6 1 Health and Safety Policy Statement It is a legal requirement for Powys Teaching Health Board (PTHB) to comply with the Health and Safety at Work, etc. Act 1974 and other relevant health and safety legislation. The health board understands that it must provide a safe and healthy environment for all employees, patients, visitors, contractors and other members of the public who have contact with the organisation. Powys Teaching Health Board (PTHB) places great importance on the prevention, management and control of risks to the health, safety and welfare of everyone, and will ensure suitable and sufficient levels of awareness of health and safety throughout the organisation. PTHB recognises the need for high standards of health, safety and welfare, and that these are an integral element to efficient management and contribute to the operational effectiveness of the organisation. Hosted services within the organisation, will be expected to have an equally high standard of health and safety, and to work proactively with the health board, in order that all organisations can discharge their legal duties. All employees are responsible for maintaining compliance with statutory and mandatory regulations. Employees at all levels have a role within this policy, therefore they must comply with all health and safety instructions and systems that are in place. Employees who wilfully disregard the health board s health and safety policies and/or procedures could be subject to performance and conduct procedures. The board will, so far as is reasonably practicable, identify adequate financial and physical resources in support of the implementation of this policy. 7 2 Introduction PTHB recognises the importance of ensuring the effective management of health and safety and the identification and control of risks. Continual risk assessment is acknowledged as the key driver. This forms the basis of this policy and other supporting health & safety policies which are intended to provide and maintain a positive health and safety culture. This policy and supporting documents form part of the overall risk management strategy for the organisation. This policy will: be reviewed every three years or if there are any legislative changes; be agreed at the Corporate Health & Safety Group and be approved by the Executive Committee, on behalf of the Health Board. The review will include a review of performance, which will be mapped against health and safety audits and inspections. 3 Objectives & Corporate Health and Safety Plan In order to comply with its statutory duties this policy clearly outlines the organisations health & safety objectives. These will include the following: 3.1 Produce a Corporate Health & Safety Plan that will clearly outline how the organisation intends to meet its health & safety objectives. The organisation will also produce an annual health & safety report for the board of PTHB, which will present an overview of health & safety performance and will include progress against targets within the Corporate Health & Safety Plan. 3.2 Carry out and review risk assessments of all work areas, in order to assess actual and potential health and safety hazards. 3.3 Measures will be taken to eliminate and control hazards, by applying safe systems of work/control measures as detailed within risk assessments. 3.4 Provide staff, at all levels with relevant training in order to ensure that they are competent to perform the roles, to which they have been given. 8 3.5 Identification of health and safety risks associated with new processes and their implementation, with controls or elimination of these risks established. 3.6 Where new accommodation (New Build) is planned the organisation will make every effort to ensure that Safety by Design Principals are followed and that all relevant disciplines e.g. Health & Safety, Manual Handling, infection prevention & control, etc. are involved at all stages of the commissioning, planning and building process. Safety Schemes in Procurement (SSIP) will also be applied when procuring services. 3.7 Competent personnel will be identified with the responsibility for ensuring compliance with health and safety statutory duties. All employees agree, as a term of their contract of employment, to comply with the Health and Safety at Work, etc. Act 1974 and various duties imposed by that Act. Deliberate and culpable failure to comply with known and agreed health and safety duties could lead to disciplinary action in accordance with PTHB s Disciplinary Procedure. 3.8 Health and Safety Information will be made available on all aspects of health and safety at work for all staff, as required and for other interested parties. The mechanism for this, at a local level is the supervisor and/or line manager. For hosted or other parties information will be obtained from the Locality General Manager or the corporate health and safety team. 3.9 All staff use the risk management/incident reporting database to record all risks, incidents, accidents, near misses, claims and complaints. This mandatory reporting system provides valuable information that can be used in root cause analysis of all incidents and also as a measure of performance. 