2 2018 Spring Education Conference PROGRAM SCHEDULE Registration Opens 8:30 a.m. Recent Developments in Special Needs Trusts (1.5 Hours) 9 a.m. 10:30 a.m. This presentation will cover recent developments which affect the drafting and administration of Special Needs Trusts including: the ABLE Act, Special Needs Trust Fairness Act, Military Adult Child Protection Act, AB 1875 and CalSTRS, the DeCambre decision regarding public housing, the Social Security Administration s Trust Cadre review of first party special needs trusts, and Medi-Cal payback after the Herting decision. SPEAKER: Carol Battaglia Family Dynamics: Estate Planning for Dysfunctional Families and Avoiding Litigation (1.5 Hours) 10:45 a.m. 12:15 p.m. This panel will explore estate planning scenarios involving dysfunctional families and discuss ways to help these families avoid litigation. The panel will also discuss several common trouble areas including due diligence in the client intake meeting, ethical issues in representing joint clients, and constructing an estate plan that minimizes the likelihood of litigation. 3 The BuzzFeed on 2017 Chaptered Bills: Planning and Practice Tips for New Legislation (1.0 Hour) 1 p.m. 2 p.m. This program will review 2017 legislation relevant to trusts and estates practitioners. The emphasis will be on bills chaptered in 2017 and effective 1/1/18. The speakers will discuss how new legislation may affect your practice, and will offer planning tips and suggestions in light of changes in the law. SPEAKERS: Patrick Kohlmann Jennifer Scharre Medi-Cal for Long Term Care: Overview of Program, New Developments, and Guide for Planning Under New Recovery Regulations (1.5 Hours) 2:15 p.m. 3:45 p.m. This Program will explain the Medi Cal program for Long Term Care regulations and strategies for eligibility and will review the longpending rules under the Deficit Reduction Act. The presentation will emphasize how the new recovery law and regulations have changed the horizon regarding long term planning for Medi Cal. SPEAKER: Peter S. Stern
