However, information and resources related to funding restrictions for Substance Abuse and Mental Health (SAMH) Services are not limited to the contents of this document. I. SAMH OCA S AND FUNDING GUIDELINES A. RECIPIENTS: N/A AUTHORIZED SERVICES: This OCA is not used for expenditures, revenue, or encumbrances. FUNDING: Funds for this budgetary OCA consists of General Revenue, Tobacco Settlement Trust Funds, Community Mental Health Block Grant (CMHBG), and Temporary Assistance for Needy Families (TANF) Block Grant. This BE/OCA combination has no matching requirement. OCA: MHA70 ME PROJECTS AMH G/A COMM MENTAL HLTH SVS (100610) G/A OUTPATIENT BAKER ACT (100612) COVERED COSTS: Captures allowable costs of adult mental health projects funded by the Legislature in the General Appropriations Act workpapers. RECIPIENTS: Adult with severe and persistent mental illness, with acute crisis episode and with forensic involvement. AUTHORIZED SERVICES: Community based treatment; rehabilitation; supportive services; assistance in acquiring, maintaining, and monitoring needed housing; social support; vocational training; treatment related to symptoms or disabilities associated with mental illnesses, crisis supports, and treatment provided in crisis stabilization units; short term residential treatment programs; mobile crisis services; and outpatient crisis intervention and outreach / referral. 2 OCA: MHA72 ME COMM FORENSIC BEDS AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Allowable costs for community forensic beds. RECIPIENTS: Individuals charged with a felony and found Incompetent to Proceed (ITP) or Not Guilty by Reason of Insanity (NGI) due to their mental illness and committed to the Department of Children and Families under the provision of Chapter 916, Florida Statutes; and individuals charged with a misdemeanor and believed to be at risk of moving further into the criminal justice system due to their mental illness. AUTHORIZED SERVICES: Community based treatment and training services aimed at diverting individuals from the forensic system to the mental health treatment system to reduce commitments to the Department of Children and Families under the provision of Chapter 916, Florida Statutes. Includes, but is not limited to, residential services, mental health courts, and wraparound services / incidentals. Community forensic beds (secure or non secure) and treatment includes, but is not limited to admission, assessment, evaluation, treatment, and individualized services including competency restoration training. Excludes inpatient hospital services licensed under Chapter 395 or state mental health treatment facility. FUNDING: 100% State funded with Unrestricted Cash and has no matching requirement. OCA: MHA73 ME FACT ADMIN AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Salaries and expenses for the operation of the Florida Assertive Community Treatment (FACT) program. Allowable enhancement funding for the Florida Assertive Community Treatment (FACT) program. Providers will maintain records of actual expenditures for these items and repay the Department for any unspent funds. RECIPIENTS: FACT clients AUTHORIZED SERVICES: FACT is used to increase or maintain a person's independence and integration into their community. For example, funding may be used for housing related costs, pharmaceuticals, tangible items needed for employment, or other meaningful activity or specialized treatment not provided by the FACT team (nor paid by any other means). Providers will be paid a fixed amount per client enrolled each month for these items. FUNDING: This BE/OCA combination will be allocated to the Medicaid Administration Grant and the Community Mental Health Block Grant Maintenance of Effort based on the percentage of Medicaid eligible enrollees. The Community Mental Health Block Grant is allocated based on available funds. It is funded through State funds. Tthe Community Mental Health Block Grant and has no matching requirement. 3 OCA: MHA76 ME INDIG PSYCH MED PROG AMH G/A INDIGENT PSYCH MED PRG (101350) COVERED COSTS: The Indigent Psychiatric Drug Program (IDP), including dispending fees for individuals who cannot afford them. RECIPIENTS: Identified contracted providers may use the IDP. AUTHORIZED SERVICES: Assists adults with serious mental illnesses and person's with co occurring substance use problems and mental illness who meet the federal guidelines for an indigent person. IDP may be used to order additional psychotropic medications from the IDP warehouse or a pharmacy of choice (for urgent needs). IDP providers are required to actively participate in Patient Assistance Programs (PAP) for medication offered by pharmaceutical manufacturers. Medications from PAP must be exhausted before use of IDP is permitted. FUNDING: 100% State funded and used to meet the Community Mental Health Block Grant's Maintenance of Effort. No matching. OCA: MHA79 ME CLAY BEHAV CRISIS PREVENT TEAM AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Allowable costs of the Clay Behavioral Health Center Community Crisis Prevention Team, which was appropriated in line 354 of State Fiscal Year General Appropriations Act. RECIPIENTS: Adults with mental illness. AUTHORIZED SERVICES: Operation of the Clay Behavioral Health Center Community Crisis Prevention Team. FUNDING: 100% State funded and used to meet the Community Mental Health Block Grant's Maintenance of Effort. No matching. Updated 6/1/2014, Page 3

