1 VAUGHAN PRIMARY SCHOOL HEALTH AND SAFETY POLICY Reviewed: Summer 2017 Next Review: Summer 2018 GENERAL The Governing Body notes the provisions of the Health and Safety at Work. etc Act 1974 (s.3(1)), which states that it is the duty of every employer to conduct his or her business in such a way as to ensure, so far as is reasonably practicable, that persons who are not in his or her employment but who may be affected by it are not exposed to risks to their health and safety, and accepts that it has a responsibility to take all reasonably practicable steps to secure the health and safety of pupils, staff and others using the school premises or participating in school-sponsored activities. It believes that the prevention of accidents, injury or loss is essential to the efficient operation of the school and is part of the good education of its pupils. The aim of the Governing Body is, 'To provide a safe and healthy working and learning environment for staff, pupils and visitors. OUTLINE STATEMENT The arrangements outlined in this statement and the various other safety provisions made by the Governing Body cannot prevent accidents or ensure safe and healthy working conditions. The Governing Body believes that only the adoption of safe methods of work and good practice by every individual can ensure everyone s personal health and safety. The Governing Body will take all reasonable steps to identify and reduce hazards to a minimum, but all staff and pupils must appreciate that their own safety and that of others also depends on their individual conduct and vigilance while on the school premises or while taking part in school sponsored activities. 1. INTRODUCTION 1.1 The statutory responsibility for health and safety is substantially unchanged by Local Management. The Local Authority (L.A.) will retain the primary responsibility as the employer under section 2 and 3 of the Health and Safety at Work Etc. Act The L.A will continue to issue policy and directions on health and safety provision. The Governing Bodies are required to comply with the policy statement and related directions in so far as it is within their powers. 1

2 2. GOVERNING BODIES The Governing Body as required by the Local Scheme of Delegation has a statutory duty to ensure adequate health and safety standards are maintained on premises under their control are in practice to comply with the LA's directions. 2.1 In order to perform this duty, the Governing Body in consultation with the Head shall:- (c) (d) (e) plan adequate staff funds and materials to discharge it's statutory health and safety responsibilities; make itself familiar with the requirements of the Health and Safety at Work, etc Act 1974 and any other health and safety legislation and codes of practices which are relevant to the work of the school. in particular the Management of Health and Safety at Work Regulations 1999 (51992 No.2051) ensure that there is an effective and enforceable policy for the provision of health and safety throughout the school periodically assess the effectiveness of this policy and ensure that any necessary changes are made monitor and ensure effective implementation of this Policy and the LA s statement of Safety Policy within their areas of responsibility. 2.2 In particular the Governing Body undertakes to provide: (d) (e) (f) (g) a safe place for staff and pupils to work including safe means of entry and exit plant, equipment and systems of work which are safe (c) safe arrangements for the handling, storage and transport of articles and substances safe and healthy working conditions which take account of all appropriate statutory requirements, codes of practice and guidance whether statutory or advisory. supervision, training and instruction so that all staff and pupils can perform their school-related activities in a healthy and safe manner. All staff will be offered the opportunity to receive health and safety training which is appropriate to their duties and responsibilities and which will be given before an employee commences any relevant work. Wherever training is required by statute or considered necessary for the safety of staff, pupils and others then the Governing Body will ensure within the financial resources available that such training is provided. Pupils will receive such training as is considered appropriate to the school related activities which they are carrying out. necessary safety and protective equipment and clothing together with any necessary guidance, instruction and supervision adequate welfare facilities. 2

