5 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION 1.0 INTRODUCTION AND BACKGROUND In December 2008, the Federal Aviation Administration (FAA) issued a Record of Decision (ROD) for the Final Environmental Impact Statement that evaluated the proposed expansion of Runway 9R-27L and other associated airport projects at the Fort Lauderdale-Hollywood International Airport (FLL). 1 The FAA's ROD was based on the information and analysis contained in the Final Environmental Impact Statement for the Development and Expansion of Runway 9R-27L and Other Associated Airport Projects at Fort Lauderdale-Hollywood International Airport Broward County, Florida, June 2008 (2008 FEIS). Runway 9R-27L is now referred to as Runway 10R-28L due to a change in magnetic declination. In January 2009, the FAA approved an Airport Layout Plan submitted by the Broward County Aviation Department (BCAD) that depicted the proposed expansion. 2 In May 2011, 3 BCAD submitted to the FAA an update to the 2009 approved ALP depicting further refinements to the runway expansion project that resulted from a 60-percent design study. The FAA approved a Written Re-Evaluation in July 2011 for those changes to the project (identified in this Written Re-Evaluation as the Previously Approved Action). FAA approved the update to the ALP in August Since the FAA's approval of the July 2011 Written Re-Evaluation and August 2011 ALP, further design changes and refinements associated with engineering the new runway and taxiway system have been made. Those design changes are the subject of this Written Re-evaluation. 1.1 Need for a Written Re-Evaluation FAA, with input from Broward County, has prepared this Written Re-evaluation in accordance with FAA Order B, National Environmental Policy Act (NEPA) Implementing Instructions for Airport Projects, paragraph 1401 c.(2) and FAA Order E, Environmental Impacts: Policies and Procedures. The design changes (identified in this Written Re-evaluation as the Proposed Changes) are analyzed herein "to determine whether the Proposed Changes are substantial and whether the resulting environmental impacts present significant new circumstances or information relevant to environmental concerns that have a bearing on the proposed action or its impacts. 6 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION Per FAA Order E, paragraph 515a, "The preparation of a new EIS is not necessary when it can be documented that the: (1) Proposed action conforms to plans or projects.for which a prior EIS has been filed and there are no substantial changes in the proposed action that are relevant to environmental concerns; (2) Data and analyses contained in the previous EIS are still substantially valid and there are no significant new circumstances or information relevant_ to environmental concerns and bearing on the proposed action or its impacts; and (3) Pertinent conditions and requirements (all) of the prior approval have, or will be, met in the current action." If the proposed changes do not meet the above criteria, then further analysis is necessary. (See FAA Order E, Paragraph Si6a.) 1.2 Proposed Changes to the Previously Approved Action A variety of design changes associated with engineering the new runway and ta?<iway system have been made as construction of the project is underway. The Proposed Changes to the Previously Approved Action that are the subject of this Written Re-evaluation include the realignment of the Airport Perimeter Road on the southwest side of FLL, modification of an emergency navigational aid (NAVAID) access road on the east side of the Airport, and the design to the NAVAID runway approach lighting system and the associated maintenance bridge Realignment of Airport Perimeter Road In the 2008 FEIS, a western segment of the Airport Perimeter Road was identified for relocation and termination due to its location in the projected future Runway Object Free Area (OFA) of Runway 10R-28L. 5 Based on the need to maintain the functionality of this segment of Airport Perimeter Road for vehicular access and connectivity to the west side of the airfield, BCAD is currently pursuing an FAA approval for a Modification of Design Standard to operate this segment of the Airport Perimeter Road located within the OFA. (A graphic exhibit of this proposed chang-e is provided in Appendix A.) The Airport Perimeter Road proviqes Airport personnel with access to conduct perimeter checks for maintenance operations and security. The Proposed Changes assessed in this Written Re-evaluation include the realignment of a portion of Airport Perimeter Road. This element of the Proposed Changes is expected to result in a change in wetland impacts from the Previously Approved Action. 5 This action for the Airport Perimeter Road was identified In the 2008 FEIS as a connected action. 7 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION Emergency NAVAID Access Road In the 2008 FEIS, the proposed project included the construction of a mechanically stabilized earth retaining wall to support the elevated runway end along with NAVAIDS placed near the Runway 28L end. A modification of the NAVAID Access Road, as requested by the County Fire Marshall, is needed to provide emergency vehicles with access to these NAVAIDs. With this proposed modification in the roadway, a change in wetland impacts from the Previously Approved Action is expected. (A graphic exhibit of this element of the Proposed Changes. is provided in Appendix A.) MALSF NAVAID The 2008 FEIS identified an approach light system for Runway 10R-28L that included a 2,400 foot Medium Intensity Approach Light System (MALS) with runway alignment indicator lights (MALSR), localizer, and glideslope for the Runway lor end and a 1,400 foot MALS for the Runway 28L end. 6 Based on consultation with the FAA/ the approach light system for Runway 10R-28L was changed to a 1,400 foot MALS with sequenced flashing lights (MALSF). 