3 BUCKNELL UNIVERSITY ANNUAL SECURITY AND FIRE SAFETY REPORT At Bucknell University, campus safety and security are shared responsibilities. Many departments are dedicated to making the campus a safer place to live and work. The University s Annual Security and Fire Safety Report provides information concerning safety and security at the University. All members of the University community are encouraged to use this report as a guide for safe practices on and off campus. ANNUAL SECURITY REPORT Policy on Reporting the Annual Disclosure of Crime Statistics The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, 2 U.S.C. 192(f) (the Clery Act ), is a federal law that requires colleges and universities that receive federal financial assistance to disclose annually certain information about campus crime and safety and security policies. This Annual Security and Fire Safety Report contains crime and fire statistics for the three previous calendar years and information on safety and security, crime prevention, and campus law enforcement. The University s Clery Act Compliance Officer and the Department of Public Safety prepare and distribute this report. They receive cooperation from other University departments, including the Division of Student Affairs, Athletics & Recreation Services, the Office of Global and Off-Campus Education, the Office of the General Counsel, the Office of the Provost, Admissions, Environmental Health and Safety, Human Resources, and Facilities, and outside law enforcement agencies. The crime statistics contained in this report include statistics for Clery Act crimes (identified in the Crime Information Section) that were identified by or reported to the Department of Public Safety, designated Campus Security Authorities (including, for example, athletic coaches, deans, advisers to student clubs and organizations, and resident advisers), or local law enforcement agencies. A written request for Clery Act crime statistics is made annually to all Campus Security Authorities. The Department of Public Safety and the Compliance Officer request crime statistics from law enforcement agencies with jurisdiction over non-campus buildings and properties that are owned or controlled by the University, used in direct support of its educational purposes, and frequently used by students. This report also contains statistics for weapons, drug, and liquor law violations that resulted in arrest or referral to a University official who initiated a disciplinary action (provided a record was 217 SECURITY & FIRE SAFETY REPORT 1

4 kept and the proceeding may have resulted in the imposition of a sanction). The Student Conduct Administrator and the Associate Vice President for Human Resources report disciplinary referral statistics to the Department of Public Safety. The University s Annual Security and Fire Safety Report is published by October 1 each year. In compliance with the Clery Act, the University annually discloses crime and fire statistics to the United States Department of Education. 5 The Department Of Public Safety The Bucknell University Department of Public Safety maintains police patrols on and around campus by foot, bicycle and/or motor vehicle 24 hours/day, 7 days/week. All Department of Public Safety officers have complete police authority to apprehend and arrest anyone involved in illegal acts on campus or in areas immediately adjacent to the campus. Officers derive their police powers from 22 Pa. Con. Stat. 51. Violations of law by students, faculty, staff or others may result in the filing of criminal charges with the Magisterial District Judge in the Union County Courthouse. Student, faculty and staff misconduct (whether violations of law or University policy and whether occurring on or off campus) may also be referred for internal disciplinary action. The Chief of the Department of Public Safety serves as the University s law enforcement liaison with local, state and federal law enforcement officials and emergency management agencies. The Chief of Public Safety also serves as a member of the neighborhood town-gown committee. The Department of Public Safety works closely with local, state and federal law enforcement agencies as circumstances demand. Leaders of the Department of Public Safety and the Buffalo Valley Regional Police Department meet on both a formal and informal basis. The officers of these agencies communicate regularly regarding incidents that occur in and around the campus area. There is no written memorandum of understanding between the Department of Public Safety and the Buffalo Valley Regional Police Department. The Department of Public Safety is not aware of any off-campus buildings or properties owned or controlled by any officially- recognized student organizations. How to Report a Crime The University encourages the accurate and prompt reporting of all crimes to the Department of Public Safety at (57) (emergencies) or (57) (non-emergencies) or, for incidents that occur off-campus, to Buffalo Valley Regional Police at 911 (emergencies) or (57) (non-emergencies). Individuals may call the Department of Public Safety on campus phones by dialing x71111 (emergency) or x73333 (non- emergency) or by pressing the red button on the Blue Light Emergency Phones equipped with red buttons. 6 Alleged violations of the University s Sex Discrimination, Sexual Misconduct, Relationship Violence & Stalking Policy may be reported to the Title IX Coordinator at (57) If the alleged offender is a faculty or staff member, incidents may also be reported to Human Resources at (57) Other bias-related violations of University policy may be reported to a resident adviser, the Associate Provost for Diversity or the Assistant Dean of Students for Diversity or using the online Bias Response Form at In the case of an emergency, please contact the Department of Public Safety or local police. For the purpose of making timely warnings and the annual statistical disclosure, the University prefers that all crimes be reported in the manner described above. Confidential Reporting The University offers several ways to report criminal activity while preserving privacy. Victims who do not wish to pursue campus disciplinary or criminal action, but who wish to document the details of an incident with the University, may file a report with the Department of Public Safety and request that their names be withheld from the report. Crimes may be reported anonymously using the Anonymous Tip Form at Individuals may also report Sexual Misconduct (which includes sexual assault, non-consensual fondling, non-consensual touching, sexual exploitation, and sexual harassment), Relationship Violence (which includes dating and domestic violence) and Stalking to the Title IX Coordinator. The Title IX Coordinator will protect the privacy and confidentiality of the individuals involved in any report to the extent appropriate and allowed by law. The Title IX Coordinator will evaluate any request for confidentiality in the context of the University s responsibility to provide a safe and nondiscriminatory environment to all members of its community. The amount of information detailing the alleged incident or identifying the alleged individual(s) responsible will determine the University s ability to respond. All reports of Clery Act crimes (even those reported anonymously) are counted and disclosed in the University s annual crime statistics, as appropriate. The University does not have written procedures requiring professional and pastoral counselors (who are exempt under federal law from the requirement to report crime statistics) to inform individuals they are counseling of procedures to report crimes on a voluntary, confidential basis for inclusion in the annual disclosure of crime statistics. It is standard practice, however, for the University s professional and pastoral counselors to discuss with their clients the various options 217 SECURITY & FIRE SAFETY REPORT 4

