1 CHAPTER 13 PROMOTIONS General Guidelines 13.1 While dealing with matters related to seniority amongst police personnel, and their respective claim of promotion to the next rank, below mentioned fundamental principles shall be duly kept in mind:- (1) The State police service, though comprises of varied wings, units, branches and cells, and is broadly divided into four major cadres, yet constitutes a unified composite organization, as envisaged in Section 3 of the Act. (2) Any person of any cadre, division, wing, unit, branch or cell, is deemed to be the member of the Police Service also and he is primarily member of the respective unit and cadre, where he is enrolled. The functional divisions are meant for administrative convenience, promotion of excellence in earmarked domain, and optimal utilization of specialized potential in the best interest of the service. (3) All personnel, commencing from the lowest rank, onwards, shall have the equal opportunity to be considered for any higher rank, as permissible by the relevant rules and regulations. (4) The entire Police Service upto the rank of Inspector comprises of four cadres, and are intended to merge at the level of the Deputy Superintendent of Police, and therefore, all promotions within the cadres shall form common foundation and progression on the basis of common principles for all personnel to be promoted step by step, upto the rank of Deputy Superintendent of Police and as DSPs to be considered on equal footing for onward promotions. (5) The number of posts of Inspectors in any cadre or subcadre, shall be proportionate to the strength of the particular cadre and sub-cadre and the posts of Deputy Superintendents of Police available shall be apportioned amongst different cadres, proportionate to the strength of the Inspectors, and overall strength of the cadre or subcadre. The Director General of Police, in consultation with different cadre control authorities, and keeping in view the 1

2 administrative requirement of the posts in any cadre or subcadre, shall decide the number of posts made available for the promotion as Deputy Superintendents of Police. (6) Inter-cadre transfer of personnel has been specifically prohibited, hence the utilization of services of any personnel, in cadre, other than to which he belongs is possible only through deputation, as per relevant rules. (7) In the interest of espirit de corps and morale of the Police service the process of recruitment, seniority, promotion and placement at an appropriate rank on deputation has to be absolutely logical and transparent. It has also to be responsive in terms of redressal of grievances if any, perceived by any personnel, presenting it appropriately, before the concerned authority. (8) In order to manage, matters related to points mentioned above, proper seniority is essential to be maintained within the sub-cadre, and cadre, as well as within the Police service, as one organization. a. As regards officers of Indian Police Service and Punjab Police Service, there is state-level seniority, common to all in the respective category. b. The ranks below the rank of the Deputy Superintendent of Police, i.e. Inspector, Sub- Inspector, Assistant Sub-Inspector, Head Constable and Constable shall also have state level common seniority, as well as cadre seniority, and sub-cadre seniority, within the respective cadre, and subcadre. (9) a) The State Seniority List (SSL) shall be prepared, maintained and updated in the office of the Director General of Police. This list shall be prepared without disturbing the seniority already existing at the time of publication of these Rules and this list shall have prospective effect. b) The Cadre Seniority List (CSL) shall be similarly prepared, maintained and updated by the designated Cadre Controlling Authorities and Incharges of sub-cadres. c) There shall be a separate seniority list for officers of every rank in every cadre or sub-cadre. The nomenclature for the 2

3 seniority lists, rank-wise, and authorities responsible to prepare and maintain in an updated manner are mentioned in Appendix 13.16(1). d) All the seniority lists shall be reviewed and published in the Police Gazette and loaded on the official website; by 1 st January of every year. Any expression of grievance against placement in the seniority list shall be welcome within one month of the said publication, and to be redressed by a Departmental Committee headed by the officer of the rank of Inspector General of Police and above, within 30 days; hence the lists of seniority at all levels shall be finalized by 1 st April of every year without fail. (10) While any authority adjudging grievances, represented by any personnel or group of personnel, about determination of seniority or any matter related thereto, such personnel must be heard in person, and the authority shall dispose of the matter within 30 days of the receipt of the representation by passing a speaking order. Therefore, the organization of Police Service is responsible to:- a. Maintain balance and fair play in promotions. b. Ensure that there is no discrimination against or preferential treatment to any personnel or group of personnel. c. d. e. Principles that are common to the entire police service shall govern seniority and promotions of all personnel, of all the cadres. The principles and norms related to promotions shall be duly placed in public domain for the purpose of transparency. Principles of natural justice shall be followed in letter and spirit in deciding all aspects and issues related to promotions. (11) a. The authorities designated to be the Cadre Controlling Authority, for different cadres and sub-cadres, shall be as follows:- 3