4 OCA: MHAJD JAIL DIVERSION AND TRAUMA RECOVERY G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Includes, but is not limited to, implementing the Jail Diversion Programs for the Substance Abuse and Mental Health Services Projects of Regional and National Significance (PRNS) five year grant. RECIPIENTS: Persons, especially Veterans, with mental illnesses in the criminal justice system. AUTHORIZED SERVICES: Administrative and general program costs associated with the Jail Diversion and Trauma Recovers (JDTR) project. Provided to redesign and transform a system of care to ensure ready access to effective services and minimize the unnecessary involvement of people, especially veterans, with mental illnesses in the criminal justice system. FUNDING: This BE/OCA combination is funded through the Substance Abuse and Mental Health Services PRNS Grant. OCA: MHAOP ME OPERATIONAL COSTS AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Operational costs of the Managing Entity, as it relates to the administration of the system of care for Adult Mental Health. RECIPIENTS: N/A AUTHORIZED SERVICES: Operation of the Managing Entity. FUNDING: 100% State funded and used to meet the Community Mental Health Block Grant's Maintenance of Effort. No matching. 5 OCA: MHAPG ME PATH GRANT AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Allowable administrative and general program costs in the Regions / Circuits that are incurred under the Projects for Assistance in Transition from Homelessness (PATH) Grant. RECIPIENTS: Individuals who are suffering from serious mental illness or serious mental illness and substance abuse; and are homeless or at imminent risk of becoming homeless. AUTHORIZED SERVICES: Outreach; Screening and diagnostic treatment; habilitation and rehabilitation; community mental health services; alcohol or drug treatment; staff training, including the training of individuals who work in shelters, mental health clinics, substance abuse programs, and other sites where homeless individuals require services; case management services; assistance in obtaining income support services, including housing assistance, food stamps, and supplemental security income benefits; referral for other appropriate services representative payee services in accordance with Section 1631(a)(2) of the Social Security Act if the eligible homeless individual is receiving aid under Title XVI of such act and if the applicant is designated by the Secretary to provide such services; supportive and supervisory services in residential settings; referrals for primary health services; job training; and educational services. Relevant housing services (subject to Section 522(h)(1); including minor renovation, expansion, and repair of housing, planning of housing, technical assistance in applying for housing and assistance, improving the coordination of housing services; security deposits, matching individuals with appropriate housing situation, and one time rental payments to prevent eviction. FUNDING: Costs associated with this BE/OCA combinations are directly charged to the PATH Grant, and requires a 25% in kind or cash match. OCA: MHASF ME FIXED PAYMENT AMH G/A COMM MENTAL HLTH SVS (100610) COVERED COSTS: Adult Mental Health Fixed Payment for the Managing Entity providers. RECIPIENTS: Managing Entities AUTHORIZED SERVICES: Managing Entity services FUNDING: Once the actual invoice is received a Journal Transfer (JT) will be processed to transfer the expenditures to the appropriate expenditure OCAs. 6 OCA: MHATB ME TANF AMH G/A COMM MENTAL HLTH SVS (100610) G/A CONTRACTED SERVICES (100778) COVERED COSTS: Allowable costs for eligible adult mental health services for Temporary Assistance for Needy Families (TANF) eligible participants. RECIPIENTS: TANF eligible participants. AUTHORIZED SERVICES: To provide interim services for TANF eligible participants who would either be required to wait on a list for treatment, or have no other method of payment. Priority is given to families with child welfare involvement. These non medical services must be in line with the Federal TANF Legislative Goals, TANF Florida State Plan (in accordance with Florida Statute ). Eligible services include; aftercare, assessment, case