7 (including anonymous reporting) for reporting criminal incidents. Timely Warnings When the Department of Public Safety identifies or receives a report of a crime, occurring either on or off campus, that in the judgment of the Clery Act Compliance Officer and the Chief of the Department of Public Safety, and in consultation with the Dean of Students and General Counsel, constitutes a serious or continuing threat to the campus community, the Department of Public Safety issues a campus-wide timely warning. The Department of Public Safety notifies the President s Office when a timely warning is issued. The timely warning is provided to students and employees in a manner that is timely, withholds as confidential the names and other identifying information of victims, and will aid in the prevention of similar crimes. The timely warning is issued through the University s system to all students, faculty and staff. Campus-wide notifications are labeled with TIMELY WARNING in the subject line. The Department of Public Safety also sends text alerts to all students, faculty and staff who have provided cell phone information for this purpose. All students must provide a cell phone number or indicate that they do not wish to provide one before they can register for classes. Faculty and staff are encouraged, but not required, to provide cell phone information for text alerts and emergency notifications. Individuals may add or update this information on my.bucknell.edu/emergencynotification. Students, faculty and staff are encouraged to read these alerts as soon as they receive them. Depending on the particular circumstances of the incident, an alert may also be posted on the Department of Public Safety s webpage at and/or on its Facebook and Twitter pages. Timely warnings will often ask members of the University community for their help in gathering information about an incident or in identifying those responsible. Individuals are encouraged to contact the Department of Public Safety by calling or in-person at the Department of Public Safety office located at 58 Snake Road, Lewisburg, PA If there is an immediate threat to the health or safety of students or employees occurring on campus, the University will follow its emergency notification procedures. 217 SECURITY & FIRE SAFETY REPORT 5

8 Campus Security Authorities are instructed to report crimes promptly so that the University may determine if a timely warning is warranted. Emergency Notifications The Department of Public Safety encourages all members of the University community to promptly report emergencies and dangerous situations by calling (57) Upon receiving a report, the Department of Public Safety immediately investigates and responds to the situation. If the investigation confirms the existence of a significant emergency or dangerous situation that presents an immediate threat to the health or safety of students, faculty or staff on campus, the Department of Public Safety, taking into account the safety of the campus community, determines what information to release about the situation and immediately begins the notification process. The only reason the Department of Public Safety would not immediately issue a notification for a confirmed emergency or dangerous situation is if (in the judgment of the Clery Act Compliance Officer and the Chief of the Department of Public Safety) doing so would compromise efforts to assist a victim, contain the emergency, respond to the emergency, or otherwise mitigate the emergency. Upon confirmation, the Department of Public Safety immediately notifies the campus community or the appropriate segments of the community that may be affected by the situation. The entire campus community is notified when there is at least the potential that a very large segment of the community will be affected by a situation or when the situation threatens the operation of the campus as a whole. If the Department of Public Safety notifies only the segment of the campus community that may be affected by the situation, it continues to assess the situation and notifies additional segments of the campus community if and when the situation warrants such action. The Department of Public Safety determines the content of the notification and initiates the notification system with an initial alert. Messages can be initiated by any member of the Department of Public Safety upon verification of the situation. Thereafter, a subset of the University s Operations Management Group (which may include the President of the University, the Provost, the General Counsel, the Vice President of Communications, and the Dean of Students) and the Chief of the Department of Public Safety determine how much additional information is appropriate to disseminate at different points in time. The University maintains various systems for communicating information quickly to the 217 SECURITY & FIRE SAFETY REPORT 6

9 University community. Some or all of these methods of communication may be activated in the event of an emergency or dangerous situation. The University notifies the campus community (or the appropriate segments of the campus community that are affected) through the University s system. notifications are labeled with BUCKNELL UNIVERSITY ALERT in the subject line. The Department of Public Safety also sends text alerts to all students, faculty and staff who have provided cell phone information for this purpose. All students must provide a cell phone number or indicate that they do not wish to provide one before they can register for classes. Faculty and staff are encouraged, but not required, to provide cell phone information for text alerts and emergency notifications. Individuals may add or update this information at Students, faculty and staff are encouraged to read these notifications as soon as they receive them. Depending on the particular circumstances of the incident, an emergency notification may also be posted on the Department of Public Safety s webpage at and/or on its Facebook and Twitter pages. The University also maintains a Siren and Public Address system that can be used to send campus-wide emergency notifications. The system is comprised of two (2) speakers that transmit audio emergency messages and alert tones to the outdoor campus environment. If the Department of Public Safety and/or the University s Operations Management Group determine that it is appropriate and necessary to inform individuals and/or organizations outside of the campus community of the situation, the Department of Public Safety notifies the Union County Communications Center. In the event of an emergency, all are encouraged to check the University s emergency management website, Emergency Response and Evacuation Procedures If the Department of Public Safety determines that a building or area must be evacuated, the Department of Public Safety dispatcher contacts appropriate personnel to advise them of the nature of the evacuation. The Department of Public Safety initiates and supervises the evacuation with the cooperation of the Facilities Department, the Events Management Office, and/ or the Division of Student Affairs. When an evacuation alarm sounds, individuals should evacuate the building calmly and quietly to a distance of at least 5 feet from the building and out of the way of emergency personnel. 217 SECURITY & FIRE SAFETY REPORT 7

10 Individuals should not use the elevators because they may become inoperative. If possible, abled individuals should assist disabled individuals in exiting the building or to the closest stairwell (and should notify Department of Public Safety officers of the disabled person s location). Disabled individuals who cannot use stairs should proceed to the closest stairwell and wait until help arrives. Individuals should not return to the building until instructed to do so by Department of Public Safety officers or authorized personnel. Emergency Response Procedures: Flood or Severe Weather Emergency In the event of a flood or weather emergency on or near campus, the Department of Public Safety receives advance notification from the Union County Communications Center as to the extent and nature of the impending flood or weather emergency. Instructions for preparations and/or evacuations are relayed from the Union County Emergency Management Agency to the campus community through the Department of Public Safety. The University s Events Management Office (in cooperation with the Department of Public Safety) sends out an to all students, faculty, and staff. The alert includes the nature of the emergency and instructions for preparation and/ or evacuation if necessary. Procedures to Test Emergency Response and Evacuation Procedures All of the University s alerting methods are tested at least bi-annually to ensure all faculty, staff and students are familiar with emergency alerts and what their individual roles are during an actual situation. A fire and evacuation drill is coordinated by the Department of Public Safety each semester in each residential facility (except Bucknell West) and academic building. The Department of Public Safety does not tell individuals in advance about the designated locations for long-term evacuations because those decisions are affected by time of day, location of the building being evacuated, the availability of the various designated emergency gathering locations on campus, and other factors such as the location and nature of the threat. The purpose of evacuation drills is to prepare building occupants for an organized evacuation in case of an emergency. In addition to educating occupants of each building about evacuation procedures during the drills, the process also provides the Department of Public Safety with an opportunity to test the operation of fire alarm system components. Evacuation drills are monitored by the Department of Public Safety to evaluate egress and 217 SECURITY & FIRE SAFETY REPORT 8

