Document Definition 1.2 Purpose Rationale A uniform or dress code for those in uniform and not in uniform provides a means of easy identification and allows the wearer to project an image which will inspire public confidence in the trust. Principles This policy sets out the expectations of the Trust in relation to corporate dress code. The policy forms part of the terms and conditions of employment not just for those for whom a uniform is supplied. 1.3 Scope The guidelines set out in this document apply to all employees of East Sussex NHS Trust, and other workers including agency staff, contractors, work experience students and volunteers. Particular reference is made to individuals issued with uniforms and/or protective clothing. Some areas in the Trust, for example Theatres, Intensive Care, High Dependency Unit and Special Care Baby Unit wear specific clothing and as such Nurse Managers will be required to formulate a local uniform policy that supports this code. Any other exemptions must be discussed first with the Director of Nursing & Midwifery or her Deputy in her absence 1.4 Equality Impact Statement East Sussex Healthcare NHS Trust aims to design and implement services, policies and measures that meet the diverse needs of its service, population and workforce, ensuring that none are placed at a disadvantage over others. An Equality and Human Rights Assessment (EHRA) has been completed to identify Equality and Human Rights issues that impact on staff related to in this policy. 2. Policy Details 2.1 Introduction This document defines a dress code and minimum standards of appearance which are required by the Trust to portray a professional and corporate image to all, whether they are patients, visitors, clients or colleagues. The Trust also recognises that managers may need to adopt standards of dress code, which are specific to the department or area of work. Page 4 of 28

6 All employees and volunteers of East Sussex Healthcare NHS Trust are, at all times whilst performing their duties, in the public eye and therefore representatives of the Trust. 3. Diversity East Sussex Healthcare NHS Trust recognises diversity within the work place; however individuals should present a professional image whilst at work. No individual will be discriminated against in furtherance of this code, on the grounds of gender, ethnicity, religious beliefs, age or disability in line with the Respecting Individual Differences, The Management of Equality, and Diversity and Human Rights Policy. The sincere wearing of manifestation of religious belief through symbols, clothing or articles intrinsic to that belief is welcomed by the Trust. An individual s right to wear or manifest that symbol will only be restricted if there is a proper legal basis; if it is necessary (not just reasonable) and pursues one of the following aims; public safety, the protection of public order, health or morals; or the protections of the human rights and freedoms of others. Restricting the wearing or manifestation of a religious symbol or article will be decided between an individual and their line manager; and will only be permissible if there is a pressing and well-founded reason, considering the essential duties and functions of the individuals role. Any restrictions agreed should not be more that is absolutely needed (and could include the provision of alternative uniform items) and should be agreed at the earliest possible opportunity e.g. before a student placement begins. Turbans, kippot s, veils and headscarves are examples of possible manifestations of belief. The latter should be shoulder length and must be worn unadorned and secured neatly. Symbols and jewellery such as a crucifix are permissible provided that the guidelines above are adhered to. Clothing that is necessary to overcome substantial disadvantage linked with a disability (e.g. head covering to overcome an individual s embarrassment as a result of hair loss due to cancer treatment) will be agreed between the staff member and their line manager or another appropriate person to suit their individual need and the requirement s of their role at the earliest appropriate opportunity. If the line manager has any concerns about these adjustments, they must discuss these with the HR Department. Pregnant female members of staff will not be treated unfavourably through the operation of this policy. Allowances for maternity wear will be interpreted in line within this policy as far as reasonably possible. Page 5 of 28

7 Transgender/ gender fluid/ gender nonconforming staff will be allowed flexibility in the application of this policy to accommodate the process of transition from one gender role to another. Temporary redeployment related to appearance will be considered at the individual Trans staff member s request. Appendix A - Due Regard, Equality & Human Rights Analysis 4. Objective The overall objective is to ensure that through dress and personal appearance, employees/workers are able to maintain a professional image and inspire confidence as well as providing a safe, healthy and hygienic environment. This code sets a unified standard across the organisation, and will assist the patient, family, carer or the public to recognise the role an individual plays in the Trust. 5. Responsibility Managers are responsible for ensuring the code is adhered to in respect of themselves and the employees they manage. It is recognised that issues relating to clothing, personal hygiene and personal presentation may be sensitive. It is the responsibility of managers to counsel individuals in the first instance where the code is not upheld. All employees/workers have a duty to ensure that the provisions of this code are met. It is the responsibility of the employee/worker/volunteer to adhere to this policy. In cases where the policy is abused, or where counselling has been unsuccessful, an investigation will be instigated and disciplinary action may be considered in accordance with the Trust Disciplinary Procedure. 6. Clothing and Uniform 6.1 Staff who wear a uniform Colour and style of uniform will be specified in accordance with corporate and professional identity. See Appendix B Currently Approved Dress Code for Staff Groups Uniforms are not considered personal protective equipment (PPE). PPE is worn in addition to uniforms if contamination is anticipated. ITEM STANDARD Shoes and bags Low heeled, enclosed, covering the toes and heels and offering support to the feet no higher than 5 cm Black/navy blue Soles should be of a material that reduces noise e.g. rubber and non-slip Page 6 of 28