management, crisis support / emergency, day care, day night, incidental expenses, in home / on site, intensive case management, intervention, outpatient, outreach, prevention, residential levels I through IV, room and board with supervision, supported employment, supported housing / living (nonrent) and Treatment Alternative to Street Crime (TASC). Community Support Services include, but are not limited to, income supports, social supports, housing supports, and vocational supports. FUNDING: TANF is the last payer for services. This BE/OCA combination is funded through the TANF Block Grant and no match is required. OCA: MHC00 ME SVCS & SUP PROV ACTIVITY CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) G/A CONTRACTED SERVICES (100778) G/A CHILDREN'S BAKER ACT (104257) COVERED COSTS: This BE/OCA combination is used for budgetary purposes only. This OCA is not used for expenditures, revenue or encumbrances. 7 OCA: MHC70 ME PROJECTS CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) COVERED COSTS: This BE/OCA combination captures the allowable costs of children's mental health projects funded by the Florida Legislature in the General Appropriations Act workpapers. RECIPIENTS: Children and adolescents with severe emotional disturbance, emotional disturbance, or those at risk of developing emotional disturbance AUTHORIZED SERVICES: Community based services and supports to help children and adolescents remain successfully in the community in the least restrictive setting possible. Authorized services include, but are not limited to, assessment, outpatient treatment, in home or on site community based services and supports that are individualized and developmentally appropriate, as well as crisis support and treatment provided in crisis stabilization units, services from mobile crisis, outpatient crisis intervention and outreach / referral. FUNDING: 100% State funded and has no matching requirement. OCA: MHC71 PRTS FOR EMOT. DISTURB CHILDREN/YOUTH CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A PRTS EMO DIS CHI/YOUTH (102780) COVERED COSTS: This BE/OCA combination captures the state funded portion of expenditures for residential care service active, under Title XIX Medicaid, related to the Purchase of Residential Treatment Services (PRTS) for emotionally disturbed children and youth. RECIPIENTS: Emotionally disturbed children and youth AUTHORIZED SERVICES: Various residential treatment center providers, throughout the State, serve children with serious emotional disturbances with Level I services. Level I services are the most intensive and restrictive level of residential therapeutic intervention. FUNDING: This BE/OCA combination is 100% State funded and has no matching requirement. This OCA records the transfer of the state's matching share of expenditures to the Agency for Health Care Administration (AHCA). The Payment process is as follows: 1. The residential treatment center providers will submit claims to the AHCA for processing and payment. 2. A monthly request for a journal transfer is prepared by AHCA and submitted to the Department of Children and Families (DCF) for the state matching share of expenditures. AHCA will draw the applicable federal earnings via separate report to the federal government. 3. The DCF program office will review and approve AHCA's journal transfer request for the state portion of the costs and transmit the approval to the Financial Support Office for the appropriate transfer of funds to AHCA. 8 OCA: MHCBN ME BNET CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) COVERED COSTS: This BE/OCA combination captures the allowable Behavioral Health Network expenditures for the services provided under the Florida Statewide Child Health Insurance Program that will assist children and their families to live successfully in the community. RECIPIENTS: Children and their families AUTHORIZED SERVICES: These services include, but are not limited to, supported housing, supported living, crisis support and treatment provided in crisis stabilization units and inpatient facilities. These services provide immediate support to children with a serious emotional disturbance in acute emotional distress. These services enable children with serious emotional disturbance to live in a stable setting, function appropriately, attend school and stay out of the Juvenile Justice System. In accordance with an interagency agreement with the Department of Health (DOH), the Department of Children and Families (DCF) is authorized to establish the scope of behavioral health services, clinical guidelines for referral, service standards, performance based measures and practice guidelines. To deliver the services, DCF will create a Behavioral Health Specialty Network comprised of member providers throughout the state. FUNDING: Reimbursed 100% by the Agency for Health Care