1 Application No : Applicant: COMPREHENSIVE PLAN TEXT AMENDMENT Policies supporting notification of property owners around Joint Base Lewis- McChord (JBLM) of potential noise impacts from on-base military activities Pierce Planning and Land Services GENERAL DESCRIPTION The proposal adds policies to the Pierce County Comprehensive Plan to support notification of property owners around JBLM of potential noise impacts from on-base military activities. PROPOSED AMENDMENT Proposed revised text highlighted in grey Pierce County Comprehensive Plan Land Use Chapter 2-79 GOAL LU-108 Recognize aircraft noise as a health impact and an environmental constraint when developing land use classifications and regulations LU Promote cooperation between Joint Base Lewis-McChord and Pierce County to address the reduction or mitigation of noise-generating uses. LU Establish a disclosure process advising property owners of possible noise impacts to property around JBLM. Pierce County Comprehensive Plan Environment Element Chapter 7-9, Page 157 Goal ENV-13 Reduce, mitigate, and where possible, eliminate noise problems. ENV-13.1 Allow innovative methods of reducing of mitigating noise. ENV-13.2 Reduce, mitigate, and where possible, eliminate problems associated with noisegenerating land uses. ENV-13.3 Promote cooperation between Joint Base Lewis-McChord and Pierce County to address the reduction or mitigation of noise generating uses. ENV Establish a disclosure process advising property owners of possible noise impacts to property around JBLM. 1

2 STAFF RECOMMENDATION Staff supports the proposal. Staff supports the proposal as it is consistent with the most recent JBLM Joint Land Use Study, which recommends that Comprehensive Plans in neighboring jurisdictions have policies that support notification of property owners around JBLM of potential noise impacts from on-base military activities. IMPLEMENTATION REQUIREMENTS The policy may be implemented through County Development Regulations. The potential regulations would apply to the area depicted on the Real Estate Disclosure Map found in Attachment A. IMPACT ANALYSIS Procedures for Amendments to the Comprehensive Plan, PCC 19C.10, requires that the merits of all amendments to the Plan be evaluated based on the following (PCC 19C A.): 1. The effect upon the rate of growth, development, and conversion of land as envisioned in the Plan The proposal may impact possible land or home purchases in the area based on notifications that the area is impacted by noise and operations from JBLM. 2. The effect upon the County's capacity to provide adequate public facilities 3. The effect upon the rate of population and employment growth The proposal should have no impact. 4. Whether Plan objectives are being met as specified or remain valid and desirable The amendment would support Pierce County Comprehensive Plan policies that support implementation of JBLM Joint Land Use Study recommendations. 5. The effect upon general land values or housing costs The proposal should have no impact. 6. Whether capital improvements or expenditures, including transportation, are being made or completed as expected 7. Whether the initiated amendment conforms to the requirements of the GMA, is internally consistent with the Plan and is consistent with the Countywide Planning Policies for Pierce County The proposal would maintain consistency with criteria in the Pierce County Comprehensive Plan by working together with involved jurisdictions and stakeholders to review and 2

3 consider issues of mutual concern as well as promoting cooperation between Pierce County and Joint Base Lewis-McChord. The proposal conforms to the requirements of the Growth Management Act for establishing interties and encouraging collaborative effort between local governments and Joint Base Lewis-McChord. 8. The effect upon critical areas and natural resource lands 9. Consistency with locational criteria in the Comprehensive Plan and application requirements established by this Chapter 10. The effect upon other considerations as deemed necessary by the Department The amendment is consistent with the mission of the South Sound Military and Communities Partnership. South Puget Sound cities and counties to continue to support the mission of JBLM. This amendment is an example of how, as a local jurisdiction, Pierce County can review, amend, or add Comprehensive Plan policies to provide further support. GROWTH MANAGEMENT ACT (GMA) RCW 36.70A.530 Applicable RCWs/Policies Land use development incompatible with military installation not allowed Revision of comprehensive plans and development regulations. (1) Military installations are of particular importance to the economic health of the state of Washington and it is a priority of the state to protect the land surrounding our military installations from incompatible development. (2) Comprehensive plans, amendments to comprehensive plans, development regulations, or amendments to development regulations adopted under this section shall be adopted or amended concurrent with the scheduled update provided in RCW 36.70A.130, except that counties and cities identified in RCW 36.70A.130(4)(a) shall comply with this section on or before December 1, 2005, and shall thereafter comply with this section on a schedule consistent with RCW 36.70A.130(4). No specific policies. PIERCE COUNTY COMPREHENSIVE PLAN MILITARY LAND DESIGNATION AND COMPATIBILITY 3

