4 Recent Mission Incidents Weapon, Carrying Concealed w/felony or Narcotics Conviction; Ammunition, Poss. By Prohibited Person; Warrant Arrest, Enroute To US Marshall Date: 10/18/ hours Where: 100 block of Julian Avenue On 10/18/18 at approximately 0141 hours, Sgt Fegan #1380 (assigned to NIU) was working in plain clothes and driving an unmarked police vehicle with Sgt Byrne #4218. They were in the area of 179 Julian Ave. in San Francisco, more specifically the Kailash Hotel. Sgt. Pon #178 and Sgt. Funk #1356 were also wearing plain clothes and in the area to assist Sgt Fegan in his investigation. On 10/17/18 at approximately 2145 hrs. Sgts Byrne and Fegan had responded to 179 Julian regarding a shooting. (See SFPD case # ). Mission units had already responded and set up a crime scene. Sgts Pon, Funk, and Fegan responded to room #115 regarding the shooting. The manager of the hotel informed Sgt Fegan that the victim of the shooting was visiting room #115 inside the hotel prior to the shooting. Sgt Fegan spoke to Detained 1 about the incident inside her room, but she informed Sgt Fegan that all she did was call '911'. Ofc Ramoso #658 responded to the manager's desk to retrieve video of the (shooting) incident. Sgt Fegan later viewed the video at the NIU office. At the NIU office, Sgt Fegan saw another black male, later identified as Suspect 1, walking in the hallway with detained 1 and going in and out of her room immediately after the shooting. Detained 1 did not mention suspect 1 when Sgt Fegan had spoken to her prior. Sgt Fegan continued to watch the video and saw that suspect 1 had a handgun in his hand and went into detained l's room #115. Sgt Fegan saw suspect 1 exit the room shortly after carrying a blue shopping bag. Sgt Fegan saw suspect 1 enter another room down the hallway with the blue shopping bag. Sgt Fegan believed that suspect 1 had entered another room, possibly his, to hide the handgun. Sgt Fegan took a photo of the video showing suspect 1 with the handgun in his hand. Sgt's Fegan and Byrne responded back to 179 Julian Ave to locate suspect 1. Ofc Wilson #627 and Ramoso responded to assist. The officers entered the hotel and Sgt Byrne went to the room that suspect 1 was seen walking into while carrying the blue bag. The room was a bathroom. The manager of the building provided a pass card to open the bathroom which was searched with negative results.

5 - Recent Mission Incidents continued At approximately 0145 hours, Sgt Fegan knocked on the door to room #115 and detained 1 answered. Sgt Fegan asked if he could speak with her regarding the video that he had viewed. While Sgt Fegan was at the door, he could see, behind detained ion the floor of the room, a white colored Nike high top shoe, the same kind of shoe that suspect 1 was seen wearing in the video from the hotel. Detained 1 allowed the officers to enter the room and Sgt Fegan could see items in a closet moving. Sgt Byrne searched the closet, which was full of bags and clothes. Sgt Byrnes advised that he saw a person (suspect 1) hiding in the closet. Suspect 1 had placed items in the closet over him in an attempt to conceal himself. Suspect 1 came out of the closet and was immediately handcuffed. Ofc Ramoso searched suspect 1 and found a magazine with bullets inside his pants pocket. Suspect 1 spontaneously stated inside the room that he was sorry and that he had a federal warrant for his arrest. Sgt Fegan asked suspect 1 if he was on federal probation and he stated that he was. It should be noted that Sgt Fegan saw the same blue bag that Hunter had brought to the bathroom laying on the ground in the room in plain view. Sgt Fegan instructed the officers to not search the room until it was confirmed that suspect 1 was on federal probation and was searchable by any law enforcement. Sgt Fegan conducted a computer query on suspect 1 and confirmed that suspect 1 was on federal probation for firearms and that he could be searched by any law enforcement officers as part of his probation. Also during the computer check, Sgt Fegan saw that suspect 1 had an outstanding federal warrant for his arrest. CWB later confirmed the warrant. Sgt Fegan read suspect 1 his Miranda rights and interviewed him outside the hotel. Suspect 1 agreed to speak with Sgt Fegan. Suspect 1 admitted that he was in the hotel and carrying the blue bag. Suspect 1 admitted that he had a handgun earlier but had handed it off to someone else. Sgt Fegan responded back to room #115 where he began to search with the other officers. Due to the fact that suspect 1 had a magazine with bullets on his person, Sgt Fegan believed that there was a handgun inside the room and possibly in the closet area where suspect 1 was hiding. Ofc Ramoso had transported suspect 1 to Mission Station for Sgt Fegan. Ofc Ramos later contacted Sgt Fegan and advised him that he had found a loaded handgun on suspect l's person. Sgt Fegan and the remaining officers continued to search the room for additional weapons or contraband with negative results.