8 The FAA evaluated the MALSF system in Sections 1 and 3 of the July 2011 Written Re-Evaluation and determined that it did not constitute a substantial change from the FEIS. Since the July 2011 Written Re-Evaluation, the FAA has been performing construction design and preparing this particular element to go out for public procurement for a contractor to construct. Slight design modifications have bee.n needed from the conceptual plans such as the orientation of the lighting pads and the design changes to the maintenance bridge. Implementation of these changes would have a similar environmental impact to those previously approved including impacts to wetlands as approved by the FAA in the July 2011 Written Re-Evaluation. Broward County has already obtained adequate mitigation credits for this slight change in design as approved in the FLL U.S. Army Corps of Engineers (USACE) Runway Expansion Permit SAJ (IP-MJW). No permit modifications would be needed. Therefore, all mitigation requirements that were conditions of the prior approval have been met for the MALSF NAVAID. 2.0 AFFECTED ENVIRONMENT The 2008 FEIS Affected Environment chapter provided a description of the existing environmental conditions in and around the vicinity of FLL. 8 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION the 2008 FEIS baseline is still relevant and representative of existing conditions at the time of this Written Re-evaluation because conditions have not changed substantially in and around the vicinity of FLL. 3.0 ENVIRONMENTAL CONSEQUENCES Pursuant to the requirements of FAA Orders , National Environmental Policy Act (NEPA) Implementing Instructions for Airport Actions, and E, Environmental Impacts: Policies and Procedures, the environmental consequences of the Proposed Changes to the Previously Approved Action have been reviewed to determine if the data and the analysis in the 2008 FEIS are still substantially valid and to determine whether there are any new significant circumstances or information from those disclosed in the 2008 FEIS and July 2011 Written Re Evaluation requiring additional NEPA. analysis. This Written Re-evaluation also determines whether pertinent conditions and requirements of the prior approval have been, or will be, met with the Proposed Changes to the Previously Approved Action. 3.1 Environmental Categories Where No Changes Occur The study areas and the limits of disturbance are the same as in the 2008 FEIS and July 2011 Written Re-Evaluation and the types of construction and development are similar in type and character to those for the Previously Approved Action. Based on this review, there is no change in environmental impacts associated with the Proposed Changes to the Previously Approved Action for the following resource categories. Air Quality. Coastal Resources Compatible Land Use Department of Transportation Act Section 303(c) (Formerly Section 4(f) Resources) Farmlands Fish, Wildlife, and Plants Floodplains Hazardous Materials, Pollution Prevention, and Solid waste Historical, Architectural, Archaeological, and Cultural Resources Light Emissions and Visual Impacts Natural Resources and Energy Supply Noise Secondary (Induced) Impacts Socioeconomic Impacts, Environmental Justice, and Children's Environmental Health and Safety Risks Wild and Scenic Rivers 3.2 Environmental Categories Where a Change in Impacts May Occur The resource categories where environmental consequences could potentially differ from those disclosed in the 2008 FEIS and the July 2011 Written Re-Evaluation are addressed in the following sections. 9 FORTLAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRirrEN RE-EVALUATION Construction Impacts Construction impacts associated with the Proposed Changes would occur within the limits of disturbance disclosed in the 2008 FEIS. Construction of both the realigned Airport Perimeter Road and the Emergency NAVAID Access Road is expected to be substantially similar to the estimated construction impacts disclosed in the 2008 FEIS and the July 2011 Written Re-Evaluation. As noted in Section 1.2.3, slight design modifications have been needed for the MALSF from the conceptual plans. Implementation of these changes would have a similar environmental impact to those previously approved including impacts to wetlands as approved by the FAA in the July 2011 Written Re-Evaluation. Therefore, no substantial changes in environmental impacts with.respect to construction impacts would occur with the Proposed Changes to the Previously Approved Action. Data and analysis contained in the 2008 FEIS remain substantially valid. The Proposed Changes to the Previously Approved Action would not result in any changes to the 2008 FEIS conclusions regarding construction impacts Water Quality The FAA determined in the 2008 FEIS ROD and the July 2011 Written Re-Evaluation that the Previously Approved Action would not result in significant adverse water quality impacts for either surface or ground waters. This determination was based on analyses included in the 2008 FEIS. With the Proposed Changes it is anticipated that existing permits obtained by Broward County will need to be modified. Broward County is still responsible for assuring that all required permitting requirements are met. Broward County has initiated the process of modifying the existing permits with the applicable regulatory agencies (USACE, SFWMD, and Broward County Environmental Protection and Growth Management Department. (The documentation of agency coordination activities is provided in Appendix A.) Through the permit process Broward County will meet the requirements of the State of Florida's Public Interest Test (See F.S.A (1)(a)). Therefore, the Proposed Changes to the Previously Approved Action would not result in any substantial changes to the 2008 FEIS or July 2011 Written Re Evaluation conclusions regarding water quality impacts. Data and analysis contained in the 2008 FEIS remain substantially valid. All permit and mitigation requirements that were conditions of the prior approval have been, or will be, met by Broward County Wetlands As discussed. in the 2008 FEIS, the Previously Approved Action was developed to avoid and minimize direct impacts to wetlands to the extent practicable. However, the Previously Approved Action disclosed that direct impacts to acres of December 2013 PageS

