3 SECTION 1.0 INTRODUCTORY MATERIALS 1.1 Statement of Purpose The Department of Health (the Department) is requesting proposals for basic and consultative school health services for students in Miami-Dade as well as for the training, clinical supervision, and monitoring of the school staff that provide these services to students Legal Authority 1.2 Definitions School health services programs are health services, pursuant to section , Florida Statutes Baseline Data: Health services data available or collected as of December 31, That is, data available or collected from the beginning of the school year through December 31, If available, DOH will provide a Baseline Data report by January 1, Basic services: Health services, pursuant to section , Florida Statutes, that will be available to students enrolled in at least 62 Miami-Dade County Public Schools. Basic services include but are not limited to school health nursing services, comprising BMI screenings and follow-up, vision screenings and follow-up, chronic disease management and follow-up, hearing screenings and follow-ups, and care plan development. BMI: Body Mass Index, a number calculated from a student's weight and height for age and gender. Business days: Monday through Friday, excluding state holidays. Business hours: 8 a.m. to 5 p.m., Eastern Time on all business days. Calendar days: All days, including weekends and holidays. Consultative services: Health services, pursuant to section , Florida Statutes, that will be provided to at least 40 Miami-Dade County Public Schools. Upon request of the school, the Provider will provide consultative services to the schools regarding care of students with chronic illnesses. This would include training staff and teachers on signs and symptoms, preventive actions, medication administration, and emergency response. Schools where consultative services will be provided will also be eligible to participate in classroom educational classes offered via WebEx. Child specific trainings related to chronic illnesses and emergency care under section , Florida Statutes, are: Level 1 training consists of a general awareness for all staff that have student contact. The training provides an overview of disease process, signs, and symptoms, general treatment recommendations and emergency actions for the following conditions: asthma, diabetes, seizures, and severe allergies. This training is usually provided during a staff meeting. Title: Basic and Consultative School Health Services Page 3

4 Level 2 training consists of all elements in Level 1 in addition to child specific chronic illnesses. This training pertains to the teachers and paraprofessionals who have students assigned to their particular class and parents have agreed to disclosure of condition. Each student s emergency action plan, particular signs and symptoms, and treatment plan, including emergency actions, are discussed. Level 3 training consists of all elements of Level 1 and 2 trainings for the designated school health staff (facilitator). In addition, the designated school facilitators are provided training on how to care for the students in the event of an emergency, medication administration if applicable (medication needed during the day or for emergencies as well as appropriateness of delegated task), and treatments if applicable (treatments delegated must be appropriate). CNA: Certified Nursing Assistant Contract: The formal agreement that will be awarded to the successful Respondent under this RFP, unless indicated otherwise. Contract Manager: An individual designated by the Department to be responsible for the monitoring and management of the Contract. DOH: Florida Department of Health. DOH-Miami-Dade: Florida Department of Health in Miami-Dade County. ECP: Emergency Care Plan. ESE: Exceptional Student Education. Healthy Lifestyle Intervention: Services aimed at implementing healthy growth and development recommendations, e.g., guiding to enhance and strength motivation for change, address problems and difficulties for changing unhealthy habits, and communication, collaboration, and explanation of healthy habits benefits. IHP: Individualized Healthcare Plan. LPN: Licensed Practical Nurse. Minor Irregularity: As used in the context of this solicitation, indicates a variation from the RFP terms and conditions which does not affect the price of the Proposal, or give the Respondent an advantage or benefit not enjoyed by other respondents, or does not adversely impact the interests of the Department. Proposal: The complete written response of the Respondent to the RFP (technical and cost proposals), including properly completed forms, supporting documents, and attachments. School Health Services Plan: A plan developed jointly by the DOH in Miami-Dade County, County, The Children s Trust, Community Partners, the school district/the School Board of Miami-Dade County, Florida, and School Health Advisory Committee, under Section , Florida Statutes, outlining the provisions and responsibilities to provide mandated health services in all public schools. Chapter 64F-6.002, Florida Administrative Code (F.A.C.) requires the plan to be completed biennially. It is the responsibility of the Respondent to be aware of any addenda that might affect their Proposal. 2.6 Questions This provision takes precedence over General Instruction #5 in PUR1001. Questions related to this solicitation must be received, in writing (either via U.S. Mail, courier, , fax, or hand-delivery), by the Procurement Officer identified in Section 2.4, within the time indicated in the Timeline. Verbal questions or those submitted after the period specified in the Timeline will not be addressed. 2.7 Identical Tie Proposals Where there is identical pricing or scoring from multiple respondents, the Department will determine the order of award in accordance with Florida Administrative Code, Rule 60A Title: Basic and Consultative School Health Services Page 7