3 3. PREMISES MANAGERS 3.1 Premises Managers who are defined as employees with the assigned responsibility for the management of a Council establishment function, e.g. Headteacher. The Premises Managers shall fulfil the responsibilities as outlined in section 3.5, so far as is reasonably practicable and within the resources allocated by the Governors. 3.2 As well as the general duties which all members of staff have (see 5.0), the Head has responsibility for the day-to-day maintenance and development of safe working practices and conditions for teaching staff, non-teaching staff, ancillary staff, pupils, visitors and any other person using the premises or engaged in activities sponsored by the school and will take all reasonably practicable steps to achieve this end through the senior members of staff, teachers and others as appropriate. 3.3 The Head is required to take all necessary and appropriate action to ensure that the requirements of all relevant legislation, codes of practice and guidelines are met in full at all times. 3.4 Liaise with Co-ordinators and the Site Supervisor to monitor implementation and compliance of this Policy on a termly basis and report results to the Governing Body. 3.5 As a part of their day-to-day responsibility they will ensure that they:- (c) (d) (e) (f) (g) (h) identify the resources necessary to discharge the Council's obligations, as an employer, under the Act and draw these to the attention of the Governing Body; take steps to discharge the Council's obligations, as an employer under the Act. institute the investigation of accidents and initiate where necessary the required action to prevent a recurrence and to ensure appropriate records are maintained and returns made; ensure safety discipline in the work place; provide instruction, supervision and training to ensure safe systems of work; communicate health and safety information to the work force; any item which it is felt should be raised with the Health and Safety Executive, should, in the first instance, be referred to the Health and Safety Officer for onward transmission to the Executive; be responsible for ensuring that visiting workers, contractors and other visitors to the work place do not put themselves, the workforce or the general public at risk; consider the particular hazards of premises, plant, vehicles and/or machinery under their control and ensure safe working methods in relation thereto. 3

4 4. SUPERVISORS- Senior Leadership Team 4.1 Supervisors who are defined as employees who have the responsibility of supervising the operation of other employees, e.g. Co-ordinators, Site Supervisor. 4.2 All supervisory staff (e.g. co-ordinators, resource assistant) will make themselves familiar with the requirements of the Health and Safety at Work, etc Act 1974 and any other health and safety legislation and codes of practice which are relevant to the work of their area of responsibility. 4.3 In addition to the general duties which all members of staff have (see 5.0), they will be directly responsible to the Head or the member of staff nominated by the Head to have overall day-to-day responsibility for the implementation and operation of the school s health and safety policy within their relevant departments and areas of responsibility. 4.4 They will take a direct interest in the school's health and safety policy and in helping other members of staff, pupils and others to comply with its requirements. 4.5 As part of their day-to-day responsibilities they will ensure: a tidy and orderly workplace is maintained; safety discipline in the workplace; (c) they set an example in safe behaviour; d) safe methods of working exist and are implemented throughout their area of control; (e) they monitor the standard of health and safety throughout the area of school in which they work, encourage staff, pupils and others to achieve the highest possible standards of health and safety; (f) health and safety regulations, rules, procedures and codes of practice are being applied effectively; (g) staff, pupils, new employees and others under their jurisdiction are instructed in safe working practices; (h) regular safety inspections are made of their area of responsibility as required by the Head or as necessary; (i) positive, corrective action is taken where necessary to ensure the health and safety of all staff, pupils and others; (j) all plant. machinery and equipment in the department in which they work is adequately guarded and is in good and safe working order; (k) all reasonably practicable steps are taken to prevent the unauthorised or improper use of all plant, machinery and equipment in the area in which they work; (l) appropriate protective clothing and equipment, first aid and fire appliances are provided and readily available in the area in which they work; (m) toxic, hazardous and highly flammable substances in the area in which they work are correctly used, stored and labelled; (n) all health and safety information is communicated to the relevant persons; 4