10 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION wetlands would result from fill, erosion, sedimentation, and the clearing of vegetation associated witli the expansion of Runway 10R-28L, the installation of the runway approach lights, and the associated access roads. In addition to direct impacts, the 2008 FEIS and July 2011 Written Re-Evaluation disclosed potential secondary impacts of acres to wetlands. Wetland mitigation from the project's anticipated impacts was developed based on Uniform Mitigation Assessment Method (UMAM) functional loss (FL) units and.the functional gain (FG) units required to compensate for both direct and secondary impacts. 9 The UMAM FG units provided a conservative estimate oftotal m,itigation required for the project. UMAM scores were calculated based on input from, and in coordination with, the USACE, the South Florida Water Management District (SFWMD), and the U.S. Environmental Protection Agency. A total of 7.97 functional units was needed for mitigation for the proposed project. The direct and secondary impacts and associated UMAM scores developed in the July 2011 Written Re-Evaluation are provided in Table 1, Dirt;!ct and Secondary Wetland Impacts and UMAM Scores for the Previously Approved Action. It was Broward County's intent to use mitigation credits at West Lake Park to mitigate the project's potential wetland impacts. As stated in the 2008 FEIS ROD, it is Broward County's responsibility as the Airport Sponsor to apply for and obtain permits required by these regulatory agencies. Broward County obtained the required permits that allow for habitat restoration and enhancement within West Lake Park. 10 Based on the amount of mitiga~ion credits available to Broward County in the SFWMD and USACE permits for West Lake Park, there are sufficient mitigation credits available to accommodate the 7.97 functional units. Proposed Changes Due to changes in design associated with Airport Perimeter Road, additional wetlands that rim the entire bank of two storm water ponds (GB Pond West and GB Pond East) on the southwest side of the Airport would now be impacted. The direct wetland impact to both these areas totals 0.25 acres. On the east side of FLL, direct impacts to wetland W-N3a would increase from those disclosed in the 2011 Written Re-Evaluation due to the need expressed by the County Fire Marshall to provide emergency access to the NAVAID. The direct impacts to W-N3a would increase from 1.51 acres to 1.59 acres with the Proposed C.hanges. 9 FL units refer to the impacts from the Project. The revised direct and secondary impacts and associated UMAM scores are provided in Table 2, Direct and Secondary Wetland Impacts and UMAM Scores Pr~posed Changes. With the Proposed Changes, the UMAM FG units needed for mitigation have been revised to 8.05 FG units (6.64 direct FG units and 1.41 secondary FG units) as compared to 7.97 FG units disclosed in the July 2011 Written Re-Evaluation. Based on the amount of mitigation credits available to Broward County in the SFWMD and USACE permits for West Lake Park, there are sufficient mitigation credits available to accommodate this increase in total FG units. 12 FORT LAUDERDALE-HOLLYWOOD international AIRPORT WRITTEN RE-EVALUATION The functional value of the wetland resources will be offset with mitigation that replaces the wetland functions to be lost. Therefore, no n et adverse impact to the functional values of the wetland resources and water quality is anticipated as the result of the proposed activities. Table 2. Although overall the acreage for direct impacts to wetlands has increased and UMAM FG units have increased, there is adequate mitigation for project impacts with the Proposed Changes to the Previously Approved Action. 13 Data and analysis contained in the 2008 FEIS and the July 2011 Written Re Evaluation remains substantially valid and all mitigation requirements that were conditions of the prior approval have been, or will be, met with the Proposed Changes to the Previously Approved Action. The Airport Sponsor is in the process ofsecuring all required permits from the regulatory agencies. FORT LAUDERDALE-NOLL YWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION 4.0 CUMULATIVE IMPACTS The potential cumulative impacts of the Proposed Changes to the Previously Approved Action, in combination with other related or independent actions in the vicinity of FLL, are presented in this section. 11 The analysis of potential cumulative impacts recognizes that while the impacts of many actions may be individually. small, when combined with the impacts of past, present, and reasonably foreseeable future actions on populations or resources, the impacts could be potentially significant from a cumulative perspective. 4.1 CUMULATIVE IMPACT COMPARISON FAA has determined in this Written Re-evaluation that there are no changes in environmental impacts with the Proposed Changes to the Previously Approved Action for the following environmental categories: air, noise, coastal resources, D.OT 4(f) resources, farmlands, fish, wildlife, and. plants, floodplains, historical, architectural, archeological, and cultural resources,. light emissions and visual impacts, natural resou.rces and energy supply, compatible land use, hazardous waste, secondary (induced) impacts, socioeconomic impacts, environmental justice and children's health and safety issues, and wild and scenic rivers. Because there is no change in environmental impact, there is also no change in cumulative effect associated with these resource categories for the Proposed Changes to the Previously Approved Action when combined with past, present, and reasonably foreseeable future projects. Therefore, there is no change in the 2008 FEIS or July 2011 Written Re-Evaluation conclusion of no significant cumulative impacts with regard to air, noise, coastal resources, fish, wildlife, and plants, light emissions and visual impacts, natural resources and energy supply, compatible land use, hazardous waste, secondary (induced) impacts, socioeconomic impacts, environmental justice and children's health and safety issues. FAA has determined in this Written Re-evaluation that there are no significant changes in environmental impacts with the Proposed Changes to the Previously Approved Action for the following environmental categories: construction, water quality, and wetlands. 11 Cumulative impacts are those impacts that can be reasonably expected to occur as a result of implementing the Proposed Changes, in combination with the impacts from other past, present, and reasonably foreseeable future activities, development, and/or projects that may be connected by geography or time. Considering Cumulative Impacts Under the National Environmental Policy Act, Council on Environmental Quality, Executive Office of the President. Dated: January December 2013 Page9

