer Peace testified on the way back from the event, she heard shouting and woke up to the bus driver saying get off the bus. Officer Peace stated she heard Sergeant Casey state I m not getting off the bus. Officer Peace indicated Lieutenant Dean stated he would depart the bus; however Sergeant Casey continued to shout. Officer Peace testified while speaking with Sergeant Casey, she did not observe any marks on his face that would indicate he was punched by Lieutenant Dean. Officer Peace stated Lieutenant Dean and Officer Colon departed the bus and it continued to Orange County Property. Officer Peace indicated upon arrival back on property, she exited the bus and returned to her vehicle and departed the area. Page 27 of 57

28 Officer Enrique Ceballos Officer Ceballos testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Ceballos further testified he neither wished to add or change anything to his witness statement at this time. Officer Ceballos testified on the way back, he heard a commotion, and the lights were turned on. Officer Ceballos indicated the bus began to merge to the right and stop as Sergeant Casey and Lieutenant Dean were arguing and cursing. Officer Ceballos advised the bus driver then announced someone had to get off the bus, so Lieutenant Dean and Officer Colon departed the bus and the bus continued back to Orlando. Officer Ceballos testified once the bus arrived back to Orange County property, he observed through the window, Lieutenant Dean standing by his vehicle and Sergeant Casey going towards Lieutenant Dean. Officer Ceballos stated at this point he departed. Officer Elizabeth Drummond Officer Drummond testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. Officer Drummond further testified she neither wished to add or change anything to her witness statement at this time. Officer Drummond testified she boarded the bus, put on her headphones and went to sleep. Officer Drummond continued stating she woke up, looked around and wondered why the bus had stopped. Officer Drummond stated she looked around and heard someone say that Lieutenant Dean had hit Sergeant Casey. Officer Drummond indicated she peaked through her seat however she did not observe Sergeant Casey or Lieutenant Dean engaged, however she observed Sergeant Casey seated and Lieutenant Dean in his seat. Officer Drummond stated the bus driver then departed the bus, and people were talking about the bus driver wanting someone to exit the bus or he would not continue the trip back to Orange County. Officer Drummond testified someone asked Lieutenant Dean to exit the bus, and Officer Colon kept questioning why he needed to leave the bus stating he is fine, leave him alone. Officer Drummond stated, Lieutenant Dean then exited the bus without incident and the bus continued to the Orange County Corrections complex. Officer Drummond testified once arriving at Orange County property, someone instructed them not to leave, so she inquired why they weren t allowed to exit the bus. Officer Drummond advised someone stated Corporal Cruz went to check on the other bus. Officer Drummond testified Sergeant Casey then stated what are we waiting for and she replied to him, Corporal Cruz told us to wait. Officer Drummond testified Sergeant Casey then screamed at her move and she replied why are you screaming at me, and that s probably why something happened to you because you re rude. Page 28 of 57

29 Officer Drummond indicated Sergeant Casey was agitated and another person on the bus told Sergeant Casey to shut the fuck up and sit down, Cruz said to wait. Officer Drummond indicated Sergeant Casey then replied, Fuck Cruz, I m getting off this fucking bus. Officer Drummond testified she then sat back down in her seat, and Sergeant Casey exited the bus. Officer Drummond stated she didn t observe where Sergeant Casey went but other people then began to exit the bus as well. Officer Drummond testified she got off the bus, entered her car and left the property. Officer Ismael Aguirre Officer Aguirre testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Aguirre further testified he neither wished to add or change anything to his witness statement at this time. Officer Aguirre testified he boarded the bus, and on the trip home he fell asleep. Officer Aguirre stated he felt the bus come to a stop and when he opened his eyes it was pitch dark. Officer Aguirre indicated he looked around the bus and the interior lights were turned on. Officer Aguirre testified his wife told him that Sergeant Casey had been pulled off the bus. Officer Aguirre stated the bus doors then closed and he went back to sleep. Officer Aguirre stated once arriving back at Orange County property; he got off the bus, went to his vehicle and left property. Officer Wheeler McLilly Officer McLilly testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer McLilly further testified he neither wished to add or change anything to his witness statement at this time. Officer McLilly testified during the trip back to Orlando, he was on the second bus. Officer McLilly indicated the lead bus pulled off to the side of the road and the bus McLilly was on pulled in behind it. Officer McLilly stated both bus drivers spoke, and Lieutenant Dean and Officer Colon boarded his bus. Officer McLilly stated they both went to the back of the bus and