1 TEXAS MEDICAL BOARD LICENSURE COMMITTEE MEETING MINUTES March 1, 2018 The meeting was called to order 10:16 a.m. by Chair, Timothy Webb, J.D. Other committee members present were Michael Cokinos, Frank S. Denton, Kandace B. Farmer, D.O. and John R. Guerra, D.O. Agenda Item 2 Discussion, recommendation, and possible action regarding proposed amendments to Title 22 of the Texas Administrative Code. a. Chapter 172. Temporary and Limited Licenses Sports Physician Temporary License Ms. Tuthill presented information about the proposed new rule that would create an exemption for visiting sports team physicians who travel with a team from other states and provide care to athletes and individuals associated with the team during sporting events held in Texas no longer than 10 days, with a special license required for sporting events that last longer than 10 days in duration. Mr. Cokinos moved to recommend to the full Board that the proposed new rule as presented be published in the Texas Register for public comment, with one amendment to the proposed language: the proposed exemption for medical licensure will apply to sporting events lasting no more than 21 consecutive days. Dr. Farmer seconded. All voted in favor. The motion passed. Dr. Guerra moved, Dr. Farmer seconded that the Committee close the meeting to the public and continue in Executive Session for deliberations concerning Agenda Items 3 and 4a. The motion passed. Mr. Webb announced that the meeting would be closed for deliberations at 10:38 a.m. concerning licensee requests, licensure applications and the character and fitness of applicants under the authority of The Medical Practice Act Sections and , Occupations Code, and that while in executive session, the Board would not take any action, make any decision, or vote with regard to any matter that may be considered or discussed. A certified agenda of any executive session will be made. The Executive Session ended at 1:28 p.m. The Licensure Committee conducted hearings to review licensees and applicants appearing concerning eligibility. The hearings were conducted in Executive Session. Following the hearings, the Committee reconvened and considered the applications. 1
2 Agenda Item 3 Licensee requests. Licensee #2148 appeared before the Committee in executive session. In open session, Mr. Denton moved that the committee recommend to the full Board that the licensee s request be granted and that the licensee s license be returned to Active status contingent upon the following conditions being completed in full: Within one year from March 2, 2018, completion of a 90-day mini residency in general practice. The mini residency must be completed in a continuous 90-day period. The mini residency must be approved by the Executive Director of the Board before the licensee initiates the program. Within one year from March 2, 2018, completion of 48 hours of Continuing Medical Education that meet the requirements under 166.2(a)(1)(A), with a minimum of 12 hours in the topic of Risk Management and Recordkeeping (the 12 hours between the two topics can be divided in any amount); 12 hours in the topic of Occupational Medicine; 12 hours in the topic of Family Medicine; 4 hours in the topic of Ethics, and at least 8 hours in topic(s) of the licensee s choosing. Within one year from March 2, 2018, passage of the Special Purpose Examination with a minimum score of 75 within 3 attempts. Within one year from March 2, 2018, passage of the Texas Medical Jurisprudence examination with a minimum score of 75 within 3 attempts. This recommendation is based on the licensee s time out of the active practice of medicine. Dr. Guerra seconded the motion. All voted in favor. The motion passed. Agenda Item 4a - Applicants appearing concerning eligibility. Applicant #1220 appeared before the Committee, with counsel, in executive session. In open session, Mr. Cokinos moved that the committee recommend to the full Board that the applicant appeal of the Executive Director s determination of ineligibility be denied and the original determination stands. Dr. Guerra seconded the motion. All voted in favor. The motion passed. Applicant #2132 appeared before the Committee, with counsel, in executive session. In open session, Dr. Cokinos moved that the committee recommend to the full Board that the Applicant be granted an unrestricted license. Dr. Farmer seconded the motion. All voted in favor. The motion passed. 2