5 5. DUTIES AND RESPONSIBILITIES OF ALL EMPLOYEES 5.1 In the interests of themselves and of others, staff are required to observe safe working methods and comply with relevant health, safety and welfare regulations. Codes of Practice will be formulated in full consultation with staff representatives and, although these will not have legal status, they will be looked upon as the standards to be observed by employees in the establishment. All members of staff should note especially Section 7 and 8 of the Health and Safety at Work, etc. Act 1974 which have been interpreted as follows:- Section 7 It shall be the duty of every employee while at work:- "to take reasonable care for the health and safety of her/himself and of other persons who may be affected by her/his acts omissions at work". "to co-operate with employers and others in meeting statutory requirements". Section 8 "No person shall intentionally, or recklessly, interfere with or misuse anything provided in the interests of health, safety or welfare in pursuance of any of these relevant statutory provisions." 5.2 The promotion of Health and Safety measures is a mutual objective for both the Council and its employees. The duties of individual employees are further set out in the Council's Safety Policy, Section 2, Paragraph In particular all members of staff will: (c) (d) (e) (f) (g) (h) (i) be familiar with the safety policy and any and all safety regulations as laid down by the Governing Body ensure health and safety regulations, rules, routines and procedures are being applied effectively by both staff and pupils see that all plant machinery and equipment is adequately guarded see that all plant machinery and equipment is in good and safe working order not make unauthorised or improper use of plant machinery and equipment use the correct equipment and tools for the job and any protective equipment or safety devices which may be supplied ensure that toxic, hazardous and highly flammable substances are correctly used, stored and labelled report any defects in the premises, plant, equipment and facilities which they observe take an active interest in promoting health and safety and suggest ways of reducing risks. 5

6 6. HIRERS, CONTRACTORS AND OTHERS 6.1 When the premises are used for purposes not under the direction of the Head, then the principal person in charge of the activities for which the premises are in use will have responsibility for safe practices as indicated in paragraph 3.0 of this document. 6.2 The Head or the co-ordinator will seek to ensure that hirers contractors and others who use the school premises conduct themselves and carry out their operations in such a manner that all statutory and advisory safety requirements are met at all times. 6.3 When the school premises or facilities are being used out of normal school hours for a school-sponsored activity then, for the purposes of this policy the organiser of that activity, even if an employee will be treated as a hirer and will comply with the requirements of this section. 6.4 When the premises are hired to persons outside the employ of the Governing Body, it will be a condition for all hirers, contractors and others using the school premises or facilities that they are familiar with this policy, that they comply with all safety directives of the Governing Body and that they will not without prior consent: (c) (d) introduce equipment for use on the school premises alter fixed installations remove fire and safety notices or equipment take any action that may create hazards for persons using the premises or the staff or pupils of the school. 6.5 All hirers, contractors and others who work on the school premises are required to ensure safe working practices by their own employees under the provisions of the Health and Safety at Work, etc Act 1974 and must pay due regard to the safety of all persons using the premises in accordance with S.8 of the Health and Safety at Work, etc Act In instances where the hirer, contractor or other creates hazardous conditions and refuses to eliminate them or to take action to make them safe the Head will take such actions as are necessary to prevent persons in his or her care from risk of injury. Where a "contractor" undertaking work on departmental premises is doing so in a manner thought (by the premises manager), to be hazardous, the premises manager shall inform the Supervising Officer of his/her concern and then inform the Department's Health and Safety Officer The word "contractor" means any person, partnership or company who is employed by the Council to carry out specific work which will necessitate their going onto Council premises. This includes contractors who deliver supplies, or deliver, install, erect or maintain plant or equipment, those who repair or maintain Council premises and those carrying out building, engineering and associated works. It also includes employees of one department of the Council (e.g. building maintenance 6

7 employees ) while carrying out such works at premises occupied by another department (e.g. at a school) Under the Council's arrangements for competitive tendering, situations may arise where a Contractor is located on a site. Liaison between the Contractor, the Premises Manager and officers responsible for monitoring that contract need to reflect their health and safety responsibilities and they must conduct themselves in such a manner which accords with the maintenance of all aspects of this safety policy statement. 6.9 The Governing Body draws the attention of all users of the school premises (including hirers and contractors) to S.8 of the Health and Safety at Work, etc Act 1974, which states that no person shall intentionally or recklessly interfere with or misuse anything which is provided in the interests of health, safety or welfare in pursuance of any of the relevant statutory provisions. 7