11 behavioral patterns. Reports are prepared by the Department of Public Safety and identify deficient equipment so that repairs can be made immediately. Recommendations for improvements are also submitted to the appropriate departments for consideration. The Resident Advisers are trained in these procedures and act as an ongoing resource for students living in residential facilities. The Department of Public Safety documents each test it conducts, including a description of the test, the date the test was held, the time the test started and ended, and whether the test was announced or unannounced. The Department of Public Safety publicizes the University s emergency response and evacuation procedures in an notification in conjunction with at least one regularly scheduled test of the University s emergency plans and capabilities. Daily Crime and Fire Log In addition to disclosing crime and fire statistics to the US Department of Education and in its Annual Security and Fire Safety Report, the Department of Public Safety maintains a combined Daily Crime and Fire Log that includes all criminal incidents, alleged criminal incidents, and firerelated incidents that are reported to or identified by the Department of Public Safety. The Log includes the date the incident was reported, the date and time the incident occurred, the nature of the incident, the general location of the incident, and the disposition of the complaint, if known. The Department of Public Safety reserves the right to exclude certain reports or temporarily withhold information from the log under circumstances permitted by law. The Daily Crime and Fire Log for the most recent 6-day period is available for public inspection, upon request, during normal business hours at the Department Public Safety, 58 Snake Road, Lewisburg PA. The Daily Crime and Fire Log can also be found online at Portions of the Log that are older than 6 days will be made available within two business days of a request. A link to the Daily Crime and Fire Log is also published daily in the University s Message Center to the campus community. Security Of and Access To Facilities During business hours, the University (except housing facilities) is open to the public. During non-business hours, access to certain University buildings may be restricted. Some facilities have individual hours, which may vary at different times of the year. Examples are the Elaine Langone Center, the Kenneth G. Langone Athletics and Recreation Center, and University libraries. In 217 SECURITY & FIRE SAFETY REPORT 9

12 these cases, the facilities will be secured according to schedules developed by the department responsible for the facility. All perimeter doors for student housing facilities (except Bucknell West) and other critical infrastructure doors are secured via an electronically controlled access system. The control system allows automatic locking and unlocking of doors. It also provides selected access through the use of the Bucknell OneCard, which is issued to University students, faculty and staff. Bucknell West housing is secured by a brass key system. The Facilities Department maintains the buildings, grounds and utility systems for the campus. Security service needs (including, but not limited to, inoperable doors, burned out lights, malfunctioning smoke alarms, and broken windows) receive priority. Emergencies and afterhours safety issues are reported to the Department of Public Safety. The Department of Public Safety and Facilities routinely survey campus lighting and identify/report any deficiencies found, such as inadequate illumination and defective fixtures, to the appropriate personnel for corrective action. Residential Education staff make daily rounds of the facilities to check for maintenance problems that may pose a hazard to residents safety and security. Resident Advisers inform their residents in student housing to write all maintenance concerns on a work request form, typically located on the custodial closet of each residence hall floor (or, in the case of a special interest house or fraternity, on one of the custodial closets in the building). A custodial staff member reviews the form and either corrects the issue or submits a work order to Facilities through their supervisor. If a student reports a concern to the Housing Services Office, Housing Services staff will submit a work order to the Facilities Department. After normal business hours, emergencies and safety issues are reported to the Department of Public Safety, which will either call a Facilities staff member back to campus or submit a work order to Facilities. Preventing and Responding To Sexual Assault, Stalking, Dating Violence and Domestic Violence Training and Education The University provides information and training for students and employees to assist in the awareness of the University s response and resources for those who have experienced sexual assault, stalking, dating violence and domestic violence. These initiatives include the following: 1. A statement that the University prohibits sexual assault, stalking, dating violence and domestic violence; 217 SECURITY & FIRE SAFETY REPORT 1

13 2. The definition of sexual assault, stalking, dating violence and domestic violence under Pennsylvania law; the definition of consent under Pennsylvania law; 3. Procedures victims should follow if a crime of sexual assault, stalking, dating violence or domestic violence has occurred (including the importance of preserving evidence, how and to whom the alleged offense should be reported, options to notify law enforcement authorities, the option to be assisted by campus personnel in notifying authorities, and the option to decline to notify authorities); 4. Options for no-contact orders and orders of protection issued by local courts; 5. Information about how the University will protect confidentiality; and statements that a. The University will provide written notification about existing counseling, mental health, victim advocacy, legal assistance, visa and immigration assistance, and other services (both within the University and in the community) to victims and b. The University will provide i. written notification to victims about options for, and available assistance in, changing academic, living, transportation, and working situations if so requested and reasonably available, regardless of whether the victim chooses to report the crime to law enforcement authorities and ii. an explanation of the procedures for campus disciplinary action. In addition, the University informs students and employees that it will provide a written explanation of rights and options to students and employees who report offenses. c. The University will also inform students and employees that disciplinary proceedings will i. Include a prompt, fair, and impartial process from the initial investigation to the final result, ii. Be conducted by officials who at a minimum receive annual training on issues related to sexual assault, stalking, dating violence and domestic violence and how to conduct an investigation and hearing process that protects the safety of victims and promotes accountability, iii. Provide the victim and alleged offender with the same opportunity to have others present, including the opportunity to be accompanied to any related meeting or proceeding by an adviser of their choice and iv. Simultaneously notify, in writing, both parties of the result of any disciplinary proceeding, procedures for appeal, any change to the result, and when the result 217 SECURITY & FIRE SAFETY REPORT 11