Administration (AHCA); therefore, no match is required. OCA: MHCFA ME MIAMI DADE WRAPAROUND FACES STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CONTRACTED SERVICES (100778) COVERED COSTS: Allowable administrative and general program costs in the Regions/Circuits associated with the "Miami Dade Wraparound Project" (MDWP), better known as FACES (Families and Communities Empowered for Success) for the managing entity. Costs include, but are not limited to implementing the MDWP for the Substance Abuse and Mental Health Services Projects of Regional and National Significance (PRNS) four year Grant. RECIPIENTS: Children who have serious emotional disturbances (SED) and their families or caretakers in Miami Dade County, Florida. AUTHORIZED SERVICES: MDWP is a collaborative effort to enhance, expand and strengthen the existing communitybased family and youth mental health services in Miami Dade County, in order to better serve children who have serious emotional disturbances (SED) and their families or caretakers in Miami Dade County, Florida. FUNDING: This BE/OCA combination is funded through the Substance Abuse and Mental Health Services PRNS Grant and the match of 49.37% is being certified by the local providers. 9 OCA: MHCMD ME MIAMI DADE WRAPAROUND GRANT CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) G/A CONTRACTED SERVICES (100777) COVERED COSTS: Allowable administrative and general program costs in the Regions/Circuits associated with the "Miami Dade Wraparound Project" (MDWP), which include, but are not limited to implementing the MDWP for the Comprehensive Community Mental Health Services for Children with SED six year grant. RECIPIENTS: Children with SED. AUTHORIZED SERVICES: MDWP is a collaborative effort to enhance, expand, and strengthen the existing communitybased family and youth mental health services in Miami Dade County, in order to better serve adolescents who have serious emotional disturbance (SED) and a co occurring substance diagnosis and their families or caretakers in Miami Dade County, Florida. FUNDING: This BE/OCA combination is funded through the Comprehensive Community Mental Health Services for Children with SED Grant and the match of 76.13% is being certified by the local providers. OCA: MHCOP ME OPERATIONAL COSTS CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) COVERED COSTS: This BE/OCA combination captures the allowable operational costs of the Managing Entity, as it relates to the administration of the system of care for Children's Mental Health. RECIPIENTS: N/A AUTHORIZED SERVICES: Managing Entity services FUNDING: This BE/OCA combination is funded 100% with state general revenue funds, is limited to what is provided in the contract, and has no matching requirement. RECIPIENTS: Young children from birth to 8 AUTHORIZED SERVICES: These services address the gaps in existing prevention and targeted intervention services and strengthen the partnership between state and local agencies serving young children and their families. The Florida (FL) LAUNCH Project enhances the partnership between the Department of Children and Families (DCF), Department of Health (DOH), and service providers in Pinellas County, FL. The project is aimed at preventing youth substance use and mental, emotional and behavioral disorders by improving family function and the quality of the parent child relationship through parenting training and skill building and selective intervention for young children. FUNDING: This BE/OCA combination is funded through the Substance Abuse and Mental Health Services PRNS Grant and has no matching requirement. OCA: MHCSF ME FIXED PAYMENT CMH STATE PROGRAM: CHILD/COMM/MENTAL/HEALTH ( ) G/A CHILD MENTAL HEALTH SV (100435) COVERED COSTS: This BE/OCA combination captures the Children's Mental Health Fixed Payment for the Managing Entity providers. 12 OCA: MSA81 ME EXP OF SA SVCS FOR PREG WOM & THEIR FAM ASA STATE PROGRAM: ADULT SUBSTANCE ABUSE ( ) G/A COM SUB ABUSE SVCS (100618) COVERED COSTS: This BE/OCA combination captures the allowable costs associated with the expansion of substance abuse services for pregnant women and their affected families, which was appropriated in line 375 of the State Fiscal Year General Appropriation Act. RECIPIENTS: Pregnant women and their affected families. AUTHORIZED SERVICES: Provided for the expansion of substance abuse services for pregnant women and their affected families. These services shall include the expansion of residential treatment, outpatient treatment with housing support, and post partum case management supporting both the mother and child consistent with recommendations from the Statewide Task Force on Prescription Drug Abuse and Newborns made in the February, 2013 report. Priority for services shall be given to counties with greatest need and available treatment. FUNDING: These are