Alcoholic Beverages PERFORMING ARTS CENTER USE The presence, consumption or serving of alcoholic beverages in any form is not permitted on school grounds or in school facilities. B. Food and Beverages Food and beverages (refreshments) are to be served only in the cafeteria. Under no circumstances will food or beverages be permitted in the auditorium/stage, lobby area, orchestra pit, etc. C. Smoking D. Time Smoking is not permitted on school grounds or in school facilities. All activities must be terminated and building emptied by 11:00 p.m. Requests for an exception to this time limit must be made when the application is submitted. E. Insurance All activities will require proof of a Certificate of Insurance in the amount of at least $1,000,000 which names the Burlington Township Board of Education as additional insured. The applicant or user will hold harmless and indemnify the Burlington Township Board of Education inclusive of all heirs, assigns, employees, trustees, Board members and representatives for all demands, claims, property damage, losses, penalties, and/or expenses, and suits. This includes attorney fees, arising out of the applicant's use of facilities regardless of fault. F. Purposes of Use The Board of Education reserves unto itself the sole right to approve and/or deny applications for the use of the Performing Arts Center and/or related facilities. When projected performance occupancy is less than one hundred forty persons, it is recommended that a large group instruction room be utilized in lieu of the Performing Arts Center.

2 7510.1/page 2 of 5 G. Priorities of Use All school or school sponsored activities shall have priority and take precedence over all other organizations and functions. Priority shall be as follows: 1. Organizations or functions which are part of or directly sponsored by the school district (includes pupil, teacher and parent groups); 2. Non-profit organizations within Burlington Township; and 3. Others. H. Availability 1. The Performing Arts Center will not be available when the facility is being used for school or school sponsored functions, or when closed for an emergency. 2. The Performing Arts Center will not normally be available to non-school groups during the school day (when school is in session). 3. In cases of inclement weather, the Burlington Township Facilities Director has the right to cancel the event in the interest of safety for the participants. I. Application Deadlines/Guidelines 1. Application Submittal Applications for use of the Performing Arts Center must be filed at least six weeks in advance of the intended use. 2. Organizations must request only those facilities, dates and times required so that the most effective use of the facilities is realized. Unwarranted or impractical requests will not be approved. 3. The fiscal and calendar school year runs from July 1 to June 30. Applications for use of the Performing Arts Center by outside organizations will not be accepted before July 1 of the school year of the event.

Each organization or group granted permission to use the Performing Arts Center shall be responsible for providing for the proper supervision of participants, spectators and facilities during its use of the Performing Arts Center. K. Fire Permit A written description (outline) of the method of providing supervision shall be submitted along with the organization's or group's application. The Board of Education reserves the right to require additional security be provided at no cost to the Board of Education. Provision of ushers (one per eighty spectators) must be made. The school district possesses a fire registration certificate for the PAC. A local fire permit is not required. L. Maintenance and Use of Facilities 1. In general, the cleaning and maintenance of the Performing Arts Center shall be the responsibility of the Board of Education. However, the organization or group using the facilities shall be expected to maintain reasonable order and to properly utilize the facilities and equipment. Abuse of the facilities and/or equipment shall result in suspension of its use and the denial of all future requests. 2. Organizations granted use of the Performing Arts Center (and related facilities) shall not permit its use by any other organization in lieu of their use. 3. In granting permission for the use of the Performing Arts Center (and related facilities) it is agreed that activities determined by the Board or its agent to be in poor taste or not to be in the best interest of the school shall not be permitted or held. 4. Additional facilities, such as coatrooms, lavatories, dressing rooms, projection/sound booth, cafeteria, kitchen, etc., must be included in the initial request. 5. Aisles and doorways must at all times be kept open and free of any objects (including standees).

4 7510.1/page 4 of 5 6. At no time shall tickets be sold or issued in excess of the rated room capacity of the Performing Arts Center or related areas. 7. The use of decorations in the Performing Arts Center or related areas must have prior approval of the Board of Education or the authorized agent of the Board. Decorating materials (in general) shall be made of nonflammable materials. At no time may materials or equipment be pinned, pasted or otherwise attached on stage curtains, walls or painted surfaces. The Performing Arts Center manager must approve the use of tape on the stage floor. M. Lighting/Sound System Operation and use of stage lighting and/or the sound system shall be permitted by district approved personnel, employed for that specific purpose. The district reserves the right to require supervision over the use of stage lighting and/or the sound system. N. Schedule of Fees See Attached A schedule of fees shall be maintained by the Business Office and reviewed/updated by the Board of Education as needed. See Policy Attachment 1 Fee Schedule O. Parking 1. Parking is limited to areas designated as parking lots (i.e., blacktop-surfaced areas around the buildings). No parking will be permitted in designated fire zones, or other areas designated as no parking areas. 2. Handicapped parking spaces are appropriately designated and shall be occupied by vehicles with the required identification only. 3. Parking attendants may be required at functions. Organizations may provide their own parking attendant or, may request, the Board to provide attendants according to the attached fee schedule. The number of parking attendants required shall be determined by the Business Administrator. 4. Violation of the parking policy may result in revocation of the organization s privilege to continue using the facilities. P. Damages

5 7510.1/page 5 of 5 Users of school facilities, as part of the application for use thereof, automatically shall assume responsibility for all damages and loss to school property that occurs while using said facilities. Q. Approval Authority The Performing Arts Center Manager shall receive and review all applications for the use of the Performing Arts Center and shall recommend approval or denial to the Assistant Superintendent for Business. The Assistant Superintendent for Business shall inform the organization in writing of the decision. The Board of Education reserves to itself power to approve the use of the Performing Arts Center by non-school organizations. R. Payment of Fees/Deposit 1. A deposit of one-half of the total basic usage fee must be received within two working days after an organization has received notice that their application has been approved. No organization shall be permitted to use the Performing Arts Center or have access to the Performing Arts Center unless and until the deposit has been received by the Board of Education. 2. The basic usage fee shall be paid in full three days prior to the actual use of the Performing Arts Center. 3. Charges for other fees (i.e., additional equipment, technical support, custodians, etc.) shall be billed to the organization, based on utilization, and payment must be received within thirty days of billing. Organizations that fail to make payments of the required fees will not be permitted to apply for future facility use until all fees are paid. 4. Payment of deposits, basic usage fees and other fees must be in the form of a cashier's check, certified check or money order, made payable to the Burlington Township Board of Education. 5. A cancellation fee for each date canceled will be charged, if cancellation is made after formal approval has been received per the attached schedule. First Reading August 28, 2013 Adopted:
