2 Quality Jobs Program Quality meets rewards in Louisiana. The Quality Jobs Program provides a cash rebate to companies that promote economic development by creating wellpaying jobs. Provides a 5 percent or 6 percent cash rebate of annual gross payroll for new, direct jobs for an initial five-year term with an option for a five-year renewal. It can also provide a 4 percent sales/use tax rebate on capital expenditures or a 1.5 percent investment tax credit for qualified expenses. The program is open to businesses that: are in bioscience, manufacturing, software, environmental technology, food technology, advanced materials or oil and gas field service OR have at least 50 percent of annual sales out-of-state and/or to in-state customers or buyers if the product or service is resold by the purchaser to an out-of-state customer or buyer or to the federal government OR are located in an area designated by LED as a distressed region. 1. Submit Advance Notification with fee either on LED s website or by mail, then begin the project. 2. File for an Unemployment Insurance ID number with the Louisiana Workforce Commission. 3. Complete the application on LED s website and submit any required addendum material to LED for review. 4. LED reviews application and submits it to the Board of Commerce and Industry. 5. 3 Research and Development Tax Credit Fostering innovation. That s the goal of the Research & Development Tax Credit, which encourages existing businesses with operating facilities in Louisiana to establish or continue research and development activities within the state. Provides up to a 40 percent tax credit on qualified research expenditures incurred in Louisiana with no cap and no minimum spending requirement. Businesses can also receive up to a 40 percent tax credit under the following programs: Small Business Innovation Research Grant (SBIR) and/or Small Business Technology Transfer (STTR). The program is open to businesses that have incurred research and development expenditures in Louisiana and meet certain requirements. Only research and development conducted in Louisiana qualifies for the tax credit incentive. Qualified research expenses may include: Wages, subject to withholding, paid to Louisiana resident employees who perform services engaged in research, supervising research or supporting research Supplies used in the conduct of research and development 65 percent of contract research expenses incurred in Louisiana 1. Complete the application on LED s website and submit the fee and additional required documentation for type of business either online or by mail. 2. LED reviews application. 3. Business notified of approval or denial and Louisiana Department of Revenue is notified. 4. If approved, business files or amends state income tax return and claims the tax credits. 5. Louisiana Department of Revenue issues refund once all state liabilities have been resolved. 4 Industrial Tax Exemption Program How can Louisiana give your business a competitive edge? The Industrial Ad Valorem Tax Exemption Program (ITEP) offers an attractive tax incentive for manufacturers within Louisiana. The program abates local property taxes (Ad Valorem) on a manufacturer s new investment and annual capitalized additions related to the manufacturing site. Provides a 100 percent property tax abatement for an initial five-year term with an option for a five-year renewal on manufacturer s qualifying capital investments. The program is open to businesses classified as a manufacturer or related to the project or the manufacturer. For specific eligibility requirements, contact the or visit OpportunityLouisiana.com/ITEP. 1. Submit Advance Notification with fee either on LED s website or by mail, and then begin the project (if project is $5 million or less and will take less than 18 months to complete, skip to step 3). 2. File for Louisiana Unemployment ID number (if business does not have one) with the Louisiana Workforce Commission to receive NAICS code. 3. Complete the application on LED s website and submit any required addendum material to LED for review. 4. LED reviews application and submits it to the Board of Commerce and Industry. 5. If approved, the Board issues contract through LED. 6. Submit Project Completion Report and Affidavit of Final Cost to LED. 7. Submit Annual Report to LED. OpportunityLouisiana.com/ITEP. 5 Enterprise Zone Program How can Louisiana give your business a competitive edge? Equal opportunity defines the Enterprise Zone (EZ) program. The EZ program provides Louisiana income and franchise tax credits to a business creating new jobs within the state, and hiring at least 50 percent of the new jobs from one of four targeted groups. Provides a one-time $2,500 job tax credit for each permanent net, new job created and a 4 percent rebate of sales and use taxes paid on materials, machinery, furniture and equipment purchased; or a 1.5 percent refundable investment tax credit on the capital investment. The program is open to most Louisiana businesses that create permanent, net, new full-time jobs and fill 50 percent of those jobs with employees who meet one or more of the certification requirements: Enterprise Zone residency, public assistance, lacking basic skills and/or unemployable by traditional standards. Retail businesses with a NAICS of 44 or 45 who employ more than 100 employees nationwide, including affiliates, are only eligible to participate in the Enterprise Zone program if they are a grocery store or pharmacy located in an enterprise zone. 1. Submit Advance Notification with fee either on LED s website or by mail, then begin project. 