We are looking for an individual who is skilled and experienced; reporting directly to the Executive NMAHP Director who provides strategic and clinical leadership across the organisation for Public Protection for NHS Dumfries and Galloway. You will be responsible for the further development and implementation of safe adult and child protection systems in all services across NHS Dumfries and Galloway. You will be responsible for the development and maintenance of effective working relationship with interagency partners across both the statutory and voluntary sector. The post holder will be responsible for leading in the development of public protection services working in collaboration with a wide range of stakeholders to meet the needs of children and adults, and will be a key contributor to MAPPA processes. 4 1. JOB IDENTIFICATION Job Title: Nurse / AHP Consultant: Public Protection Department(s): Corporate Nursing Job Holder Reference: Grade 8B No of Job Holders: one 2. JOB PURPOSE Nurse Consultant Public Protection for NHS Dumfries & Galloway, providing strategic and clinical leadership across the organisation. Lead on the development and implementation of safe child protection systems in all services across NHS Dumfries & Galloway. Lead on the development and implementation of safe adult protection systems in all services across NHS Dumfries and Galloway. Provide expert strategic and clinical advice, nursing leadership and expert consultancy across NHS Dumfries & Galloway. Responsible for the development and maintenance of effective working relationships with interagency partners across both the statutory and voluntary sector. Ensure evidence-based practice in child protection and adult support and protection practice throughout the organisation. Produce and direct the implementation of strategies, policies, procedures and protocols for all NHS staff relevant to child protection. Lead on the continuing organisational self-evaluation against the Care Inspectorate quality indicators for child protection and adult support and protection Represent Dumfries & Galloway on National Child Protection and Adults Support and Protection Forums. To offer accessible expert advice and support to individual cases of children in need and in need of protection. 5 3. ORGANISATIONAL POSITION The post holder reports to the Executive Nurse Director 4. SCOPE AND RANGE This is a region wide post for NHS Dumfries and Galloway that covers a population of 146,567. All NHS staff are involved in the protection of children and vulnerable adults including Children s Services, Midwifery Services, Acute Services, Community Paediatrics, Allied Health Professionals, Mental Health Services, Psychology Services, GPs, Practice Nurses, Community Hospitals, Minor Injury Units, A&E, Outpatients, Theatres, Day Surgery, Community Services including Health Visiting and School Nursing. 5. MAIN DUTIES/RESPONSIBILITIES Expert Practice Provide leadership, expertise and consultancy in Child Protection and Adult Support and Protection to both strategic and operational staff across NHS Dumfries & Galloway advising on the requirements that will inform both the commissioning and strategic development of services for children and adults in need of protection, children in need and vulnerable children and adults. Act as expert adviser to all NHS staff on all public protection issues providing detailed advice and clinical supervision as required. Collate complex case specific information received and sought from diverse sources. Where there are conflicting opinions, differing options, and no precedents use expert critical analysis to reach a justifiable judgement as to the actions to safeguard an adult or child/children e.g. children admitted with serious injuries and children born to chaotic drug abusing parents Ensure Nurse Director is aware of all significant complex and contentious cases, managerial and operational gaps and risks to the organisation relating to child protection and adult support and protection services.