4 Pierce County is engaged in a collaborative planning effort involving Joint Base Lewis-McChord and local governments surrounding this military installation. The goal of this effort is to encourage compatible development and redevelopment in surrounding areas. The effort is designed to balance the sustaining the local military mission with long-term community land use needs. GOAL LU-105 Recognize the unique character of land uses associated with military operations and support structures. LU Designate the portions of Joint Base Lewis-McChord and Camp Murray that contain urban level of services and characteristics as Urban Military Lands. LU Designate the portions of Joint Base Lewis-McChord that lie outside the UGA as Rural Military Lands. LU The application of the Military Lands designations shall be consistent with official federal and state military installation master plans. GOAL LU-106 Provide the military installations with opportunities to participate in the review and development of land use programs, policies, and decisions that affect them. LU Consider the military installations as an affected agency for land use planning decisions. LU Invite the military to participate as members on growth management committees. LU Provide opportunities for the military to participate in local and regional planning issues and programs. LU Establish periodic meetings of elected local, state, and federal officials and military commanders on growth management issues of mutual concern. LU Environmental policies adopted by the military should continue to reinforce the environmental policies of surrounding jurisdictions. LU Comprehensive Plan policies pertaining to environmental issues should agree with and not degrade the environmental policies of the military installations. LU Consider amendments necessary to provide consistency and compatibility between the County s Comprehensive Plan, Development Regulations, and the Joint Base Lewis-McChord (JBLM) Joint Land Use Study (JLUS) upon completion of the JLUS which is anticipated to occur in October GOAL LU-107 Recognize the possibility of military lands reverting back to Pierce County. 4

5 LU If military lands revert back to Pierce County, the County should adopt interim regulations that restrict development of the reverted property until such time a sub-area plan is adopted. LU The County should coordinate with adjacent cities and towns to identify the desired character of the reverted property. GOAL LU-108 Recognize aircraft noise as a health impact and an environmental constraint when developing land use classifications and regulations. GOAL LU-109 Recognize safety issues associated with training, artillery, and small-arms activities on Joint Base Lewis-McChord. LU Future construction adjacent to the installation should provide for fire protection at Fort Lewis boundaries. LU Incorporate the Installation Compatible Use Zone Study (ICUZ) noise contour maps and the "Recommended Land Uses for Installation Compatible Use Zone (ICUZ) Program Noise Zones" for Noise Zone II. LU Prohibit the following land uses within Noise Zone II: LU New residential uses, unless the design of the structure and general site plan incorporate noise-reduction measures to meet the Department of Housing and Urban Development (HUD) standards; LU Public services and quasi-public services such as hospitals, public meeting rooms, and libraries, and cultural, recreational, and entertainment land uses, unless the design of the structure and general site plan incorporate noise reduction measures to meet HUD standards; and LU Schools, daycare facilities, and other facilities which incorporate outside activities. LU Direct the following land uses away from property abutting the installation boundary: LU High density residential; LU Public buildings (such as schools, medical facilities, public meeting facilities, and churches); and LU Cultural facilities. LU Cooperate with Joint Base Lewis-McChord and Camp Murray in developing plans for circulation improvements in and around the installations. 5

6 LU The viability of cross-base corridors (arterial or highway) should be determined on the basis of detailed studies of population projections, military mission, land availability, land use projections, and environmental analysis of alternative routes and corridors. LU Plan public services, transportation, land use, and other decisions on the ability of the public transportation network to meet access needs without depending on military roads. LU Cooperate in the development of mitigation plans for military road closures that affect public use. 6