8 SECTION 3.0: SCOPE OF SERVICES 3.1 Background: Currently, these services are under a contract where the vendor is providing basic school health services and consultative services. The vendor is staffing school health suites that consist of a multidisciplinary team who work collaboratively to identify, prevent, or remedy a student s health problems and provide a linkage to appropriate community care. The vendor is responsible for training and providing clinical supervision and monitoring of the school staff that provide school-day health services to students. The goal is to promote a healthy school environment that is conducive to student wellbeing, fosters positive behavior, and supports higher academic achievement. 3.2 Scope of Services The Respondent will provide school telehealth program including basic school health services and consultative services to include telehealth virtual visits, trainings, and guidance to students, parents, and school personnel. The Respondent will provide school health nursing services, including BMI screenings and follow-up; vision screenings and follow-up; hearing screenings (to begin July 1, 2018) and follow-ups; chronic disease management and follow-up; care plan development; child specific trainings, Level 1, 2, and 3 trainings; health education classes; parent consultation, staff consultation, referrals for assistance and support with social, emotional, financial, and insurance issues, parentteacher conferences, and lice screenings. The Respondent will also be responsible for record reviews, administration of immunization to increase compliance, and immunization compliance follow-up Client Eligibility Client eligibility will be determined by the Respondent who will verify client eligibility by collecting the opt-out forms from the students or students representatives. The Respondent will also verify that the students receiving services have not selected the option of opting-out from the applicable telehealth basic services or consultative services. For health services including Telehealth services requiring consent form, the Respondent must obtain signed parental or legal consent Task List Respondent will perform the following tasks throughout the term of this contract: 1. Actively participate in the development, review, and implementation of the School Health Services Plan Provide a report containing recommendations on development and review of the School Health Services Plan within fifteen (15) calendar days of the end of the resulting contract. 2. Meet monthly, at a date and time that will be agreed upon by the Respondent and DOH, with DOH assigned personnel to discuss opportunities for improvement and the progress of the services provided Title: Basic and Consultative School Health Services Page 8

9 under this contract. Meetings do not have to be face-to-face and may be conducted via conference call. Evidence of participation at these monthly meetings must be provided. Acceptable evidence will include copies of conference notices, agendas, meeting minutes or summaries, meeting materials, or supporting materials. 3. Follow all recommendations based on QI/QA (quality improvement/quality assurance) visits/inspections provided by DOH relative to services under this contract. Respondent must submit corrective action reports based on QI/QA inspections as requested. 4. Provide consultative services to at least 40 of the Miami-Dade County Public Schools listed in Exhibit B. The Department will receive the request for consultative services and will send it to the Respondent for completion. The Respondent must the school requesting the consultative services within ten (10) calendar days of request. Respondent must use Exhibit A of this RFP for outreach services. The Respondent must provide at least one (1) Level 2 training and one (1) Level 1 training per public school requesting consultative services by the end of the school year. The Respondent must submit the format provided and a list of the schools in which trainings were completed, the name of trainings completed, date of training completion, and copy of sign-in sheets. Provide services to 100% of students in need of health services utilizing the school telehealth program, when medically appropriate (as some services may require in person interaction) to provide basic school health and consultative services to include telehealth virtual visits, trainings, and guidance to students, parents, and school personnel. The Respondent must provide a report reflecting the percentage of the school clinic visits that utilized the school telehealth program.for health services requiring consent form, the Respondent must obtain signed parental or legal consent. 5. Provide: a) Telehealth technology mobile solutions including installation, maintenance, and technical support. b) At least seven (7) Registered Nurses (RN) who provide direct services in schools and virtually from the telehealth command center. c) Scheduled appointments for students with Respondent s RNs as needed. d) At least seven (7) on-site telehealth presenters or certified nursing assistants (CNA) who rotate between schools. Each telehealth Presenter or CNA will have a territory of schools. e) Initial and ongoing telehealth training, guidance, and support for school health facilitators. f) At least Seven (7) telehealth Mobile Medical Stations to assess students. 