6 Provide leadership and expert advice and clinical supervision to the Child Protection Advisers and Public Protection Health Liaison Officers ensuring they continuously develop their knowledge and expertise to support practising clinicians. Take the lead in the most highly complex, sensitive and contentious cases. Develop, review and evaluate NHS Dumfries and Galloway Adult Support and Protection policies, guidelines, protocols and procedures in order to ensure a quality service is provided to vulnerable adults. Act as NHS Dumfries & Galloway representative on the Interagency Significant Case Review panel, Child Protection Committee sub groups e.g. Training and Communication, Performance and Quality, continuous Improvement and Policy and Procedure Groups and act as expert NHS resource for statutory and voluntary sector. Advise on the management of complex, contentious cases with information sharing dilemmas and differing interagency threshold of risk regarding vulnerable adults, and where there may be legal, ethical and professional implications where there is a lack of precedent. Lead and participate in the process for Significant Case Reviews involving the death or serious injury of adults at risk, and produce an action plan of any actions required as a result of the review and monitor their implementation. Undertake monitoring and reporting relating to public protection Initiate and develop framework for supervision to ensure, support and advice for staff working with vulnerable children is in place and evaluated, in order to support safe and effective clinical practice and effective support for clinicians working with vulnerable children. Develop, review, and evaluate NHS Dumfries& Galloway child protection policies, guidelines, protocols and procedures in order to ensure a quality service is provided to children, young people and families ensuring they operate within a controlled system. Advise on the management of complex, contentious cases with information sharing dilemmas and differing interagency threshold of risk regarding children, and where there may be legal, ethical and professional implications where there is a lack of precedent. Demonstrate an understanding of court skills in order to attend as a witness when cited Prepare NHS staff who may also be cited to attend court and give police statements. Give expert advice to Health staff when required to prepare them for Child Protection Case Conferences, Children s Hearings and Court. Challenging professional attitudes and organisational cultures and perceived norms to effect change and improve the outcomes for vulnerable children and adults and protection those at risk of abuse in all forms, sexual, physical, neglect and emotional. Negotiating with professional and medical staff, managers and senior managers both within the NHS and across agencies where political and organisational resistance to change management exist. Negotiating where different thresholds of risk exists and the requirement is to focus on the needs of children at risk and vulnerable adults. This will involve taking into account organisational accountability and national requirements and legal accountability have to be addressed. Professional Leadership Where there are other competing agendas ensure that the protection of children and adults deemed to be at risk and the needs of vulnerable children and adults are prioritised strategically across the organisation. Advise NHS Dumfries and Galloway on strategic planning to ensure services meet the Framework of Standards for Protecting Children and Young People (Scot Exec 2004) and current standards for inspection purposes. Formulate structure and schedule long-term strategic plans, which impact across the whole organisation at both operational and strategic e.g. Adult, Support and Protection and Child Protection Training Strategies, Accountability Framework and Supervision Strategy for child protection for NHS Dumfries & Galloway.

7 Act as NHS Dumfries & Galloway s representative strategically with other agencies to plan initiatives to meet NHS Dumfries and Galloway s joint accountability for meeting the needs of vulnerable children and adults both within the legislative framework and national guidance and standards e.g. formulation and implementation of single and interagency action plans. Provide clinical leadership, mentoring and role modelling in public protection practice for NHS staff across the region. Provide leadership and oversight to MAPPA processes and systems. Represent Dumfries & Galloway on the National Child Protection Adviser s Forum. Ensure that robust communication channels are developed, implemented and maintained across NHS Dumfries and Galloway within Mental Health, PCCD and Acute Directorates to promote and build effective working relationships with patients/clients, families and carers, NHS Dumfries and Galloway staff as well as statutory and voluntary sectors to enable collaborative partnership working and effective co-ordination of service which will improve the outcomes for children and adults at risk. Undertake a pivotal role in the engagement of service users and carers in Adult Support and Protection issues, including their engagement in both training delivery and participation. Establish and maintain robust links with service user and carer networks. Management of situations where best practice has not been applied. Practice and Service Development, Research and Evaluation Initiate and lead and implement on change management and, development of evidenced based practice across all staff groups in NHS Dumfries & Galloway both in the community and acute sector relating to the needs of vulnerable children and adults, risk assessment and children in need of protection.. Strategically review services and where gaps are identified undertake risk assessments developing action plans and submitting proposals and papers (for e.g. Corporate Management Team and Health Care Governance Committee) to reduce corporate risk. Ensure adverse incident reporting in child protection and adult support and protection at all levels and in all areas across Dumfries & Galloway and provide and ensure appropriate action plans to reduce reoccurrence reporting these to the Nurse Director Undertake risk assessment across NHS Dumfries & Galloway in accordance with Clinical Governance and the Risk Management Strategy in relation to Child protection in all services. Support risk assessment across NHS Dumfries and Galloway in accordance with clinical Governance and the Risk Management Strategy in relation to Adult Support and Protection in all services. Undertake own and participate in local and national research and facilitate staff to develop critical appraisal skills and promote evidenced based practice. Establish mechanisms for evaluating and reviewing current practice and develop quality improvement programmes relating to child and adult protection for all NHS Dumfries & Galloway. Act as Associate Assessor for the Inspection of Child Protection Services. Provide consultancy and expert advice at both strategic and operational levels on current national developments and legislation which require to be integrated by NHS Dumfries & Galloway to ensure corporate responsibility is met. Represent Dumfries & Galloway on National and local forums. Maintain in-depth clinical practice by active involvement in and management of complex interagency child protection and adult support and protection cases attending complex, contentious and highly sensitive case conferences, strategy meeting and pre-discharge meetings where complex risk analysis and assessments for a child/children or adult is required.