14 FORT LAUDERDALE-HOLLYWOOD INTERNATIONAL AIRPORT WRITTEN RE-EVALUATION For these categories, additional environmental impacts due to the Proposed Changes to the Previously Approved Action were minor or insignificant. All mitigation requirements that were conditions of the prior approval have been, or will be, m et with the Proposed Changes to the Previously Approved Action. Additipnally, all permitting and mitigation requirements have been or will be met for past, present, and reasonably future actions. Therefore, there would be no cumulative effect associated with these resource categories for the Proposed Changes to the Previously Approved Action when combined with past, present, and reasonably foreseeable future projects. Therefore, this Written Re-evaluation of the Proposed Changes does not demonstrate a change in the conclusions reached in the 2008 FEIS or July 2011 Written Re-Evaluation. The Proposed Changes do not cause significant cumulative impacts with regard to construction impacts, water quality, or wetlands. * * * * * Cumulative effects are not expected to be substantially different from those disclosed in the 2008 FEIS and the July 2011 Written Re-Evaluation. Because the additional impacts are minor, and mitigation is provided, it is reasonable to expect that the Previously Approved Action with the Proposed Changes combined with other identified actions, would not result in significant cumulative effects. All of the identified actions would be required to comply with regulatory. requirements and mitigation in accordance with local, state, and Federal regulations. 5.0 CONCLUSION Based on the above analysis the Proposed Changes conform to plans for which a prior EIS has been filed, and involve no substantial changes that are relevant to environmental concerns. Data and analyses contained in the 2008 FEIS and July 2011 Written Re-Evaluation are still substantially valid, and there are no significant new circumstances or information relevant to environmental concerns and bearing on the Proposed Changes or their impacts. Finally, the Proposed Changes meet pertinent conditions and requirements of the prior approval. Therefore, as discussed above and in accordance with FAA Order E, Environmental Impacts: Policies and Procedures, and FAA Order , National Environmental Policy Act (NEPA) Implementing Instructions for Airport Actions, the preparation of a new EIS is not necessary. Commencement Notification: Within 10 days from the date ofinitiating the authorized work, the Permittee shall provide to the Corps a written notification ofthe date of commencement ofwork authorized by this permit. Notification will be provided to the Regulatory Division, Special Projects and Enforcement Branch, 4400 PGA Boulevard, Suite 500, Palm Beach Gardens, Florida 33410, or by to Jose.J.Rivera@usace.am}1.mil. 2. The Permittee understands and agrees that, iffuture operations by the United States require the removal, relocation, or other alteration, ofthe structures or work herein authorized, or if, in the opinion ofthe Secretary ofthe Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation ofthe navigable waters, the Permittee will be required, upon due notice from the U.S. Anny Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. Cultural Resources/Historic Properties: a. No structure or work shall adversely affect impact or disturb properties listed in the National Register ofhistoric Places (NRHP) or those eligible for inclusion in the NRHP. b. Ifduring the ground disturbing activities and construction work within the permit area, there are archaeological/cultural materials encountered which were not the subject of a previous cultural resources assessment survey (and which shall include, but not be limited to: pottery, modified shell, flora, fauna, human remains, ceramics, stone tools or metal implements, dugout canoes, evidence of structures or any other physical remains that could be associated with Native American cultures or early colonial or American settlement), the Permittee shall immediately stop all work and ground-disturbing activities within a 1 00-meter diameter ofthe discovery and notify the Corps within the same business day (8 hours). The Corps shall then notify the Florida State Historic Preservation Officer (SHPO) and the appropriate Tribal Historic Preservation Officer(s) (THPO(s)) to assess the significance ofthe discovery and devise appropriate actions. c. Additional cultural resources assessments may be required ofthe permit area in the case of unanticipated discoveries as referenced in accordance with the above Special Condition ; and if deemed necessary by the SHPO, THPO(s), or Corps, in accordance with 36 CFR 800 or 33 CFR 325, Appendix C (5). Based, on the circumstances ofthe discovery, equity to all parties, and considerations ofthe public interest, the Corps may modify, suspend or revoke the permit in

28 -3 accordance with 33 CFR Part Such activity shall not resume on non-federal lands without written authorization from the SHPO for finds under his or her jurisdiction, and from the Corps. d. In the unlikely event that unmarked human remains are identified on non-federal lands, they will be treated in accordance with Section Florida Statutes. All work and ground disturbing activities wit~in a 1 00-meter diameter ofthe unmarked human remains shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archeologist within the same business day (8-hours). The Corps shall then notify the appropriate SHPO and THPO(s). Based, on the circumstances ofthe discovery, equity to all parties, and considerations ofthe public interest, the Corps may modify, suspend or revoke the permit in accordance with 33 CFR Part Such activity shall not resume without written authorization from the State Archeologist and from the Corps. 4. Erosion Control: Prior to the initiation ofany work authorized by this permit, the Permittee shall install erosion control measures along the perimeter ofall work areas to prevent the displacement offill material outside the work area. Immediately after completion ofthe final grading ofthe land surface, all slopes, land surfaces, and filled areas shall be stabilized using sod, degradable mats, barriers, or a combination of similar stabilizing materials to prevent erosion. The erosion control measures shall remain in place and be maintained until all authorized work has been completed and the site has been stabilized. 