2. Apply for local benefits with local governing authority. 3. File for a Sales Tax Registration Certificate with the Louisiana Department of Revenue and an Unemployment Insurance ID number with the Louisiana Workforce Commission. 4. Complete the application on LED s website and submit any required addendum material to LED for review within 90 days after project completion. 5. LED reviews application and submits it to the Board of Commerce and Industry. 6. If approved, the Board issues contract through LED. 7. Submit Project Completion Report and Affidavit of Final Cost to LED. 8. File for sales and use tax rebate or refundable investment tax credit with the Louisiana Department of Revenue. 9. 6 Tech Commercialization Tax Credit Louisiana technology, Louisiana jobs. The Technology Commercialization Tax Credit provides credit for companies that invest in the commercialization of Louisiana technology and create new, direct jobs. Provides a 40 percent refundable tax credit for indivduals or businesses that invest in the commercialization of Louisiana technology and a 6 percent payroll rebate for the creation of new, direct jobs. The program is open to individuals or businesses that invest in the commercialization of Louisiana technology. The technology must be created by a Louisiana business and researched by a Louisiana university or college through a licensing agreement. 1. Complete the eligibility application and submit the fee and all additional documentation either on LED s website or by mail. 2. LED reviews the application and required documentation. 3. The business will be notified of the approval or denial and Louisiana Department of Revenue will be notified. 4. If approved, the business completes a Technology Commercialization application to LED for credits. 5. The business is notified of the amount of tax credits awarded and the Louisiana Department of Revenue is notified. 6. The business amends the Louisiana Department of Revenue tax return to apply the credits. 7. The Louisiana Department of Revenue issues the refund once all Louisiana liabilities have been resolved. 7 Restoration Tax Abatement Program Louisiana fosters the preservation of neighborhoods and the revitalization of commercial districts. Property owners are encouraged to enhance existing structures to receive substantial tax savings. Under the Louisiana Restoration Tax Abatement Program, property taxes can be abated on the restoration, improvement, development or expansion of an existing structure located in a qualifying district for five years with a five-year renewal option. Provides five-year property tax abatement with an option for a five-year renewal for the rehabilitation of existing commercial structures and owner-occupied residences based on assessed valuation of property prior to beginning of improvements. The incentive is open to all Louisiana businesses and homeowners with existing commercial structures and owner-occupied residences to be expanded, restored, improved or developed in qualifying downtown development districts, economic development districts and historic districts, and approved by the local governing authority. 1. Submit Advance Notification with fee either on LED s wesbite or by mail, and then begin the project. 2. Complete the application and submit the fee and all required documentation either online or by mail for LED review. 3. Local governing authority approves application. 4. Board of Commerce and Industry reviews application. 5. If approved, the state executes contracts and mails to the applicant, assessor, local governing body and others, as required. 6. 8 Digital Interactive Media and Software Development Incentive Strongest incentive of its kind + wealth of talent + high-tech curricula + low cost of living. Make no mistake, Louisiana is fast becoming a digital media hotspot with attractive incentives like its 35 percent Digital Interactive Media and Software Development Incentive. Provides a 35 percent refundable tax credit for Louisiana resident in-state labor, coupled with a 25 percent refundable tax credit for qualified production expenses on items like building leases, workstations and training. The incentive has no caps and no minimum requirements. The incentive is available to all Louisiana-based development of commercially distributed software and software products. Software developed primarily for internal purposes, static Internet sites and products regulated under the Louisiana Gaming Control Law are ineligible. Eligible projects may include: Consumer software Business and enterprise software Industry-specific applications and platforms Digital media and games Web-based and mobile applications Entertainment software Interactive devices and consoles Embedded systems 1. 