10 g) A monthly report on the number of appointments for students, number of telehealth presenters rotating between schools, and number of telehealth Mobile Medical Stations used. Template provided by DOH 7. Provide basic school health services to students enrolled in at least 62 Miami-Dade County Public Schools listed in Exhibit B, which may be amended from time to time under the resulting contract as agreed by the parties and The School Board of Miami-Dade County, Florida. Report to DOH, the percentages as indicated in section of this RFP within 30 calendar days of the end of the resulting contract. Provide the following Basic Services and report the services to DOH (to both the DOH-Miami- Dade School Health Program Office and the Contract Manager) using Exhibit D (weekly report) within seven (7) calendar days following the end of each week as specified in the resulting contract: a) Provide initial and on-going nursing assessments with at least 90% assessments quantity improvement from 12/31/17 Baseline Data for students with chronic and complex health conditions and as needed to students accessing clinic services. Report the number of the assessments. Report the school year percentage. b) Review and assess student s health records with at least 90% improvement from Baseline Data applicable period by March of each school year. Maintain 100% of students health records. Provide the number of initial record reviews, number of student emergency contacts collected, number of health data cards received, and health data cards not received. Report the percentages. c) Provide Individualized Healthcare Plan (IHP) with at least 90% IHP quantity improvement from Baseline Data for students with diagnosed conditions requiring disease/condition management, medications and medical procedures at school. Provide at least 100% of subsequent review/revision of IHP. Provide and report the number of IHPs provided to students and number of subsequent review/revision and updates of IHPs. Report the percentages. d) Train and provide clinical supervision of the Miami-Dade County Public School facilitators that provide the evaluations, interventions, and encounters when needed. Report the number of these evaluations, interventions, and encounters. e) Provide at least one onsite or virtual RN visit per month, and as needed to ensure the health and safety of students, to each school land report it. f) Train and provide clinical supervision to 100% of the school staff assigned to administer medications to students. Assigned staff list will be provided by the School Board of Miami-Dade County, Florida. Report the number of medication doses administered. Report the percentage. g) Provide clinical supervision to the school staff that provides First Aid administration to students as needed. Verify that the assigned school staff has the proper CPR (Cardiopulmonary Resuscitation) and First Aid certifications and identification. Report number of First Aid encounters. h) Train and provide clinical supervision to 100% of the assigned school staff that provide complex medical procedures (such as monitoring Title: Basic and Consultative School Health Services Page 10

11 students with diabetes, asthma, seizures, severe allergies, etc.). Assigned staff list will be provided by The School Board of Miami-Dade County. Report number of procedures. Report the percentage. i) As allowed by parental or legal consent, provide immunization administration, flu vaccinations, and immunization follow ups to 100% of students not meeting the requirements of Florida Statutes, Florida Administrative Code, and Florida Department of Health Immunization Guidelines. Report the number of immunization follow ups. Report the percentages. j) Provide staff consultations with at least 90% staff consultation quantity improvement from Baseline Data. Report the number of staff consultations. k) Provide parent consultations with at least 90% quantity improvement from Baseline Data to identify nursing service needs. Report the number of parent consultations. l) Provide health care provider consultations to school staff with at least 90% quantity improvement from Baseline Data.. Report the number of health care provider consultations. m) Provide staffing and screening for 100% of exceptional students whose exceptionality/ies involve a health-related condition based upon referrals from Miami-Dade County Public Schools. Report the number of staffing and screenings for exceptional students. Report the percentage. n) Plan and implement at least one (1) educational program/session for students, one (1) educational program/session for parents, and one (1) educational program/session for school staff per school per month. Report the number of educational programs or sessions conducted and the number of students, parents, and school staff members attending such programs or sessions. Submit copy of sign-in sheets. o) Conduct child specific training sessions for all school staff required to provide health services specified in IHPs and Emergency Care Plans (ECPs). Report the number of sessions and school personnel participants as well as the school where the session took place. Include topic in reports such as severe allergies, diabetes, seizures, and asthma, as well as any other chronic condition. Submit to DOH (to both the DOH-Miami-Dade School Health Program Office and the Contract Manager) copy of sign-in sheets. p) Provide at least 100 community presentations and send BMI educational resources to parents at each school per school during the school year. Report number and copy of presentations and educational resources sent to parents. Educational resources sent to parents with BMI results are considered community presentations. q) Provide vision screening with at least 95% students number improvement from Baseline Data for eligible students (excluding optout and exceptional students) in mandated grades as per section Florida Statutes, Florida Administrative Code Rule 64F , and DOH Florida School Health Schedule C Scope of Work by March 31, Vision screenings must be provided, at a minimum, to students in grades Kindergarten (K), 1, 3, and 6, and students Title: Basic and Consultative School Health Services Page 11