4 Definitions Those who use and provide services for and within PTHB are, for the purpose of this policy defined as: All staff, including locum, part-time, temporary and bank. 9 Contractors. Visitors. Clients. Patients. Students on placement e.g. Medical Students, Student Nurses Members of the public. Volunteers. Hosted services. Tenants, for example Public Health Wales. 5 Organisational Responsibilities In order to ensure the effective implementation of this Corporate Health and Safety Policy and the Corporate Health & Safety Plan details of responsibilities are given within this section. 5.1 The Board of Powys Teaching Health Board It is the responsibility of the Board to ensure the health board meets its legal obligations under current statutory and mandatory requirements and to ensure adequate resources are available to meet those requirements. The Board will oversee the health & safety arrangements that the health board has in place. It will receive an annual health & safety report and quarterly reports from the Chief Executive on matters of health & safety. The following describes the responsibilities of key roles in the organisation: 5.2 Chief Executive The Chief Executive has overall responsibility and is accountable to the Board for the management of health & safety within the organisation. Responsibilities include: the resourcing and implementation of all measures needed to comply with the relevant legislation and relevant guidance and for ensuring the full implementation of the Corporate Health & Safety Policy and Corporate Health & Safety Plan. 10 5.3 Executive Directors Executive Directors are responsible to the Board of PTHB for ensuring that all health & safety risks are adequately identified, managed and controlled within their area of responsibility and that all incidents and accidents are reported and investigated in line with PTHB policy. This will include ensuring that all risk assessment action plans are adequately monitored and that incident investigations are fully completed in line with the organisations Incident Reporting Policy. It is recommended that Executive Directors attend an approved and suitable health & safety awareness course (e.g. IOSH Leading Safely-Essential Learning for Senior Leaders), as identified through their PADR. 5.4 Director of Workforce & Organisational Development In addition to the responsibilities outlined in 5.2 the Director of Workforce & Organisational Development will take lead responsibility for the corporate management of health & safety and is accountable to the Chief Executive Officer. These responsibilities include ensuring that the organisation receives competent advice, via the Health & Safety Manager, regarding the management of health & safety and that adequate training and monitoring takes place. Ensuring an appropriate infrastructure is in place, for effective and specialist health and safety knowledge. Director of Workforce & Organisational Development will produce a quarterly health & safety report to the Executive Committee. This will include progress reports on the Corporate Health & Safety Plan. Director of Workforce & Organisational Development will also report on urgent/ongoing health & safety matters to the weekly Executive Management Team meetings where these are escalated via local health & safety meetings (e.g. FISH meetings) where Issue Date: Aug 2018 Page 10 of 28 Review Date: Aug 2021

11 there is also the requirement to ensure that resources are prioritised to high risk areas. Director of Workforce & Organisational Development is also responsible for the provision of statutory and mandatory training across the organisation. 5.5 Assistant Director Estates & Property Assistant Director Estates & Property will have responsibility for the following: The completion of risk actions involving Works and Estates and the Integrated Facilities Management System. The management of asbestos within the organisation. The management of hot & cold water systems. Ensuring that where new accommodation (New Build) is planned every effort is made to ensure that Safety by Design Principals are followed and that all relevant disciplines e.g. Health & Safety, Manual Handling are involved at all stages of the commissioning, planning and building process. The management of fire safety within the organisation and the compliance with NHS FIRECODE and the provision of fire training within the organisation. The implementation and regular review of the Permit to Work System. Regular condition surveys of PTHB premises to ensure the provision of safe place to work. Ensure effective contractor management and that contractors comply with Health and Safety Policies and Procedures. Attend an approved and suitable health and safety training course. To attend Corporate Health & Safety Meetings. 5.6 Health & Safety Manager The Health and Safety Manager is responsible for providing health & safety management, professional and technical advice and Issue Date: Aug 2018 Page 11 of 28 Review Date: Aug 2021