5. Turbidity Barriers: Prior to the initiation ofany ofthe work authorized by this permit the Permittee shall install floating turbidity baniers with weighted skirts that extend to within one foot ofthe bottom around all work areas that are in, or adjacent to, surface waters. The turbidity barriers shall remain in place and be maintained until the authorizeq work has been completed and all erodible materials have been stabilized. 6. Mitigation Credit Transfer: Within 30 days from the date ofinitiating the authorized work the Permittee shall provide verification to the Corps that 0.05 functional units will be debited from the West Lake Park Mitigation Area (SAJ ). The required verification shall reference this project's permit number (SAJ ). A functional loss summary is provided in Attachment B. 7. As-Builts: Within 60 days ofcompletion ofthe authorized work or at the expiration ofthe construction authorization ofthis pennit, whichever occurs first, the Permittee shall submit asbuilt drawings ofthe authorized work and a completed As-Built Certification Form (Attachment A) to the Corps. The drawings shall be signed and sealed by a registered professional engineer and include the following: a. A plan view drawing ofthe location ofthe authorized work footprint (as shown on the permit drawings) with an overlay ofthe work as constructed in the same scale as the attached

29 -4 permit drawings (8Vl-inch by 11-inch). The drawing should show all "earth disturbance," including wetland impacts, water management structures, and any on-site mitigation areas. b. List any deviations between the work authorized by this permit and the work as constructed. In the event that the completed work deviates, in any manner, from the authorized work, describe on the As-Built Certification Form the deviations between the work authorized by this permit and the work as constructed. Clearly indicate on the as-built drawings any deviations that have been listed. Please note that the depiction and/or description ofany deviations on the drawings and/or As-Built Certification Form does not constitute approval ofany deviations by the U.S. Army Corps ofengineers. c. The Department ofthe Army Permit number. d. Include pre- and post-construction aerial photographs ofthe project site, ifavailable. 8. Fill Material: The Permittee shall use only clean fill material for this project. The fill material shall be free from items such as trash, debris, automotive parts, asphalt, construction materials, concrete block with exposed reinforcement bars, and soils contaminated with any toxic substance, in toxic amounts in accordance with Section 307 ofthe Clean Water Act. 9. Endangered Species: a. Eastern Indigo Snake Protection Measures: The Permittee shall comply with U.S. Fish and Wildlife Service's "Standard Protection Measures for the Eastern Indigo Snake" dated February 12,2004 and provided in Attachment C ofthis permit." b. All gopher tortoise burrows, active or inactive, will be evacuated prior to site manipulation in the vicinity ofthe burrow. Ifan indigos snake is encountered, the snake must be allowed to vacate the area prior to additional site manipulation in the vicinity. All holes, cavities, and snake refugia other than gopher tortoise burrows will be inspected each morning before planned site manipulation ofa particular area, and, ifoccupied by an indigo snake, no work will conunence until the snake has vacated the vicinity ofthe proposed work. 10. Regulatory Agency Changes: Should any other regulatory agency require changes to the work authorized or obligated by this permit, the Permittee is advised that a modification to this permit instrument is required prior to initiation ofthose changes. It is the Permittee's responsibility to request a modification ofthis permit from the Palm Beach Gardens Regulatory Office. This letter ofauthorization does not obviate the necessity to obtain any other Federal, State, or local permits, which may be required. Prior to the initiation of any construction, projects qualifying for this Nationwide permit must qualify for an exemption under section (1),

30 -5 Florida Statutes or , Florida Statutes, or otherwise be authorized by the applicable permit required under Part IV of Chapter 3 73, Florida Statutes, by the Department ofenvironmental Protection, a water management district under section , Florida Statutes, or a local government with delegated authority under section , Florida Statutes, and receive Water Quality Certification and applicable Coastal Zone Consistency ConcmTence or waiver thereto, as well as any authorizations required for the use ofstate-owned submerged lands under Chapter 253, Florida Statutes, and, as applicable, Chapter 258, Florida Statutes. You should check Statepermitting requirements with the Florida Department ofenvironmental Protection or the appropriate water management district. This letter ofauthorization does not include conditions that would prevent the 'take' ofa statelisted fish or wildlife species. 42 STANDARD PROTECTION MEASURES FOR THE EASTERN INDIGO SNAKE 1. :An eastern indigo snake protection/education plan shall be developed by the applicant or requestor for all construction personnel to follow. The plan shall be provided to the Service for review and approval at least 30 days prior to any clearing activities. The educational materials for the plan may consist ofa combination of posters, videos, pamphlets, and lectures (e.g., an observer trained to identify eastern indigo snakes could use the protection/education plan to instruct construction personnel before any clearing activities occur). Informational signs should be posted throughout the construction site and along any proposed access road to contain the following information: a. a description ofthe eastern indigo snake, its habits, and protection under Federal Law; b. instructions not to injure, harm, harass or kill this species; c. directions to cease clearing activities and allow the eastern indigo snake sufficient time to move away from the site on its own before resuming clearing; and, d. telephone numbers ofpertinent agencies to be contacted ifa dead eastern indigo snake is encountered. The dead specimen should be thoroughly soaked in water and then frozen. 2. Ifnot currently authorized through an Incidental Take Statement in association with a Biological Opinion, only individuals who have been either authorized by a section IO(a){l)(A) permit issued by the Service, or by the State offiorida through the Florida Fish Wildlife Conservation Commission (FWC) for such activities, are permitted to come in contact with.an eastern indigo snake. 