3 Minutes of the meeting of MOS (PP) /Secretary, DOP&T with Principal Secretaries of GAD/Personnel Department of States/Cadres held on at Civil Service Officers Institute, Vinav Marg, Chanakvapuri, New Delhi. List of participants is annexed. 2. After the welcome address of AS(S&V), Secretary (P) outlined the objectives of the annual meeting 3. Secretary (P), while inviting suggestions from the State Governments that would help the DoPT En formulating/fine-tuning policies approharartly emphasized the necessity of open, informal, interactive and purposeful deliberations in the meeting_ Expatiating this further, Secretary (P) ci -rese.pri on the need for promoting an accountable, citizen-centric and transparent administration which provides maximum information in the public domain. Accordingly, draft rules and policies should not only be put on the website but comments of the users should also be invited and their suggestions incorporated, wherever possible. 4. Our emphasis should be on self-certification, than seeking affidavits or a certificate from an office-. and our efforts must be focused on simplifying the forms, the procedures and the administrative work alike, he elaborated. 5. As regards training for the Group 'C' employees, who substantially form the cutting-edge of governance, Secretary (P) suggested that ATIs and District Training Centers could be effectively utilized through planning phased training programmes for them. 6. In order to overcome the shortage of staff at various levels, if encountered, involving the pensioners whose outreach extended to even

4 remote locations and whose experience equally strongly counted were also suggested by him. 7. In his short address, Secretary, DARPG stressed on the need for reaching the goal of accountable, responsive, transparent efficient and resourceful governance and highlighted the necessity of adequately harnessing the value of human capital and the power of new technology. 8. Hon'ble MoS (PP), in his address, underlined the significance of continuing a purposakil dialogue between the States and the Gel:re in every field, stating that the role of States in growth and development of n ation is vital, since cutting-edge administrative functions and communication with governance at grass-root level are primarily carried through the States alone. He highlighted that the focus of the meeting was to work in concert for a responsive administration. 9. Stressing on the need for formulation and implementation of policies and programmes for having a transparent, objective, responsive and responsible administration for the good of general public, he further highlighted the initiative taken by the present government at the centre with these objectives by way of simplification of procedures, practices, rules, replacement of affidavits by self certification, increased use of information technology etc. He shared his optimism that discussion on all these issues would be fruitful by seizing targets and drawing a road map for achieving those targets by the State as well as the Central Government alike. 10. in his address, Ef.AAS, DoPT shared his satisfaction on the initiative over the excellent response received from most of the States in implementing "SPARROW" and invited states to comment on the technical issues of this programme. He, however, raised the concern that in a number of cases,

5 after selection of an officer for central deputation on the basis of nomination received from the State concerned. the State withdrew the nomination in the last minute creating difficulty for the Central Government besides debarring the officer. 11. Principal Secretary, GAD, Government of Gujarat made a presentation on 'Human Resources Management System' (HRMS) developed by Government of Gujarat for projection of varancies and preeligibility exam. -ration. The possibility of replicating the best principles of HRMS for man.pcwer planning and human resources deyelopment by the State Governments and the Central Government was GcSiberated so that suitability of of5rrs for various posts could be adjudged. 12. Transaction of business on listed agenda points was then undertaken and in respect of each agendum, the following action points emanated: Agenda No.1: Status and issues in Cadre Review Secretary (P) highlighted the need for clearly delineating the dynamism each quinquennial review of cadre review required, as it was the basis of Human Resource Management, with the caveat that regulation of cadre sheitytti will have to be restrictive in as much as increase cannot be more than 5% of existing strength. The tendency of operating excadre posts by keeping cadre posts vacant or in abeyance would have to be curbed, he advised. After deliberations, it was agreed that unlike in the past State Government shall be requested to support their proposal in a 'Presentation to the Department of Personnel & Training' and only after

6 a mutual agreement on the agreed proposal. further processing of the case would be undertaken. It was also agreed that the aspect of tenure stability will be incorporated as a guiding factor during cadre review. It was accordingly decided that Secretary (P) will write to the States whose cadre review was due in 2014 &15, besides other States, to factor in this aspect in their review prosa.ts Agenda No.2: Stability of tenure for AIS off-as posted with State Government It was decided that the directions of the Hcn'b!e Supreme Court of 3V October 2013 on minimum tenure prescriptions will have to be followed and quarterly reports will have to be rranciatorily provided by the State Governments, in consonance with the schedule appended to DoPT notification under Rule 7 of IAS/IPS/IFS (Cadre) Rules. It was agreed that the aspect of tenure stability will be incorporated as a guiding factor during cadre review of the States. It was accordingly decided that Secretary (P) will write to the States whose cadre review was due in 2014 &15, besides all the other States, to factor in this aspect in their review proposals. Agenda No.3: Unauthorized absence of officers from cadres: After reviewing State-wise position of officers unauthorizedly absent from the cadre, it was decided that as stipulated in Rule 7 of the AIS (Leave) Rules, 1955, State Governments would quickly complete the required action and intimate their position for further action by the DoPT.

