2 FACTS CONSTUTING PROBABLE CAUSE On June 6, 2013 at 2045 hours I was standing beside my unit at the intersection of Clear Creek and Mtn. Pine road speaking to a complainant about a truck that had just left the area, and the male subjects that were in the truck attempted to kick in her front door. A green pickup drove by us and the female complainant stated that is the vehicle, so I got in my unit and made a traffic stop on the vehicle (Ar. L.P.N. GGDIL) a 1998 green GMC pickup at the New Salem church on Mtn. Pine road. I made contact with the driver a white male Jordan Hoover (D.O.B, 03/13/93) and advised him that the vehicle that he is driving matched the description of a suspect vehicle that we were looking for. The passenger a white male Jerry Hoover (D.O.B. 12/05/70) started yelling and cussing at me so I told him to calm down so I could talk to the driver. He continued to yell profanities at me and stated "I don't care take me to jail". I went over to the passenger side of the truck and had him step out. I could smell intoxicants on his breath, he was unsteady on his feet, and had blood shot eyes. I placed him under arrest and when I was walking back to my unit to put him in the back, the driver Jordan Hoover went to get out and come towards me. I ordered him several times to get back into the vehicle but he would not comply. After Jerry was placed in the back on my car, I told Jordan Hoover that he was under arrest and to put his hands behind his back. Jordan Hoover refused to comply so I grabbed him and placed him up against the truck as he continued to yell and threaten to whoop my ass. I radioed for additional units to assist and Arkansas State Police Trooper Crook arrived to assist. As the Trooper arrived I partially had a hold of Jordan Hoover and he slung me off of him to my knees. I got up and Trooper Crook and I had him up against the truck and he kept pushing off trying to get away. I had to use my ASP baton to get him to comply. I struck him three times in the right side under his shoulder blade. We eventually took him to the ground and were able to get handcuffs on him and he kept trying to get up. After a few minutes we helped the suspect up and was attempting to put him in the back of my unit with his father, but he pulled away acting like he was going to flee. I then leaned him over the driver side hood of my unit and he became even more enraged and started hitting his head on the hood of my unit. Jordan Hoover kept pulling away and was

3 placed on the ground once again. Cpl. Greg Kellar arrived and places leg shackles on him and we had to carry him and put him in the back of the unit. Both Hoover subjects were transported to the Garland County Sheriff's Office. Jerry Hoover was charged with public intoxication. Upon arrival at the S.O. Jordan Hoover still would not comply with deputies and finally I was able to read him his Implied Consent rights and he agreed to take a breath test. Cpl. Kellar administered three standardized field sobriety tests at the jail. The first test was an HGN test Cpl. Keller stated that he noticed a lack of smooth pursuit in both eyes, nystagmus prior to 45 degrees in both eyes, and also nystagmus at maximum deviation. The next test he performed was the walk and turn test he missed heal to toe on steps; 4, 6, 7, and 8. The final test was the one leg stand he failed on 3 one thousand to 9 one thousand. Cpl. Kellar advised me that Jordan Hoover was impaired. Cpl. Kellar administered a breath test with the final results being 0.106, He was charged with DWI. Jordan Hoover was also charged with Obstructing Governmental Operations, Resisting Arrest, Criminal Mischief, and Disorderly Conduct. Initialed byaffiant_