nonrecurring funds from the General Revenue fund. This BE/OCA combination has no matching requirement. Costs associated with this BE/OCA combination are directly charged to the Substance Abuse Prevention and Treatment (SAPTBG) Block Grant Maintenance of Effort (MOE). OCA: MSA82 ME ST JOHNS SHERRIFF S OFFICE ASA STATE PROGRAM: ADULT SUBSTANCE ABUSE ( ) G/A COM SUB ABUSE SVCS (100618) COVERED COSTS: This BE/OCA combination captures the allowable costs associated with the St. Johns Sheriff's Office which was appropriated in line 375 of the State Fiscal Year General Appropriations Act. RECIPIENTS: Adults. AUTHORIZED SERVICES: St. John's Sheriff's Office substance abuse detoxification program. FUNDING: These are nonrecurring funds from the General Revenue fund. This BE/OCA combination is funded with state funds. AUTHORIZED SERVICES: The purpose is to provide interim services for TANF eligible participants who would either be required to wait on a list for treatment, or have no other method of payment. This is to be used to give priority to families with child welfare involvement. These non medical services must be in line with the Federal TANF Legislative Goals, Florida TANF State Plan (in accordance with Florida Statute ), and must be for TANF eligible consumers. Eligible services include; aftercare, assessment, case management, crisis support / emergency, day care, day night, incidental expenses, in home / on site, intensive case management, intervention, outpatient, outreach, prevention, residential levels I through IV, room and board with supervision, supported employment, supported housing /living (non rent) and Treatment Alternative to Street Crime (TASC). Community Support Services include, but are not limited to, income supports, social supports, housing supports and vocational supports. FUNDING: TANF is the last payer for services. 16 II.SAPT BLOCK GRANT NOT FOR PROFIT/FOR PROFIT SAPT BLOCK GRANT FINANCIAL ASSISTANCE (SUBGRANT) TO PUBLIC OR NON PROFIT ENTITY: SAPT (CFDA ) Compliance Requirement for Activities Allowed or Unallowed: Grants funds may not be used to provide financial assistance (i.e., a subgrant) to any entity other than a public or non profit entity. A State is not precluded from entering into a contract for services, since payments under such a contract are not financial assistance to the contractor (42 USC 300x 31(a); 45 CFR section (a) (5)). The OMB Circular No. A 133 Audit of States, Local Governments, and Non Profit Organizations provides guidance in determining whether payments constitute a Federal award (financial assistance) or a payment for goods and services. In Section 210 Subrecipient and vendor determinations, paragraphs (b) and (c) are the core to in determining what constitutes a Federal award (financial assistance) or a payment for goods and services. (b) Federal award. Characteristics indicative of Federal award (financial assistance) received by a subrecipient (sub contractor) are when the organization (provider): (1) Determines who is eligible to receive what Federal financial assistance; (determines eligibility of clients) (2) Has its performance measured against whether the objectives of the Federal program are met; (performance measures in the sub contract, enters data in DCF data system for accountability) (3) Has responsibility for programmatic decision making; (4) Has responsibility for adherence to applicable Federal program compliance requirements: (5) Uses the Federal funds to carry out a program of the program compliance as compared to providing goods or services for the program. (program compliance = a subcontract for SAMH units of service) (c) Payment for goods and services. Characteristics indicative of a payment for goods and services received by a vender (sub contractor can be for profit) are when the organization (provider): (1) Provides the goods and services within normal business operations (2) Provides similar goods or services to many different purchasers; (3)Operates in a competitive environment; (4)Provides goods and services that are ancillary to the operation of the program; (5) Is not subject to compliance requirements of the federal program. In Conclusion: Once DCF has contracted SAPT Block Grant Funds to a non for profit provider and the non for profit provider is asking for approval to sub contract the SAPT Block Grant Funds. You would need to determine if paragraph (b) or (c) above apply to the sub contract. SAPT BLOCK GRANT SERVICE REQUIREMENTS SUBSTANCE ABUSE PREVENTION AND TREATMENT BLOCK GRANT REQUIREMENTS: Organizations who are contracted with DCF for substance abuse prevention and treatment services and are funded in whole or part with Substance Abuse Prevention and Treatment (SAPT) Block Grant funds are required to comply with subparts I and II of Part B of Title XIX of the Public Health Service Act, sections 42 