14 becomes final. Students and employees will be informed that the University will not limit the choice of adviser or presence in any meeting or disciplinary proceeding, except that the University has established restrictions regarding the extent to which the adviser may participate in the proceedings. At the beginning of each academic year, all incoming students are required to participate in a peer-led bystander intervention education program that provides safe and positive options that may be carried out by an individual or individuals to prevent harm or intervene when there is a risk of sexual assault, stalking, dating violence, or domestic violence. This in-person training also explores the effects of trauma and provides information about on campus resources. The University also provides ongoing bystander educational programming, including follow-up peer-led bystander education, a seven week peer-led bystander ally training program for sorority women and fraternity men, and peer-led dating violence and stalking education. The University annually offers a variety awareness events and programs, including guest presentations, the making of a No More video, theater-based programs such as the Beat the Blame Game comedy show, Take Back the Night, and the Clothesline Project. The Department of Public Safety regularly offers a 12-hour Rape Aggression Defense (R.A.D.) class and a 2-hour Self- Defense Awareness Familiarization Exchange (S.A.F.E.) class. These educational awareness, crime-victim prevention programs provide individuals with information that may reduce their risk of exposure to violence and introduce them to the physical aspects of self-defense. Reporting and Confidentiality Victims are encouraged to report sexual assault, dating and domestic violence, and stalking to the University and have several options for doing so. In an emergency, victims and others are encouraged to call (57) (Department of Public Safety) or 911 (Union County Emergency Services). For non-emergencies, individuals may report incidents to the Department of Public Safety at (57) and/or the Title IX Coordinator at (57) Incidents involving University faculty or staff members may also be reported to Human Resources at (57) The Department of Public Safety and Human Resources will inform the Title IX Coordinator of the report. University personnel will assist the victim in notifying authorities if the victim so requests. It is important that the incident be reported immediately so that evidence may be preserved. Victims also have the option to decline to 217 SECURITY & FIRE SAFETY REPORT 12

15 notify law enforcement. If a University faculty or staff member becomes aware of an alleged incident of Sexual Misconduct, Relationship Violence or Stalking committed against a student, they must promptly report that information to the Title IX Coordinator, unless that individual is authorized or required by law to keep that information confidential by virtue of their professional role (Advocates, psychological counselors, or clergy, for example). The Title IX Coordinator provides a confidential online reporting form for this purpose. Students also have the option to make anonymous reports to the Department of Public Safety using the anonymous tip form at The amount of information detailing the alleged incident or identifying the alleged individual(s) responsible will determine the University s ability to respond. The University will seek to protect the privacy and confidentiality of the individuals involved in any report of alleged Sexual Misconduct, Relationship Violence or Stalking to the extent appropriate and allowed by law. The Title IX Coordinator will evaluate any request for confidentiality in the context of the University s responsibility to provide a safe and nondiscriminatory environment to all members of its community. The University will complete any publicly available record-keeping, including Clery Act reporting and disclosure, without the inclusion of identifying information about the victim. It will also maintain as confidential any interim measures or remedies provided to the victim to the extent that maintaining confidentiality will not impair its ability to provide the interim measures or remedies. The University will provide written notification to students and employees about existing counseling, mental health, victim advocacy, legal assistance, visa and immigration assistance, and other services, both within the University and in the community. The University will also provide written notification to victims about options for, and available assistance in, changing academic, living, transportation, and working situations if so requested and reasonably available, regardless of whether the victim chooses to report the crime to the Department of Public Safety or local law enforcement or pursue campus disciplinary action. When a student or employee reports to the University that the student or employee has been 217 SECURITY & FIRE SAFETY REPORT 13

16 a victim of sexual assault, dating violence or domestic violence, or stalking, whether the alleged offense occurred on or off campus, the University will provide the student or employee a written explanation of the student s or employee s rights and options. The University does not limit the time frame for reporting, although a delay in reporting may impact the University s ability to take certain actions. The University retains the authority to pursue disciplinary action against students who withdraw or are suspended from the University after an incident of sexual misconduct is alleged to have occurred. The University may withhold a student s diploma where a report of sexual misconduct is pending against the student. It may also, with Board of Trustee approval, revoke any degree awarded to an individual who is subsequently found responsible for prohibited conduct that occurred prior to the degree being awarded. As time passes, evidence may dissipate or become lost or unavailable, thereby making investigation, possible prosecution, disciplinary action, or the issuance of a protection from abuse order more difficult. If a victim chooses not to make a complaint regarding an incident, they should nevertheless consider speaking with the Department of Public Safety or other law enforcement to preserve evidence in the event they later decide to file charges. Evangelical Community Hospital s Sexual Assault Nurse Examiners (SANE nurses) are on call 24 hours a day to conduct sexual assault evidentiary examinations to collect and preserve evidence (generally within 96 hours of an incident). Ordinarily, when an evidentiary examination is performed, the hospital will contact local police to inform them that evidence was collected, but this does not mean that the victim has to proceed with criminal charges. Treatment to prevent certain sexually transmitted infections is available and is most effective when taken as soon as possible after possible exposure (within 72 hours). Treatment is also available for injuries and to prevent pregnancy. Medical treatment is available at Bucknell Student Health and Evangelical Community Hospital. The Advocates and the Department of Public Safety can arrange transportation to the hospital. Resources and Support Services The University recognizes that in instances of alleged Sexual Misconduct, Relationship Violence or stalking, community assistance is both necessary and helpful. 17 encouraged to access the support services identified below: Confidential Resources The Advocates (24 hours) For students who have experienced Sexual Misconduct, Relationship Violence or Stalking. The Advocates are trained members of the campus community who provide information and support regarding the legal, medical, counseling, academic and housing options a student may have following an incident of Sexual Misconduct, Relationship Violence or stalking. They help to facilitate referrals, accompany students to medical treatment, answer questions about legal and judicial options, and help to ensure appropriate followup and support. The Advocates also assist students in connecting with resources that can help minimize the impact an incident may have on one s academic career. Counseling & Student Development Center (CSDC) (24 hours) CSDC provides individual and group counseling, psychiatric consultation, crisis intervention, consultation and outreach programming. Services are available for all students free of charge. Bucknell Student Health (business hours) Bucknell Student Health provides medical attention that includes treatment of any physical injuries and treatment to prevent pregnancy and certain sexually transmitted infections (generally most effective within 72 hours). Bucknell University Chaplains & Religious Life (business hours) The University Chaplain, the Chaplain for the Catholic Community, and the Jewish Chaplain are available to discuss religious, spiritual, and personal issues. Transitions (24 hours) Transitions is a local crisis center that provides confidential counseling services, advocacy, emergency shelter, and relocation assistance to survivors of sexual assault, domestic and dating violence, and other serious offenses. Complaints will be handled consistent with applicable procedures in the faculty or staff policies and procedures. ** These resources will protect privacy and confidentiality to the extent appropriate and allowed by law, but they are required to inform the Title IX Coordinator of any reports. The Title IX Coordinator will evaluate any request for confidentiality in the context of the University s responsibility to provide a safe and nondiscriminatory environment to all members of its community. Disciplinary Proceedings to Resolve Allegations of Sexual Assault, Dating Violence, Domestic Violence and Stalking The University s disciplinary proceedings provide a prompt, fair, and impartial process from the initial investigation to the final result. The proceedings are conducted by officials who (i) receive at least annual training on issues related to sexual assault, stalking, dating violence, and domestic violence and on how to conduct an investigation and hearing process that protects the safety of victims and promotes accountability and (ii) do not have a conflict of interest or bias for or against the victim or alleged offender. The proceedings will provide the victim and alleged offender with the same opportunity to have others present, including the opportunity to be accompanied to any related meeting or proceeding by the adviser of their choice. The University does not limit the choice of adviser or presence in any meeting or disciplinary proceeding, except that it has established certain restrictions 217 SECURITY & FIRE SAFETY REPORT 17