12 entering schools for first time in grades K through % of students failing vision screening must be referred. Students referred must receive follow up (complete or incomplete) by end of school year. Report percentages. Healthy Lifestyle Intervention services (in grades 1, 3, and 6), Healthy Lifestyle intervention outcomes (in grades 1, 3, and 6) for referred students ( 95%) that complete Healthy Lifestyle Intervention only when physician or nutritionist outcome is not obtained. Number of students with BMI underweight referral, parent/guardian non-response or refusal to follow-up or student withdrawn (in grades 1, 3, and 6). Number of students with BMI obese referral, parent/guardian nonresponse or refusal to follow-up, or students withdrawn (in grades 1, 3, and 6). 13 s) Conduct hearing screening services beginning on the first day of the school year (beginning July 1, 2018). The Respondent will provide hearing or auditory screening services to a minimum of 19,718 students per School Year (and must conduct at least 500 students hearing screenings per month) enrolled in at least 62 Miami-Dade County Public Schools listed in Exhibit B as follows: 1) Provide hearing screenings to 100% of Exhibit B schools students in mandated grades K, 1, and 6, and students entering the listed schools for first time in grades K through 5. Each student who fails hearing screening must be referred to appropriate professional for further evaluation and followed up. Students referred for further evaluation must have such outcome documented in their school health records within fifteen (15) calendar days following the end of each month. 2) Provide initial and on-going assessments of all students tested and report all students who could not test or were absent as specified in the resulting contract. 3) Report the hearing screening services to DOH (to both the DOH-Miami- Dade School Health Program Office and the Contract Manager) using Exhibit E (weekly report) within seven (7) calendar days following the end of each week as specified in the resulting contract. 4) Pprovide at least an audiologist and a technician to conduct hearing screening services, including hearing deviation, determine the range, nature, and degree of hearing loss, referral process, referral outcomes, and follow ups necessary for medical or other professional attention. 5) Participate annually in the planning and implementation of the hearing screening services. 6) Meet monthly with DOH assigned personnel to discuss opportunities for improvement and the progress of the services provided as specified under the resulting contract. 7) Follow all recommendations provided by DOH relative to services under the resulting contract. Submit to DOH a monthly report as stipulated in the resulting contract. 8) Prepare and submit an annual report to DOH (to both the DOH-Miami- Dade School Health Program Office and the Contract Manager), emulating Exhibit E, encompassing totals of all hearing screenings provided under the resulting contract. 9) Test each scheduled student Monday Friday, 8:00AM 4:00PM, with an audiometer that has been properly calibrated. The calibration date and the name and initials of the calibrator must be referenced on the meter. Hearing testing or screenings should be provided during each school s normal operating hours as indicated in Exhibit B. 10) Document in the Cumulative School Health Record (DH3041), attached as Exhibit F, the results of all hearing (audiometric) screenings, specialist referrals, follow-ups and outcomes in the Cumulative School Health Record. Submit it to DOH within fifteen (15) calendar days of findings. Title: Basic and Consultative School Health Services Page 13

14 11) Send hearing referral letter for further evaluation to parents/guardians within fifteen (15) calendar days of findings. Submit to the Department a copy of the letter(s) sent to parents/guardians notifying about the hearing screening services as indicated in the resulting contract. 12) Submit to the Department the date(s), location(s), agendas, and signin sheets of the staff required hearing trainings as stipulated in the resulting contract. 13) Submit the hearing screener s school schedule to DOH (to both the DOH-Miami-Dade School Health Program Office and the Contract Manager) as required in the resulting contract. 14) Provide to the Department, on a monthly basis, a copy of each screener s school attendance log/sheet that lists the student s name, corresponding grade, and date of testing or screening. Each Screener must also document, at the conclusion of each testing, whether the student Passed, Failed, Could Not Test, or Absent. Conduct students and families satisfaction surveys and submit to DOH a summary report within fifteen (15) calendar days of the end of the resulting contract. 8. Prepare and submit an annual report to DOH containing a summary of all services provided under this contract to Miami-Dade County Public Schools during the School Year. Include the percentage of students receiving Basic Services as required in section of this RFP. This annual report must be submitted within thirty (30) calendar days of the end of the resulting contract. 