As the number of personnel of Information & Communications Technology Wing is large, the officer heading the Wing is Cadre Controlling Authority for them. For remaining elements in this cadre, the functions of Cadre Controlling Authority shall be performed by Additional Director General of Police /Administration. b. Immediately after the publication of these Rules in the official gazette, within a period of six months, the office of Director General of Police and the respective Cadre Controlling Authority shall prepare the seniority lists, in Appendix 13.16(1), according to the norms and Rules in this Chapter, completing the process of disposal of grievances, if any. Role, Functions And Responsibilities of Cadre Controlling Authority 13.2 I. The role, functions and responsibilities of Cadre Controlling Authority inter alia include the following:- To ensure organization, co-ordination and supervision amongst all the designated Appointing Authorities and that concerned Appointing Authority prepares and maintains a seniority list pertaining to the personnel appointed in the unit 4

5 under him. II. III. IV. To prepare and maintain state-level cadre seniority lists of personnel of each and every rank, and load the lists on the Police Website, and ensure publication of the lists in Police Gazette strictly in time. This aspect shall be initiated prospectively after streamlining the cadre wise seniority. To receive representations of claims of seniority and related matters, process, present, and get adjudicated or disposed of through a Departmental Committee, under the guidance and command of the Director General of Police. To ensure proper presentation of well coordinated and integrated response to any matter related to seniority and promotions, being sub-judice, or any reference received from the Director General of Police, the Court or any statutory body of the Government. V. Ensuring preparation, completion, updation and preservation of records pertaining to matters related to seniority and promotions, in a scientific manner, both manually and electronically, as a permanent record, for reference at any point of time. Even responding to the queries under Right To Information Act, VI. VII. To examine any implication of any judicial decision by competent court, having ramifications over the matters related to seniority and promotions. Keep updating the Seniority Lists, effecting additions and deletions occurring due to recruitment, promotions, retirement, resignation, termination or dismissal or death of the personnel. VIII. Extending assistance and co-operation to the office of the Director General of Police, for preparation of Seniority Lists, and to ensure that the personnel of cadre under his control, are properly placed in the Lists. IX. Selecting officers to be sent for promotional courses as per seniority and the Rules, and dealing with the cases of temporary exemption from the promotional courses. X. Dealing with matters pertaining to deputation of officers from one cadre to the other cadre and proceeding in this regard with the explicit approval of the Director General of 5

6 Police. XI. Arranging constitution of Departmental Selection Committees, Departmental Promotion Committees or any Special Committee, and the Board to conduct Competitive Examination for Constables to be placed on the List B preparatory to Promotion List-I, as and when required. XII. Getting the records, particularly the Performance Assessment Reports and information about disciplinary proceedings, rewards and punishments, and its implications on the seniority and promotions organized in complete form well in advance before the Departmental Promotion Committees are convened. Harmonious Interpretation of these Rules with Punjab Civil Service (General and Common Conditions of Service) Rules, Rank Structure And Promotions Within Each Cadre. XIII. Preparing proper information, syllabus and application form, in the shape of Prospectus, for the conduct of Competitive Examination for placement of Constables on List B preparatory to Promotional List-I, and make the same available sufficiently prior to the examination Punjab Civil Service (General and Common Conditions of Service) Rules, 1994 or any other Rule of Law for the time being in force shall be read in conjunction with these rules and interpreted harmoniously except where its provisions are specifically overridden by these rules. In such case these rules being later in time and specific to the obligations to be discharged by the police department shall prevail (1) The following rank structure of the police service, in ascending order shall be deemed to be established under the Act and the Rules: - i. Constable To be referred to as Junior Enrolled ii. Head Constable Police Officers. iii. Assistant Sub-Inspector of Police To be referred to iv. Sub-Inspector of Police as Senior v. Inspector of Police Enrolled Police Officers. vi. Deputy Superintendent of Police To be referred to And above as Senior Police Officers 6

7 All promotions shall be affected as per the above structure. (2) I. Promotion of enrolled police officers from one rank to another in all cadres shall be affected in accordance with the provisions contained in this chapter. II. Principles that are common to the entire force shall govern seniority and promotions of all personnel of each cadre, as prescribed in this Chapter. III. All personnel within each cadre shall within the meaning of these Rules have equal opportunity of promotion vis-à-vis each other. (3) The criteria, eligibility and norms of selection for promotions in specialized cadres, may vary from these norms, as specifically provided in the Chapter 18 and other relevant provisions in these Rules. Promotion From One Rank To Another. Seniority Lists And Promotion Lists Promotion from one rank to another and from one grade to another in the same rank shall be affected by selection on the basis of seniority-cum-merit. Efficiency, amenability to discipline and honesty shall be the main factors governing selection. Specific qualifications, whether in terms of training courses passed or practical experience gained shall be duly considered for an appropriate weightage. When the qualifications of two officers are otherwise equal, the senior shall be promoted first. This rule shall not affect increment within a time scale (1) Seniority Lists are separate from promotion lists and are to be maintained separately from them. A Promotion List indicates the officers those found eligible for promotion to the next higher rank as per the requisite qualifications and vacancies available or likely to occur. The Seniority List gives the placement of the officer in the entire cadre, indicating length of service. The officers selected to be eligible for promotion on the basis of seniority-cum-merit, will form the promotion list. (2) The authorities authorized to make appointments, promotions, preparation and maintenance of seniority lists and promotion lists, the nomenclature of the lists concerning different ranks, criteria and eligibility for promotion, and the 7