U.S.C. 300x 21 et seq and with all applicable sections of the Health and Human Services (HHS) Block Grant regulations (45 CFR Part ). The following Other Cost Accumulators (OCAs) are designated for funds set aside from SAPT Block Grant for SAPT Block Grant listed prevention and treatment services: PREVENTION SERVICES Prevention Services Pregnant Women and Women with Dependent Children Services HIV Early Intervention Services Interim Services Outreach Services MSA25, MSC25 MSA27 MSA23, MSC23 OCA code MSC25 for Children s Substance Abuse Prevention Services OCA code MSA25 for Adult Substance Abuse Prevention Services MSAOP, MSA00, MSCOP, MSC00 MSAOP, MSA00, MSCOP, MSC00 Prevention services are defined as programs for individuals who do not require treatment for substance abuse and, which educate and counsel participants and community leaders on strategies and activities to prevent and reduce substance use and abuse. In carrying out prevention programs, priority will be given to those populations that are at risk of developing a pattern of substance abuse. The organization shall carryout community based strategies for prevention of substance abuse, including strategies to discourage the use of alcohol and tobacco products by minors. The six SAPT defined strategies are; Information Dissemination, Education, Alternative strategies, Problem Identification & Referral, Community Based Processes, and Environmental strategies. (See DCF Pamphlet for the definitions of the six strategies.) When reporting service event data refer to the DCF Pamphlet for cost center, procedure code, and modifier information and instructions. SERVICES FOR PREGNANT WOMEN AND WOMEN WITH DEPENDENT CHILDREN OCA code MSA27 Funds are allocated to support substance abuse treatment services that are designed for pregnant women and women with dependent children as per 45 CFR and This requirement includes women who are attempting to regain custody of their children. Organizations funded to provide such programs will treat the family as a unit and therefore will admit both women and their children into treatment services, if appropriate. When billing for services for women placed in such programs refer to DCF Pamphlet for cost center, procedure code, and modifier information and instructions. In addition, the organization must provide, or arrange for, the following services (when such services are directly paid for or furnished by the organization, the organization must report such service events using the cost center and procedure codes as specified in DCF Pamphlet for service event definitions). Primary Medical Care for women, including Prenatal Care Primary Pediatric Care for the children, including Immunizations Care Updated 6/1/2014, Page 17

18 Gender specific substance abuse treatment and other therapeutic services, which may address issues of relationships, parenting, sexual and physical abuse and parenting care. Therapeutic interventions for the children in custody of the women who are in treatment which may, among other things, address their developmental needs and issues of sexual and physical abuse and neglect care. To help assure access to the above services, the provider will also provide, or arrange for, as necessary: Case management services Transportation services Childcare services Additional requirements: 1. Providers must assure that funds used for the health care services above are used as the payment of last resort. 2. Pregnant women shall be given preference for admission to treatment facilities. 3. If an admission cannot be made within 48 hours then Interim Services must be made available until such time as treatment becomes available. 4. The availability of treatment services for pregnant women must be publicized by the provider either through public service announcements, information dissemination or other outreach efforts. HIV EARLY INTERVENTION SERVICES OCA code MSA23 for Adult Substance Abuse Treatment Services OCA code MSC23 for Children Substance Abuse Treatment Services Refer to F.A.C. 65E 14 and DCF Pamphlet for cost center definition and service definition respectively. Fund are allocated to support HIV Early Intervention Services as per 45 CFR Organizations funded to provide such services are required to establish linkages with comprehensive community resource networks of related health and social service organizations. The organization shall make available these services at the sites at which the individuals are undergoing treatment for substance abuse. Appropriate pretest counseling for HIV and AIDS Testing individuals with respect to such disease, including tests to confirm the presence of the disease, tests to diagnose the extent of the deficiency in the immune system, and tests to provide information on appropriate therapeutic measures for preventing and treating the deterioration of the immune system and for preventing and treating conditions arising from the disease Appropriate post test counseling Providing the therapeutic measures for preventing and treating the deterioration of the immune system and for preventing and treating conditions arising from the disease When billing for HIV services refer to DCF Pamphlet for cost center, procedure code, and modifier information and instructions. INTERIM SERVICES OCA MSA27, MSA23, MSC23, MSAOP, MSA00, MSCOP, MSC00 Interim services are required to be provided to pregnant women and injection drug users when treatment services cannot be made available within the times required (see Preference for Admissions to Treatment below). 