7 As regards over-stay on central deputation beyond approved tenure, all State Governments agreed to follow the instructions of OM dated 14 th August, 2013 and prevent overstay on inter-cadre deputation. As regards 4 cases pending for regularization, based on the inputs of the State Government, DoPT will take further action. Agenda No.4: Courtesy to Public Representatives: State Governments concerned agreed that they would expedite sending their report by fax on privilege notices issued by the Lok Sabha/ Rajya Sabha Secretariat within of one month. Agenda No.5: SCS to las promotions For facilitating determination of vacancies for the select list, Uttarakhand and Tripura agreed fc - sending their proposals expeditiously. In the cases of Bihar, Haryana, Madhya Pradesh, Rajasthan, it was decided that the State Governments will pursue through their legal departments early disposal of the pending court cases. For expeditiously completing the task of determination of seniority/ year of allotment of promotes 1AS officers by the DoPT, States were requested to complete the required process at their end and forward their proposals within the next 3 weeks. The issue of induction training of SCS officers promoted to IAS figured prominently during the deliberations. States were requested to provide specific details of where confirmation of officers was held up for want of induction training enabling the DoPT to seek a legal opinion and resolve the difficulty at the earliest. The need for organizing such

8 induction training at the ATI in a decentralized manner was also duly considered. Agenda No.6: Inter Cadre Deputatiori Change of cadre On the proposal for Inter Cadre Deputation/ Change of cadre of IAS officers, the State Governments of Bihar, Rajasthan, Tripura, Manipur, West Bengal, Madhya Pradesh, Gujarat, Andhra Pradesh, Maharashtra were requested to provide their views within 4 weeks to facilitate an early decision. Agenda No.7: Vigilance Issues State Governments of Kamamka, Rajasthan, Jammu & Kashmir were requested to send their pending quarterly reports on vigilance issues expeditiously. Agenda No.8: CBI related issues: After a brief presentation by the Joint Director, CBI, where he set the context for early completion of trials and regularly increasing number of cases under trial, the need for setting up 11 additional special courts as per details provided in the Agenda were highlighted. The States were also requested to send their reimbursement proposals to DoPT at the earliest. Agenda No.9: Training related issues: JS (Training) made a presentation on training related issues. Due appreciation was made by the participants on the specific capacity building programmes undertaken by several states. The suggestion of JS(Training) seeking special inputs from the States of West Bengal, Karnataka, on the innovative training initiative by establishment of

9 district training institutions, was accepted by the 2 States who agreed to provide such inputs within a month. Further deliberations were interspersed by state-specific inputs from the participating Secretaries, inter alia, highlighting the innovative methods employed for capadty building and making the administration more responsive, besides tbsough introduction of digitization and e- governance initiatives. A few highlights were: implementation of e- office in Odisha where 90% d the Secretariat work was being done through a special application iṟogramme, elimination of affidavits as a reform measure by the Gevernment of Punjab, online issue of caste/residency certificate by Government of West Bengal, at school level, Human Resource Management through application of technology (SATHI) by Government of Gujarat, training of cutting-edge functionaries by Governments of Bihar and Assam etc. Agenda No.10: DARPG matters JS, DARPG made a presentation on Best Practices for Good Governance and highlighted the prominent features of the Awards instituted to recognize extra-ordinary performance by the civil servants. Thereafter, JS Pensions & Pensioners' Welfare highlighted through her presentation the ongoing efforts for the welfare of the pensioners and counseling of those whose retirement on superannuation was close. 13. After careful consideration, the following action points were agreed to: i. In the matter relating to promotion from SCS to IAS, it was decided that the State Governments (i.e. Rajasthan, Assam, Bihar) would have to pursue, through their respective Law Secretaries, so that the

10 High Court hear their pending court cases on priority to bring finality in the pending matters as subsequent Select Lists have been held up for want of decision from the concerned High Courts in respect of these States. ii. While framing the 5 year/mid-term cadre review proposal, the following information/additional requirements will have to be incorporated by the Pate Governments in their proposals, before sending the same to DST for consideration: a) Number of cad_ rrst posts kept in abeyance; b) Number of temporary posts created; c) Number of ex-mdre posts being operated; and d) The average tenure of cadre posts especially at the level of Collector/DM and the Secretariat The State Governments would be invited for a presentation on their cadre review proposal before the competent authority and only after a mutual agreement on the agreed proposal, further processing of the case would be undertaken. iii. The State Government must sponsor sufficient number of officers for central deputation at DS/ Director/ JS level so that not oniy the shortage of officers under the Central Staffing Scheme can be effectively tackled ber. also that the prospects of empanelment of Additional Secretary level are not negated. Moreover, States were requested to nominate officers for selection in CBI etc. iv. Regarding 'Induction Training' of promotion quota officers, the States may kindly send to DoPT specific note where confirmation of promoted officers is held- up for not doing the induction training so

11 that a legal opinion can be obtained in the matter and the difficulty resolved at the earliest of the promoted officers. 14. At the end, it was reiterated this mechanism of regular interaction with State Governments in the form of periodic meetings with Principal Secretaries of General Administration Departments (GAM/Personnel Departments has almost been institutionalized by DoPT which provides an opportunity for purposeful dialogue for achievement of common goals and ensuring constant follow up, rendering such focused exchange an'y meaningful. 15.