sat down, then both buses continued the trip back to Orlando. Officer McLilly testified once the buses arrived at Orange County property, he exited the bus, entered his vehicle and departed property. Officer McLilly testified neither Lieutenant Dean nor Officer Colon made any statements about what had transpired. Officer Adrian McRae Officer McRae testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer McRae testified on the way back to Orlando, he put his headphone on and went to sleep. Officer McRae stated he felt the bus going off the side of the road and then heard a commotion although he wasn t sure who it was. Officer McRae stated he observed Lieutenant Dean being escorted off the bus and the bus then continued to Orange County property. Officer McRae indicated upon arrival at the Orange County Jail, he exited the bus, went to his vehicle and departed the property. Officer Ismael Pinero Officer Pinero testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Pinero further testified he neither wished to add or change anything to his witness statement at this time. Officer Pinero testified he was on the bus asleep when he heard a commotion and woke up. Officer Pinero indicated the only thing he was able to hear during the commotion was Lieutenant Dean stating stop talking about my girlfriend. Officer Pinero stated people stood up so his view was obstructed and he was unable to see; however Lieutenant Dean later left the bus. Officer Pinero testified once the bus returned to Orange County property, Sergeant Casey was adamant about exiting the bus. Officer Pinero indicated he observed Sergeant Casey approach his vehicle, place something on the trunk then entered his car and removed something that appeared to be a firearm. Officer Victor Rodriguez Officer Rodriguez testified prior to his interview, he was given the opportunity to review his witness statement and that it was a true and accurate representation of what occurred. Officer Rodriguez further testified he neither wished to add or change anything to his witness statement at this time. Officer Rodriguez testified he was on the second bus, and on the way back, the bus pulled over on the shoulder of the highway, and then he observed Lieutenant Dean and Officer Colon board his bus and acquire a seat. Officer Rodriguez testified upon arriving at Orange County property, he exited the bus, returned to his vehicle and departed property. DSO Angela McCaskill DSO McCaskill testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. 31 DSO McCaskill testified she was asleep and was awakened by an argument and bump to her seat. DSO McCaskill stated the bus driver pulled the bus over and said someone would have to leave the bus or he was going to call the police. DSO McCaskill stated Lieutenant Dean exited the bus and the bus returned back to Orlando. DSO McCaskill testified once the bus arrived in Orlando, she proceeded to her vehicle to depart property. DSO McCaskill testified she never observed either party strike each other during the argument. DSO Ryan Brooks DSO Brooks testified prior to her interview, she was given the opportunity to review her witness statement and that it was a true and accurate representation of what occurred. DSO Brooks further testified she neither wished to add or change anything to her witness statement at this time. DSO Brooks testified she heard a loud commotion and the bus was pulled over. DSO Brooks stated a male and female (Lieutenant Dean and Officer Colon) exited the bus. DSO Brooks testified when they arrived at Orange County property, they were asked to stay on the bus. DSO Brooks stated however Sergeant Casey exited the bus. DSO Brooks stated she did not witness what occurred on the bus or in the parking lot. Sergeant Donald Casey Subject Sergeant Casey testified he has been employed by the Orange County Corrections Department for approximately twelve years (12) and understands as an employee it is his responsibility to be aware of the policies and procedures that govern his employment and for him to act in accordance with those policies and procedures. Sergeant Casey testified he went to a charity boxing event and rode on one of two Mears charter buses. Sergeant Casey indicated on the way back, there was a group (Sergeant Dunn, Lieutenant Dean and MCO Colon) talking amongst themselves. Sergeant Casey testified out of the blue, Lieutenant Dean stated to him, I don t appreciate the way you treated Colon in North Perimeter. Sergeant Casey stated he first didn t know what Dean was talking about so he asked him to clarify his statement, so Lieutenant Dean repeated the statement. Sergeant Casey testified the only statement he made to Colon at North Perimeter was that she needed to utilize the time clock in her own area. Sergeant Casey stated during his discussion with Colon, she was very professional about it and understood and that it only occurred on one occasion. Sergeant Casey continued stated Dean stopped talking and stared angrily at the seat in front of him. Sergeant Casey testified everyone began looking around at each other because Dean s statement was totally out of the blue and unprovoked. Sergeant Casey testified moments later, Dean struck him in the right side of the nose. Sergeant Casey testified the right side of his nose was swollen, his vision was blurred and his eyes were watering due to the impact of the punch from Lieutenant Dean. Page 31 of 57