45 CFR Updated 6/1/2014, Page 18

19 defines interim services as services that are provided while an individual is waiting to be admitted to treatment. At a minimum, interim services include the following: HIV/TB screening, counseling and referral for treatment. Education about the risks of needle sharing. Education about the risks of transmission to sexual partners and infants. Steps that can be taken to ensure that HIV and TB transmission does not occur. When billing for the above services refer to DCF Pamphlet for cost center, procedure code, and modifier information and instructions. OUTREACH TO INTRAVENOUS DRUG USERS OCA Code MSA22, MSC22 Refer to F.A.C. 65E 14 and DCF Pamphlet of for cost center definition and service definition respectively. 45 CFR requires providers that treat intravenous drug users to provide outreach to encourage intravenous drug users to undergo treatment. Organizations providing outreach services must comply with the following: Have written procedures for the selection, training and supervision of outreach workers; Procedures and methods for contact and follow up with high risk abusers, their associates and neighborhood residents; Provide educational materials that promote awareness about the relationship between injecting drug use and communicable diseases (HIV); Employ strategies to prevent HIV transmission among substance abusers and to encourage the entry of intravenous drug users into treatment. When billing for the above services refer to DCF Pamphlet for cost center, procedure code, and modifier information and instructions. PREFERENCE FOR ADMISSION TO TREATMENT 45 CFR and requires the organization to give preference for admission to treatment to pregnant women and injection drug users. Programs serving pregnant women and injecting drug users shall be given preference for treatment admission in the following order: Pregnant women, with women who are injecting drugs given first priority, must be admitted within 48 hours. If no service is available either at the provider s program or at another program in the geographic area, the contractor must notify the State Region DCF/SAMH office. If a treatment placement cannot be made, the pregnant woman must be provided with Interim Services as defined above to include a referral for prenatal care; Injecting drug users must be admitted within 14 days or, if no services are available, must be provided with Interim Services, as defined above. Pregnant and intravenous drug users who are receiving interim services while waiting for a treatment opening shall be given priority for admission as openings become available. In no event shall the waiting period for treatment exceed 120 days. Updated 6/1/2014, Page 19

20 OTHER REQUIREMENTS Per 45 CFR organizations are prohibited from expending funds allocated under this contract to provide individuals with hypodermic needles or syringes and to comply with all restrictions concerning expenditure of grant monies as provided by law. Funds under this grant may be used to support substance abuse treatment services for individuals with a cooccurring mental disorder as long as the funds allocated are used to support substance abuse prevention and treatment services and can be tracked for accounting purposes to the specific substance abuse activity. Organizations receiving funds under this grant are required to participate in the State s Peer Review process to assess the quality, appropriateness, and efficacy of treatment services provided to individuals under this contract. 45 CFR requires providers of substance abuse treatment services to make available, either directly or by arrangement with others, tuberculosis services to include counseling, testing and referral for evaluation and treatment. All substance abuse activities supported by this grant are subject to audit and monitoring for compliance with the requirements contained in 45 CFR Part 96. Reimbursement for SAPT Block Grant Services will be made based on the units of service provided under the eligible cost centers. Actual service events must be able to be reconciled to contract reimbursements at the end of the contract year.