8 Maintain in depth knowledge of national and international current literature on child protection and adult support and protection, network with national colleagues, peers and academic specialists ensuring e dissemination of evidenced based practice and research evidence throughout NHS Dumfries& Galloway and attend and contribute to National conferences. Actively contribute to the work of the Area Child Protection Committee and Adult Support and Protection Committee, the overarching interagency strategic committee for Dumfries & Galloway Local Authority Area, and NHS Dumfries & Galloway s Health Child Protection Committee. Education and Training Develop a multi-disciplinary training strategy informed by legislation, government guidance and child fatality enquiries, which will meet the training needs of all staff including medical, clinical, managerial and other staff appropriate to their level of involvement and accountability in meeting the needs of vulnerable children and protecting those children at risk of significant harm. Lead, establish and organise a training team, continually organising region wide training schedules ensuring ongoing review and evaluation of the training programme. Design, develop, provide and deliver appropriate evidence based evaluated in house and interagency training programme for all levels of staff across the whole of NHS Dumfries & Galloway e.g. design and implementation of Framework of assessment for children in need training for all Health Visitors and school nurses. Develop and contribute to undergraduate and post graduate curriculum development and lecture at local HEI e.g. writing a module of postgraduate certificate in child protection. Develop and deliver training programmes, underpinned by recognised validating bodies and Codes of Practice to ensure compliance with the Adult Support and Protection (Scotland) Act 2007 and other Protective Legislation. Provide training information data on a regular basis to monitor uptake and staff attendance. Provide specialist professional advice, training and educational guidance in relation to complex Adult, Support and Protection issues. Comment on, propose changes to and contribute to the development and implementation of Adult Support and Protection organisational policy, procedure and strategy, across a multi-agency network. Alert managers at all levels about resource issues which affect learning, development, development and performance. Managerial Responsibility Line manage the Child Protection and Public Protection Team of Adult Support and Protection Advisors and Administrative Assistants. Be responsible for writing KSFs, development reviews, sickness, absence disciplinary and grievance procedures, recruitment and selection and reorganising workload of the Child Protection Team. Manage available finances and budgets as required. Authorise travel expenses and recruit staff as required. Provide supervision to Public Protection Team. Professional Development Maintain in depth knowledge and skills through further postgraduate academic study/other courses as required. Access supervision with Lead Executive Director for Child Protection and Adult Support and Protection and external Nurse Consultant..

9 Attend National Conferences and access research in Child Protection/Adult Support and Protection/MAPPA. Adhere to the NMC code of professional conduct Develop and agree own develop personal development plan with the Lead Executive Director in Child protection/adult Support and Protection. 6. SYSTEMS AND EQUIPMENT The post holder is required to deliver specialist child protection/adult support and protection training from basic awareness to highly specialised and must be able to use electronic equipment for word processing, flipcharts, laptop computers, power point, spreadsheets and databases. Named person for Dumfries & Galloway for the electronic implementation and maintenance of the Scottish Executive National Missing Family Alert system. Responsible for the implementation, development and maintenance of the Child protection database for NHS Dumfries & Galloway and regularly produce reports of child protection activity to the Nurse Director. Responsible for the implementation, development and maintenance of Adult, Support and Protection and MAPPA systems database for NHS Dumfries and Galloway and regularly produce reports of activity to Nurse Director. Responsible for the design of evaluation both quantitative and qualitative for child protection/adult support and protection training evaluation reports using remark scanner. Supporting the development of information sharing and protocols with the Data Protection and Children (Scotland) Act 1995 and Adult, Support and Protection (Scotland) Act 2007 working in collaboration with the Caldicott guardian in highly complex and high profile cases and information sharing in relation to the protection of children. Ensure the accurate management, storage, monitoring and retrieval of client records in accordance with data protection, HMIE Quality indicators and professional standards. Required to use standard office equipment and desk top. Contactable by mobile phone whilst on duty. Required to maintain an up to date knowledge of relevant legislation, including e.g. range of health acts and procedures; public protection and MAPPA legislation and procedures; the care and protection of vulnerable groups, statutory requirements governing record keeping, data protection and confidentiality. Establish and maintain access database for all child protection and adult support and protection policies, procedures and protocols to ensure a controlled system of dissemination and review. Co-ordinate, support and implement action plans from Significant Case Reviews/national enquiries. Develop management systems for all aspects of adult and child protection across NHS Dumfries & Galloway including models of information sharing and case supervision. Prepare reports and reviews of service as indicated. 7. DECISIONS AND JUDGEMENTS Daily requirement for intense concentration over prolonged periods on risk analysis both operationally and strategically. High level of autonomy exercised in making highly complex decisions and judgements regarding risk analysis and information sharing both case specific relating to the needs of a child or adult at risk of abuse and interpreting corporate accountability for risk management and clinical governance.