12 support at all levels within the organisation to ensure systems are in place to enable compliance with health & safety legislation. Responsibilities include: Advising the Director of Workforce & Organisational Development on the management of health & safety within the organisation. In conjunction with the Director of Workforce & Organisational Development monitoring, updating and reviewing the overall health & safety performance of the organisation at the strategic level and producing the Corporate Health & Safety Plan and Annual Health & Safety Report. Providing the Director of Workforce & Organisational Development and other Executive Directors with reviews and reports on health & safety matters on a quarterly basis. Also providing quarterly reports to the quarterly Corporate Health & Safety Committee and other specific reports as and when required. Acting on behalf of the Director of Workforce & Organisational Development including in his/her absence on important/urgent health & safety matters. Producing and reviewing the PTHB s health & safety policies in line with current legislation, guidance and best practice. Ensuring that an effective health & safety training programme based on identified training need/ legal requirements is in place. Providing professional guidance and technical support to assist managers in their duties of implementing PTHB s health & safety policies at a directorate level. Both conducting and supporting audits and ensuring managers are implementing actions plans Conducting and assisting in incident/accident investigations where appropriate and producing an incident summary report on every RIDDOR reportable incident for the HSE and the Director of Workforce & Organisational Development. Providing PTHB managers with the guidance and technical support to enable them to implement the risk assessment and inspection process within the organisation in order to Issue Date: Aug 2018 Page 12 of 28 Review Date: Aug 2021

13 develop, implement and monitor adequate control measures to ensure that all risks are minimised and managed appropriately. Providing information and reports to the Corporate Health & Safety Committee, Audit Committee, Risk Management Group other PTHB Groups and Local Health & Safety Committees. Representing PTHB at an All Wales level on relevant health & safety issues. Consulting and liaising directly with the enforcement authorities on behalf of PTHB. 5.7 Occupational Health Doctors The Occupational Health Doctor reports professionally to the Medical Director and is managed by the Director of Workforce & Organisational Development. The activities undertaken by the Occupational Health Doctor include: Pre-employment health assessment and screening Health assessment of existing employees. Periodic health surveillance of at risk personnel. 5.8 Occupational Health Manager The Occupational Health Manager reports professionally to the Director of Nursing Services, and is responsible to the Assistant Director of Workforce and Organisational Development for the management of the Occupational Health service. He/she will undertake the following in addition to participating in activities listed above in 5.6: Institution and support of preventative health programmes, health education and health promotion. Advice on Health and Safety legislation pertaining to occupational health. Assist the investigation of accidents at work. Review of sickness absence. 14 Support and assist staff and managers in the rehabilitation of employees who have been away from their work due to illness or accident. Liaise with the Health and Safety Manager on matters of health, safety and the work environment. Undertake health assessments in relation to the individual employee and the job to be performed. Refer to the Occupational Health Doctors such cases that require further investigation and medical intervention. Assist in the provision of health education activities in relation to individuals and groups of employees. Advise managers within PTHB with responsibility for health, safety and welfare of employees. Provide a report to the Corporate Health & Safety Committee. Full details are contained within the Occupational Health Policy. 5.9 Locality General Managers/Assistant Director of Mental Health Services The Locality General Managers and Assistant Director of Mental Health Services are responsible and accountable to the relevant Executive Director for ensuring that all health & safety risks are adequately controlled and that all incidents and accidents are reported and investigated in line with PTHB policy. The Locality General Managers and Assistant Director of Mental Health Services will work closely with all senior managers who will be accountable for updating the Locality General Managers, this will include ensuring that all risk assessment action plans are adequately monitored and that incident investigations are fully completed in line with the organisation s Incident Reporting Policy in their respective areas of responsibility. The Locality General Managers for North and South Powys will present a quarterly health & safety report to the Corporate Health & Safety Committee incorporating information from the Assistant Director of Mental Health Services. 