8 distribution of posts amongst classes of personnel, coming from different streams to constitute a particular rank, are detailed in Appendix 13.6(2). (3) a) While preparing lists of personnel eligible for promotion, or the promotions lists, the exceptions, if any, reservations, implementation of Roaster System as prescribed by the Government rules and regulations, shall be incorporated and the personnel shall be so adjusted on the promotion lists. b) In cases related to Priority List (PL) Instructions, the Director General of Police may recruit the dependent in any rank of enrolled Police Officer, where enrolment takes place by direct recruitment. The seniority of such PLI/enrolment of officers, shall be placed immediately below the officer appointed or promoted, prior to the date of joining by such PLI enrolled officer. (4) The existing seniority lists referred to as Lists C, D, E, F, G in Appendix 13.6(2), for five ranks of Constables, Head Constables, Assistant Sub-Inspectors, Sub-Inspectors and Inspectors, respectively shall be the Seniority Lists, and Promotion Lists I, II, III, IV and V, shall be as shown in Appendix 13.6(2). (5) These promotion lists shall be updated twice a year on 1 st May, and 1 st November of each year. Promotional Courses 13.7 (1) There shall be five promotional courses for the promotions of enrolled Police Officers as detailed below:- S.No. Description Of Purpose Course 1. Level I For promotion of Constables to Head Constables. 2. Level II For promotion of Head Constables to Assistant Sub-Inspectors. 3. Level III For promotion of Assistant Sub-Inspectors to Sub-Inspectors. 4. Level IV For promotion of Sub- Inspectors to Inspectors. 8

9 5. Level V For promotion of Inspectors to Deputy Superintendent of Police. (2) The syllabus for these promotional courses shall be finalized and revised by the Director, Punjab Police Academy, Phillaur in consultation with Human Resources Development Wing, with the approval of the Director General of Police. (3) The status of participation in promotional course, shall only be graded as pass or fail, and the merit of an individual officer in the status of promotional course shall not impact the seniority in any manner. (4) Those who have already passed the promotional courses, the deemed dates shall be determined for the purposes of seniority. (5) Candidates who fail to pass a promotional course shall be given upto a maximum of three additional opportunities to pass those parts of the course in which they have failed. The seniority of such officer shall be placed at the top of the subsequent course where he passes the promotional course. This officer has no claim to be placed along with the batch of officers with whom he had originally undergone the promotion course. If he does not pass the course in the three additional opportunities his name shall be removed from the promotion list. (6) a. Promotion courses are compulsory qualifying conditions for any promotion and no exemption is permitted. Provided that i. Where the candidate is a sports person of the national /international level as would be covered under the conditions applicable to officers with exceptional achievements such officer would be permitted temporary exemption from such promotion course as required for participation in the sports activities. ii. Such officer would have to eventually pass the promotion course and would be given 9

10 iii. deemed date as per the course for which such officer was to be originally deputed. The same conditions shall apply to officers who are engaged in other official work that amounts to exceptional achievements that is related to police work in the meaning of these Rules. Additionally, where an officer cannot proceed on such promotion course due to being engaged in official work of a special and emergent nature as certified by the Cadre Controlling Authority, the same conditions as above shall be applicable to the case of such officer. iv. The officer s performance in such subsequent course shall be rationalised on the basis of transparent criteria and they shall be appropriately placed in the inter se merit of the course for which they were entitled to be originally deputed. v. Officers can neither gain nor lose seniority as a result of such temporary exemption. Seniority Of Directly Recruited Officers b. Such temporary exemption can be given by the Director General of Police through a written order recording reasons for the same either on his own or based on recommendation of the Cadre Controlling Authority. c. This shall ordinarily be on a proposal moved through the cadre controlling authority. In the case of sportspersons, the proposal shall be moved by the officer supervising Punjab Police Sports The State Common Seniority of directly recruited probationary officers shall be strictly determined on the basis of the merit list of the selection process. In case the marks of the two officers of the same batch are equal then their seniority shall be calculated from their date of joining. In case they have joined the department on the same date then their seniority shall be fixed according to their date of birth and the elder in age shall be senior. 10