32 Sergeant Casey testified after the altercation took place with Lieutenant Dean, it took approximately one (1) hour for the bus to arrive back at the Orange County Corrections Complex. Sergeant Casey claimed although there was no blood from the impact, there was swelling and pain to the location. Sergeant Casey testified he did not seek medical treatment for his injuries; however he was unable to work his shift the following day due to the swelling and pain. Sergeant Casey testified he returned to work the following Wednesday and the swelling from the injury had subsided but that it was still tender. Sergeant Casey when asked if any bruising had occurred indicated nothing physical but possibly deep tissue. Sergeant Casey went on to state he was still unable to blow his nose because it was still painful. Sergeant Casey testified prior to the incident that night, he had no previous confrontations with Lieutenant Dean and considered him a friend. Sergeant Casey testified prior to the argument with Lieutenant Dean, he consumed two mixed drinks on the way to the event; he had a drink at the event and a beer on the way back. Sergeant Casey testified he did not believe he was impaired due to the alcohol consumption that evening and was in complete control of his faculties. Sergeant Casey testified he did not remember an order being given by Corporal Cruz to remain on the bus upon arriving to the Orange County Corrections South Perimeter complex. Sergeant Casey testified when the bus came to a stop, the lights came on and everyone began to gather their things. Sergeant Casey stated no one appeared to be moving and he desperately needed to make a bowel movement and the bus restroom did not have toilet paper, and was unsanitary. Sergeant Casey testified his intention was to depart the bus, go to his vehicle and drive to the South Perimeter building to use the facilities and go home. Sergeant Casey stated he had a two litter bottles of soda and some personal items and placed them on the trunk of his vehicle, so he could retrieve the keys from his pocket. Sergeant Casey testified as soon as he put the items down on his trunk, Lieutenant Dean was at the driver s rear of Officer Colon s vehicle. Sergeant Casey testified Dean made the statement to him Fuck you, so he shook his head and placed his hands up in disbelief. Sergeant Casey testified he felt Dean was attempting to engage him in another physical altercation, so Sergeant Casey testified his intention was to get in his vehicle and depart the area. Sergeant Casey testified he retrieved his keys from his pocket and went to his driver s door, and Lieutenant Dean responded by going rapidly from the back of his vehicle to the driver s door, which was already open. Sergeant Casey testified he was fearful that Lieutenant Dean was going to get a gun, so he (Casey) retrieved his personal firearm from the center console, clipped it on his waistband and pulled his shirt over the firearm. Sergeant Casey testified he then turned to face Lieutenant Dean. Sergeant Casey stated Dean made the statement; Oh you re going to pull a gun, so he raised his hands above his head, rotated his wrists and replied What firearm. Sergeant Casey stated he reacted in this manner attempting to deescalate the situation. Page 32 of 57

33 Sergeant Casey denied having pointed the firearm at Lieutenant Dean or any other individual located in the parking lot that evening. Sergeant Casey denied making any threats of bodily harm to Lieutenant Dean or any other individual that evening, or having any intent to carry out such threats. Sergeant Casey testified he was embarrassed about the situation that occurred between himself and Lieutenant Dean, and just wanted the night to be over with. Sergeant Casey testified he was at his home on May 23, 2013, when his personal cell phone rang; he didn t recognize the number but answer the telephone. Sergeant Casey testified he heard an electronically disguised voice state Hey asshole, hey asshole, you better not say shit during your interview. Sergeant Casey stated he did not say anything but terminated the call. Sergeant Casey testified approximately two (2) minutes later he received a second telephone call from the same number and upon answering it, again an electronically disguised voice stated Oh your scared now, you should be. Sergeant Casey testified based on the mannerism of the person speaking; he was reasonably able to conclude it might have been Lieutenant Dean. Sergeant Casey again stated he terminated the call without making a statement and contacted the Apopka Police Department. Sergeant Casey testified he filled a police report because he was in fear of an attack by Lieutenant Dean. Sergeant Casey stated he filed a petition for injunction against Lieutenant Dean on May 30, 2013 because of the phone threats and the incident on the bus; he was scared Dean would act on his threats. Sergeant Casey when asked why, if he was in fear of Lieutenant Dean, he would drop the injunction against Lieutenant Dean on June 10, Casey claimed he was strong armed by the judge and was forced to choose between his personal safety or his livelihood because part of his job responsibilities is to carry a firearm, so he chose his job over his