6 Law on radiation protection and nuclear safety 36/09 and 93/12 Article 58 Nuclear material accountancy and control The holder of the license producing, processing, using or storing nuclear materials is obliged to keep records on these materials in line with ratified international agreements, and to submit relevant records to the SRPNA. SRPNA prescribes the manner of record keeping on nuclear materials from paragraph 1 of this Article. SRPNA keeps the central register on nuclear materials and supervises the record keeping performed by the holder of the license from the paragraph 1 of this Article. 7 Law on radiation protection and nuclear safety 36/09 and 93/12 Article 59 Supervision and Inspection of the IAEA The Holder of the license for performing nuclear activity is obliged to ensure, for the representatives of the IAEA, in line with the international agreements, to perform supervision and inspection over nuclear materials from the Article 58 of this Act. For the purpose of supervision and inspection from the paragraph 1 of this Article, the holder of the license to perform nuclear activity is obliged to ensure: specific site and installations for setting up and undisturbed operating of the equipment prescribed for nuclear materials supervision; placing a seal and other appropriate equipment for supervision and inspection over nuclear materials. The holder of the license from the paragraph 1 of this Article is obliged to ensure seal immunity and conditions for undisturbed operating of the equipment for supervision and inspection over nuclear materials. 8 Law on radiation protection and nuclear safety 36/09 and 93/12 Article 84 Penalty provisions / Enforcement The fine amounting from RSD 1,500,000 to 3,000,000 shall be imposed for an economic offence on a legal person if... 11) fails to keep the required records on the nuclear materials (NM) produced, reprocessed, used or stored or fails to submit the data from such records to the Agency (Article 58, Paragraph 1); 12) fails to allow the control and supervision over its NM to the representatives of the IAEA in accordance with the international agreements (Article 59, Paragraph 1); 13) for the purpose of conducting the control and supervision over NM fails to provide the place and installations for placing and smooth operation of the required equipment for the control of NM and placing a seal and other required equipment for the control and supervision of NM and fails to provide the conditions for the seal integrity and smooth operation of the equipment (Article 59, Paragraphs 2 and 3) Serbian Radiation Protection and Nuclear Safety Agency 8
9 Safeguards in the Republic of Serbia Agreement between the SFRY and the IAEA for the Application of Safeguards in connection with the NPT (Official Gazette of SFRY No. 67/73) INFCIRC/204 concluded between the IAEA and Yugoslavia in force since December 1973 Signed: May 26, 1972 by the SFRY and the IAEA DG Based on the model of so-called comprehensive safeguards agreement under INFCIRC/153, enacted by the IAEA in 1971 The agreement signed with SFRY was transferred to the Republic of Serbia by succession Since then IAEA SG inspections carried out regularly to this date. 78/164/Euratom vs. Law (Official Gazette of SFRY No. 67/73): Key difference found in Article 23 where it clearly states that every new member of the EU approaches 78/164/Euratom and suspends all prior SGA with the IAEA Serbian Radiation Protection and Nuclear Safety Agency 9
10 Safeguards in the Republic of Serbia: Infrastructure and Key Roles Serbian Radiation Protection and Nuclear Safety Agency (SRPNA) - established in Dec 2009 by Law (Official Gazette of RS No. 36/09 and 93/12) Safeguards regulatory authority Manages the central register/information on nuclear facilities, accounting for and control of NM, oversight of all NM subject to safeguards Point of Contact person responsible for nuclear material accountancy in the Republic of Serbia and facilitating the IAEA inspections Users of nuclear materials (Vinča Institute of Nuclear Sciences and PC Nuclear facilities of Serbia) Nuclear Material Accountancy and Control at facility level to establish the quantities and locations of the NM present in a nuclear facility and their changes Containment and surveillance measures to monitor access to, or movements of, the nuclear material and other measures to be used at the facility Design Information Contact point person responsible for provision of timely, correct and complete reports to SRPNA and for hosting the IAEA inspections Ministry responsible for nuclear safety and radioactive waste management Inspection Serbian Radiation Protection and Nuclear Safety Agency 10

For the activities in paragraph 1 of this Article a public company shall be established. 12 Rulebook on procedure of keeping records of nuclear materials 27/11 Bylaw is in effect since 2011 Transposes the provisions of the Commission Regulation 302/2005/Euratom into the domestic legal system up to the extent possible Applies to the license holders: in the Republic of Serbia a license holder can only be a legal entity registered in the Republic of Serbia Provisions which cannot be transferred / are not applicable: - those related to Additional Protocol implementation - those referring to nuclear weapon states To be adjusted: definitions derived from the Law (Official Gazette of RS No. 36/09 and 93/12) do not match definitions stated in Article 197 of the EURATOM Treaty.