11 Promotion To Be Affected As Soon As Vacancies Occur (1) Promotions are to be affected as soon as vacancies occur and there shall be no delay in filling up promotional vacancies. (2) As soon as a promotional post becomes available it shall be filled by drawing the list of officers approved for promotion as per the recommendations of the Departmental Promotion Committees in accordance with Rule below. (3) Lists of those eligible for promotion as per approval of the Departmental Promotion Committee shall be maintained in advance. The list shall be valid for a period of three months or as specified by the Government instructions. (4) Where such list has lapsed, a fresh Departmental Promotion Committee shall be constituted immediately to approve officers eligible for promotion. Explanation: At any given time, there should be a list of eligible officers available for promotion to a particular rank. Vacancies should be filled from the promotion list on the date such vacancy occurs. Redetermination Of Seniority Following Government Order Or Decision In Disciplinary Proceedings. Departmental Promotion Committees (DPC) Where an officer is reinstated from dismissal or his seniority is ordered to be re-determined under the orders of the judicial courts, the Government or the relevant senior authority of the department then the seniority of such officer shall be re-determined accordingly. The State Common Seniority lists as well as cadre seniority lists shall be amended after adjusting the seniority of the officers concerned. This will be subject to applicable Government instructions on such matters (1) Departmental Promotion Committees (hereinafter DPCs) shall be constituted for promotion to each rank. (2) All DPCs shall work in accordance with principles that are commonly applicable for a particular rank across all cadres. These shall be circulated by the office of Director General of Police from time to time and shall incorporate the latest instructions of the State Government and judgements of the courts that have a bearing on those promotions. (3) These DPCs shall be constituted in time and well in advance and before any promotional posts become vacant. As least, 11

12 they will be constituted at least twice a year for each rank. (4) The Cadre Controlling Authority shall be responsible for ensuring that all the relevant service record is complete and available well in advance of any proposed or likely DPC. Departmental Promotion Committee is distinct from Departmental Selection Committee. Composition Of Departmental Selection Committee And Departmental Promotion Committee Departmental Selection Committee is constituted as per Rule below for the selection of officers for being placed on Promotion Lists after thorough and responsible scrutiny of service record, merit, seniority, rewards and punishments and all related instructions on the subject. The Departmental Promotion Committee is meant for the final approval of officers for promotion to next ranks on the basis of an objective application of mind quite independently of the Departmental Selection Committee. The Board specially constituted to conduct Competitive Examination for placing the Constables in the List B preparatory to promotion, hereinafter referred in Rule (4) is different than both the Departmental Selection Committee and Departmental Promotion Committee (1) An officer of the rank of Deputy Inspector General of Police shall head the Departmental Selection Committee and Departmental Promotion Committee for promotions to the rank of Head Constable and Assistant Sub-Inspector of Police. Other members will include one officer of the rank of Senior Superintendent of Police or Superintendent of Police and one of the rank of Superintendent of Police or Deputy Superintendent of Police. (2) An Officer of the rank of Inspector General of Police shall head the Departmental Selection Committee and Departmental Promotion Committee for promotion to the rank of Sub-Inspector of Police and Inspector of Police. Other members will include one officer of the rank of Dy. Inspector General of Police and of Senior Superintendent of Police. (3) Officers from the SC/ST category or any other category specified by the Government shall be included as members in accordance with Government instructions. 12

13 Departmental Promotion Committee To Adjudge Suitability For Promotion And Give Final Assessment (1) The Departmental Promotion Committee shall adjudge the suitability of each officer for promotion and give an overall grading of Fit or Unfit for promotion, for each official, on the basis of integrity, reliability and assessment of Annual Performance Assessment Reports and service record of the last 06 years. (2) Officers from the relevant Promotion List, numbering three times the number of vacancies, shall be considered in the same order in which their names appear on the said Promotion List. (3) No enrolled police officer shall be promoted to the next higher rank during the currency of punishment or:- i. whose integrity has been reported as doubtful during the last 8 years or as per government instructions, or ii. whose reliability has been adverse during the last 5 years, or iii. does not fulfil the bench mark criteria as per the instructions laid down by the department and the Government from time to time. (4) In appropriate cases relevant sealed cover procedure shall be adopted as per Government instructions. (5) Police officers considered fit for promotion shall be promoted in the same order in which their names appear on the Promotion List. (6) The cases of officers found unfit for the promotion shall be considered as per their order of seniority at the time of the next subsequent Departmental Promotion Committee meeting held for that rank. Benchmark Criteria (1) Benchmark criteria for promotion shall be laid down by the department and amended from time to time after obtaining approval from the Government. (2) The benchmark criteria for promotions at each rank shall be widely circulated to all ranks and also made available on the official website well in advance. This must be done by 1 st April of the each year when the criteria is to apply. (3) Explanation:- As per Government instructions the benchmark system is applicable to the officers of Group A (Dy. Superintendent of Police) & B (Inspectors) but not 13