9. Conduct the following surveys and submit to DOH the following reports within fifteen (15) calendar days of the end of the resulting contract: a) One (1) summary report of students and families satisfaction survey responses. b) One (1) summary report on the numbers of students that come to the clinic, are sent home, returned to class, or other visit disposition. This information must also be documented daily in the clinic log. 10. Prepare the following reports and submit them to DOH within fifteen (15) calendar days of the end of the resulting contract: a) Number of communicable diseases reported. b) Number of chronic diseases reported. 11. Complete the following trainings at schools listed in Exhibit B by the end of the School Year: a) At least one (1) Level 1 general awareness training per school. b) At least one (1) Level 2 child specific training for staff with the need to know per student whose health condition is being managed at school (have IHP and/or ECP, and receive medications and medical procedures). c) At least one (1) Level 3 child-specific training for staff required to provide health services specified in IHPs and ECPs. d) At least one (1) ESE staffing training per ESE student with an exceptionality involving a health-related condition. 15 Submit to DOH a list of the schools in which trainings were completed, the name of trainings completed, and copy of sign-in sheets within fifteen (15) calendar days of the end of the School Year. 12. Prepare and submit an end-of-contract evaluation using Exhibit C to determine this program s effectiveness in providing school health services. Submit this evaluation to DOH within thirty (30) calendar days of the end of the resulting contract period. 13. Maintain at a minimum the following personnel, which shall be listed in the Respondent s proposal, during the resulting contract period. a) Seven (7) RNs. b) Two (2) RNs Supervisors. c) Seven (7) Telehealth Service Technicians. The Respondent shall ensure that the staff affiliated with the resulting contract has professional licensure or certification required by law and the experience necessary to successfully carry out their duties. Respondent s staff must be CPR and first aid certified. The Respondent will provide the names of the staff members indicated in section task 18 and the schools they are assigned to. When there are changes to the personnel, submit to DOH a report within fifteen (15) calendar days of each staff change. 14. Provide lice screenings to 100% of the students in a class at a school listed in Exhibit B, when there is a head lice incident within that class. Perform a head lice screening one (1) week and two (2) weeks after students with confirmed head lice have received treatment. Provide to DOH a report (listing the school name, number of head lice incidents, and incidents dates) within thirty (30) calendar days of the end of the resulting contract. 15. Submit to DOH a monthly schedule of school visits by RNs and other health services technicians at least fifteen (15) calendar days before the month in which services will be provided. 16. Provide to DOH on a biweekly basis, the schedule of Basic and Consultative Services provided and screenings completed for each school. Submit it within seven (7) calendar days following the end of each biweekly period. 17. Respondents must submit copies of resumes and copies of required licensing credentials or certifications for each staff member that would be providing services under the resulting contract by December 31, Title: Basic and Consultative School Health Services Page 15

Respondents must submit with the proposal staff list as required in section task 13 of this RFP by December 31, Service Times The Respondent s staff must be available between the hours of 7:30 AM to 4:00 PM, Eastern Standard Time, Monday through Friday, excluding State of Florida holidays and federal holidays, and in accordance with The School Board of Miami- Dade County, Florida s calendar. In addition, services shall be provided at such times that would be required or facilitate the effective delivery of the services. The Respondent and The School Board of Miami-Dade County, Florida leadership will determine telehealth mobile solutions business hours considering the service needs of the schools Certifications, Licenses, Permits, Taxes and Equipment Licenses, certifications, and permits as required by federal, state, or local laws. Respondent must pay for all licenses, permits, certificates and taxes required to operate in the State of Florida. Also, Respondent must comply with all applicable federal, state, and local laws, ordinances, codes, regulations, action transmittals, program instructions, and other requirements at no cost to the Florida Department of Health. Respondent will supply all necessary equipment to perform Contract Minimum Qualifications 1) The Respondent must have at least one (1) year of consistent experience in the provision of basic and consultative school health services using the telehealth technology. 2) The Respondent must have at least five (5) years of consistent experience in the provision of basic services to minor children using the telehealth technology. 3) The Respondent must have staff who will work under the resulting contract with at least six (6) months of experience in the provision of basic and/or consultative school health services using the telehealth technology. 