safety. Lieutenant Michael Dean Subject Lieutenant Dean testified he has been employed by the Orange County Corrections Department for approximately fifteen years (15) and understands as an employee it is his responsibility to be aware of the policies and procedures that govern his employment and for him to act in accordance with those policies and procedures. Lieutenant Dean testified he attended the Guns and Hoses boxing match in Jacksonville Florida. Lieutenant Dean stated he is the 1st Vice President of the Fraternal Order of Police, so he needed to be there. Lieutenant Dean testified after the event, he boarded the bus and at some point during the return trip, Sergeant Casey made a comment about the way Officer Colon looked. Lieutenant Dean stated after the comment, he told Sergeant Casey if you had anything to say to her, you should have said it before, when you observed her coming in and out when she was on day shift. Lieutenant Dean testified Sergeant Casey replied, I can t believe you are still with this nigger. Page 33 of 57

34 Lieutenant Dean stated he told Sergeant Casey to watch your mouth who replied I ll stab you. Lieutenant Dean testified he observed Sergeant Casey s right hand move and his right arm drop giving Lieutenant Dean the impression Sergeant Casey was going to pull out a knife. Lieutenant Dean stated based on Sergeant Casey s actions, he swung at him. Lieutenant Dean testified after he swung at Sergeant Casey, everyone jumped in between them and at some point; Sergeant Casey took control of Lieutenant Dean s arm. Lieutenant Dean advised someone was holding him (Dean) back and Dean kept yelling watch him because Sergeant Casey looked, as if he was going to stand up. Lieutenant Dean testified Sergeant Casey eventually let go of his arm and he was able to sit back down in the seat. Lieutenant Dean testified he was good because the threat was taken away due to the other people in the area. Lieutenant Dean testified the bus driver then pulled the bus to the side of the road and stated someone had to leave the bus. Lieutenant Dean stated they originally told Sergeant Casey to get off the bus, however Lieutenant Dean stated he (Dean) was attempting to exit the bus, however Officer Colon pushed him back preventing him from exiting the bus. Lieutenant Dean testified Corporal Cruz then came over to their seating location and spoke with Officer Colon, who then allowed Lieutenant Dean to exit the bus. Lieutenant Dean stated as he was exiting the bus, he turned around to see the location of Officer Colon, and noted Sergeant Casey was still creating a commotion by stating he would stab Lieutenant Dean in the neck when they got back. Lieutenant Dean testified once he boarded the second bus; they sat down and watched a movie. Lieutenant Dean indicated upon the bus arriving back to the Orange County Jail, they gathered their belongings and exited the bus. Lieutenant Dean testified he helped Officer Colon to her vehicle and as they approached the passenger s side of the vehicle, he opened the door to allow Officer Colon to enter the cab of the vehicle. Lieutenant Dean stated he looked over his right shoulder and observed Sergeant Casey coming. Lieutenant Dean testified he was unaware that Sergeant Casey s vehicle was in close proximity to Officer Colon s, however he placed Officer Colon in her vehicle and as she was sitting, Lieutenant Dean observed Sergeant Casey reach in to the driver s side of his vehicle and removed a firearm from the car. Lieutenant Dean testified he shut the car door, and turned to face Sergeant Casey who stated what now and then placed the firearm in his waistband. Lieutenant Dean testified Sergeant Casey pointed the firearm at him prior to placing the weapon in his waistband. Lieutenant Dean testified he then stated in a loud voice He s got a gun because he (Dean) was attempting to draw attention to the area in case Sergeant Casey started shooting. Page 34 of 57

35 Lieutenant Dean testified Corporal Cruz then walked up, placing himself between Sergeant Casey and himself. Lieutenant Dean stated himself and Corporal Cruz backed away from the area until Captain White approached, and Lieutenant Dean went with Captain White while Corporal Cruz began walking back towards Sergeant Casey. Lieutenant Dean stated he stayed with Captain White behind the buses until Corporal Cruz returned and advised Sergeant Casey had left the area. Lieutenant Dean stated he then returned to the vehicle and departed the area with Officer Colon. Lieutenant Dean said prior to this incident, he never had any previous issues with Sergeant Casey. Lieutenant Dean when asked how much alcohol he had consumed prior to the incident, and in response testified he was unsure as to how many drinks he had on the way up, once at the event he consumed one (1) drink and upon the return trip he had no drinks. Lieutenant Dean testified he felt he was in complete control of his faculties when the incident occurred and was not intoxicated. Lieutenant Dean however added that he felt Sergeant Casey was intoxicated when the incident occurred because he was consuming alcoholic beverages during the ride back to Orlando. Lieutenant Dean when asked if his actions on the bus were appropriate for a Lieutenant and an employee of the Orange County Corrections Department responded, As a