3. An eastern indigo snake monitoring report must be submitted to the appropriate Florida Field Office within 60 days ofthe conclusion ofclearing phases. The report should be. submitted whether or not eastern indigo snakes are observed. The report should contain the following information: a. any sightings ofeastern indigo snakes and b. other obligations required by the Florida Fish and Wildlife Conservation Commission, as stipulated in the permit. All activities authorized by this permit shall be implemented as set forth in the plans, specifications and performance criteria as approved by this permit. Any deviation from the permitted activity and the conditions for undertaking that activity shall constitute a violation of this permit and Part IV, Chapter 373. F.S. 2. This permit or a copy thereof, complete with all conditions, attachments, exhibits, and modifications shall be kept at the work site of the permitted activity. The complete permit shall be available for review at the work site upon request by District staff. The permittee shall require the contractor to review the complete permit prior to commencement of the activity authorized by this permit. 3. Activities approved by this permit shall be conducted in a manner which does not cause violations of State water quality standards. The permittee shall implement best management practices for erosion and pollution control to prevent violation of State water quality standards. Temporary erosion control shall be implemented prior to and during construction, and permanent control measures shall be completed within 7 days of any construction activity. Turbidity barriers shall be installed and maintained at all locations where the possibility of transferring suspended solids Into the receiving waterbody exists due to the permitted work. The permit shall not be transferred to such C!pproved operation and maintenance entity until the operation phase of the permit becomes effective. Following inspection and approval of the permitted system by the District, the permittee shall initiate transfer of the permit to the approved responsible operating entity if different from the permittee. Until the permit is transferred pursuant to Section 40E , F.A.C., the permittee shall be liable for compliance with the terms of the permit. 8. For those systems that will be operated or maintained by an entity that will require an easement or deed restriction in order to enable that entity to operate or maintain the system in conformance with this permit, such easement or deed restriction must be recorded in the public records and submitted to the District along with any other final operation and maintenance documents required by Sections 9.0 and 10.0 of the Basis of Review for Environmental Resource Permit applications within the South Florida Water Management District, prior to lot or units sales or prior to the completion of the system, whichever comes first. Other documents concerning the establishment and authority of the operating entity must be filed with the Secretary of State, county or municipal entities. Final operation and maintenance documents must be received by the District when maintenance and operation of the system is accepted by the local government entity. Failure to submit the appropriate final documents will result in the permittee remaining liable for carrying out maintenance and operation of the permitted system and any other permit conditions. 10. Should any other regulatory agency require changes to the permitted system, the permittee shall notify the District in writing of the changes prior to implementation so that a determination can be made whether a permit modification is required. 11. This permit does not eliminate the necessity to obtain any required federal, state, local and special district authorizations prior to the start of any activity approved by this permit. The permittee shall be responsible for the correction of any erosion, shoaling or water quality problems that result from the construction or operation of the surface water management system. 5. Measures shall be taken during construction to insure that sedimentation and/or turbidity violations do not occur in the receiving water. 6. The District reserves the right to require that additional water quality treatment methods be incorporated into the drainage system if such measures are shown to be necessary. 7. Lake side slopes shall be no steeper than 4:1 (horizontal:vertical) to a depth of two feet below the control elevation. Side slopes shall be nurtured or planted from 2 feet below to 1 foot above control elevation to insure vegetative growth, unless shown on the plans. 8. Facilities other than those stated herein shall not be constructed without an approved modification of this permit. 9. A stable, permanent and accessible elevation reference shall be established on or within one hundred (100) feet of all permitted discharge structures no later than the submission of the certification report. The location of the elevation reference must be noted on or with the certification report. 10. The permittee shall provide routine maintenance of all of the components of the surface water management system in order to remove all trapped sediments/debris. All materials shall be properly disposed of as required by law. Failure to properly maintain the system may result in adverse flooding conditions. 11. This permit is issued based on the applicant's submitted information which reasonably demonstrates that adverse water resource related impacts will not be caused by the completed permit activity. Should any adverse impacts caused by the completed surface water management system occur, the District will require the permittee to provide appropriate mitigation to the District or other impacted party. The District will require the permittee to modify the surface water management system, if necessary, to eliminate the cause of the adverse impacts. L:i 12. The project area is bordered on the west by 1-95, on the north by 1-595, on the east by Port Everglades and on the south by Griffin Road. The site contains a variety of airport related facilities and associated runways. The Ft. Lauderdale-Hollywood International Airport was originally permitted on March 12, 1981, under Application No D, Permit No S. Many applications for construction and operation have been issued since, all of which reside under Permit No S. On August 8, 