14 applicable for Group C officers. However, there is need to promote professionalism and this should be made applicable to the officers of group C (i.e. Sub Inspectors, Asstt. Sub Inspectors of Police, Head Constables and Constables) as well. Selection Process For Placement of Officers On Promotion Lists (1) The scrutiny and the selection process of placement of officers on the respective promotion lists to be referred to as Promotion Lists I, II, III, IV and V, as mentioned in Appendix 13.16(1), shall be organized at the State-level for each cadre every year, which should be completed before 31 st March, every year with all types of proceedings including decision on objection, if any, and final publication of the promotion lists. (2) The Departmental Selection Committees shall be constituted for selection of officers, to be placed on the promotion lists in each cadre and for personnel of every rank; every year, sufficiently prior to the fixed date of preparation of promotion lists. The Cadre Controlling Authorities shall ensure organization of such Departmental Selection Committees with the approval of the Director General of Police. (3) The number of vacancies to be made available to each unit within the cadre, and the cadre in whole, shall be strictly in proportion to the total strength of that cadre in the Police Service. (4) The number of vacancies shall include sum total of existing vacancies and the vacancies likely to be created within the current year. (5) As per Government policy on reservations in promotion, if any, shall be followed while selecting officers to be placed on respective promotion lists. (6) As permissible by relevant instructions of the Government, the reservation shall also apply while placing officers on promotion lists, through competitive examinations. (7) Officers shall be deputed for promotional courses, as per seniority. Conduct Of Competitive Exam For Placement Of (1) In order to recognise, acknowledge and promote officers of the rank of Constables, which is the real foundation of Police Service, and is constituted by the largest number, 25% of the 14

15 Constables On List B, preparatory to Promotion List-I. posts of Head Constables shall be filled through competitive exam and this percentage may vary, as prescribed by the Government. A small number of Constables more than the said number i.e. 25% can be enlisted on List B, and then sent to Promotional Course Level-I, to serve as a waiting list, which shall cease to exist after the purpose of filling of vacancies is served. However, the officer who has passed the Promotional Course, he shall be at the top for the next cycle of promotion, and he need not undergo the promotional course. (2) The said number of Constables, on the basis of their merit in the competitive exam, shall be placed on preparatory promotion list to be known as List B. On the basis of their ranking on the List B, they shall be sent for joining Promotional Course Level-I and on the basis of their merit in this course, they shall be placed on Promotion List-I. (3) An officer of the rank of Deputy Inspector General of Police or above shall be nominated by the Director General of Police, to act as Chairman of Board who shall be assisted by two more members, who are officers of the level of Senior Superintendent of Police and Superintendent of Police, to conduct the competitive exam, every year in each cadre. The Cadre Controlling Authority shall convene the Board and conduct the competitive exam sufficiently prior to the preparation of List B, mentioned in Appendix 13.6(2). Eligibility Of Constables For Candidature In Competitive Examination For Placement On List B preparatory to Promotion. (4) The officers aspiring for promotion through this competitive exam, shall be eligible to participate in the competitive exam, provided a) The officers have completed three years of service on 1 st January, and must have passed the Basic Recruits Course. b) The candidate appearing for this test must have not been charge-sheeted in a departmental inquiry for major punishment in a criminal case. c) A candidate cannot appear for the Competitive Examination during the currency of major punishment. However, minor punishments do not disqualify the officer from appearing though such officer, if selected, cannot be deputed for the 15

16 Level-I Course during the currency of the minor punishment d) No candidate shall be allowed to appear for Competitive Examination more than five times during his service. Each attempt shall be entered in the relevant service book and serve as a record for future reference. e) There shall be no age limit for competing for the test but any person of or over 40 years of age must be certified as medically fit to undergo the physical endurance test. f) The officers expecting entry to the promotion list, on account of seniority, or being the exemptee, or being outstanding sportsperson, or any other consideration, shall also be eligible to participate in the competitive exam. If in a particular year, their turn to be placed on the promotion list, does not mature, they can be so placed on the basis of the merit of competitive exam. (5) The Board, mentioned in Rule (3), for conduct of competitive exam, shall keep in mind below mentioned aspects while conducting the proceedings with regard to:- a) Ensuring a desirable Service Record of the candidate officers; b) A Competitive Examination in (a) Law and Practical Police Work This examination shall be of 60 marks for district police /District Police cadre. For the members of the other 3 cadres it shall be of 40 marks and the 20 marks shall be made up from questions based on duties specific to that cadre. (b) Endurance (qualifying); c) Rewards and Commendation Certificates 10 marks d) Training Courses 10 marks e) Education Qualifications 10 marks f) Interview (10 marks) Total 100 marks. 16