15 They will attend an approved and suitable health and safety training course which is appropriate to the job role (e.g. IOSH Managing Safely for Healthcare Professionals). The Locality General Managers will also identify and agree individual site leads for health & safety Senior Managers The Senior Managers have responsibility for the day-to-day management of health & safety for activities and staff under their control. They are directly accountable to the Locality General Manager for ensuring full compliance with health & safety legislation. Senior Managers will ensure that systems are in place to achieve the following: Ensure that each area of responsibility has a completed an up to date Health & Safety Local Implementation Procedure. (Please see HSP 002 Health & Safety Policy Local Implementation Procedure) Set targets for completion of risk assessments and training on an annual basis. Identify all health & safety risks associated with work and take steps to eliminate or reduce risk, as far as is reasonably practicable. Ensure that where a risk is identified that cannot be eliminated, a formal risk assessment is carried out and that this is then entered onto the risk register for their area within the central DATIX Risk Management Database. That any resulting action plans are monitored and control measures implemented. Be responsible for analysing and actioning any recommendations arising from the risk assessment process and ensure that systems to monitor safe practice are in place and followed. This will be continuously monitored using the DATIX Risk Management Database and by health & safety inspections etc where/when required. Issue Date: Aug 2018 Page 15 of 28 Review Date: Aug 2021

16 Ensure that staff are able to attend training sessions run by the organisation. Ensure the development of a comprehensive audit mechanism in liaison with the health & safety team and that any findings are acted upon. Establish a rolling programme of health & safety inspections in liaison with the health safety team. Areas to be covered and the frequency of inspection should be in accordance with the targets set within the Corporate Health & Safety Plan. To visibly support the development of a positive health and safety culture within the health board. To lead by example in helping to establish the health board as an exemplar in health and safety management. Attend an approved and suitable health and safety training course, which is appropriate for the job role. (e.g.pthb Essential Health and Safety Training for Line Managers) Ensure that agency staff, clinical students and bank staff have received an appropriate level of training commensurate with PTHB standards prior to employment. Assisting and ensuring common agreed standards are developed and implemented throughout the organisation. Liaising with the Health and Safety Manager on all matters relating to health and safety, including the quarterly update reports to CHSC and escalation of concerns. Include clearly stated health and safety responsibilities in job descriptions. Ensuring that all adverse incidents, hazards and near misses that are reported are fully investigated and any remedial action has been implemented in line with PTHB policy Line Managers with day-to-day responsibility for staff. (e.g. Senior Sisters, Team Leaders and Supervisors etc.) These groups of staff will be directly accountable and responsible to their immediate line manager for the health & safety of all staff, patients, clients, visitors, contractors and members of the public within their area of responsibility. 17 Continuous reporting and monitoring of risks/incidents via the DATIX Risk Management Database in accordance with the Risk Assessment Policy & Incident Reporting Policy within their area of responsibility. Ensure that PTHB Health and Safety Policies, safe systems of work and practices and procedures are followed within their area of control. Ensure that health & safety is a standard agenda item at meetings and that where required workplace/toolbox talks are delivered and recorded. Ensure that risk assessments are completed within their area of responsibility and where required ensure that control measures are implemented. Implement corrective actions arising from inquiries and investigations and/or when deficiencies are detected. Ensure that employees, both permanent and temporary, are competent to perform their duties under the organisation s health & safety policies and procedures. Effectively manage health, safety and welfare of the staff under their control. Ensure that employees attend mandatory training as required. Monitor records of mandatory training for employees in their area of responsibility via the electronic staff record training module. Implement all the health and safety policies, ensuring that all staff have access to them. Ensure that staff also have access to other health and safety documentation, for example but not limited to: risk assessments and safe systems of work. Ensure that all incidents that occur within their work area are reported in accordance with the organisations Incident Reporting Policy and that they are investigated and remedial action is taken as necessary. To visibly support the development of a positive health and safety culture within the health board and to lead by example in helping to establish the health board as an exemplar in health and safety management. 