20 regarding the extent to which the adviser may participate in the proceedings. The University simultaneously notifies, in writing, both parties of the result of any disciplinary proceeding, procedures for appeal, any change to the result, and when the result becomes final. Disciplinary proceedings are completed within reasonably prompt time frames designated by each policy (student, faculty, and staff). Time frames may be extended for good cause with written notice to the victim and alleged offender of the delay and the reason for the delay. Proceedings are conducted in a manner that is consistent with the University s policies and transparent to the victim and alleged offender, includes timely notice of meetings at which the victim or alleged offender, or both, may be present, and provides timely access to the victim, the alleged offender, and appropriate officials to any information that will be used during informal and formal disciplinary meetings and hearings. Following an allegation of sexual assault, stalking, dating violence or domestic violence, the Title IX Coordinator, Human Resources and/or the Dean of Students will take appropriate interim measures to protect the victim. These measures may include, but are not limited to, the imposition of a no-contact order and/or employment, transportation, residence, and academic modifications. The Dean of Students or designee may limit a student s access to certain University facilities or activities pending resolution of the matter. The Dean of Students may impose an interim suspension pending the resolution of an alleged violation when the Dean determines, in the Dean s sole discretion, that it is necessary in order to protect the safety and well-being of members of the Bucknell community. Complaints against Students Procedures for resolving complaints against students are outlined in the Bucknell University Sex Discrimination, Sexual Misconduct, Relationship Violence & Stalking Policy & Procedures for Resolving Complaints Against Students. The Policy can be found in the Student Handbook or obtained from the Department of Public Safety, the Title IX Coordinator, Human Resources, or the Women s Resource Center. The policy may also be found on the University s webpages, edu/sexualmisconduct and To initiate an Investigation, the Complainant must submit a statement to the Title IX Coordinator that contains: The name of the alleged offender (the Respondent ), if known, A description of the alleged violation, and 217 SECURITY & FIRE SAFETY REPORT 18

21 The date, approximate time, and location of the alleged violation, if known. The Title IX Coordinator provides the Complainant with a copy of the Sexual Misconduct & Relationship Violence Policy, reviews procedures, and informs the Complainant of available resources, support services, and options, including the option to be assisted by an adviser of choice. The Title IX Coordinator meets with the Respondent to notify the Respondent that a Complaint has been filed and will be investigated. The Title IX Coordinator provides the Respondent with a copy of the Policy, reviews procedures, and informs the Respondent of available resources, support services and options, including the option to be assisted by an Adviser of choice. After a complaint is filed, the investigator conducts an Investigation and prepares a Student Conduct Investigative Report, which may be accompanied by supporting documentation or items (for example, statements or photographs). The investigator moves forward with a hearing if sufficient information of a violation of the Policy is found. If the investigator determines to hold a hearing, the investigator meets with each party and reviews the alleged violations that will be investigated in a hearing and explains hearing procedures. The Hearing Panel Chair reviews the Student Conduct Investigative Report with the investigator and determines which witnesses, documentation, and other information will be called or presented at the hearing. No later than five (5) calendar days prior to the hearing, the investigator provides the parties with a list of all witnesses, documentation, and other information that will be presented at the hearing. The investigator also provides the parties with a copy of the Student Conduct Investigative Report. The investigator may redact the Student Conduct Investigative Report to the extent necessary to comply with the law. No later than three (3) calendar days prior to the hearing, the parties may request that additional witnesses, supporting documentation, or other information be presented at the hearing. The request must be in writing, submitted to the investigator, and include a brief description of why the information is relevant to the determination of responsibility. The parties may not introduce witnesses, documentation, or other information at the hearing that were not provided to the Investigator by this deadline. Exceptions may be made at the sole discretion of the Hearing Panel Chair if the identity of the witness or the documentation or other information was not available to the party as of this deadline or for other extenuating circumstances. The Hearing Panel Chair has sole discretion to determine whether to allow the additional witnesses, documentation, or other information to be presented at the hearing. 217 SECURITY & FIRE SAFETY REPORT 19

22 Prior to the hearing, the investigator offers to meet with each party to review hearing procedures, the alleged violation(s), and the list of witnesses and other information that will be presented at the hearing. The investigator forwards a copy of the alleged violation(s), the Student Conduct Investigative Report, the list of witnesses, witness statements, and any other information that will be presented at the hearing to the Hearing Panel in advance of the hearing. The Hearing Panel finds the Respondent responsible if a preponderance of the evidence indicates that the Respondent violated the Policy. This means the Hearing Panel must determine whether it is more likely than not, based on the information presented at the hearing, that the Respondent is responsible. The Hearing Panel must reach a decision on responsibility by majority vote. If the Hearing Panel finds the Respondent responsible, it immediately deliberates sanctions. Sanctions for students who are found responsible include a letter of censure, disciplinary probation, deferred suspension, suspension, expulsion, and revocation of degree. At the recommendation of the Hearing Panel, students found responsible may also be subject to an accountability plan developed by the Dean of Students. Both the Respondent and the Complainant have the option to appeal. Both students are simultaneously notified in writing of the outcome of a disciplinary hearing as required by law. Complaints against Faculty and Staff Members Complaints against faculty or staff members should be submitted to the Title IX Coordinator or Human Resources. Procedures for resolving complaints against staff members are outlined in the Bucknell University Sex Discrimination, Sexual Misconduct, Relationship Violence & Stalking Policy & Procedures for Resolving Complaints Against Faculty Members and the Bucknell University Sex Discrimination, Sexual Misconduct, Relationship Violence & Stalking Policy & Procedures for Resolving Complaints Against Staff Members. Notification of Results of Disciplinary Hearings The University will, upon written request, disclose to the alleged victim of a crime of violence or non-forcible sex offense the results of disciplinary proceedings conducted by the University against a student who is the alleged perpetrator. 23 University will disclose the results, upon written request, to the victim s next of kin. Sex Offender Registration Pennsylvania s Megan s Law, 21 Pa. C.S , requires the Pennsylvania State Police to create and maintain a registry of persons who have either been convicted of, entered a plea of guilty to, or adjudicated delinquent of certain sex offenses. Information provided by the State concerning registered sex offenders may be obtained through the State s Megan s Law website at or by calling (866) Alcohol and Other Drugs The possession, use and sale of alcohol on the University s campus are governed by the University s alcohol policies (found in the Bucknell University Student Handbook), the Drug-Free Workplace/Campus Community Policy (found in the Bucknell University Staff and Faculty Handbooks) and Pennsylvania law. The enforcement of alcohol laws and policies on campus is the primary responsibility of the Department of Public Safety and the Division of Student Affairs. Only under certain circumstances is the consumption of alcohol permitted. Student organizations that wish to serve alcohol must comply with the restrictions and conditions outlined in the Alcohol Policy Relating to Student Organizations (found in the Student Handbook). Under Pennsylvania law, it is unlawful to furnish alcohol to a person under the age of 21. It is also unlawful for anyone under 21 years of age to purchase, possess or consume alcohol. Individuals who violate alcohol laws may have charges filed against them with the Magisterial District Judge in the Union County Courthouse and/or face University disciplinary action. Through its Medical Amnesty Policy, the University encourages students to seek assistance when someone is overly intoxicated and in need of medical assistance. Amnesty is available to the student calling as well as the student needing assistance. For health and safety reasons, students may be referred for counseling and/or education. The student s parent or guardian may be notified. Calls for assistance may be directed to the Department of Public Safety at (57) , a local police officer or agency (such as Buffalo Valley Regional Police or by calling 911), the Student Affairs Staff On Call or, in the residence halls, a resident adviser or Residential Education professional staff. The possession, sale, manufacture, or distribution of any controlled substance is illegal under both state and federal laws and violates the University s drug policy (found in the Bucknell University Student Handbook) and the Drug-Free Workplace/Campus Community policy (found in 217 SECURITY & FIRE SAFETY REPORT 21

