1 TERMS OF REFERENCE FOR THE ANALYSIS OF CURRENT NATIONAL AND COUNTY LEVEL POLICIES, LEGISLATIONS, PROGRAMS AND INITIATIVES ON PROVISION OF BASIC EDUCATION BURSARIES AND SCHOLARSHIPS IN KENYA. TENDER NO: KCO/26/10/FY Introduction Plan International is an independent child rights and humanitarian organisation committed to children living a life free of poverty, violence and injustice. We actively unite children, communities and other people who share our mission to make positive lasting changes in children s and young people s lives. We support children to gain the skills, knowledge and confidence they need to claim their rights to a fulfilling life, today and in the future. We place a specific focus on girls and women, who are most often left behind. Plan International strives for a just world that advances children s rights and equality for girls. We engage people and partners to: Empower children, young people and communities to make vital changes that tackle the root causes of discrimination against girls, exclusion and vulnerability; Drive change in practice and policy at local, national and global levels through our reach, experience and knowledge of the realities children face; Work with children and communities to prepare for and respond to crises and overcome adversity; Support the safe and successful progression of children from birth to adulthood. For over 80 years, we have supported girls and boys and their communities around the world to gain the skills, knowledge and confidence they need to claim their rights, free themselves from poverty and live positive fulfilling lives. Plan International has been operating in Kenya since 1982 and to-date continues to work in 18 counties: Homa Bay, Kajiado, Kilifi, Kisumu, Kwale, Lamu, Machakos, Mombasa, Nairobi, Siaya, Taita Taveta, Tharaka Nithi, Migori, Kakamega, Kisii, Vihiga, Bungoma and Busia Project Background For the last 4 years, Plan International has been implementing a secondary school education bursary project which targets children from vulnerable backgrounds. The project is implemented in 7 counties (Kwale, Kilifi, Machakos, Tharaka Nithi, Kisumu, Homa Bay and Siaya) and is currently supporting 1,026 students. The project aims to contribute to improved access, retention and completion of secondary educations for the targeted beneficiaries. Plan International, through a consultative and participatory process, identifies the beneficiaries, pays their school fees, mentors them and monitors their education performance. 1

2 In addition the project builds and strengthens partnerships at various levels so that more children from vulnerable backgrounds are identified and supported. This is achieved through the existing partnerships with government line ministries at both the national and county levels, corporates, foundations, individuals and other collaborators. 3.0 Purpose and objectives of the analysis The purpose of this analysis is to provide an in-depth analysis of current national and county level policies, legislations, programs and initiatives on provision of basic education bursaries and sponsorships. The assignment will also involve mapping out of state and nonstate education partners at both the national and county levels, identifying existing gaps in policy, legislation and programs for the provision of basic education bursaries and education support in the country The scope of the review The consultant(s) will be expected to; 1. In consultation with Plan International, develop analysis tools for data collection. 2. Review documents on past and existing policies, legislations, programs and initiatives on basic education bursaries and education support in Kenya 3. Conduct a stakeholder s analysis on basic education bursaries and education support for both state and non-state players. 4. Identify programmatic gaps in the implementation of basic education bursaries and education support in Kenya. 5. Provide key recommendations on streamlining basic education bursaries and support in Kenya at County and National levels. This analysis will be conducted in at least 15 counties Duration of the contract It is expected that the assignment will take 15 days from the date of contracting. 4.0 Methodology The consultant is expected to lead and coordinate this exercise in close collaboration with Plan International staff and partners involved in the implementation of education bursaries at county and national level. The methodology adopted by the consultant must use processes and methodologies of good technical quality and systematically use reliable information from multiple, rigorous methods of data collection and analysis as well as sources that support relevant analysis and correspond to the stated goals and objectives of the review. Further, the consultant is expected to use gender responsive participatory evaluation techniques to gather both qualitative and quantitative data; primary and secondary data/information that would adequately capture required information as outlined in the terms of reference. The information gathered must be relevant to the context and be able to facilitate local process of reflection and accountability. While executing the review, it is pertinent that the methodology conforms to a sound study design and impeccable sampling 2

3 techniques. Where appropriate, sample size estimation should clearly indicate confidence interval and level. The methodology proposed by the consultant will be discussed and approved by Plan International before carrying out the study. In carrying out the study, the consultant is expected to familiarise themselves with all up-to-date secondary data relevant to the education bursaries project implemented by Plan International, state & non state partners. The consultant should include a proposed data analysis matrix in the technical report. 5.0 Ethics and child protection The consultant and associates must sign and demonstrate commitment to strictly adhere to Plan International s Policy on Safeguarding children and young people. It is also the responsibility of the consultant to ensure that all persons hired or consulted by him/her are made familiar with the policy and agree to abide by it during the execution of this work. 6.0 Selection criteria for /consultants The consultant (s) must have an integrated set of skills in basic education, law and policy with demonstrated high level experience in conducting similar assignments. Good working knowledge of gender equality and child participation is also essential. 7.0 The Consultant(s) must have the following competencies: A university degree in social sciences, education law or any relevant field; Concrete evidence and experience undertaking similar work within the past 3 years; Proven experience in writing analytical reports in the area of education, human rights gender equality, girls and women s right; Be well versed with child rights related issues. 8.0 Deliverables: This assignment will have the following deliverables: i. Inception report: Outlining the consultant's understanding or the assignment, plan of action, methodology and timelines for conducting the analysis for requisite approval by Plan International; ii. Zero draft report: For review by Plan International to provide feedback before finalization of the report; iii. Draft final report: Incorporating the feedback and input received from Plan International; iv. Finalized detailed report: Containing comprehensive substantive reviews and concrete recommendations. The format and template of presentation of the final report shall be discussed between Plan International and the consultant (s) Respondents are asked to provide: 3

4 A detailed technical proposal clearly outlining the proposed methodology Curriculum Vitae of proposed staff outlining relevant experience to the assignment A financial proposal with a detailed breakdown of costs for planning and carrying out the assignment A proposed timeframe detailing activities and a schedule/work plan (including a Gantt chart) 12.0 The financial proposal should contain: Itemized consultancy fees/costs Itemized field data collection expenses as necessary. Validity period of quotations NB: The financial quotations should be all inclusive. Plan International will not meet any other costs related to the assignment. Submission of proposals Interested and qualified firms or individuals who meet the requirements noted above and are able to provide deliverables in line with the terms expressed in the full terms of reference are invited to submit their tender documents by providing a technical and financial proposal in two separate envelopes clearly marked Technical Proposal and Financial Proposal and sealed in one plain envelope clearly marked Analysis of National and County level policies, legislations, programs and initiatives on provision of basic education bursaries and scholarships in Kenya The application must demonstrate a clear understanding of the TOR, a robust methodology and high quality standards. Completed Tender documents in plain sealed envelopes clearly showing the Tender No. and Description should be addressed to: Plan International Kenya, Methodist Ministries Center, P O Box Nairobi. and delivered to the Tender Box at the reception of Plan International Kenya, Methodist Ministries Centre on or before 15 th November 2018 at 5.00 pm. Tender prices must remain valid for 90 days from the date of tender closing. Plan International Kenya reserves the right to accept or reject any proposal and is not bound to give reasons for rejection. 4