2011, a permit modification under Application No granted authorization for construction and operation of a surface water management system to serve a acre drainage area and a acre construction area of airport development associated with the expansion of Runway 9R-27L. Under said application, major drainage basins within the airport were merged and modeled to accurately represent existing and proposed stormwater conditions. Proposed is the modification of Permit No S for the construction and operation of a surface water management system (SWMS) to serve the addition of approximately acres of roadway development (Perimeter Road) and to reflect changes to the design of the SWMS of the airport. The proposed surface water management system will consist of inlets, culverts, dry detention areas and wet detention areas which will provide water quality treatment and attenuation prior to discharge into the Dania Cut-Off Canal through six (6) control structures (see Discharge Structures). This application modifies the scope of Application No as follows: -Under Application No , Perimeter Road was proposed to be severed and decommissioned at the southwest comer of the FLL Airport. Broward County now desires to reconstruct and realign Perimeter Road thereby increasing the contributory drainage area from acres to acres and the proposed construction area from to acres. - The French Drain basin and the associated control structure (Structure FD-4) have been eliminated from the proposed site plan. The modification authorizes the realignment and reconstruction of Perimeter Road which shall impact additional wetlands in the Greenbelt Lakes. In addition, design changes to accommodate emergency access shall result in additional wetland impacts to Wetland N3a. These modifications shall result in 0.21 acre ofadditional direct wetland impacts (total direct impacts increased to acres by filling with approximately 993,320 cubic yards (6,062 cubic yards of fill below SHWT/MHWL) of clean material), 0.01 acre of additional secondary wetland impacts (0'-50' zone) and 0.20 acre of reduced secondary wetland impacts (50'-250' zone) requiring 0.07 functional units of mitigation to offset additional wetland impacts which increases the total functional units required from 7.97 to A modification to Environmental Resource License No. DF03-lll7 shall be required to debit these units. This modification does not relieve the applicant from obtaining additional authorizations from other agencies. The modification is contingent upon the following revisions to these Specific Conditions: A Standard 6. This license authorizes acres of direct wetland impacts by filling with approximately 993,320 cubic yards (6,062 cubic yards of ftll below SHWT/MHWL) of clean material to accommodate the expansion of runway 9R-27L within the Fort Lauderdale-Hollywood International Airport. The proposed construction will include the expansion of runway 9R-27L by creating a 150 foot wide by 8,000 foot long impervious area, a new taxiway system, navigational aide (NAV AIDS) lighting system and 4,019.6 linear feet of mechanically stabilized earthen (MSE) wall. B. Off-Site Compensatory Mitigation (Area) I. Compensatory mitigation for unavoidable wetland impacts is located within Broward County's West Lake Park and authorized by Environmental Resource License No. DF The acres of direct impacts shall require 6.64 functional units of mitigation; however, secondary impacts were evaluated by other agencies resulting in a total of 8.04 functional units of mitigation required to offset all wetland impacts. 77 Sec Administrative review ofepd determinations. (a) A ~erson with a substantial interest may file a petition to request review of or to intervene in a review ofa final administrative determination made pursuant to this chapter concerning: (1) The requirement that a facility or activity obtain a license or environmental review approval. (2) Interpretations oflicense or environmental review approval conditions. (3) Interpretations ofvariance conditions. (4) The decision to suspend or revoke a license or environmental review approval. (5) The requirement ofcertain license conditions. (6) The issuance ofa license or environmental review approval. (7) The denial ofa license or environmental review approval. (8) The scope ofa license or environmental review approval, geographic or otherwise. (9) The scope ofa variance, geographic or otherwise. (10) The issuance ofa stop work order. (11) Similar final administrative determinations. This administrative review procedure shall be the only means of review available for the above final administrative determinations by either the petitioner or the intervenor (the parties). (b) person may not obtain review by this procedure of: (1) The issuance or adjudication of or other matters involving a notice of violation or a citation. (2) Internal policy decisions (c) A person desiring a review of a staff determination made pursuant to this Chapter shall first bring the determination to the attention of the appropriate section supervisor to attempt to resolve the matter. If a resolution cannot be reached, then the decision shall be reviewed by successive supervisozy levels until the issue is resolved or reaches the level of the director or his or her designee for the final deteimination. (d) A person desiring administrative review of a final determination made by the director or the designee shall file a petition with the director for review by the hearing examiner. The petition shall be filed within ten (1 0) days from the rendition of the action taken or ofthe decision made by the director. An entity whose license or approval is being challenged shall be a party to the action. (e) The review shall not be heard until the provisions ofsubsection (f) are met. Upon motion to the hearing examiner, an insufficient petition shall be dismissed with or without leave to refile. Ifa petition is determined to be insufficient by the hearing examiner and the petitioner has been given leave to refile by the hearing examiner, unless otherwise ordered by the hearing examiner, the petitioner must refile within ten (1 0) days of the rendition of the order of dismissal or the petition will be dismissed with prejudice. (f) A sufficient petition for review or petition for intervention in the review shall, at a minimum, contain the following information: (1) The nature ofthe determination sought to be reviewed.