24 the Bucknell University Staff and Faculty Handbooks). The enforcement of drug laws and policies on campus is the primary responsibility of the Department of Public Safety and the Division of Student Affairs. Individuals violating drug laws may have criminal charges filed against them with the Magisterial District Judge in the Union County Courthouse and/or face University disciplinary action. Faculty and staff members who violate the Drug-Free Workplace/Campus Community policy may be referred to the employee assistance program and/or disciplined, up to and including termination. The University complies with the requirements of the Drug-Free Schools and Communities Act Amendments of Weapons Policy Possession or storage, even if legally owned, of weapons, explosives, fireworks, ammunition, or other materials that could be harmful to the members of the community is prohibited. The University recognizes certain exceptions to this policy, including use by authorized law enforcement personnel and ROTC. Missing Student Policy All reports of missing students (or suspected missing students) should be made to the Department of Public Safety at (57) (emergencies) or (57) (non-emergencies). If any University faculty or staff member receives a report of a missing student, they should immediately inform the Department of Public Safety of the report. Every report of a missing student should be forwarded to the Department of Public Safety regardless of how long the student is believed to have been missing. If the reported missing student resides off-campus, the Department of Public Safety immediately notifies the appropriate local law enforcement agency. Missing Student Confidential Contact Form The University encourages all students to identify a contact person or persons whom the University will notify within 24 hours of the determination that the student is missing. Any contact information provided in the Missing Student Confidential Contact Form is accessible only to authorized University officials and it is not disclosed except to law enforcement personnel in furtherance of a missing person investigation. If a student is under 18 years of age and not emancipated, the University must notify a custodial 217 SECURITY & FIRE SAFETY REPORT 22

25 parent or guardian within 24 hours of the determination that the student is missing, in addition to notifying any additional contact person designated by the student. If the University has contact information for a parent or guardian, it notifies the parent or guardian even if the missing student is a legal adult and the parent or guardian is not the student s designated contact. The University notifies local law enforcement within 24 hours of the determination that the student is missing, unless the local law enforcement agency was the entity that made the determination that the student is missing. Procedures When the Department of Public Safety receives a missing student report, it conducts a thorough and timely investigation to determine the whereabouts of the student. It notifies the Dean of Students and other necessary administrators of the missing student report. If the student has designated a contact person, the Dean of Students notifies that contact person within 24 hours that the student is missing. If the student is under 18 years of age, the Dean of Students notifies the student s custodial parent or guardian and any other designated contact person within 24 hours that the student is missing. If the University has contact information for a parent or guardian, it notifies the parent or guardian even if the missing student is a legal adult and the parent or guardian is not the student s designated contact. Regardless of whether the student has identified a contact person, is 18 years of age or older, or is an emancipated minor, the Department of Public Safety notifies the local law enforcement agency that has jurisdiction in the area within 24 hours that the student is missing. Campus Security Awareness and Prevention Programs for Students, Faculty, and Staff The University offers security awareness and prevention programs for students, faculty, and staff. Each semester, the Department of Public Safety provides evacuation and fire extinguisher training for students, faculty and staff, and self-defense training (Rape Aggression Defense and Self Defense Awareness and Familiarization Exchange) for students, faculty and staff. It collaborates with the Office of Global and Off-Campus Education to offer annual safety programs 217 SECURITY & FIRE SAFETY REPORT 23