10 Requirement to interpret and advice on NHS, Scottish Executive, national legislative changes, local, and interagency policy, and strategy regarding the protection of children in order that goals, standards and targets are set for NHS Dumfries & Galloway e.g. Quality Indicators and Framework of Standards Use professional judgment to interpret how national, local policies, protocols and guidelines are to be implemented in the multi- agency decision-making process i.e. information sharing between agencies, domestic abuse guidelines. Act as expert resource for medical, clinical and all other staff across NHS Dumfries & Galloway. In the risk and management of highly complex, contentious and high profile cases maintain objectivity and a clear focus on the welfare of the child and vulnerable adult. Acting without the benefit of precedent in unique situations initiate action taking account of the scope, pace, and immediacy of the action required to safeguard an adult or child who is at risk of abuse. To be responsible for ensuring that at every stage of the child protection and adult support and protection process that a risk assessment is considered with respect to the safety of the child, the adult, the practitioner and the organisation. Performance is reviewed through informal contact and regular meetings with the line manager, appropriate Leads, written reports and participation in the Appraisal and Personal Development Planning process. 8. COMMUNICATIONS AND RELATIONSHIPS Use developed communication skills to provide an analysis of highly complex, sensitive contentious information where considerable barriers may be encountered e.g. differing NHS and interagency thresholds of risk regarding child/children or vulnerable adults.. Use of highest level of communication, motivational and interpersonal skills in challenging, hostile and emotive situations to persuade all parties to work to ensure the safety of a child/children/vulnerable adult. Maintain close working relationships with the Lead Executive for Child Protection, Designated Consultant for Child Protection, and Designated Consultant for Looked After Children, Medical Director/Caldicott Guardian, Child Protection Advisers, Adult Support and Protection (ASP) Advisors, General Managers, Managers at operational and strategic levels and Heads of Clinical Governance in Risk management and Performance and Quality, negotiating and managing change to improve services. Develop and support a team of Child Protection Advisors/ASP Advisors and administration support staff. Develop and maintain an effective collaborative relationship with colleagues in other agencies such as Local authority (including Schools, Social Services), Police, Children s Services and Voluntary Agencies. Negotiate effectively in role of Nurse consultant and lead health representative in complex multi-agency planning meetings e.g. IRD s, Child Protection case Conferences, Pre-discharge Meetings where parents and carers can be involved in a multi-agency setting and analysis of risk to an adult or child is required and highly contentious issues may have to be addressed e.g. preventing the discharge of a child or a discharge to the care of his/her carers, MAPPA meetings. Promote and facilitate working across agencies by encouraging understanding of the roles of other workers and the ethos and culture of other organisations, breaking down of barriers between organisations and removal of constraints to working together. Use highly developed communication skills to present complex, sensitive information to varied audiences and arenas. Public protection is an emotive and stressful area of work and the role involves maintaining ones own emotional resilience to provide effective emotional support to individuals and managers who are working with complex and often distressing cases and situations, and promoting objectivity in effective risk assessment, where there may be a risk of collusion with families or agencies Ensure that all types of personal information are handled in a confidential and secure manner and

11 complies with appropriate national, legal and local standards. Maintain sufficiently accurate and contemporaneous records regarding child abuse and adult support and protection cases, which are acceptable for interagency investigations, significant case review and court. Receive and generate information regarding the development and implementation of policy, clinical guidelines, protocols, redesign and service change relating to adults at risk/ 9. PHYSICAL AND EMOTIONAL DEMANDS OF THE JOB Occasional transportation of training materials and equipment including laptops, projectors and flip charts. Involves considerable time word processing Driving long distances across the Region and Nationally are regularly required. Responding to an unpredictable workload. Frequent interruptions for advice. Frequent requirement for concentration and attention to detail. Responding to competing demands from a wide range of staff across Dumfries and Galloway at all grades from most senior to most junior. High concentration levels in dealing with abuse and neglect cases and reading multiple highly sensitive reports. Working and supporting staff that are dealing with patients with specialist, sensitive and complex needs on a regular basis. Planning and organising own workload, chairing and facilitating meetings and professional fora. Frequent exposure to a variety of extreme emotions, distress and complex long-standing difficulties e.g. domestic abuse, drug and alcohol misuse, and neglect, children and adults at risk. NHS representative on Interagency Significant Case Review panels and practice reviews where practice is challenged within an emotionally difficult and contentious inter-agency arena. 