2 Draft Minutes Sustainability Advisory Board (SAB) Regular Meeting Thursday, May 18, 2017, 7:30 a.m Jimmy Durante Blvd Del Mar, California SAB Members Present: John Goodkind, Mayela Manasjan, Chair Ann Feeney, Alan Sweedler, Nitza Leichtling SAB Members Absent: Vice-Chair Shirley King (excused) City Council Liasons Present: Ellie Haviland, City Staff Present: Kristen Crane Ex Officio Member Absent: Henry Abarbanel Public Present: Don Mosier, City of Del Mar Climate Action Plan Volunteer Facilitator, Daniela Battaglioli, UCSD (SIO) Graduate Student in Climate Science and Policy Program 1. Call to Order: 7:34 am 2. Approval of April 20, 2017 Meeting Minutes: Ann Feeney suggested the following corrections to the meeting minutes: Item 4B. The upcoming SAB trip to Waste Management s CORe facility on June 6, 2017, in the City of Orange will begin at 9:30 am instead of 8:30 am. Item 4C. Jake s restaurant had reached their Ocean Friendly Restaurant certification. Moved by Alan Sweedler; Seconded by Mayela Manasjan; Unanimous approval. 3. Reports from Committees/Staff: A. Community Choice Energy Report on Inter-City North County CCA Working Group/Potential Feasibility Study (Don Mosier, Kristen Crane). Item will be brought to council on June 5, City staff is working on preparing the Staff Report which will include the Draft CCE Technical Feasibility Study Cost Share Agreement and the CCE Study prepared by Daniela Battaglioli. Don Mosier raised concerns that the City of Carlsbad may opt out of the Feasibility Study. Kristen Crane stated that the budget for the Feasibility Study was increased in the May budget workshop in the event that one of the other potential cities opts not to participate. Kristen Crane will present the Staff Report, Daniela Battaglioli will give a 10 minute presentation, and Ann Feeney will provide public comment on behalf of the SAB at the upcoming City Council meeting. B. Report from City Council SAB Liason Ellie Haviland. SANDAG has a new pre-requisite that requires the City of Del Mar to develop a Complete Streets Policy no later than November 2017 to be eligible for grant funding. Kathy Garcia, Planning Director will be invited to a future SAB meeting to give a presentation. 1 P a g e

3 C. Update on Ocean Friendly Restaurants Survey (Subcommittee Members: Mayela Manasjan and Nitza Leichtling). The SAB developed a list of 35 restaurants in Del Mar. Nitza Leichtling conducted an initial survey at 22 Del Mar restaurants in February 2017 to assess whether restaurants are using Styrofoam take out containers, plastic bags and recycling. Mayela Manasjan conducted additional outreach at nine Del Mar restaurants on Monday, May 15, The purpose of her efforts were three-fold: 1) To confirm whether or not the restaurants are currently using any Expanded Polystyrene (EPS) products (none of the nine restaurants reported using EPS) 2) Advise the restaurants that the City of Del Mar is considering a ban on all EPS Products (which includes Styrofoam) at restaurants and 3) To inform them of the Surfrider s Ocean Friendly Restaurant voluntary certification program. Mayela received favorable responses from all nine of the restaurants with five restaurants indicating that they were interested in immediately becoming certified as Ocean Friendly Restaurants. The following four restaurants are currently certified as Ocean Friendly Restaurants in Del Mar: Jakes, Secret Café, Americana and Elixir. In addition to her outreach efforts with the restaurants, Mayela also exchanged s with Jen Grove, Executive Director at the Del Mar Village Association (DMVA) and she offered to send out an e-blast with the Surfrider Foundation s Ocean Friendly Restaurant details to all of the DMVA restaurants. Lastly, the SAB continues to regularly check-in via with Emelia DeForce at Surfrider Foundations to coordinate outreach efforts, certify new updates and receive updates. 4. Old Business A. Recycling at Powerhouse and the park, contracts. Kristen Crane, Assistant City Manager, is working with Community Services to update the contract language to require recycling at all events and removal of all recycling and trash after each event. Recycling bins are currently available for all private events. All city staff are also being trained on these new changes. Nitza Leichtling requested more recycling and trash receptacles be made available for city events such as the City s Concerts in the Park. Kristen Crane agreed to deploy more trash and recycling cardboard receptacles at future events. B. SAB website reorganization (Subcommittee Members: Ann Feeney, Shirley King and Mayela Manasjan). The Subcommittee Members met on Sunday, April 23, 2017 to discuss updating the City s Sustainable Del Mar website. They reviewed two exemplary websites for the City of Los Angeles and the City of Vancouver. They discussed renaming the website to Green Del Mar, Keep Del Mar Green, or Go Green Del Mar. They agreed to the following nine topics and assigned the following SAB members (in parenthesis) to research and update each topic: 1) Climate Action Plan (Al Sweedler and Daniela Bataglioli), 2) CCE (John Goodkind, Al Sweedler, Mayela Manasjan and Daniela Bataglioli) 3) Zero Waste (Shirley King and Ann Feeney), 4) Energy Efficient Buildings (Ann Feeney), 5) Water Conservation/Clean Water (Mayela Manasjan), 6) Open Space/Parks/Beaches (Ann Feeney), 7) Transportation (unassigned), 8) Air Quality (Nitza Leichtling), 9) How Can You Go Green? (unassigned). 5. New Business A. Discuss potential Expanded Polystyrene (EPS, Styrofoam ) ban. Ann Feeney received staff reports and ordinances from the City of Encinitas and the City of Solana Beach. She also received a report from the Surfrider Foundation highlighting over 100 cities and counties that have already banned EPS at a minimum. The City of Del Mar should state that all take out containers need to be recyclable, biodegradable or compostable. Many of the ordinances are written such that all take out products need to be recyclable by 2 P a g e