17 SECTION 4.0: INSTRUCTIONS FOR PROPOSAL SUBMITTAL 4.1 General Instructions to Respondents (PUR1001) This section explains the general instructions of the solicitation process to respondents (PUR 1001) and is a downloadable document incorporated into this solicitation by reference. This document should not be returned with the Proposal: The terms of this solicitation will control over any conflicting terms of the PUR Proposal Format The Department discourages lengthy proposals. If the Respondent considers any portion of its Proposal to be confidential, exempt, trade secret, or otherwise not subject to disclosure pursuant to Chapter 119, Florida Statutes, the Florida Constitution or other authority, the Respondent must segregate and clearly mark the document(s) as CONFIDENTIAL. Simultaneously, the Respondent will provide the Department with a separate redacted paper and electronic copy of its Proposal and briefly describe in writing the grounds for claiming exemption from the public records law, including the specific statutory citation for such exemption. This redacted copy must contain the solicitation name, number, and the name of the Respondent on the cover, and must be clearly titled REDACTED COPY. The redacted copy must be provided to the Department at the same time the Respondent submits its response and must only exclude or redact those exact portions which are claimed confidential, proprietary, or trade secret. The Respondent will be responsible for defending its determination that the redacted portions of its Proposal are confidential, trade secret, or otherwise not subject to disclosure. Further, the Respondent must protect, defend, and indemnify the Department for any and all claims arising from or relating to the determination that the redacted portions of its response are confidential, proprietary, trade secret, or otherwise not subject to disclosure. Respondent s failure to submit a redacted copy with its response, constitutes authorization by the Respondent for the Department to produce the entire documents, data or records submitted by the Respondent in answer to a public records request for these records. 20 4.8 Cost Proposal Each Respondent must provide its proposed cost utilizing Attachment A, Cost Proposal. The proposed cost should not be carried more than two places to the right of the decimal point. 4.9 Documentation Respondents must complete and submit the following information or documentation as part of their Technical Proposal: References Respondents must provide contact information for three entities the Respondent has provided commodities or services of a similar size and nature of those requested in this solicitation. Respondents may use Attachment B, Reference Form of this RFP to provide the required information. The Department reserves the right to contact any and all entities, prior to execution of a Contract, in order to verify experience. Information received may be considered in the Department s determination of the respondent s responsibility. The Department s determination is not subject to review or challenge Statement of Non-Collusion Respondents must sign and return with their proposal the Statement of Non- Collusion form, Attachment C Special Accommodations Any person who requires special accommodations at DOH Purchasing because of a disability should call the DOH Purchasing Office at (850) at least five work days prior to any pre-proposal conference, Proposal opening, or meeting. 21 SECTION 5.0: CONTRACT TERMS AND CONDITIONS 5.1 General Contract Conditions (PUR1000) The General Contract Conditions (PUR 1000) form is a downloadable document incorporated in this solicitation by reference, which contains general Contract terms and conditions that will apply to any Contract resulting from this RFP, to the extent they are not otherwise modified. This document should not be returned with the Proposal. The terms of this solicitation will control over any conflicting terms of the PUR1000. Paragraph 31 of PUR 1000 does NOT apply to this solicitation or any resulting Contract. 5.2 Renewal The Contract resulting from this solicitation may be renewed. Contracts may be renewed for a period that may not exceed three years or the term of the original Contract, whichever is longer. Renewals must be in writing, subject to the same terms and conditions set forth in the initial Contract and any written amendments signed by the parties. Renewals are contingent upon satisfactory fiscal and programmatic performance evaluations as determined by the Department and are subject to the availability of funds. 5.3 Conflict of Interest Section (17)(c), Florida Statutes, provides A person who receives a Contract that has not been procured pursuant to subsections (1)-(3) to perform a feasibility study of the potential implementation of a subsequent Contract, who participates in the drafting of a solicitation or who develops a program for future implementation, is not eligible to Contract with the agency for any other Contracts dealing with that specific subject matter, and any firm in which such person has any interest is not eligible to receive such Contract. However, this prohibition does not prevent a Respondent who responds to a request for information from being eligible to Contract with an agency. The Department considers participation through decision, approval, disapproval, recommendation, preparation of any part of a purchase request, influencing the content of any specification or procurement standard, rendering of advice, investigation, auditing, or any other advisory capacity to constitute participation in drafting of the solicitation. Refer to Statement of Non-Collusion, Section Certificate of Authority All limited liability companies, corporations, corporations not for profit, and partnerships seeking to do business with the State must be registered with the Florida Department of State in accordance with the provisions of Chapters 605, 607, 617, and 620, Florida Statutes, respectively prior to Contract execution. The Department retains the right to ask for verification of compliance before Contract execution. Respondents may not propose subcontract agreements as part of their Proposal. 