10. MOST CHALLENGING/DIFFICULT PARTS OF THE JOB. To be adaptable and responsive on a daily basis in a constantly unpredictable and emotionally challenging child or adult protection arena where staff need a high level of support mentorship and expert advice. Constant daily exposure to front line child protection issues and crisis management and the undertaking of risk management analysis in safeguarding children in complex high profile and contentious cases. Negotiating within a challenging environment where other agencies criteria and norms may provide difficulties and challenges to the interagency process. Adult and Child Protection is an emotionally challenging area to work and this role involves providing emotional support to individuals at all levels working with complex distressing cases. This role requires the emotional resilience to remain objective, focused on the adult or child s safety and ability to challenge poor practice. Exposure to front line Adult Support and Protection issues and crisis management and the undertaking of risk management analysis in safeguarding adults in complex high profile and contentious cases to MAPPA. Constant requirement for prolonged intense concentration. Short notice participation as lead NHS representative at complex Child or Adult Protection Inter-agency forum e.g. Child Protection case conferences or IRD s. Constant requests for expert advice from all levels in the organisation in complex, contentious cases where risk assessment and analytical skills are required immediately. Implementation of Adverse incident reporting in child protection Writing of significant case reports involving root cause analysis of circumstances which involved a child/adult death or a child/adult left at risk.

KNOWLEDGE, TRAINING AND EXPERIENCE REQUIRED TO DO THE JOB The job requires a clinical qualification and extensive experience of working in the community with Public Protection issues and a qualification at Masters level. 19 Section 5: Main Terms and Conditions of Service Terms and Conditions NHS Dumfries & Galloway The terms and conditions of service are those approved and amended from time to time by the National Agenda for Change Terms and Conditions Agreement CONTRACT: SALARY: Contract details will be contained in the advert Salary Scale will be contained in the advert Entry point in the salary scale is generally at the minimum point. Any appointments above the lowest point of the pay band/range will be subject to verification of previous NHS service or experience outside the NHS, which is given in recognition of relevant complete years of experience. A formal process of approval would need to be completed before confirmation could be provided. Salaries are paid on a monthly basis in arrears by credit transfer on the last Thursday of every month. HOURS OF WORK: The standard hours of all full time staff (Agenda for Change) is hours per week excluding meal breaks. Start and finish times will be determined by the needs of the service. ANNUAL LEAVE: The annual leave year runs from 1 April to 31 March. Annual leave entitlement is as set out in section 13 of the Agenda for Change Terms and Conditions, and outlined below for staff working 37.5 hours per week. An hourly pro-rata calculation will be used for part time staff. For all staff commencing employment during the leave year annual leave will be calculated on a pro rata basis for complete months of service. You are entitled to 8 public holidays as they fall in accordance with your working arrangements, again a pro-rata calculation will be used for part time staff. Length of Service Annual Leave + General Public Holidays On appointment 27 days + 8 days After 5 years service 29 days + 8 days After 10 years service 33 days + 8 days Reckonable service may be credited for annual leave purposes in accordance with the Agenda for Change Agreement. SICK PAY: SUPERANNUATION: Entitlements to Statutory Sick Pay and Occupational Sick Pay will be determined in accordance with the Agenda for Change Agreement. Reckonable service may be credited for Sick Pay purposes providing there has been no break in service of 12 months or more at time of appointment in accordance with the Agenda for Change Agreement. New entrants to NHSD&G who are aged 16 but under 75 will be enrolled automatically into the NHS Pension Scheme. Our Scheme is provided by the Scottish Public Pension Agency (SPPA). All benefits including life insurance and family benefits are explained on the SPPA website

20 Your remuneration is automatically subject to deduction of Superannuation contributions unless you formally notify the Salaries and Wages department that you wish to opt out of the Scheme. Contributions rates will vary from 5.2% to 14.7% depending on pensionable earnings. DECLARATION OF CONVICTIONS: All current or spent criminal convictions, cautions, warnings or any case pending must be disclosed prior to commencing in employment as detailed on the application form. You must tell us about all convictions and cautions regardless of how long ago the offence may have occurred. Convictions from other countries must also be notified. Please note that having a conviction will not automatically disqualify you from securing employment with the Board. Careful consideration will be given to the relevance of the offence to the particular post in question.
