9 INSTRUCTIONS TO TENDERERS 2.1 Qualifying Criteria: 1. Agency must be a Proprietorship or partnership firm with the valid registration from Council of Architecture and structural Engineers on its rolls with minimum experience of 05 (five) years. (Documentary evidence needs to be submitted). 2. Agency must have PAN and GST Registration No. (Documentary evidence is to be submitted). 3. Average Annual Financial Turnover on Engg. Consultancy works during the last three years, ending 31st March of the previous financial year i.e , should be at least INR Lakhs. (Documentary evidence needs to be submitted). 4. The bidder should not have incurred any loss in more than two year during available last five consecutive balance sheet (i.e to ) duly certified and audited by the charted accountant. 5. Experience: Agency should have the experience of completion of similar works during last 7 years ending last day of month previous to the one in which tenders are invited should be either of the following: a. Three similar completed works each costing not less than the amount equal to 40% of the estimated cost, i.e. Rs.3000 Lakhs or b. Two similar completed works each costing not less than the amount equal to 60% of the estimated cost, i.e. Rs.3000 Lakhs or c. One similar completed work costing not less than the amount equal to 80% of the estimated cost. i.e. Rs.3000 Lakhs 6. Similar Works Means Agency must have successfully completed the consultancy work for Convention centre / RCC Multi-storied Institutional building which consists of Electrical, Water supply, Sanitary, HVAC, Fire Alarm, Detection and Firefighting, Security system/access control, Audio-visual system, Solar Energy Utilization, Telephone system, Voice& Data communication system, Rain water harvesting, land scape work, UPS, Back-up power source and intelligent/energy efficient lighting system, Road and pathways and external development works - all complete work of a building with any Central / State Govt. Departments / Central PSUs/ State PSU/ Central Autonomous bodies/ State Autonomous bodies/ City Development Authority/Municipal Corporation of City formed under any act by Central/State Government and published in Central/State Gazette or Public Limited Companies Listed in stock exchange duly supported with TDS Certificate in evidence of the value of work. 10 Submission of documentary evidence of Public Limited Company listed in stock exchange is the responsibility of bidder. 7. Joint ventures are not permitted. 8. Agency must have EPF Registration and shall submit proof of having valid EPF registration certificate. In case of non-applicability in terms of EPF norms, bidder may submit the proof of non-applicability along with undertaking in this respect. 9. Firm should have not been blacklisted, debarred or restrained in last 7 years to participate by any Govt. department. Indemnity to this effect needs to be submitted as per format enclosed. 10. Small scale Industries registered with the National Small Scale Industries Corporation or registered with MSME shall be exempted from payment of tender cost/earnest money deposit as per eligibility limits. 11. Tenderers seeking exemption should enclose a photocopy of Valid Registration Certificate giving details such as product/services and Monetary limits, failing which they run the risk of their tenders being passed over as ineligible for this concession. 12. NPCC may consider award of work to MSEs as per provision of Public Procurement Policy for Micro and Small Enterprises (MSEs) order, 2012 with special provision for Public Procurement Policy for Micro & Small enterprises owned by the Scheduled Caste or the scheduled Tribe entrepreneurs. Downloading of tender documents alone will not make a tenderer eligible for participating in the bidding. The documents uploaded by the tenderers will be subjected to verification subsequently by Department. If found not meeting the requirement. DEFINITIONS 2.20 In this document the following works and expressions have the meaning hereby assigned to them: (i) "EMPLOYER" OR "NPCC" Means National Project Construction Corporation Limited. (ii) "APPLICANT" Means the individual, proprietary firm, firm in partnership, limited company, private or public or corporation. (iii) YEAR means Financial year unless stated otherwise METHOD OF APPLICATION: (i) If the applicant is an individual, the application shall be signed by him above his full typewritten name and current address. (ii) If the applicant is a proprietary firm, the application shall be signed by the proprietor above his full typewritten name and the full name of his firm with its current address. (iii) If the applicant is a firm in partnership, the application shall be signed by all the partners of the firm above their full typewritten names and current addresses or alternatively by a partner holding power of attorney for the firm. In the latter case a certified copy of the power of attorney should accompany the application. 