78 (2) A short, plain statement of the facts which form the subject matter upon which the determination was made as asserted by all parties of record at the time that the petition is filed; a statement of the material facts in dispute, if any. If any party is unable to state the matters in sufficient detail at the time initial petition is filed, the petition may be limited to a statement of the issues involved; and thereafter, upon timely written motion. a more definite and detailed statement shall be furnished not less than seven (7) days prior to the date set for the hearing. (3) The specific determination for which the review is sought. (4) The specific legal grounds upon which the parties seek review of the determination. (5) A short statement of the petitioner's or the intervenor's substantial interest in the matter to be reviewed. (6) The specific section of this chapter on which the decision is based, if known. and the specific section that the parties allege should control the decision. ifknown. (7) A copy of the director's or the designee's written final determination. (8) A statement of the relief requested stating precisely the action that the petitioner wants EPD to take with respect to the final determination. (g) All pleadings or other documents filed in the proceeding must be signed by a party, the party's attorney, or the party's qualified representative. The signatui:e of a party, the party's attorney or a party's qualified representative constitutes a certificate that he or she has read the pleading or other document and that to the best of his or her knowledge, infomiation. and belief formed after reasonable inquiry, it is not brought for any improper purposes, such as to harass or to cause unnecessary delay ar for frivolous purpose or needless increase in the cost of litigation. If a pleading or other d09ument is signed in violation of these requirements, the hearing examiner, upon motion or his oi her own initiative, shall dismiss the matter. (h) A petitioner or intervenor may request an emergency hearing to stay all activities or work conducted pursuant to the challenged license or approval. Such petitioner or intervenor has the burden of proof to show by a prepo~derance of ~e evidence that the continued activities would cause substantial pollution or degradation to the environment. (i) (j) The petition for review will not stay environmental protection activities required for the remediation or mitigation. of a site or facility, the protection of the environment or the health,. safety and welfare ofthe citizens ofbroward County, or the prevention of fijrther environmental degradation. The person responsible for these activities must take all necessaiy steps to prevent environmental degradation and must conduct the remediation or mitigati~ activities required by this chapter. The director may allow these activities to be delayed until after the hearing examiner's decis"ion by certlfying to the hearing examiner that, by reason of facts stated in the certificate, a delay in the initiation or completion. of these ac::tivities would not cause substantial environmental degradation or peru to life or property. The delay for conducting these activities may be subject to appropriate terms to ensure protection of the environment. The person responsible for these activities shall be responsible for any environmental damage or any violation ofthis chap~er caused by the delay. Notice and Schedulirig Reqv.irements:

79 (1) The hearing on the review shall be scheduled within a reasonable time. It shall be the responsibility of the petitioner to request through EPD that the hearing date be scheduled It shall also be the responsibility ofthe petitioner to give notice in accordance with this section at least ten (10) days prior to the hearing. (2) The petitioner shall give notice ofthe hearing by: a. Giving personal notice to all proper parties; and b. Publishing notice on two (2) days in a newspaper of general circulation in the county; and c. Posting notice at a location determined by the Broward County Administrator's Office. (3) The petitioner shall bear the cost of giving notice. (4) The notice shall contain, at a minimum: a. A description and location of the facility or the activity to be conducted by the petitioner; and b. The time and place ofthe hearing. (k) The petitioner shall bear the cost of accurately and completely preserving all testimony and providing full or partial transcripts to all parties. (1) The hearing shall be a quasi-judicial hearing. (1) The applicant/petitioner requesting the administrative review, any intervenor/petitioner and EPD shall have an opportunity to respond to and to present witnesses, other evidence and argument on all issues involved, to conduct cross-examination and submit rebuttal evidence, to submit proposed findings offacts and orders, and to be represented by counsel. Members of the general public who are not intervenors as set forth in Section of this chapter are not parties to the proceeding. (2) When appropriate, the general public may be given an opportunity to present oral or written communications. If the hearing examiner proposes to consider such material, then all parties shall be given an opportunity to cross-examine, challenge or rebut it. (m) Denial, protest ot: revocation, or suspension ofa license, environmental review approval, or any other approval: (1) In regard to denial or protest of approval of a license and any other review of an administrative decision, notwithstanding (2) below, the petitioner shall have the burden of showing, by a preponderance of the evidence, that the determination of the director was an arbit:raiy and/or capricious abuse of discretion, not supported by competent, substantial evidence or not in conformance with the essential requirements of this chapter. The hearing examiner shall not substitute his or her judgment for that ofepd on an issue ofdiscretion even though the hearing examiner may have reached a different conclusion based on the same facts. (2) In an action to revoke or suspend a valid license or approval, the burden shall be upon EPD to prove, by a preponderance of the evidence in an administrative hearing, the grounds for revocation or suspension. The license holder or approval recipient shall be provided notice of the hearing and a copy of the petition stating the grounds for revocation or suspension as provided in section of this chapter. The petition shall state with specificity the acts complained of in order to allow the license holder or

80 approval recipient an opportunity to prepare a defense. The hearing shall be conducted in accordance with the provisions ofsection of this chapter. (n) Findings of fact shall be based exclusively on the evidence of record and on matters officially recognized. (o) Ifthe hearing examiner finds that the director or his or her ~ignee has erroneously interpreted a provision and that a correct interpretation compels a particular action, he or she sbal1 remand the case to. the director or his or her designee for further action under a correct interpretation of the provision. (p) The hearing examiner shall complete and submit to the director and all parties a final order consisting ofhis or her findings of fact and conclusions oflaw. (q) A party to the hearing may obtain appellate review of the final order as provided by section ofthis chapter.