17 (6) The mode of conduct of competitive exam, syllabus and other modalities shall be laid down in a transparent manner, and duly publicised, through special Standing Order, by the Director General of Police, every year, sufficiently prior to the date of competitive exam. (7) The assessment of various other related aspects of the aspiring candidates, shall be made as explained below:- I) Assessment Of Educational Qualifications II) Qualification Marks Awarded a) 10+2 or below NIL b) Graduation 02 c) Post Graduation 05 d) Additional Professional 03 Qualification i.e. of use to the Department such as special knowledge of Computers, Accounting, Forensics etc. Assessment Of Training Courses Undergone Type of Training Course a) For training courses of duration exceeding 02 weeks but not exceeding 04 weeks. b) For training courses of duration exceeding 04 weeks but not exceeding 08 weeks. c) For training courses of duration exceeding 08 weeks but not exceeding 12 weeks. d) For training courses of duration exceeding 12 weeks. Marks Awarded Training Courses finally passed by the candidates up to 31 st December of the year preceding the year of examination shall be taken into account while awarding marks. Maximum 10 marks can be awarded for training courses. III) Assessment Of Commendations And Rewards a) Commendation Disk of DGP b) Class I Commendation Certificate 05 marks 02 marks 17

18 c) Class II Commendation Certificate d) Class III Commendation Certificate 01 mark ½ mark Total marks to be awarded for Commendation Certificates shall not exceed 10. Only the Commendation Certificates granted on or before 31 st day of December of the year prior to the year of the test shall be taken into consideration for assessment of the service record. Marks shall be deducted for every punishment inflicted on the member of the service in accordance with these rules, as follows:- a) For every major punishment 05 marks b) For every minor punishment marks The total marks to be deducted for punishment shall not exceed 213. Only the punishments awarded on or before the 31 st day of December of the year prior to the year in which the selection is made, shall be considered for deduction of marks. IV) Endurance Test The Endurance Test shall only be qualifying in nature. Its conditions are as under:- i meters run for men and ii meters run for women - in 9 Minutes For candidates over 40 years the physical endurance conditions shall be reduced. The conditions shall be formulated by the Human Resources Development Wing approved by the Director General of Police and duly publicised. (8) I. The Constables, who have been designated as Senior Constables, as per policy laid down by the Director General of Police, through a standing order, shall wear one strip on their uniforms. II. Constables who have successfully qualified their Level-I Course shall wear two stripes on their

19 III. IV. uniform. Constables after promotion as Head Constables shall wear three stripes on their uniform. Head Constables who have qualified their Level- II Course shall wear three stripes with the Ashoka Emblem on their uniform. (9) The Cadre Controlling Authority, concerned, with the approval of the Director General of Police, shall prepare proper information, syllabus and application form, in the shape of Prospectus, and make available for the aspirants, every year in the first week of April. (10) If at the time of selection for admission to List B the aggregate marks of two constables are equal, the Constable who is senior in service shall be selected, and in case they have equal marks and the same seniority, the Constable whose date of birth is prior in point of time shall be brought onto List B. (11) 1. Objections A candidate may within 07 days of the declaration of the result of the Competitive Examination and finalization of List B, file an objection with the Departmental Selection Committee for appropriate relief/order. The Departmental Selection Committee shall decide the representation/ objection after recording reasons in writing, within three working days of filing of such objection. 2. Appeal Process An appeal against the order of the Departmental Selection Committee may be preferred to the office of Director General of Police within 2 weeks of the decision made by the Departmental Selection Committee. While filing the appeal, it shall be the responsibility of the appellant to directly provide a copy of the said appeal to the Departmental Selection Committee so that it is able to prepare its comments on the same immediately and forward those to the office of Director General of Police without loss of time. The appeal shall be decided by the office of the Director General of Police within one week and no further appeal shall lie against this order. 19

20 (12) The result prepared by the Board-cum-Departmental Selection Committee shall not be implemented or made final until the same is approved by the Director General of Police who will accord approval only after due scrutiny on all aspects. He may refer the list back to the Board or Departmental Selection Committee for correction of errors/omissions, if any, and will also be competent to seek clarification on any point from such Committee or other officers as considered necessary. (13) All candidates shall be ranked inter se on respective Cadre Seniority Lists and a Common State-wide basis as per the marks obtained by them in the competitive exam. Selected candidates will be brought onto List B and be deputed for Promotional Course Level-I, as per their merit in the State List B. A fresh List shall be prepared for each year. However, once an officer has been placed on List B he shall continue on that list till deputed for the Promotional Course Level-I. Merit on List B, Relevant Up to Joining Of Promotional Course. Departmental Selection Committee For Promotion Based Seniority. (14) a. The List B merit list ceases to have effect after the selected officers have joined the course and their final seniority will be as per their ranking in the Promotional Course Level-I. b. The rank obtained in the Promotional Course Level-I, subject to other applicable conditions, shall be the foundation for governing seniority of the officer in service thereafter (1) The selection for entry to Promotion Lists on the basis of seniority, up to the percentage of posts mentioned in Appendix (1), shall be organized through specially constituted Departmental Selection Committees for each rank, in the each cadre at the State level. The concerned Cadre Controlling Authority, with the guidance and approval of Director General of Police, shall organize the process for constitution of committee and other related affairs. (2) Selection of the officers for placement on the promotion lists shall be made on the basis of the seniority on State level Cadre Seniority List provided they have completed specified number of years of service. (3) Other conditions, regarding service record, there being no criminal case or disciplinary proceedings pending as 20