8 Specialist foot wear Shoes must be of wipeable material suitable to be decontaminated if splashed with blood or body fluids in line with the Trust decontamination policy Croc shoes or Trainers must not be worn in general wards, units and departments unless there is a medical reason that is supported by a letter from the Occupational Health Department (refer to section below for permitted areas) or required as part of the role e.g. Allied Health Any form of bags, this includes those containing personal belongings, should be removed before seeing patients within the clinical area and kept in a safe place (i.e. locker or locked room) Specialist footwear is permitted in certain areas i.e. Theatres, ICU, SCBU, Delivery Suite, Stores, Mortuary and A&E. If crocs are worn in these specialist areas, the top of the foot must be fully enclosed and back straps must be worn around the heel (i.e. not with holes) Specialist footwear must not be worn outside the hospital Nails Fingernails must be kept clean and short, without nail polish or decoration. False nails and nail extensions must not be worn. Hands Hands must not be written on (e.g. bleep numbers) Compliance with bare below the elbow Hair Hair must be neat, tidy, clean and well groomed. Hair longer than shoulder length must be secured away from the face and collar and must not be arranged in a way that falls forward when attending to patients Hair must be covered as appropriate in specific areas e.g. Theatres; hats must be latex free Hair to be within natural colour range ( no primary colours or purples) Tattoos As far as possible tattoos should be covered Tattoos considered offensive ( as agreed by the Director of Nursing /Chief Exec) must be covered at the individuals expense Staff planning to get a tattoo should give consideration to content and position e.g. not below the elbow Make-Up False eye lashes must not be worn Make up should be discrete Fragrances and colognes should not be excessive Jewellery One finger ring - yellow/white metal band (no stones) No wristwatches permitted No bracelets/bangles/decorative wristbands One pair of stud earrings (no stones and flesh holders should be removed) Only a clear retainer should be used for visible facial and body piercing except in the case of arm piercing where bare below the elbows will apply and should be removed entirely No neck chains visible (excluding SOS necklace) Page 7 of 28

