6 Code of Ethics Preamble: The Virginia Association for Home Care and Hospice (VAHC) was founded by members who encouraged the development and delivery of high quality, fairly priced home care & hospice services throughout Virginia. In meeting this goal, the association membership seeks to establish and retain the highest possible level of public confidence. With this in mind, the Board of Directors has adopted this Code of Ethics to govern the conduct of business by the association and its members. The standards set forth in the code serve as a statement to the general public and to governmental agencies that the association, and its individual members, stand for integrity and strive to maintain the highest ethical standards. The Code of Ethics is intended to inform members and the general public of the acceptable guidelines of ethical conduct for home care agencies. It is a condition of participation in the association that members abide by the Code of Ethics or risk expulsion. The Code of Ethics, adopted by the Board of Directors of the Virginia Association for Home Care and Hospice, consists of the following principles: 1. Members will assure that the patient/client receives appropriate quality care. Each patient/client is to be treated with courtesy, respect and regard for privacy. Patient/clients have the right to be informed concerning their care and have the right to participate in planning the care they receive. Each member shall be responsible for developing, adopting, and observing Patient/Client Rights and Responsibilities in order to establish and maintain lawful and effective patient/client care and satisfaction. Each member will ensure quality by complying with accepted standards of professional practice. 2. Members will place the well-being of the patient/client above individual member gains. In this regard, members shall collaborate to assure comprehensive services to patient/ clients and will honestly and conscientiously cooperate to assure the patient/client s best interest. Members shall refrain from inducing or coercing employees, physicians, other health care providers or businesses in an effort to refer patient/clients to the member for provision of health care services or goods. Members shall refrain from inducing, persuading or coercing a patient/client to change home care providers. Adopted by Board of Directors 10/20/98 3. Members or hospice will provide human resource management to ensure qualified staff. Each member will provide human resource management and supervision to ensure that qualified staff render competent and comprehensive patient/client care. 4. Members will conduct business in accordance with fair business practices and accepted industry and regulatory standards and guidelines. Each member will issue oral and written statements or bills to the public, patient/clients, and other health care providers honestly and accurately represent the value of goods and services rendered. 5. Members will promote home care & hospice services in a manner that demonstrates a positive image of the industry. 6. Each member shall abide by all applicable federal and state laws, rules and regulations. 7. Each Medicare certified agency member will comply with Medicare guidelines prohibiting fraudulent and abusive practices. 8. Members shall not engage in kick-backs, pay-offs, or other types of fraud or abuse. 9. 9 VAHC 2015 Accomplishments Advocacy Successful recoupment of over $1 million in delayed or denied managed care payments. Successfully advocated for Medicaid Rate Increases: Two percent increase for Medicaid waiver personal care and respite care services effective July 1, percent increase for skilled nursing services in the ID and IFDDS waiver effective July 1, Six percent increase for EPSDT to be equal to the private duty nursing rates in the Technology Assisted Waiver effective July 1, Successfully amended a bill that requires hospices to notify the patient s pharmacy that dispensed certain narcotics to a hospice patient of their death. This bill is intended to help slow narcotics drug diversion. Passage of a bill that prohibits any person who is not licensed as a home care organization from advertising or marketing himself as or otherwise holding himself out to be a home care organization. Successfully amended legislation that requires the director of a home health or hospice organization to report any professional disciplinary actions against any licensed health care profession to the Office of Licensure and Certification. Such action will then be communicated to the appropriate licensing board. Successful passage of a requirement that DMAS report quarterly on the implementation of the Commonwealth Coordinated Care program to the Chairmen of House Appropriations and Senate Finance Committees. Imposed a requirement that the Department of Medical Assistance Services evaluate the costs borne by providers to participate in the Commonwealth Coordinated Care program. Advocated for a repeal of the Home Health Face-to-Face requirements. Continued to oppose reimbursement cuts to Certified Home Health and Hospice programs. Supported efforts to over-turn regulations imposed by the Department of Labor. Assisted members complying with a new DMAS requirement that providers use a National Provider Identified number. Continued to advocate for a fair Home and Community Based Services Medicaid audit process. Facilitated regional office visits with Virginia s Congressional Delegation to express concerns with Medicare reimbursement cuts, employer mandates under health care reform, and repeal of the companionship exemption within the federal Fair Labor Standards Act. Ongoing work with the Office of Licensure and Certification to improve survey processes and update regulations to be more consistent with current practice standards. Represented home care and hospice at Community Integrated Health Planning group meetings. Participated in the POLST Respecting Choices Advance Care Planning. Served on the legislatively mandated Commonwealth Coordinated Care Commission. Represented the industry interest revolving around Integrated Community Paramedic Health Care. Managed the Political Action Committee for home care and hospice in Virginia. Reviewed and recommended changes to various provider manuals within the Department of Medical Assistance Services Membership Directory & Resource Guide 7

10 VAHC 2015 Accomplishments Communications with Members Monthly newsletters packed full of timely information and one of VAHC s most popular publications. 22 For Members Only bulletins on hot issues. Weekly Legislative updates during the legislative session. Coordinated and facilitated nine face to face meetings across the Commonwealth. Ninety-five members participated in these networking opportunities. Responded to over 241 member inquiries regarding business practices, regulation, reimbursement, contracting, etc. Assisted members with participation, claims payments, credentialing, and authorization in the Commonwealth Coordinate Care program. Held eight For Members Only informational calls. Enhanced Community Impact Member of the Steering Committee for the Governor s Conference on Aging. VAHC staff presented information to the community on the benefits of home care and hospice. Increased opportunities for membership engagement through regional meetings. Worked with the Office of Licensure and Certification and the Office of the Attorney General to enforce licensure requirements. Completed a study of the industry s Economic Impact in Virginia. Conducted a study with Dobson/DaVanzo on the Economic and Clinical Value of Home Health Care Provided in the Commonwealth of Virginia. Developed a report on Improving Care, Reduction Cost and Lowering Hospital Readmission The Value of Personal Care providers in collaboration with Virginia Tech Center for Gerontology. Participated in Virginia Partners for Care Transitions. Facilitated Emergency Preparedness outreach. VAHC provided a Digital Membership Directory on our website. Professional Development Provided 46 educational workshops on issues of importance to home care and hospice providers. Held three Industry Conferences. Trained 84 home care and hospice professionals on ICD-10. Held the only statewide Trade Show for home care and hospice. Offered 11 free members only meetings/conference calls, providing contact hours at no charge to VAHC member nurses. 8 Virginia Association for Home Care & Hospice

11 VAHC 2015 Accomplishments Membership Member use of the Legislative Action Center used to communicate with elected officials. VAHC staff guided members working to comply with the new federal over-time requirements. VAHC staff guided members in working through issues in Medicaid/Medicare audits. VAHC staff guided members through the implementation of Commonwealth Coordinated Care. VAHC staff guided members with licensure and certification issues. VAHC staff assisted members with healthcare reform issues. VAHC staff provided support services in determining industry best practices. Fiscal Integrity The association continues to be fiscally sound, while the reserve fund has assets value of $81,607 as of December 31, The educational fund, after sales and proceeds adjustments has an asset value of $22,347 as of December 31, Total revenues for 2015 year end were $545,190 while expenses were $435,302. Excessive revenues totaled $109,888. VAHC s financial statements are independently audited annually by R.H. Hamlin. Copies are available for review at the VAHC office. CHAP, under an agreement with VAHC, will waive the $550 application fee for any VAHC member seeking initial or renewal accreditation with CHAP.