4 the current waste hauler. Ann recently sent an to Lori Somers, the City of Del Mar Waste Management Representative, to ask which products are currently recyclable. Ellie Haviland stated that the City s ban should not be more restrictive than the Surfrider Foundation s Ocean Friendly Restaurant Program. Mayela Manasjan will provide the SAB with a Food Container Comparison Chart that was developed by the Solana Center. She also mentioned that the City of Encinitas partnered with a local nonprofit organization the Surfing Madonna Ocean s Project to offer incentives to restaurants to help them transition from EPS food service ware to alternative products. Motion by Ann Feeney to recommend to City Council approval of an EPS ban and that all take out containers should be recyclable, biodegradable or compostable. Motion approved unanimously by all SAB members in attendance. Outreach efforts will continue with Surfrider Foundation and the Business Support Advisory Committee. B. Project Plan for CAP. No updates. C. 8:30 AM Presentation by Jim McMenamin, Zephyr Partners and Marin Gertler, Gensler regarding building a resort on 16.6 acres on Border Ave. Zephyr Partners is proposing a 16.6 acre resort which will include resort villas and a community trail system that would connect to the city owned parcel James Scripps Bluff Preserve. Zephyr Partners will be partnering with The Robert Green Company and working with Marin Gertler, Design Director with Gensler Architects. Zephyr Partners have just finished the first phase of the Citizen s Participation Program (CPP) to solicit community feedback and they also wanted to get suggestions from the SAB. Concerns they have received from citizens include traffic, impact on views. Positive comments included the provision of incorporating a public feature, public benefits of the project and building a sustainable green project. Dudek Environmental Services has been selected to prepare all technical reports. Zephyr has submitted an application for a Specific Plan and will appear before council on June 5 or June 19, 2017 with a process resolution for specific plans and local coastal program amendments all part of the entitlement application process. Comment from Ann Feeney: One of the strategies in the City s Climate Action Plan (CAP) is to increase the tree canopy. Suggest that the landscape architects increase the tree canopy where possible to compensate for any trees that have or will be removed. Questions from Mayela Manasjan: 1) Will the project be LEED certified? Zephyr Answer: There are no specific plans yet; however, at a minimum the project will be built to Cal Green standards which are equivalent to a LEED silver rating. 2) What other sustainability features are being considered for this project? Zephyr Answer: Start with a smart site approach and leverage all existing sustainable technologies. Consider energy use, photovoltaics, and battery pack storage. 3) Have you had a chance to review the City of Del Mar s CAP? If so, how will the project address the strategies in the CAP? Zephyr Answer: We have done a cursory review and would like to discuss this in greater detail at future meetings. Question from Nitza Leichtling: 3 P a g e

5 1) Can you discuss the concepts that you are considering for this project? Zephyr Answer: We re interested in incorporating natural features and considering all of our options based on the feedback we received at the CPP meetings. Question from Alan Sweedler: 1) This project is being described as a resort, what will be there? Zephyr Answer: This will be a resort like the Montage Laguna Beach, Hotel Del Coronado a community oriented resort without walls that will be an integral part of the community. A resort where you can take your family for Mother s Day dinner, weddings, function rooms, a hotel with amenities, privately owned villas and a publicly accessible perimeter walkway path. The height of the structure has not been determined yet most likely three stories. Question from Nitza Leichtling: Will there be a fence keeping people from accessing the property? Zephyr Answer: Anyone will be able to walk in and enjoy the resort. There will be several access points along the perimeter of the property. Question from John Goodkind: Will there be direct beach access? Zephyr Answer: The current beach access is north of Dog Beach, but this project does not propose creating any new beach access down the side of the cliff. Question from Alan Sweedler: Will this project add any affordable housing to Del Mar? Zephyr Answer: There is an affordable housing and low cost visitors serving accommodations requirement with the City of Del Mar and the California Coastal Commission. Although it is too soon in the process to provide specific answers. Question from Nitza Leichtling: What is the Coastal Commissions limit on height for coastal properties? Zephyr Answer: There is a 26 foot maximum height requirement for residential zoning. The property is currently zoned both R-1 14,000 sq. ft. minimum and R-1 40,000 sq. ft. minimum residential zoning. The goal is to develop a specific plan to include development guidelines with the provision of open space, building heights, and style of architecture. Question from John Goodkind: Will you need to change the zoning? Zephyr Answer: The land use will change from residential to a visitor commercial zone. Comment from Kristen Crane: The City of Del Mar just expanded their recycled water pipeline down Via de la Valle; hopefully this project can incorporate this into the landscaping and toilet flushing. Question from Alan Sweedler: How are you going to deal with sea level rise and possible cliff erosion? Zephyr Answer: Soils and geotechnical firm Geocon is studying this. It is a required part of the process. Comment from Mayela Manasjan: I d like to reiterate the importance of reviewing the city s CAP and would encourage you to offer suggestions and solutions for how to address energy efficiency, transportation, water efficiency, etc. and how you plan to integrate this into your project. D. Tour date for Organics Recycling, Waste Management June 6, 2017, 9:30 am 2:30 pm. Tour date for SDG&E Innovation Center TBD.