person that felt threatened yes. Lieutenant Dean, when asked if telephone number belonged to him testified, Yes. Lieutenant Dean further stated he was in possession of the telephone the entire night of May 23, Lieutenant Dean however denied making any telephone calls to Sergeant Casey on the date in question. Lieutenant Dean confirmed he filed an injunction for protection against Sergeant Casey on May 30, Lieutenant Dean stated he filed the injunction because he was called to the Cassidy Building and was served with an injunction filed by Sergeant Casey. Lieutenant Dean stated the information provided in the injunction filed by Sergeant Casey was a complete lie and if someone was going to lie on a court document there was no telling what this person would do. Lieutenant Dean therefore filed an injunction against Sergeant Casey for protection from him. Lieutenant Dean was asked if he was in fear for his life from Sergeant Casey because of all the incidents that occurred why didn t he ever file a police report, and in response stated, I was advised to do so, but never did. 37 Frame 3 (April 13, 2013 / 23:33:32): Video shows Sergeant Dunn appearing to separate Lieutenant Dean and Sergeant Casey. It appears from the video Sergeant Casey has a grasp on Lieutenant Dean s arm. Frame 4 (April 13, 2013 / 23:33:35): Video shows Sergeant Dunn still attempting to separate Sergeant Casey and Lieutenant Dean. At this point, other persons on the bus appear to be awoken from the confrontation. Frame 5: 2333 HRS Frame 6: 2333 HRS Frame 5 (April 13, 2013 / 23:33:36): Video shows Sergeant Dunn, now attempting to stand and separate Lieutenant Dean and Sergeant Casey. Sergeant Casey has remained seated while Lieutenant Dean is observed standing. Frame 6 (April 13, 2013 / 23:33:45): Video shows Lieutenant Dean, who is still standing, appears being held back by Sergeant Dunn and other bus riders. Sergeant Casey still appears seated. Corporal Nelson Cruz is now out of his seat attempting to assist with the situation. Frame 8 (April 13, 2013 / 23:38:35): Video shows Captain Berry White standing in the aisle separating Sergeant Casey, who is still seated, from Lieutenant Dean who appears entering the bus aisle presumably to disembark the bus. Frame 9: 2338 HRS Frame 10: 2338 HRS Frame 9 (April 13, 2013 / 23:38:37): Lieutenant Dean, who is still in the aisle, appears turning back to reengage Sergeant Casey who is still seated. Captain White is blocking Lieutenant Dean s actions with his body. Frame 10 (April 13, 2013 / 23:38:39): Video shows Lieutenant Dean still attempting to engage Sergeant Casey who is still seated. Frame 12 (April 13, 2013 / 23:38:45): Video shows Captain White take control of Lieutenant Deans left arm, which is still pointed at Sergeant Casey, and escorts Lieutenant Dean from the bus. APOPKA POLICE REPORT May 23, 2013 On May 23, 2013, I, Officer Eller responded to 514 Sundown Court in reference to harassing phone calls. Upon arrival I met with Sergeant Donald Casey, of the Orange County Corrections Department who related the following verbally and in a sworn written statement: Casey told me he is currently under Internal Investigation by the Orange County Corrections Department for an incident that occurred on April 13, 2013, while en-route to Orlando from Jacksonville on a charter bus from the Guns and Hoses event. On the trip back Casey and Orange County Corrections Lieutenant Michael Dean got into a verbal altercation, and that Dean eventually sucker punched Casey in the stomach. The two were separated and upon arrival back to the Orange County Jail, a second altercation occurred in which Casey is accused of pulling out a firearm and threating Dean, who was actively threating him. There is an active investigation in the above mentioned case ( ) which began on May 6, Casey told me he has an upcoming interview with Internal Affairs. On May 23, 2013 at 2102 hours, Casey received a phone call from a number he does not know ( in which he heard a person with a disguised voice state, Hey asshole, hey asshole, you better not say shit during your interview! Casey stated after hearing this he ended the phone call. At 2104 hours he received a second phone call from the same phone number and heard the same disguised voice state, Oh you re scared now! You should be! Casey again ended the phone call. Casey stated he could not identify the voice and did not recognize the phone number. Casey told me Dean is not in his direct chain of command; however, he does have access to all of Casey s personal records. Casey stated he is fearful someone may try to come to his home and harm him. Casey stated he tried to call the number back with negative results and I attempted a reverse look up of the number with negative results. Page 39 of 57

40 SERGEANT DONALD CASEY TELEPHONE SNAPSHOT The Internal Affairs Unit requested from Sergeant Donald Casey evidence showing that telephone number contacted him on May 23, 2013, as indicated in the Apopka Police Report. Sergeant Casey subsequently provided the Internal Affairs Unit with a snapshot of his telephone screen showing two telephone calls were placed to his cell phone on May 23, 2013, from telephone number This snapshot was subsequently verified to be accurate by a review conducted by the Internal Affairs Unit of Sergeant Casey s cell phone.
