3 Round Table Discussion Topics TABLE ONE If You Have a Phone, You Have a Camera (use of photography in healthcare) Discussion of the HIPAA, CMS and TJC requirements for the use of photography and how they apply to patient care and clinical situations. Host: Jacqueline Spielman, JD, RN, CPHRM, Director of Risk Management, MedStar Franklin Square Medical Center As a Risk Manager for many years, both as an employee in teaching hospitals, as well as in a consultant role, Ms. Spielman has prepared and presented many inservices to physicians, nurses and other staff. For five years, she was an Assistant Professor of Law in a paralegal department of a local college. She has also been a guest lecturer for nursing classes on topics related to legal and ethical issues in nursing and has published articles in local trade newspapers and nursing magazines. The use of photography in the clinical setting is of particular interest to Ms. Spielman, and she researched and wrote a policy related to the use of photography at MedStar Franklin Square Medical Center. TABLE TWO Just Sign on the Dotted Line (informed consent issues) We will discuss best practices for documentation of informed consent, and the requirements under Maryland law for an informed consent claim. We will also discuss recent case law regarding informed consent. Host: Damien Banks, Esq., Baxter, Baker, Sidle, Conn & Jones, P.A. Damien Banks is a litigation attorney with a special emphasis in medical malpractice and professional liability. Mr. Banks has obtained numerous defense verdicts in bench and jury trials as a first chair attorney in courts throughout Maryland and the District of Columbia. Mr. Banks lectures to health professionals across the State of Maryland on current legal issues such as informed consent and risk management. He represents a variety of health care related entities including physicians, hospitals, oral surgeons, and acute and long term care facilities. He also represents health care professionals in administrative actions related to their licensure. Mr. Banks is a member of the Maryland State Bar Association, Maryland Defense Counsel, and the MD-DC Society of Healthcare Risk Management.

4 TABLE THREE Yikes! Another Psych Patient?? (Behavioral health patients in non-behavioral health settings) The presenters will focus on three risk mitigation strategies to safely manage the behavioral health patient in acute care settings: assessment/documentation, staff competencies, and BH resources. Hosts: Monica Cooke, MA, RNC, CPHQ, CPHRM, FASHRM / CEO, Quality Plus Solutions LLC Ms. Cooke has more than 35 years of experience in the field of behavioral health and substance abuse. For the past 14 years, her passion has been to assist organizations with risk management and patient safety initiatives. She is the founder of Quality Plus Solutions LLC, a behavioral health risk and quality management consulting firm that provides risk assessments throughout the nation. She also provides legal nurse expert services. As a Certified Psychiatric/Mental Health Nurse, Monica also continues to practice part time as an RN in a detox and rehab treatment setting. Ms. Cooke is the author of the Behavioral Health Risk Chapter in the Health Care Organization Risk Management: Forms, Checklists, & Guidelines. She provides frequent seminars and webinars and is recognized as a national speaker having presented multiple times at ASHRM conferences and the National Association for Healthcare Quality. Nancy Connelly, RN, CPHRM, Risk Management Consultant, RCM&D Ms. Connelly has 20 years experience in healthcare risk management and is a Certified Professional in Healthcare Risk Management (CPHRM). Her clinical and administrative experience as a registered nurse is varied, with a strong concentration in perinatal nursing. At RCM&D, Ms. Connelly works with risk management and patient safety staff at client facilities, performing risk assessments, providing guidance and presenting risk management educational programs. Ms. Connelly is a member of ASHRM, VASHRM and MD-DC SHRM, the Association of Women s Health, Obstetric and Neonatal Nurses (AWHONN) and the Loudoun County (Virginia) Medical Reserve Corps. She currently serves as Editor for the ASHRM Journal of Healthcare Risk Management. TABLE FOUR The Dog Ate My Prescription (risk management strategies for dealing with drug-seeking patients) Emergency departments are frequently challenged with patients exhibiting drug seeking behavior. The presenter is a practicing emergency medicine physician who will share tips for identifying drug seeking patients, and offer sound risk management strategies for staff. Host: Neel Vibhakar, MD, FACEP, Chairman of the Emergency Department at University of Maryland Baltimore Washington Medical Center (UM-BWMC) Dr. Vibhakar is Chairman of the Emergency Department at UM-BWMC, the second busiest ED in the state with approximately 104,000 patients per year. After completing an emergency medicine residency at Johns Hopkins University, Dr. Vibhakar joined Baltimore Washington Emergency Physicians at UM-BWMC in He was the Assistant Medical Director from and has been Chairman of the department for the past 5 years. He is President-Elect to the Medical Staff at UM-BWMC and chairs the Credentialing Committee in that capacity. He also chairs the ED Peer Review Committee and hospital wide Patient Flow Task Force, co-chairs the University of Maryland Medical System Emergency Medicine Risk Management Forum, is on the Board of Directors for Maryland American College of Emergency Physicians (MD ACEP), and sits on the Medical Medicine Comprehensive Insurance Program Claims Risk Management Committee.

(risk management in the physician practice setting ) With more hospitals and health systems are acquiring physician practices, risk management professionals in these organizations will not only be tasked with developing and implementing risk management programs and related policies and procedures; they will also be challenged with providing risk management guidance. The presenters will discuss strategies for handling the top 3 risk management issues in this setting. Hosts: Elizabeth A. Svoysky, J.D., Vice-President Risk Management for Medical Mutual Liability Insurance Society of Maryland and Professionals Advocate Insurance Company. In her current position at Medical Mutual Liability Insurance Society of Maryland and Professionals Advocate Insurance Company, Ms. Svoysky is responsible for creating a variety of risk management educational activities and materials. She also produces and edits the Doctors Rx newsletter, a risk management publication. Ms. Svoysky has, over her career, served in both the claims representative and claims supervisor capacities for the Company. Ms. Svoysky is a graduate of the Johns Hopkins University, and received her law degree from the University of Baltimore. She is a member of ASHRM, MD-DC SHRM and VASHRM and routinely presents on risk management topics for Medical Mutual, Professionals Advocate, and a variety of other healthcare organizations. Jama Allers, CMC, CMOM, CMA-C, Compliance and Billing Manager - Vascular Surgery Associates Ms. Allers has more than 25 years of healthcare experience including extensive knowledge in the areas of physician practice related matters including risk management, human resources, medical records management, as well as compliance in fraud and abuse. For 10 years, she was the practice consultant for MedChi, The Maryland State Medical Society where she was a leader in educating physicians regarding profitability, negotiating insurance contracts and navigating appeals and grievances. She has presented many of the above topics throughout the state of Maryland, at venues such as The Maryland Medical Convention, Medical Mutual of Maryland Risk Management Series, and physician office organizations such as MGMA, PAHCOM and AAPC.