26 for students, faculty and staff who will study or work abroad. The Department of Public Safety also provides written information to students, faculty and staff concerning crime prevention. The Division of Student Affairs provides annual educational programming concerning alcohol and drug use and abuse, sexual assault, relationship violence, stalking community expectations, and downtown safety for students. It provides fire safety training to students several times each year. First-year students also complete an alcohol online education program that contains information on drug and alcohol-facilitated sexual violence. The Division of Student Affairs provides annual training for residential student leaders that addresses sexual assault, relationship violence, staking, alcohol, depression, self-harm, suicide, and fire safety and emergency preparedness. Drug and Alcohol Abuse Education Programs Prevention Programs The University provides educational programming to prevent the unlawful possession, use, and distribution of illicit drugs and alcohol by students, faculty and staff. The programming provides services related to drug use and abuse, including dissemination of informational materials, educational programs, counseling services, referrals, and college disciplinary actions. The Division of Student Affairs provides annual educational programming concerning alcohol and drug use and abuse for students. The Counseling & Student Development Center offers assessment geared towards helping students explore their patterns of alcohol and drug use. This assessment is designed to help students critically examine their patterns of alcohol/ drug use in a judgment-free environment. As part of this assessment, students complete the BASICS (Brief Alcohol Screening and Intervention for College Students) program, which is evidencebased and has been shown to be an effective intervention. Some students schedule these appointments to fulfill a requirement stemming from an alcohol or drug violation whereas others choose to participate hoping to gain a more intimate understanding of their relationship with substances. First-year students must complete an alcohol online education program prior to matriculation and a second online education program after they have been on campus for several weeks. Alcohol and drug educational programming, which includes information on the impact of alcohol on campus and the link between alcohol and sexual assaults, is offered to all resident advisers and peer advisers annually. 27 Crime Statistical Disclosure Crime Definitions Murder /Non-negligent Manslaughter: the willful (non-negligent) killing of one human being by another. Negligent Manslaughter: the killing of another person through gross negligence. Sex Offense: any sexual act directed against another person, without the consent of the victim, including instances where the victim is incapable of giving consent (includes rape, fondling, incest and statutory rape). Rape. The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim. Fondling. The touching of the private body parts of another person for the purpose of sexual gratification, without the consent of the victim, including instances where the victim is incapable of giving consent because of his/her age or because of his/her temporary or permanent mental incapacity. Incest. Sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law. Statutory Rape. Sexual intercourse with a person who is under the statutory age of consent. Robbery. The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear. Aggravated Assault. An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault is usually accompanied by the use of a weapon or by means likely to produce death or great bodily harm. (It is not necessary that injury result from an aggravated assault when a gun, knife, or other weapon is used which could and probably would result in serious personal injury if the crime were successfully completed.) Burglary. The unlawful entry of a structure to commit a felony or a theft. For reporting purposes this definition includes: unlawful entry with intent to commit a larceny or felony; breaking and entering with intent to commit a larceny; housebreaking; safecracking; and all attempts to commit any of the aforementioned. 217 SECURITY & FIRE SAFETY REPORT 25

28 Motor Vehicle Theft. The theft or attempted theft of a motor vehicle. (Classify as motor vehicle theft all cases where automobiles are taken by persons not having lawful access even though the vehicles are later abandoned including joyriding.) Arson. Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, or personal property of another, etc. Hate Crimes A hate crime is a criminal offense committed against a person or property which is motivated, in whole or in part, by the offender s bias. Bias is a preformed negative opinion or attitude toward a group of persons based on their race, gender, religion, disability, sexual orientation or ethnicity/national origin. Categories of bias included in the annual statistical disclosure are: Race. A preformed negative attitude toward a group of persons who possess common physical characteristics (e.g., color of skin, eyes, and/or hair; facial features, etc.) genetically transmitted by descent and heredity which distinguish them as a distinct division of humankind (e.g., Asians, blacks, whites). Gender. A preformed negative opinion or attitude toward a group of persons because those persons are male or female. Religion. A preformed negative opinion or attitude toward a group of persons who share the same religious beliefs regarding the origin and purpose of the universe and the existence or nonexistence of a supreme being (e.g., Catholics, Jews, Protestants, atheists). Sexual orientation. A preformed negative opinion or attitude toward a group of persons based on their sexual attraction toward, and responsiveness to, members of their own sex or members of the opposite sex (e.g., gays, lesbians, heterosexuals). Ethnicity. A preformed negative opinion or attitude toward a group of persons of the same race or national origin who share common or similar traits, languages, customs and traditions (e.g., Arabs, Hispanics). Disability. A preformed negative opinion or attitude toward a group of persons based on their physical or mental impairments/challenges, whether such disability is temporary or permanent, congenital or acquired by heredity, accident, injury, advanced age or illness. Gender Identity. A preformed negative opinion or attitude toward group of persons based on their actual or perceived gender identity, e.g., bias against transgender or 217 SECURITY & FIRE SAFETY REPORT 26

29 gender non-conforming individuals. For purposes of the annual statistical disclosure, hate crimes include any Clery-reportable offense (listed above) and the following additional offenses: National Origin. A preformed negative opinion or attitude toward a person or group of persons because of the person s, or the person s ancestor s, place of origin, or because an individual has the physical, cultural or linguistic characteristics of a national origin group. For purposes of the annual statistical disclosure, hate crimes include any Clery-reportable offense (listed above) and the following additional offenses: Larceny-Theft. The unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another. Constructive possession is the condition in which a person does not have physical custody or possession but is in a position to exercise dominion or control over a thing. Simple Assault. The unlawful physical attack by one person upon another where neither the offender displays a weapon, not the victim suffers obvious severe or aggravated bodily injury involving apparent broken bones, loss of teeth, possible internal injury, severe laceration, or loss of consciousness. Intimidation. Unlawfully placing another person in reasonable fear of bodily harm through the use of threatening words and/or other conduct, but without displaying a weapon or subjecting the victim to actual physical attack. Destruction/Damage/Vandalism of Property. Willfully or maliciously destroying, damaging, defacing, or otherwise injuring real or personal property without the consent of the owner or the person having custody or control over it. Other Crimes Involving Bodily Injury. Dating Violence, Domestic Violence, & Stalking Dating Violence. Violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim. The existence of such a relationship shall be determined based on the reporting party s statement and with consideration of the length of the relationship, the type of relationship, and the frequency of interaction between the persons involved in the relationship. Domestic Violence. A felony or misdemeanor crime of violence committed by (i) a current or former spouse or intimate partner of the victim; (ii) by a person with whom the victim shares a 217 SECURITY & FIRE SAFETY REPORT 27

30 child in common; (iii) by a person who is cohabitating with or has cohabitated with the victim as a spouse or intimate partner; (iv) by a person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction in which the crime of violence occurred, or (v) by any other person against an adult or youth victim who is protected from that person s acts under the domestic or family violence laws of the jurisdiction in which the crime of violence occurred. Stalking. Engaging in a course of conduct directed at a specific person that would cause a reasonable person to (i) fear for the person s safety or the safety of others; or (ii) to suffer substantial emotional distress. Arrests and Referrals Arrest and referral statistics include the number of arrests and the number of persons referred for disciplinary action for the following violations: Liquor law violations. The violation of state or local laws prohibiting the manufacture, sale, purchase, transportation, possession or use of alcoholic beverages, not including driving under the influence and drunkenness. Drug law violations. The violation of laws prohibiting the production, distribution and/or use of certain controlled substances and the equipment or devices utilized in their preparation and/or use. The unlawful cultivation, manufacture, distribution, sale, purchase, use, possession, transportation or importation of any controlled drug or narcotic substance. Arrests for violations of state and local laws, specifically those relating to the unlawful possession, sale, use, growing, manufacturing and making of narcotic drugs. Weapon law violations. The violation of laws or ordinances prohibiting the manufacture, sale, purchase, transportation, possession, concealment, or use of firearms, cutting instruments, explosives, incendiary devices or other deadly weapons. Geographical Definitions On Campus. Any building or property owned or controlled by an institution within the same reasonably contiguous geographic area and used by the institution in direct support of, or in a manner related to, the institution s educational purposes, including residence halls; and any building or property that is within or reasonably contiguous the aforementioned area that is owned by the institution but controlled by another person, is frequently used by students, and supports institutional purposes (such as a food or other 217 SECURITY & FIRE SAFETY REPORT 28