5.8 Performance Measures Pursuant to section , Florida Statutes, the resulting Contract must contain performance measures which specify the required minimum level of acceptable service to be performed. These will be established based on final determination of tasks and deliverables Financial Consequences Pursuant to section , Florida Statutes, the Contract resulting from this solicitation must contain financial consequences that will apply if Provider fails to perform in accordance with the Contract terms. The financial consequences will be established based on final determination of the performance measures and Contract amount Standard Contract Respondents must become familiar with the Department s Standard Contract which contains administrative, financial, and non-programmatic terms and conditions mandated by federal law, state statute, administrative code rule, or directive of the Chief Financial Officer. 23 terms and conditions are located at: Conflict of Law and Controlling Provisions Any Contract resulting from this RFP, plus any conflict of law issue, will be governed by the laws of the State of Florida. Respondents acknowledge that this solicitation (including but not limited to the resulting Contract, exhibits, attachments, or amendments) is not a rule nor subject to rulemaking under Chapter 120 (or its successor) of the Florida Statutes and is not subject to challenge as a rule or non-rule policy under any provision of Chapter 120, F.S Records and Documentation To the extent that information is used in the performance of the resulting Contract or generated as a result of it, and to the extent that information meets the definition of public record as defined in Section (12), Florida Statutes, said information is hereby declared to be and is hereby recognized by the parties to be a public record and absent a provision of law or administrative rule or regulation requiring otherwise, Respondent must make the public records available for inspection or copying upon request of the Department s custodian of public records at cost that does not exceed the costs provided in Chapter 119, Florida Statutes, or otherwise, and must comply with Chapter 119 at all times as specified therein. It is expressly understood that the Respondent s refusal to comply with Chapter 119, Florida Statutes, will constitute an immediate breach of the Contract resulting from this RFP and entitles the Department to unilaterally cancel the Contract agreement. Unless a greater retention period is required by state or federal law, all documents pertaining to the program contemplated by this RFP must be retained by the Respondent for a period of six years after the termination of the resulting Contract or longer as may be required by any renewal or extension of the Contract. During the records retention period, the Respondent agrees to furnish, when requested to do so, all documents required to be retained. Submission of such documents must be in the Department s standard word processing format. If this standard should change, it will be at no cost incurred to the Department. Data files will be provided in a format readable by the Department. The Respondent must maintain all records required to be maintained pursuant to the resulting Contract in such manner as to be accessible by the Department upon demand. Where permitted under applicable law, access by the public must be permitted without delay Attorney s Fee In the event of a dispute prior to or post award, each party responding to this solicitation shall be responsible for its own attorneys fees, except as otherwise provided by law. 24 SECTION 6.0: PROPOSAL EVALUATION PROCESS AND CRITERIA 6.1 Introduction The Department will evaluate and score proposals to determine the most advantageous Proposal. The ability of the Department to evaluate a respondent s Proposal is dependent upon the completeness of the Proposal. Failure of a Respondent to provide information requested by this RFP may result in reduction in scoring during the evaluation. The Department may accept or reject any and all proposals, and waive any minor irregularity, technicality, or omission if the Department determines that doing so will serve the State s best interests. 6.2 Evaluation Criteria The Department will evaluate proposals against all evaluation criteria set forth in Section in order to determine the Proposal most advantageous to the Department. 25 6.3 Cost Proposal Opening Cost Proposals will be opened in a public meeting after scoring and ranking of Technical Proposals Cost Proposal Scoring The Department s cost evaluation will be based upon the respondent s proposed cost, as prescribed in Section 6.2 of this RFP. The proposed cost will be scored in accordance with the below formula: 6.4 Notice of Agency Decision Maximum Cost Proposal Points x (Lowest Proposal Cost/Respondent s Proposal Cost) = COST SCORE At the conclusion of evaluation of the proposals the Department will announce its intended decision. Notice will be posted on the state s Vendor Bid System. The Department will award to the responsible, responsive Respondent determined to be the most advantageous to the state, taking into consideration technical and cost proposals. Award of a Contract does not guarantee placement of order for services. The Department reserves the right to award more than one Contract as a result of this RFP. 6.5 Agency Inspectors General It is the duty of every state officer, employee, agency, special district, board, commission, contractor, and subcontractor to cooperate with the inspector general in any investigation, audit, inspection, review, or hearing pursuant to section , Florida Statutes. 