18 health and safety performance and by integrating safety in to the day-to-day management process. Ensure that health and safety is discussed at team meetings and is a standing agenda item. Attend an approved health and safety course (e.g.pthb Essential Health and Safety Training for Line Managers) which is appropriate to the job role Employees Duties Every employee must: Take reasonable care in regard to the health and safety of themselves and persons who could be affected by their actions/ omissions. To co-operate with Managers/Team Leaders/ Supervisors and senior management on all health and safety matters. Know the local emergency arrangements/ procedures for the premises/ area of work. Attend and complete training courses as detailed within the training plan and also those courses that may be job specific. Follow all safety procedures contained within risk assessments; safe systems of work and/or method statements which relate to work activities. Not intentionally or recklessly interfere with or misuse anything that has been provided for the purpose of health and safety legislation. Report to the supervisor or manager any defects to work equipment or other hazards that could cause injury or damage to property. Use any personal protective equipment (PPE) that has been supplied and keep it in good order and request replacements or repair when necessary. Contribute as required to the management of health and safety for example in task specific risk assessments. Through the Datix reporting system report any incident or near miss within 24 hours. 19 Use all equipment as instructed and trained, also complying with control measures that are included within risk assessments and/or safe systems of work. To co-operate fully with the Health Board on all health and safety matters. To attend meetings as may be required from time to time. 6 Communication of Health and Safety Issues In order to comply with relevant legislation and to create a supportive health and safety culture, PTHB encourages active participation through communication and involvement. For this communication to be effective the following groups have responsibilities as listed: 6.1 Corporate Health & Safety Group (CHSG) The Corporate Health and Safety Group will be responsible and accountable to the Executive Committee of PTHB for the development, planning, promotion and effective monitoring of the organisation s health and safety objectives. The Director of Workforce, OD & Support Services, as lead Executive for health and safety will chair the committee. The committee will meet every three months. It is a requirement that management members attend every meeting or send a nominated deputy in their stead. The following will be members of the Corporate Health & Safety Group: The following will be permanent members of the Group: Director of Workforce & Organisational Development (Chair) Assistant Director Quality & Safety Health and Safety Manager Locality General Managers Senior Nurse Infection & Prevention & Control Primary Care Representative Occupational Health Consultant Occupational Health Manager Mental Health Directorate Representative Issue Date: Aug 2018 Page 19 of 28 Review Date: Aug 2021

20 Public Health Wales Representative Assistant Director Estates and Property Head of Facilities Finance Representative Representatives from organisations hosted by PTHB Professional Bodies and Trade Unions will be represented via Health & Safety Representatives; this representation should reflect the membership of the different bodies within the organisation A decision on a policy can be made with a minimum of 4 management representatives and 4 staff side representatives in attendance. From time to time specific disciplines may be invited to give representation and opinion on certain, relevant issues. The terms of reference of the Group are as follows: 1. On behalf of the Board of PTHB to develop and oversee the Corporate Health Safety Plan and effectively monitor the organisations health & safety objectives. 2. To develop health and safety policy for the organisation and monitor its implementation. 3. To analyse information and reports provided by enforcing authority inspectors, e.g. HSE and local authority inspectors and to oversee action plans for compliance. 4. To receive action plans and reports arising from the Health & Safety Audit Schedule. 5. To receive action plans and reports arising from trade union/ professional body health & safety inspections, undertaken by accredited health & safety representatives. 6. To discuss issues of health & safety and risk raised by members and report those that cannot be resolved to the Executive Committee, Risk Management Group. The Patient Experience, Quality and Safety Group will receive reports for assurance purposes. 7. To receive reports on the appraisal and monitoring of the effectiveness of health and safety training. To monitor accident and incident statistics and trends, so that reports can be made to management on unsafe or unhealthy conditions and practices, along with recommendations for remedial action. 9. To observe the adequacy of safety and health communication and awareness in the workplace. 10. To consider any other relevant health and safety risk issues and to forward items on to the Executive Committee. 6.2 Radiation Protection Committee (RPC) The Radiation Protection Committee will consider safety matters associated with the use of ionising radiations in clinical and other situations as it may affect the health care environment in Powys. It will report through the Director of Workforce, OD & Support Services to the Quality & Safety Committee. The RPC will meet annually and a summary report of radiation related health and safety issues will be submitted to the following meeting of the Corporate Health & Safety Group. 