12 (iv) If the applicant is a limited company or a corporation, the application shall be signed by a duly authorized person holding power of attorney for signing the application accompanied by a copy of the power of attorney. The applicant should also furnish a copy of the Memorandum of Articles of Association duly attested by a Public Notary FINAL DECISION MAKING AUTHORITY NPCC reserve the right to modify the eligibility criteria, to decide on cut off date of implementation, to accept or reject any application, to annul the PRE- QUALIFICATION process, to reject all applications or accept new applications at any time, without assigning any reason or incurring any liability to the applicants EVALUATION CRITERIA FOR PRE-QUALIFICATION For the purpose of pre-qualification, applicants will be evaluated on the basis of minimum stipulated financial and past experience criteria. The details of plant & machinery holding, manpower employed, pending litigations shall also be evaluated for Pre-Qualification of the firms Even though an applicant may satisfy the above requirements, he would be liable to disqualification if he has: (a) Record of poor performance such as abandoning work, not properly completing the contract, delay in completion of works, or financial failures / weaknesses etc. (b) Made misleading or false representation or deliberately suppressed the information in the forms, statements and enclosures required in the Pre-Qualification documents FINANCIAL INFORMATION Applicant should furnish the follow financial information: (a) Annual financial statement for the last three years (in Form "C"). This should be supported by audited balance sheets and profit and loss accounts (with all schedules attached) along-with details required for assessing the net worth duly certified by a Chartered Accountant, as submitted by the applicant to the Income Tax Department. (b) Name & Address of the bankers, name of persons familiar with the applicant's financial standing and a banker's statement on availability of Unutilized Cash credit and bank guarantee limits EXPERIENCE IN WORKS HIGHLIGHTING EXPERIENCE IN SIMILAR WORKS Applicant should furnish the following: (a) List of all similar works successfully completed during the last seven years (in form "D") Particulars of completed works and performance of the applicant duly authenticated I certified by an officer not below the rank of Executive Engineer or equivalent should be furnished separately for each work completed or in progress ( preferably in Form Sig. & Seal of Tenderer Page 12 of 28 N.P.C.C. 13 "F" or as per performa of concerned Clients covering the required information as asked for in Form 'F') ORGANIZATION INFORMATION Applicant is required to submit the following information in respect of his organization. (a) Name & Postal Address, including Mobile No., Telephone, Fax numbers, and E- Mail address etc. (b) Copies of original documents defining the legal status, place of Registration and principal places of business. (c) Name of Directors and Officers concerned with the work, with designation of individuals authorized to act for the organization. (d) Information on any litigation in which the applicant was involved during the last five years, including any current litigation. (e) Authorization for NPCC to seek detailed references LETTER OF TRANSMITTAL The applicant should submit the letter of transmittal attached with Pre-Qualification document (Section - 4) duly signed by him Any effort on the part of the applicant or his agent to exercise influence or to pressurize the employer would result in rejection of his application. Canvassing of any kind is prohibited CANCELLATION OF PRE-QUALIFICATION The pre-qualification of contractor shall be cancelled by NPCC in case of their poor performance, abandoning of the allotted work, and abnormal delay in completion of work, bankruptcy and for activities detrimental to the interest of NPCC. The decision of NPCC in this regard shall be final and binding on the contractor The contractor / firm shall not effect any change in the constitution of the firm or in its name without the prior approval of NPCC. Such proposal, if any shall be submitted in advance furnishing full details of the proposed change along with all supporting documents. Any change in the constitution or name of the firm /company without the prior approval of NPCC will render the contractor/ firm liable for removal from the approved list of consultants. The discretion to allow/disallow the proposed change shall vest solely with NPCC. In case, the original partners/ constitution change by more than 50% either due to substitution or due to retirement or death the enlistment of the firm/ contractor by that name shall be cancelled.