21 applicable to Constables through competitive exam, as per Rule 13.17(4), shall also apply here in this regard. Seniority Based Promotion (1) Except 25% vacancies of Head Constables to be filled through Competitive Examination amongst Constables, all other vacancies in all the ranks are to be filled through promotion based on seniority-cum-merit; as mentioned in the Appendix 13.16(1). (2) The availability of excess vacancies in one cadre as compared to others will not impact the opportunity of the senior most Constables in State Seniority List. Subject to other criteria, the senior most Constables will be promoted against the vacancy irrespective of whether the vacancy is in their cadre or another cadre. In case they are promoted against a vacancy of another cadre, the Department will have the option of deputing them to take up the post in that cadre. This can be possible only if a complete State Seniority List is prepared which is an ultimate target but shall be achieved gradually and more relevant for management of seniority related matters as a long-term measure. OR In case it is decided not to depute the promoted officers to the other cadre, the alternative is that officers are promoted as per their seniority in their own cadres. However, they will retain their State Seniority and continue to proceed on deputation or rise to a common rank as per their rank in the State Seniority List. Note: The Department has to select one of these options. Assessment Of Service Record (1) The procedure for assessment of Record of the other officers to be selected on Promotional Lists II, III, IV and V, shall be the same, as applicable for Constables through competitive exam, mentioned in Rule (2) The officers to be selected for placement on promotional lists must have been confirmed and passed relevant promotional course. (3) Conditions mentioned in clauses (1) and (2) above, are exactly applicable to categories of Outstanding Sportspersons etc. (4) At the time of making assessment of officers for selection to be placed on the promotional lists, with regard to officers in 21

22 the category of outstanding performance, an expert, can be associated for the help of Departmental Selection Committees. (5) The mandatory length of service for being considered for selection for placement on the promotional lists, for different rank shall be as prescribed from time to time. (6) The said mandatory length of service and period of probation or confirmation shall not be relaxed in any individual case. (7) Any officer claiming promotion, on the basis of outstanding achievements, may apply within six months of the achievement, furnishing all necessary details, to the concerned Appointing Authority; which may forward the same to the Cadre Controlling Authority appropriately. (8) Mechanisms of publication of recommendations of Departmental Selection Committees, representations and appeals against grievance, and redressed in time bound manner, shall be applied as that in case of Constables through competitive exam as per Rule Sports Policy The Outstanding Sportspersons in Police Service, shall be promoted against the earmarked quota of 3% in every cadre, as per sports policy of the State Government, prescribed from time to time. Vacancies Not To Be Carried Forward. Promotions Of Officers On Five Years Leave. Promotions Of Officers Who Proceed On Study Leave Seats earmarked for promotion of certain categories of officers, if not filled or exhausted, due to non-availability of such candidates, shall not be kept available or carried forward, rather filled through available candidates from the general category Officers who proceed on 5 years leave will be entitled and maintain their seniority in all relevant promotion Lists as per Government instructions. Such personnel shall be eligible for promotion with the period being considered a No Performance Assessment Report period and the officer awarded the notional benchmark required for promotion Notional bench mark shall be given to an officer who is on study leave provided he has completed the course of study. In case of inability to complete the course he shall be graded average. Where the failure is for reasons beyond the control of the officer notional benchmark may be permitted 22

23 by the Cadre Controlling Authority for reasons to be recorded in writing. Provided that where a report on the training course has been recognised as per Government instructions as equivalent to Confidential Report it shall prevail. Promotions Of Officers On Training Notional bench mark shall be given to an officer who is on study leave provided he has completed the course of study. In case of inability to complete the course he shall be graded average. Where the failure is for reasons beyond the control of the officer notional benchmark may be permitted by the Cadre Controlling Authority for reasons to be recorded in writing. Provided that where a report on the training course has been recognised as per Government instructions as equivalent to Performance Assessment Report it shall prevail. Promotions Of Officers On Duty With International Organizations. Promotions Of Officers On Deputation With Government of India Or Other State Governments. Personal Rank And Promotion In case of officers being on duty with International Organization, the notional bench mark shall be given to an officer Where officers are on deputation with the Government of India or other State Governments, the Annual Performance Assessment Report of the period shall be taken into consideration for promotions and all other procedures as per applicable rules and Government instructions (1) Enrolled police officers, borne on any cadre in the service, who could not be promoted as per the provisions applicable to their respective cadre, may be promoted under the Assured Promotion Scheme and hold a Personal Rank (PR) as under:- a) Constables on completion of 16 years of qualifying service may be promoted as PR Head Constable. b) Head Constables and ORP Head Constables on completion of 24 years of qualifying service may be promoted as PR Assistant Sub- Inspector of Police. c) Assistant Sub-Inspectors, Exemptee Assistant Sub-Inspectors of Police and ORP Assistant 23