9 Motion Picture Investor Tax Credit Its lights, camera and all action for movies and films in Louisiana. A pioneer with its innovative 30 percent Motion Picture Investor Tax Credit Program, Louisiana ranks as the thirdbest location in the nation for motion picture production. Provides motion picture productions a 30 percent transferable tax credit on total in-state expenditures including resident and non-resident labor with no cap. For productions using in-state labor, Louisiana offers an additional 5 percent payroll tax credit. The program is open to all motion picture productions headquartered and domiciled in Louisiana for the purpose of producing nationally or internationally distributed motion pictures with total expenses exceeding $300,000. Qualifying productions may include: Feature-length motion pictures Television pilots, series or movies-of-the-week Animated feature films Animated short films Webisodes or any other digitally distributed motion picture Documentaries Commercials 1. Complete the application form on LED s website. 2. If approved, LED issues Initial Certification. 3. Track production project s expenses. 4. Submit audited cost report performed by Louisiana-licensed CPA to LED. 5. If approved, LED issues Final Certification for the amount of the tax credit. 6. 10 Musical and Theatrical Production Income Tax Credit How can Louisiana give your production a competitive edge? Whether you re launching a national concert tour, staging a new theatrical production or even buying and restoring a performance venue, we ll help you hit your mark. Louisiana offers a robust 25 percent to 35 percent tax incentive for musical and theatrical productions and qualified infrastructure projects. Provides musical or theatrical productions a refundable tax credit of up to 25 percent, based upon a sliding scale from 1 percent with a minimum spend of $100,000 up to 2 percent for projects over $1 million. For productions using in-state labor, Louisiana offers an additional 1 percent payroll tax credit. The program is open to concert, theatrical and other live performance productions that originate in Louisiana with total expenses exceeding $100,000. Eligible production expenses may include: Salaries Physical production costs Artist compensation Creative team compensation Local and touring crew compensation Hotel and airfare expenditures Venue rental and associated fixed costs 1. Whether you re looking to cut an album, score a film, produce a radio commercial, record an audio book or even track sound content for a video game, Louisiana s recording incentive is proof of positive momentum. Today, it s more affordable than ever to tap into our gold mine of facilities and talent. Provides a 25 percent tax credit for sound recording projects completed in Louisiana. The program is subject to a cap of $3 million in tax credits per calendar year, and credits are issued as rebates. The program is open to the recording, tracking and overdubbing of music and vocal performances; recording of film scores; recording of spoken word performance; and the recording of live musical performances. A $15,000 minimum in expenditures is required. Eligible expenditures may include: Studio rental fees and associated fixed costs Artist and musician salaries Producer fees Mixing and mastering of a recording made in whole or in part in Louisiana Instrument and equipment rental Hotel, airfare and catering expenses 1. 12 Angel Investor Tax Credit Program How can Louisiana give your business a competitive edge? Louisiana s Angel Investor Tax Credit (AITC) encourages accredited investors to invest in early stage, small, wealth-creating Louisiana businesses that seek start-up and expansion capital. Provides a 35 percent tax credit on investments by accredited investors who contribute to businesses certified by LED as Louisiana Entrepreneurial Businesses. Investors can invest $1 million per business per year and $2 million per business over the life of the program. The program is open to Louisiana businesses that are not involved in retail, real estate, professional services, gaming or gambling, natural resource extraction or exploration, or financial services including venture capital funds. Accredited investors have an individual or joint net worth with a spouse exceeding $1 million at the time of investment, individual income exceeding $200,000 or joint income with a spouse exceeding $300,000. The program has a $5 million annual program cap and sunsets on July 1, Qualifying uses of investment funds may include: Capital improvements Plant equipment Research and development Working capital 1. Apply for Louisiana Entrepreneurial Business certification by submitting eligibility documents detailed on the LED website to angelinvestor@la.gov. 2. Apply for AITC Reservation on LED s website. 3. Provide proof of investment in the form of subscription agreement to LED. 4. LED issues tax credit certification letter stating the amount of the tax credit and the years in which it will be applied against Louisiana income tax and corporate franchise tax liabilities of the investor. 5. State Trade and Export Promotion (STEP) Program The State Trade and Export Promotion (STEP) Program is a three-year pilot trade and export initiative authorized by the Small Business Jobs Act of Funded by federal grants and state matching funds, the program is designed to help increase the number of small businesses that are exporting and raise the value of those already exporting. Participating small businesses will receive companytailored and market-specific individual export preparation counseling. New-to-export companies will follow a graduated export preparation process to become exportready. Companies already prepared to export will be eligible to receive funds for participating in approved export related activities.