8 7. STAFF CONSULTATIVE ARRANGEMENTS 7.1 Elected Safety representatives will be appointed from amongst the Staff Governors to be involved in the Premises Committee. 8. CODES OF PRACTICE AND SAFETY RULES 8.1 In consultation with the Governing Body (where appropriate) and taking into account the requirements of this statement the safety committee will approve (where necessary) codes of practice for the observation of safety requirements in school. 8.2 From time to time the DfES, the Health and Safety Executive and other regulatory or advisory bodies will issue codes of practice on particular topics for the guidance of Heads and others who are in control of educational premises who will normally incorporate such codes into their health and safety policy and procedures. If the Head considers the inclusion of all or any such documents into this policy to be inappropriate, he or she will be required to demonstrate to the satisfaction of the Governing Body that he or she has already introduced codes of practice and methods of working which achieve a similar or higher standard of health and safety. 9. RISK ASSESSMENT 9.1 The Head will ensure that a risk assessment survey of the premises, methods of work and all school-sponsored activities is conducted annually. This survey will identify all defects and deficiencies, together with the necessary remedial action or risk control measures. The results of all such surveys will be reported to the Governing Body- Premises Committee. 10. SAFETY PROCEDURES This section sets out safety responsibilities and procedures to be followed in the event of discovery of a hazard. 8

9 Emergencies 10.1 The Head will ensure that an emergency plan is prepared to cover all foreseeable major incidents which could put at risk the occupants or users of the school. This plan will indicate the actions to be taken in the event of a major incident Any employee finding or being aware of an alleged safety hazard within the establishment, must report it to their immediate supervisor. Precautions should be taken to discourage persons from having access to the hazards. If the Premises Manager fails to have a particular hazard investigated and eliminated if the hazard proves real, in a reasonable time, the employee may contact the establishment Safety Representatives Fire Please see the Fire Management and Evacuation policy Other officers and Sections with Council-wide health and safety related responsibilities are:- Health and Safety - Health And Safety Officers: Occupational Health: Ext Fire Equipment, The Fire Officer: Public Health, Group Manager Community Safety Services: (via Civic Centre switchboard) General safety Standards are laid down in DfES guides and circulars i.e.:- Safety in Outdoor Pursuits Safety in Science Laboratories Safety in Practical Departments Safety in Physical Education Safety in Workshops Safety at School - General Advice 10.6 These, in addition to any relevant statutory or other provision, shall be adopted as the minimum safety standards for the operation in question. 9

10 11. FIRST AID 11.1 The arrangements for first aid provision will be adequate to cope with all foreseeable incidents At the discretion of the Governing Body other staff will be given such training in first aid techniques as is required to give them a basic, minimum level of competence. This level will be agreed by the Governing Body Supplies of first aid material will be held in the welfare room. They will be prominently marked and all staff will be advised of their position. The materials will be checked regularly and any deficiencies made good without delay Adequate and appropriate first aid provision will form part of the arrangements for all out-of-school activities A record will be made of each occasion any member of staff pupil or other person receives first aid treatment either on the school premises or as part of schoolrelated activity. 10

11 12. SPECIAL HAZARDS 12.1 When non-routine work, such as maintenance, repairs, minor improvements, major building works, or routine support work such as delivery of materials, grass-cutting etc., is carried out on the premises, additional hazards may be introduced. Notices of such potential hazards shall be displayed and adequate arrangements made by the Premises Manager acting on advice if required from the Health and Safety Officer for the safety of all personnel using the premises, notwithstanding the obligations placed upon the "contractors" * See paragraph 6) to carry out their work in accordance with the requirements of the Health and Safety at Work Act or other legislation Vehicle Movement - The Safety Assessment Manual details the issues relating to Vehicle Movement around the premises Asbestos The Asbestos Management Plan covers the treatment of asbestos throughout the premises. Contractors working on site should refer to the Asbestos Log. 13. REVIEW The Governing Body will review this policy statement annually and update modify or amend it as it considers necessary to ensure the health, safety and welfare of staff and pupils.