24 Sub-Inspectors of Police on completion of 32 years of qualifying service may be promoted as PR Sub-Inspector of Police. Provided that they should have crossed the pay scale for the rank to which he is being given promotion and fulfil all other criteria as per rules. Further, that this promotion will not cast any additional financial burden on the State. (2) To effect promotions under the Scheme, an equal number of posts shall be deemed to have been upgraded to the higher rank, provided that the upgraded post will be purely personal to such member of the service and will remain in force until he is promoted or reverted or leaves the service in accordance with the provisions of these rules. (3) The promotion accorded under the Scheme will not confer any right to claim seniority or any other service benefits. (4) All cases for promotion under the Scheme will be taken up by the competent authority immediately after the completion of qualifying service as per sub rule (1) above. No application is necessary from any candidate to be considered for promotion under this provision. Promotion will be effected subject to the following eligibility conditions:- i. The officer should have obtained at least 70% or more Annual Performance Assessment Reports of good or better categories during the last 10 years or as per Punjab Government instructions on the subject. ii. His integrity during the last 8 years should not be adverse; and iii. His reliability during the last 5 years should not be adverse. (5) The following shall be disqualifications for promotion under the Scheme:- i. Any major punishment during the preceding 5 years from the date of promotion; and ii. Any minor punishment, during the preceding 6 months from the date of promotion. Probation And Training Courses (1) Police officers promoted under the Assured Promotion Scheme shall be on probation for a period of one year in the 24

25 For Officers Promoted Under The PR Scheme. ordinary course as is applicable to other promotions. (2) During the probation period, every member of the service shall be deputed to undergo a training course of minimum one month s duration known as Career Development Course 1, 2 and 3 for the ranks of Head Constables, Assistant Sub-Inspectors of Police and Sub-Inspectors of Police respectively. Successful completion of this course is necessary for retaining the PR. Probation Of PR Officers To Culminate In Approval For PR And Not In Confirmation For The Rank (1) (2) No member of the service promoted under the assured promotion scheme shall be confirmed in the higher rank. The probation period shall end in approval to hold the PR and not in confirmation in the rank. It should be entered in the Service Record as approval for PR in that rank only. Withdrawal Of PR In case the officer holding PR is given a major punishment or charge sheeted in a criminal case the PR may be withdrawn after giving due notice and following the principles of natural justice. Medical Examination Residuary Provisions (1) All officers selected to undergo promotion courses shall, before proceeding for such courses be medically examined by a registered medical practitioner who shall certify to their health. (2) Medical conditions that have resulted from exigencies of service shall be given special consideration for required relaxation in norms (1) The norms and practices for determination of seniority and effecting promotions prescribed through the Rules in this Chapter are relevant for the officers of all the cadres and sub-cadres, whereas some specific norms may have been laid down, in connection with specialized cadre, as per requirements of the service. (2)a) The Appointing Authorities and the Cadre Controlling Authorities, of all the officers and cadres, have a significant role in the matters of determination of seniority, effecting promotions, and managing related matters e.g. effects of rewards and punishments on seniority, promotion and 25

26 deputation. These authorities are enjoined to perform their roles, functions and responsibilities, with utmost care, transparency, fair play and punctuality; functioning proactively to neutralize any typical circumstance in the best interest of the service. b) These authorities shall encourage an early hearing if any grievance of any officer, employing instruments of personal hearing, transparency, orderly rooms, counselling for desirable remedy, to save unwarranted litigation and undue publicity of avoidable circumstances, and ultimately leading to better image and credibility, and espirit-de-corps. c) The authorities responsible for recording of Performance Assessment Reports of these authorities may particularly observe and record their remarks on the performance of their roles and functions in this regard. An intentional failure on the part of these authorities may be treated to be an act of misconduct, for which they may be penalized. (3) Various processes of conduct of preparation of lists, competitive examinations, constitution of committees, boards, responsible for these processes, publication of decisions, redressal of objectives and grievances, and finalization of these processes, are time bound, as specifically mentioned in these Rules. The officers responsible shall ensure timely proceedings as per schedule. (4) Proformas of seniority lists and promotion lists are exhibited as Appendix 13.33(4)(a), Appendix 13.33(4)(b) and 13.33(4)(c), respectively, for uniform application of these Rules and required transparency. 26
