IMPORTANT: The sick pay prvisins described in this plicy d nt apply t the M14 and M15 ppulatin. Sick pay fr hurly team members classified as M90 is prvided under the salary cntinuatin cmpnent f the Medical Disability plicy fr management team members. The sick pay prvisins described in this plicy d nt apply. The Cmpany is cmmitted t cmplying with the cntinually expanding sick leave laws applicable in all jurisdictins where the Cmpany engages in business. THE FOLLOWING APPLIES TO ALL HOURLY TEAM MEMBERS (EXCLUDING THE M14 & M15 POPULATION) WHO WORK IN A LOCATION WITH STATUTORY SICK PAY LAWS: Use f Sick Pay Generally, yu may use sick pay fr hurs lst due t nn-wrk-related illness r injury. Yu may als use sick pay hurs t receive pay when an illness r injury t yur spuse, parent r dependent child causes yu t miss wrk. In additin, yu may use sick pay starting n the third day f a wrkers' cmpensatin illness r injury, up t the end f yur waiting perid. Medical dcumentatin is required fr sick days exceeding 3 cnsecutive days. Additinal State specific usage prvisins are utlined belw. Hurs Cunting Twards Accrual Sick pay hurs are accumulated based n yur hurs wrked, whether full-time r part-time. The mre hurs yu wrk, the mre sick pay hurs yu accrue. Hurs used fr vacatin, ETO and/r sick pay will be cunted as hurs wrked. Time Off Service Date and Anniversary Year Sick pay is based n yur Time Off Service Date, which is yur riginal hire r anniversary date, r last rehire date fllwing a break in service in accrdance with the state/city specific timeframes listed in the chart belw see yur lcatin s applicable rehire rule. (Applies t sick time nly; all ther accruals fllw the 90 day rehire rule). If yu were hired n r after February 1, 1990, yur Anniversary Year begins n the anniversary f yur Time Off Service Date each year. If yu were hired befre February 1, 1990, yur Anniversary Year is frm February 1st t January 31st. Maximum Sick Accrual Yu may accumulate up t 240 hurs f sick pay. If yu start an Anniversary Year with the maximum 240 hurs f sick pay and use sick pay hurs during the Anniversary Year, yu will begin t accumulate additinal sick pay hurs, up t the 240 hur maximum allwed. Prmtins and Demtins during an Anniversary Year When yu are prmted r demted, yur sick pay alltments may change. Please refer t the Paid Time Off sectin in the Life Event - Wrk Status Change fr mre details n hw yur sick pay may be affected. Pay in Lieu f Paid Time Off Tys R Us will nt pay yu fr unused accrued sick pay time, except as may be required upn transfer. Terminatin Tys R Us des nt payut unused accrued sick pay time upn yur terminatin f emplyment. Team members must wrk 30 hurs in rder t accrue 1 sick hur. Sick hurs may be used beginning n a team member s 90th calendar day f emplyment. Once this requirement is met, sick hurs may be used beginning with the first day f the absence fr any reasn allwed under State Law. Seasnal team members are eligible fr Califrnia paid sick leave. If a team member has a break in service that lasts 1 year r less, any remaining sick time will be reinstated upn rehire and the team member will resume accruing sick hurs as if service was uninterrupted*. If the break in service is greater than 1 year, any remaining sick time wuld nt be reinstated and the team member will be treated as a new hire. Sick hurs may be used fr all reasns utlined by the Califrnia Earned Sick Time Act including: (See Addendum belw). Medical dcumentatin is required after the team member is ut n sick ADDENDUM FOR: CITY OF EMERYVILLE (CA): In additin t the CA and sick pay prvisins listed abve, the fllwing als applies in Emeryville, CA: If yu dn t have a spuse r registered dmestic partner, yu will be given the pprtunity t designate an individual in which yu will use sick time t prvide care. The pprtunity t designate an individual will be given within 30 days frm the date yu begin t accrue sick time. Yu may change yur designated persn nce per year. Sick hurs may be used t care fr a guide dg, signal dg r service dg as defined by Civil Cde sectin ADDENDUM FOR CITY OF LOS ANGELES (CA): In additin t the CA and sick pay prvisins listed abve, the fllwing als applies t emplyees in Ls Angeles Emplyees can als use sick leave t care fr any