9 Tights/ stockings/ socks Maternity Uniform Cardigans/ Jackets Trust Identification Plain, dark socks with trousers Tights must be worn at all times with uniform dress and must be of black or neutral colour. In the event of a heatwave bare legs may be worn Standard uniform will be supplied to all pregnant staff upon request. This applies only to staff who normally wear a uniform. The uniforms are to be returned laundered to the sewing room before taking maternity leave. Black or dark blue, but these must not be worn when delivering patient care Other colours may be worn if provided as part of the uniform Identification must be worn at all times for security reasons. A Lanyard is the East Sussex Healthcare Trust specific coloured ribbon with job role identifiable for front line staff with safety clasp that is worn around the neck and visible to all service users. Lanyards must be secured when providing care and undertaking clinical duties It is essential that staff remove ESHT lanyard/badge and any other attire that associates them with ESHT when off site unless required within your role e.g. domiciliary visits 6.2 Staff NOT wearing uniform who work in a clinical area and/or role This applies to all staff that will be required to see patients and/or visit the clinical areas as part of their daily duties. Employees who are not required to wear a uniform must ensure that clothing and appearance is in keeping with the corporate image, to protect both themselves from a Health and Safety perspective as well as the reputation of the Trust. 11 6.3 Staff working in a non-clinical environment and do NOT wear a uniform This applies to non-clinical staff with no direct patient contact as part of their normal working day e.g. Trust management, medical records. It is an expectation that staff not required to wear uniform ensure that their clothing and appearance is in keeping with the corporate image. Employees who do not have direct patient contact should exercise care and discretion when wearing jewellery and accessories, with regard to Health and Safety at Work, and public image. Item Standard Shoes Should be appropriate to the environment and role Backless shoes and flip-flops are not appropriate and must not be worn unless medically approved Clothing Mini-skirts, shorts, jeans, revealing clothing or clothing bearing inappropriate slogans are not acceptable and must not be worn Neck ties and scarves should be removed when entering a clinical area Tailored shorts may be worn Thin straps on tops or tops that show you midriff are not appropriate and may not be worn Skirts should sit no more that 5cm above the knee. Maxi dresses are not permitted to prevent trips. 12 6.4 Study Days It is acknowledged that many members of staff attend these in their own time; however, as representatives of the Trust there is an expectation that staff attending in-house and external study days will maintain a professional image. 6.5 General Information regarding clothing and uniform To minimise the risk of cross infection, clothing worn during direct patient contact should only be worn outside the workplace where employees are required to work off site, or when travelling directly to and from home. It is the employee/workers responsibility to ensure that patients and the general public are not put at risk of infection, through the wearing of uniforms in public places. Entering commercial premises in uniform/protective clothing is unacceptable. Uniforms issued to employees remain the property of East Sussex NHS Trust and should be returned upon leaving the Trust. Individuals should take reasonable steps to ensure that uniforms are presentable and in a good condition. Where uniform and/or protective clothing is issued, it should be worn as directed in all clinical areas. Uniforms provided by the Trust should not be worn when not working for the Trust i.e. as an agency locum member of staff. Decorative buckles/belts must not be worn when involved in direct patient contact. 6.6 Additional Theatre staff dress code When leaving the theatre environment /department all staff wearing theatre scrubs are required to remove hats and masks and wear a disposable full length overcoat, unless it is a clinical emergency. Fresh clean attire should be donned on return to theatre. Used theatre attire should not be stored in lockers for further use. Theatre attire must not be worn outside of the hospital environment. Theatre staff should wear well-fitted dedicated operating theatre footwear must be comfortable with non-slip anti-static properties and have enclosed toecaps. The footwear should be cleaned/decontaminated on a regular basis, particularly when visibly dirty or when contaminated with blood or body fluids. Each theatre suite manager should ensure that local procedures are in place for these procedures to take place. The use of over shoes is not permitted for infection control reasons. Within the operating theatre, hair must be entirely covered with a clean, disposable hat or head covering, which should be changed at least daily, or on leaving the theatre suite. Staff wearing a turban must have it covered with a clean, disposable hat or head covering. Hats or head coverings should be changed if they become contaminated with blood or body fluids. It is recommended that beards are covered with a hood. Page 11 of 28

13 7. Personal hygiene Uniforms must be regularly laundered and clean and all staff must be clean, presentable and well groomed when at work. 8. Protective clothing/shoes In accordance with Health and Safety legislation, staff should wear personal protective equipment (PPE) where applicable, at all times, in accordance with the Trust Policy & Procedure for Standard/Universal Precautions for the Prevention of Infection. Reference should be made to the Latex Policy for guidance on the use of protective gloves. Employees (including Bank and Agency staff) have a responsibility to follow Health and Safety Guidelines, if they do not they could be subject to disciplinary action in line with the Trust s Disciplinary Procedure. 9. Laundering of Uniforms Laundering uniforms at home (excluding Theatre scrubs) is acceptable providing they are laundered separately from other clothing and at the highest temperature the fabric will withstand. Arrangements should be made for grossly contaminated uniforms to be laundered in the Central Laundry. Appendix C Guidelines for Home Laundering (RCN 1999) 10. Integration This procedure complies with the following statutory requirements; Sex Discrimination Act (1975), Race Relations Act (1975), Disability Discrimination Act (1995), Employment Relations Act (1996), Human Rights Act (1998) Part Time Workers legislation (2000), 11. Compliance with Code Staff must comply with the code and exceptions must be agreed with line managers, both operational and professional. If a member of staff does not comply, then the disciplinary policy will be introduced at this stage. 14 Any staff arriving to work not adhering to the dress code will be asked to leave. This will result in no payment for the shift. That agency staffs who fail to conform to the dress code on two occasions will not be permitted to work for ESHT, 12. Audit This code will be subject to a Matron Audit and the results will be reported within the appropriate Clinical Division. Any Trust staff not adhering to Trust policy will be challenged and reported to their line manager. (Appendix D) Page 13 of 28

28 Appendix C Guidelines for Home Laundering (RCN 1999) GUIDELINES FOR HOME LAUNDERING (RCN 1999) RATIONALE: To reduce the risk of bacterial contamination and to ensure the effective reduction of pathogens to a safe level through thermal disinfection of uniforms that have not been washed by the hospital laundry. Uniforms should be washed in a washing machine separate from other items The wash temperature must be at the highest temperature suitable for the fabric with a contact time of 10 minutes The uniform must be either tumble dried or ironed at the hottest temperature the garment can withstand The laundered uniform should be stored carefully to prevent contamination with other pollutants.