6.3 Locality Partnership Meetings The Locality Partnership Meetings have health & safety and risk management as an integral part of the local management process. Full details can be found within the forum guidelines drawn up by the PTHB Partnership Board. Locality Partnership Meetings TOR 6.4 Fire, Major Incident and Health & Safety (FISH) Meetings The FISH meetings are hosted within each locality and have representatives from all services areas. They are chaired by the Locality General Manager and have the remit of holding staff to account for delivery against Fire, Incident and Health & Safety objectives. Full details can be found within the terms of reference for the groups. The FISH meetings will provide a quarterly report to the Corporate Health & Safety Group. 24 7 Health & Safety Monitoring Arrangements Effective monitoring of health & safety performance is essential for the organisation to meet its legal obligations and to demonstrate how managers at all levels are held accountable to the PTHB board. The Corporate Health & Safety Group will identify and monitor a programme of Audit Activity to assess compliance, with reports to the Executive Committee. In addition external scrutiny may be secured through Internal Audit. 26 8 Supporting Guidance and Arrangements 8.1 Incident Reporting The organisation s Incident Reporting Policy aims to encourage the reporting of all adverse incidents, hazards and near misses. This information plays a crucial part in establishing the risks that are pertinent to the organisation. Staff must report adverse incidents, hazards and near misses using the Datix (DIF 1) report form. The information is then held centrally on the incident reporting system, a database that provides a record of incidents reported within PTHB. All incident reports are continually reviewed by managers and relevant specialist advisors to ensure that action is taken appropriately to prevent a recurrence. Serious incidents and incidents that are of significance to the organisation as a whole are discussed at the Risk Management Committee. Serious incidents are also reported to the relevant Executive Director and to the relevant external body where appropriate. Full details of the organisation s incident reporting requirements can be found in the Incident Reporting Policy. 8.2 Policies and Guidance Documents Where practicable, specific corporate health and safety policies and procedures have been developed, for use throughout PTHB, and will be subordinate to this policy. The policies are held on line, where all staff may have access to them. Policies will be reviewed and updated every three years or sooner, as required. 8.3 Health Surveillance The Occupational Health Department provides a range of services for employees including pre-employment health checks and health surveillance for specific work activities. 27 8.4 Temporary/Agency Workers Temporary & Agency workers shall be given sufficient information on the risks that may be present in the work area/s in which they may be employed. They must be competent to carry out the tasks they are given to do, also they must have received inductions, prior to commencing work. 8.5 Contractors All contractors engaged shall abide by their statutory obligations, and also comply with any specific instructions given by the client. Construction Phase Plans (CPP s) where required must be submitted, and any method statements/risk assessments must be followed. Any risks to others arising out of their work, must be notified to the client, and steps taken to address the issue/s. 8.6 Shared Workplaces Where workplaces are shared, or PTHB staff are placed in buildings other than those owned by PTHB and likewise where PTHB Buildings have tenants e.g. Public Health Wales Staff, there must be communication between all parties. All parties have a legal duty to co-operate under the Management of Health & Safety at Work Regulations (MHASAW) While it is recognised that each employer will have their own policies and procedures these need to be shared in order to ensure the safety of all persons. 8.7 Policy Review The Corporate Health & Safety Policy will be reviewed every three years as a minimum, be agreed at the Corporate Health & Safety Committee and be approved by the Executive Committee. The review will include a review of performance. 8.8 Infection & Prevention & Control Based within the Quality & Safety Unit, the Senior Nurse Infection & Prevention & Control has an organisation wide remit to provide infection prevention and control advice through the normal range of primary and secondary care to all professional and non-professional groups within Powys. 28 8.9 Health & Safety Audit Programme In line with its Health & Safety Strategy the Health and Safety Manager leads a programme of health & safety audits across the organisation. The resultant reports are issued to the Locality General Managers and Assistant Director of Mental Health Services by the Health & Safety Team and progress against actions is monitored via the FISH meetings and the Corporate Health & Safety Group. 9 References H.M.