6.6 Protests Failure to file a protest within the time prescribed in section (3), Florida Statutes, or failure to post a bond or other security required by law within the time allowed for filing a bond shall constitute a waiver of proceedings under Chapter 120, Florida Statutes. Provider, its employees, subcontractors, and agents will comply with all security procedures of the Department in performance of this contract. Provider will provide immediate notice to the Department s Information Security Manager (ISM), or their designee, in the event it becomes aware of any security breach and any unauthorized transmission of State Data as described below or of any allegation or suspected violation of security procedures of the Department. Except as required by law or legal process and after notice to the Department, Provider will not divulge to third parties any confidential information obtained by Provider or its agents, distributors, resellers, subcontractors, officers or employees in the course of performing contract work, including, but not limited to, Florida Administrative Code Chapter 74-2, security procedures, business operations information, or commercial proprietary information in the possession of the state or the Department. At the request of the Department the Provider will obtain a current American Institute of Certified Public Accountants (AICPA) Standards for Attestation Engagements no. 16 (SSAE 16). The Department may review the Provider s SSAE 16 in lieu of the Department conducting a test. b. Loss of Data: In the event of loss of any State Data or record(s) where such loss is due to the negligence of Provider or any of its subcontractors or agents, Provider will be responsible for recreating such lost data in the manner and on the schedule set by the Department at Provider s sole expense, in addition to any other damages the Department may be entitled to by law or the Contract. Provider will: 1) Copies: At contract termination or expiration--submit copies of all finished or unfinished documents, data, studies, correspondence, reports and other products prepared by or for the Contractor under the Contract; submit copies of all State Data to the Department in a format to be designated by the Department in accordance with section , Florida Statutes,; shred or erase parts of any retained duplicates containing personal information of all copies to make any personal information unreadable. 2) Originals: At contract termination or expiration--retain its original records, and maintain, in confidence to the extent required by law, Provider s original records in unredacted form, until the records retention schedule expires and to reasonably protect such documents and data during any pending investigation or audit; 3) Both Copies and Originals: Upon expiration of all retention schedules and audits or investigations and upon notice to the Department, destroy all State Data from Provider s systems including, but not limited to, electronic data and documents containing personal information or other data that is confidential and exempt under Florida public records law. Data Protection: No State Data or information will be stored in, processed in, or shipped to offshore locations or outside of the United States of America, regardless of method, except as required by law. Access to State Data will only be available to approved and authorized staff, including offshore Provider personnel, that have a legitimate business need. Requests for offshore access will be submitted in accordance with the Department established processes and will only be allowed with express written approval from the Deputy Secretary of Administration. Third parties may be granted time-limited terminal service access to IT resources as necessary for fulfillment of related responsibilities with prior written approval by the ISM. Third parties will not be granted remote access via VPN, private line, or firewall holes, without an approved exemption. Requests for exceptions to this provision must be submitted to the ISM for approval. When remote access needs to be changed, the ISM will be promptly notified. Provider will abide by all Department and State data encryption standards regarding the transmission of confidential or confidential and exempt information. Offshore data access must be provided via a trusted method such as SSL, TLS, SSH, VPN, IPSec or a comparable protocol approved by the ISM. Confidential information must be encrypted using an approved encryption technology when transmitted outside of the network or over a medium not entirely owned or managed by the Department. Provider agrees to protect, indemnify, defend, and hold harmless the Department and State from and against any and all costs, claims, demands, damages, losses and liabilities arising from or in any way related to Provider s breach of data security or the negligent acts or omissions of Provider related to this subsection. d. All employees, subcontractors, or agents performing work under the contract must comply with all security and administrative requirements of the Department. Provider will not divulge to third parties any confidential information obtained by Provider or its agents, distributors, resellers, subcontractors, officers or employees in the course of performing Contract work, including, but not limited to, security procedures, business operations information, or commercial proprietary information in the possession of the state or the Department. 2. Notice Requirement: Provider will notify the Department upon detection of anomalous or malicious traffic within the scope of contracted services. To the extent applicable, failure to notify the Department of events or incidents that result in breach will subject Provider to administrative sanctions, together with any costs to the Department of such breach of security.