31 retail vendor). Student Housing Facility. Any student housing facility that is owned, controlled or rented by the institution, or is located on property that is owned or controlled by the institution, and is within the reasonably contiguous geographic area that makes up the campus. Non Campus Building or Property. Any building or property owned or controlled by a student organization that is officially recognized by the institution; or any building or property owned or controlled by the institution that is used in direct support of, or in relation to, the institution s educational purposes, is frequently used by students, and is not within the same reasonably contiguous geographic area of the institution. Public Property. All public property, including thoroughfares, streets, sidewalks, and parking facilities, that is within the campus, or immediately adjacent to and accessible from the campus. 35 CAMPUS FIRE SAFETY REPORT This fire safety report contains fire safety policies and procedures related to on-campus student housing and statistics for fires that occurred in those facilities. Fire Safety Education and Training The Department of Public Safety staffs a Life and Fire Safety office that is responsible for a majority of the University s fire prevention and safety training programs as well as regular fire and life safety inspections for some on campus events. Fire safety education and training programs, including fire extinguisher training, are taught by local fire authorities and members of the Department of Public Safety. Each semester, the Department of Public Safety coordinates a fire and evacuation drill in each residential facility (except Bucknell West). Students learn the locations of the emergency exits in the buildings. The Department of Public Safety does not tell individuals in advance about the designated locations for long-term evacuations because those decisions are affected by time of day, location of the building being evacuated, the availability of the various designated emergency gathering locations on campus, and other factors such as the location and nature of the threat. The purpose of the fire and evacuation drills is to prepare building occupants for an organized evacuation in case of a fire or other emergency. In addition to educating occupants of each building about fire safety and evacuation procedures during the drills, the process also provides the Department of Public Safety with an opportunity to test the operation of fire alarm system components. Evacuation drills are monitored by the Department of Public Safety to evaluate egress and behavioral patterns. Reports are prepared by the Department of Public Safety which identify deficient equipment so that repairs can be made immediately. Recommendations for improvements are also submitted to the appropriate departments for consideration. The Resident Advisers are trained in these procedures and act as an ongoing resource for students living in residential facilities. The Department of Public Safety documents each test it conducts, including a description of the 217 SECURITY & FIRE SAFETY REPORT 33

36 test, the date the test was held, the time the test started and ended, and whether the test was announced or unannounced. In addition to the fire and evacuation drills, the Department of Public Safety (in cooperation with local fire authorities) conducts a mock residence hall fire each year. The purpose of this exercise is to demonstrate how quickly a fire spreads and the necessity of immediate and swift evacuation. Procedures If a fire occurs, individuals are instructed to sound the building fire alarm by pulling the red alarm pull box and, if possible, call the Department of Public Safety at (57) Once a fire alarm has been sounded, individuals should evacuate immediately using the nearest fire exit door or stairwell. Individuals should not use elevators because they may become inoperative due to the fire. If possible, abled persons should assist disabled persons in exiting the building. Disabled persons who cannot use stairs should wait in the stairwell until the Department of Public Safety or firefighters arrive. Individuals should notify Department of Public Safety officers or fire authorities of the location of any disabled persons remaining in the building. Individuals should also notify Department of Public Safety officers or firefighters if they suspect that someone may be trapped inside. The fire alarm may not sound continuously. Even if the alarm stops, individuals should continue the evacuation. Warn others who may enter the building after the alarm stops. Individuals should evacuate to a distance of at least 5 feet from the building and out of the way of emergency personnel. Individuals should not return to the building until instructed to do so by the Public Safety officers or other authorized personnel. When a fire alarm has been sounded or a fire otherwise reported to the Department of Public Safety, the Department of Public Safety dispatcher will initiate the notification procedures for contacting appropriate personnel. How to Report That a Fire Has Occurred For purposes of counting and disclosing fires in the University s annual fire statistics, individuals should notify the Department of Public Safety at (57) that a fire has occurred. 217 SECURITY & FIRE SAFETY REPORT 34

37 Policies Regarding Portable Electrical Appliances, Smoking and Open Flames In Student Housing Facilities Smoking Smoking is prohibited in all University buildings (including all non-university-owned fraternity houses) and within 25 feet from all building entrances and exits. Portable Electrical Appliances and Open Flames To ensure the safety of student residential facilities, the following items are prohibited: air conditioning units (unless valid medical documentation of necessity) open flames, candles (lit or unlit), incense, oil lamps, halogen lamps ceiling fans combustible engines and materials, including grills and petroleum products decorations made of flammable materials (including live Christmas trees and wreaths) electrical appliances including refrigerators larger than 4.5 cubic feet, microwaves drawing more than 75 watts, personal appliances drawing more than 4 watts. extension cords that are not UL approved Fire Safety Improvements The University assesses and upgrades fire safety equipment to ensure that all equipment meets National Fire Safety standards. The University continues to evaluate and improve smoke/heat detection systems, as necessary, to meet life safety requirements and protect University assets. It periodically assesses the need for other improvements in fire safety, making recommended improvements as soon as possible. Fire Statistical Disclosure Definitions: Fire: Any instance of open flame or other burning in a place not intended to contain the burning or in an uncontrolled manner. Unintentional Fire: A fire that does not involve an intentional human act to ignite or spread fire into an area where the fire should not be. Intentional Fire: A fire that is ignited, or that results from a deliberate action, in circumstances where the person knows there should not be a fire. 38 Fire-related Injury: Any instance in which a person is injured as a result of a fire, including an injury sustained from a natural or accidental cause, while involved in fire control, attempting rescue, or escaping from the dangers of the fire. Fire-related Death: Any instance in which a person (i) is killed as a result of a fire, including death resulting from a natural or accidental cause while involved in fire control, attempting rescue, or escaping from the dangers or a fire or (ii) dies within one year of injuries sustained as a result of the fire. Value of Property Damage: The estimated value of the loss of the structure and contents, in terms of the cost of replacement in like kind and quantity.