3 Applicant #2133 appeared before the Committee in executive session. In open session, Dr. Farmer moved that the committee recommend to the full Board that the Applicant be granted an unrestricted license. Dr. Guerra seconded the motion. The motion passed. Applicant #2141 appeared before the Committee, with counsel, in executive session. In open session, Dr. Guerra moved that the committee recommend to the full Board that the applicant appeal of the Executive Director s offer of an Agreed Order be denied and the original determination stands. Mr. Cokinos seconded the motion. Mr. Cokinos, Dr. Farmer, and Dr. Guerra voted for the motion. Mr. Denton voted against the motion. The motion passed. Agenda Item 4b Proposed orders offered by the Executive Director. Ms. Johnston reported on 2 Remedial Plans and 1 Agreed Order offered by the Executive Director and accepted by the applicants. Mr. Denton moved to recommend to the full Board that the 2 Remedial Plans and 1 Agreed Order be approved. Dr. Guerra seconded. All voted in favor. The motion passed. Agenda Item 4c Physician licensure applicants to be licensed. Ms. Johnston reported that there were 189 applicants who met all requirements to be considered for permanent licensure by the full Board. Dr. Farmer moved to recommend to the full Board that all 189 physician licensure applicants determined to meet eligibility requirements by staff be approved. Mr. Cokinos seconded the motion. All voted in favor. The motion passed. Agenda Item 4d Surgical assistant licensure applicants to be licensed. Ms. Johnston reported that were 11 surgical assistant applicants who met all requirements to be considered for licensure by the full Board. Dr. Guerra moved to recommend to the full Board that all 11 surgical assistant applicants determined to meet eligibility requirements by staff be approved. Dr. Farmer seconded the motion. All voted in favor. The motion passed. Agenda Item 4e Acudetox Specialist applicants to be certified. Ms. Johnston reported that were 3 Acudetox Specialist applicants who met all requirements to be considered for licensure by the full Board. Mr. Cokinos moved to recommend to the full Board that all 3 surgical assistant applicants determined to meet eligibility requirements by staff be approved. Dr. Guerra seconded the motion. All voted in favor. The motion passed. 3
4 Agenda Item 5 Report on licensure statistics. Ms. Johnston reported that in Quarter 2 of FY17, 1140 new physician licenses were issued in an average processing time of 42 days. In Quarter 2 of FY 18 as of February 16, 2018, 831 licenses were issued in an average processing time of 36 days. Agenda Item 6 Cancellation of Licenses by request or for incomplete registration. There are none. Agenda Item 7a -Nonprofit Health Organizations - Applicants for Initial Certification. Ms. Johnston reported that were 11 applications for initial certification as a Nonprofit Health Organization for approval. Mr. Cokinos moved to recommend to the full Board that the 11 requests for initial certification as a Nonprofit Health Organization be approved. Dr. Guerra seconded. All voted in favor and the motion passed. Agenda Item 7b - Nonprofit Health Organizations - Applications for Biennial Recertification. Ms. Johnston reported that were 3 applications for biennial recertification as a Nonprofit Health Organization for approval. Dr. Guerra moved to recommend to the full Board that the 3 requests for initial certification as a Nonprofit Health Organization be approved. Mr. Denton seconded. All voted in favor and the motion passed. Agenda Item 7c - Nonprofit Health Organizations Cancellation of Certification. There are none. There being no further business, the meeting was adjourned at 1:44 p.m. 4
5 SPORTS TEAM PHYSICIAN LIMITED LICENSE The following rules apply to an outof state nontexas licensed physician who is designated or employed as a physician for visiting athletes athletic teams and sporting event related individuals participating in sporting events in Texas and family members of such individuals a DEFINITIONS The following words and terms when used in this section shall have the following meanings unless the context clearly indicates otherwise Episodic medical caremeans providing medical care or treatment during sporting events in Texas by a physician designated or employed by a visiting sports team and the care or treatment is provided only to those individuals listed in sectionb3a and B below and the sporting event lasts no more than 10 days b LICENSURE REQUIRED FOR SPORTS TEAM PHYSICIAN Unless otherwise exempt under subsection c of this section an outofstate team physician who is not licensed in Texas is required to obtain a temporary license In order to obtain the temporary license the team physician must meet the following requirements 1 is employed or designated as a team physician by a sports team visiting this state for a specific sporting event 2 is licensed to practice medicine in the team s home state and 3 limits the person patient care to the period beginning on the date the team arrives in this state for the event to the date that the team leaves the state to A the members coaches and staff of the team and B a family member of a person described by A immediately above if the family member is visiting this state for the event c EXEMPTION FOR SPORTS TEAM PHYSICIAN An outofstate team physician is exempt from the licensing requirements of this subtitle and may engage in the practice of medicine in this state if 1 Only episodic medical care is provided and 2 The team physician meets and complies with the requirements ofb12 above d APPLICATION FOR SPORTS TEAM LIMITED LICENSE 1 A team or sports physician shall be required to provide a completed application form in order to be issued a temporary license if required under the requirements of subsection b 2 The application form must be submitted at least 30 days prior to the start of the event