individual related by bld r affinity whse clse assciatin with the emplyee is the equivalent f a family relatinship. ADDENDUM FOR CITY OF SAN DIEGO (CA): In additin t the CA and sick pay prvisins listed abve, the fllwing als applies t emplyees in San Dieg: Emplyees can als use sick leave t engage in safety related services if the emplyee s family member is a victim f dmestic vilence, stalking r sexual assault; if the wrksite is clsed due t a public health emergency, r if the emplyee is prviding care r assistance t a child whse schl r child care prvider is clsed by rder f a public fficial due t a public health emergency. A public health emergency is defined as a state f emergency declared by a public fficial f any level f gvernment with authrity t make such a declaratin. Chicag (IL) Sick hurs begin t accrue as f date f hire. Nn-exempt, hurly team members accrue 1 sick hur fr every 40 hurs wrked. All team members accrue a maximum f 40 sick hurs per year; n further sick hurs are accrued until the Time Off Service Date r new Anniversary Year, as defined abve. At each Time Off Service Date r new Anniversary Year as defined abve, team members can carry ver up t 60 hurs f accrued but unused sick Updated Octber 1, 2017

3 hurs. Any additinal sick hurs cannt be carried ver and will be lst. Team members cannt begin using accrued sick hurs until 180 days after their date f hire. Once this requirement is met, sick hurs may be used beginning with the first day f the absence, including an absence due t a wrkers cmpensatin illness r injury. Sick hurs must be used in a minimum increment f 4 hurs. Sick hurs can be used fr any f the fllwing purpses: a. The team member is ill r injured. b. T attend appintments with a physician, dentist r health care prvider. c. T attend t family members wh are ill r injured, r t take the family member t a physician, dentist r apprved health care prvider. d. The team member is a victim f dmestic vilence, sexual vilence, r stalking. e. The team member s family member is a victim f dmestic vilence, sexual vilence, r stalking. f. The team member s place f business has been clsed by a public fficial due t a public health emergency. g. The team member s child s schl r place f care has been clsed by a public fficial due t a public health emergency. Fr purpses f the abve, family member is defined t include: a. Spuse r dmestic partner b. Child (including adpted, step, fster, in lc parentis, legal guardian, r legal ward relatinships) c. Gdchild d. Parent (including adpted, step, fster, and legal guardian relatinships, as well as a persn wh std in lc parentis when the emplyee was a minr) e. C-parent f. Gdparent g. Spuse r dmestic partner s parent (as defined in (d) abve) h. Sibling i. Grandparent j. Grandchild k. Any persn related by bld t the emplyee l. Any persn with a clse assciatin t the emplyee that is the equivalent f a family relatinship Fr freseeable uses f sick hurs, such as scheduled medical appintments, the team member must give 7 days ntice befre using the sick hurs. Fr unfreseeable uses f sick hurs, the team member must give as much advance ntice as pssible, and must make every effrt t give ntice befre the start f his r her scheduled shift if pssible. Team members are nt expected t give ntice when uncnscius r incapacitated. If necessary, anther persn may give ntice n the team member s behalf. Fr any use f sick hurs that is als cvered by the federal Family and Medical Leave Act (FMLA), the FMLA s requirements fr ntice will apply, rather than the plicy abve. Cnnecticut (CT) Sick hurs begin t accrue as f date f hire. t accrue sick hurs as f yur date f hire. If yu were hired Team members must wrk 40 hurs in rder t accrue 1 sick hur. Sick hurs may be used nce a team member has wrked fr 4 mnths. Once this requirement is met, sick hurs may be used beginning with the first day f the absence. Seasnal team members are nt eligible fr CT paid sick leave. If status Updated Octber 1, 2017

4 Updated Octber 1, 2017 is changed t regular, the CT sick time prvisins apply and sick hurs will begin t accrue as f the effective date f the status change t regular. Hurs wrked as seasnal will nt apply twards the sick pay accrual. Sick hurs may be used fr all reasns utlined by the CT Earned Sick Time Act.