6 Recent Mission Incidents continued At Mission Station, during a booking counter search, a bindle of heroin was found in suspect l's property. Suspect 1 was subsequently booked on the above listed charges. Assault, Aggravated, w/other Weapon; Weapon, Deadly, Imitation or Laser Scope, Exhibiting Date: 10/21/ hours Where: 300 block of 18th Street On 10/21/18 at approximately 0356 hours, Officers Cassinelli #1104 and Castaneda #451 were in full uniform on patrol in a marked SFPD vehicle. They responded to th St. (7-Eleven store) regarding a possible assault with a pipe. Dispatch advised that the reporting party was the 7-Eleven employee and gave a suspect description as follows: Hispanic male, 30 years old, grey sweatshirt, black backpack and black pants armed with a pipe. Ofc Castaneda and Ofc Cassinelli arrived on scene and observed a subject, later identified as reporting victim 1 (RV) Raul Reyes, standing on the sidewalk in front of th St. who matched the description provided by dispatch. Ofc Cassinelli immediately detained reporting victim 1 and placed him in handcuffs without incident. Ofc Cassinelli observed that reporting victim 1 was bleeding from the head. Reporting victim 1 advised that he had been hit on the head with a pipe. An ambulance was requested to assess reporting victim l's injury. Ofc Cassinelli spoke with suspect 1 who advised he had pain to the left side of his body. Another ambulance was requested to assess suspect l's injuries. While speaking to Ofc Cassinelli, suspect 1 relayed the following in summary:

7 Recent Mission Incidents continued Reporting victim 1 walked into 7-Eleven and engaged in an argument with suspect 1 over food. Reporting victim 1 was rude and disrespectful so suspect 1 wanted him out. Suspect 1 threw the pipe at reporting victim 1 in attempt to get him out. Believing that suspect 1 may have been the primary aggressor, Ofc Cassinelli placed suspect 1 into handcuffs. Ofc. Castaneda preformed a pat search for weapons on suspect 1 and located a knife in suspect l's right front pant pocket. Both reporting victim 1 and suspect 1 were transported to SFGH to be evaluated for their injuries. While at SFGH, Ofc Cassinelli again spoke with reporting victim 1 who stated the following in summary: Reporting victim 1 walked into 7-Eleven to buy some food. Reporting victim 1 observed that there was only one slice of pizza left and limited taquitos. Reporting victim 1 asked if suspect 1 could make some more food. Suspect 1 refused to make any additional food. Reporting victim 1 called suspect 1 "lazy". Reporting victim 1 was immediately hit with a pipe suspect 1 had grabbed from under the counter top. Reporting victim 1 stated suspect 1 grabbed the pipe with his right hand and swung the pipe in an overhead motion and struck reporting victim 1 on the top of the head. Suspect 1 struck reporting victim 1 from the employee side of the counter. As soon as the pipe connected with reporting victim 1 head, suspect 1 lost control of the pipe and the pipe hit the ground on the customer side of the counter. Suspect 1 then jumped over the counter top. Not wanting suspect 1 to grab the pipe and hit him again, reporting victim 1 grabbed the pipe off the ground. Reporting victim 1 observed suspect 1 brandish a folding pocket knife from suspect l's right pant pocket and "flicked" the knife open, exposing the blade. Suspect 1 told reporting victim 1 to, "come closer, come closer". Fearing for his safety, reporting victim 1 hit suspect 1 two times with the pipe in the arm. Reporting victim 1 then walked out of the store. Also at SFGH, Ofc Cassinelli again spoke with suspect 1 who stated the following in summary:

8 Recent Mission Incidents continued Suspect 1 stated that reporting victim 1 had walked into 7-Eleven asking for 20 taquitos. Suspect 1 advised reporting victim 1 that what was displayed was all the store had available. Reporting victim 1 demanded suspect 1 to make more pizza. Suspect 1 advised Reyes that he was not going to making any additional food. Reporting victim 1 responded by telling suspect 1 that he was lazy. Suspect 1 replied by telling reporting victim 1 to leave the store. Suspect 1 grabbed a pipe from under the counter. In an attempt to scare reporting victim 1 out of the store, suspect 1 jumped over the counter with the pipe in hand and lost control of the pipe, hitting reporting victim 1. Reporting victim 1 then picked up the pipe and hit suspect 1 with the pipe three to four times on the left side of suspect l's body. Reporting victim 1 then exited the store. Suspect 1 took out his pocket knife in order to defend himself from any further attack by reporting victim 1. Suspect 1 put the knife back into his pocket and walked back behind the counter and contacted the police. Based on Ofc Cassinelli's investigation, suspect 1 was subsequently booked on the above listed charges.
